SPECIAL CITY COUNCIL MEETING
CITY OF LAKE ELSINORE
WEDNESDAY, MAY 31, 1989

CALL TO ORDER
-
The Special City Council Meeting was called to order by Mayor
Winkler at 7:32 a.m.
PLEDGE OF ALLEGIANCE
The Pledge of Allegiance was led by Councilman Washburn.
ROLL CALL
PRESENT: COUNCILMEMBERS: BUCK, DOMINGUEZ, STARKEY, WASHBURN,
WINKLER
ABSENT: COUNCILMEMBERS: NONE
Also present were: City Manager Molendyk, Administrative Services
Director Wood, Community Services Director Watenpaugh, Public
Services Director Kirchner, City Planner Thornhill, Chief Building
Official Shear and City Clerk Kasad.
BUSINESS ITEMS

1. Cottonwood Hills Annexation/Parks and Recreation Services.
Community Services Director Watenpaugh explained the two
proposed resolutions with the first modifying the City's
existing sphere of influence and the second directing staff to
look at current operations and work with the Recreation and
Park District for provision of recreation services.
City Manager Molendyk advised that the second Resolution
carries out the intent staff understood from the" Joint Study
Session on May 25, 1989.
Councilman Washburn requested confirmation that these
Resolutions would not conflict with the specific plan already
approved. Staff confirmed.

MOVED BY BUCK, SECONDED BY STARKEY AND CARRIED BY UNANIMOUS VOTE
TO ADOPT RESOLUTION NO. 89-16 AS PRESENTED.
RESOLUTION NO. 89-16
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE,
CALIFORNIA, CONSENTING TO THE COMMENCEMENT OF PROCEEDINGS TO
AMEND THE SPHERE OF INFLUENCE OF COUNTY SERVICE AREA 145 (SUN
CITY) .
MOVED BY BUCK, SECONDED BY WASHBURN AND CARRIED BY UNANIMOUS VOTE
TO ADOPT RESOLUTION NO. 89-17 AS PRESENTED.
RESOLUTION NO. 89-17
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE,
CALIFORNIA, INITIATING A STUDY TO EVALUATE THE FUTURE
PROVISION OF PARK AND RECREATION SERVICES.

3. Stephens Kanqaroo Rat Conservation Aqreement ~ Homestead
Development.
City Manager Molendyk advised that this item had been

requested by Homestead Development and further advised that
Chris Taylor, representing Homestead was available for
comment.
Chris Taylor advised that this agreement has been requested by
the United States Fish and Wildlife Service, so if Homestead
should ever cease operation in this area, the arrangement for
the Kangaroo Rats will remain, under the jurisdiction of the
City. He detailed the provisions of the agreement which
includes a 560 acre area as well as a potential additional
46.7 acres which would be under the control of the City.
City Manager Molendyk suggested that since the final proposed
agreement had not yet been completed, this approval should be
subject to the City Attorney's review.

MOVED BY DOMINGUEZ, SECONDED BY BUCK AND CARRIED BY UNANIMOUS VOTE
TO APPROVE THE PROPOSED AGREEMENT SUBJECT TO CITY ATTORNEY REVIEW
AND APPROVAL.
2. Ordinance No. 858 ~ Reqarding Development in the Lake Elsinore
Floodplain Below Elevation 1260'.
Mayor Pro Tern Dominguez assumed the Chair in that Mayor Winkler.
could not participate in discussions on this matter.
City Manager Molendyk advised that the Army Corps of Engineers
had requested this action as part of the 404 permit approval for
the Lake Management Plan. He further advised that this
ordinance would require application for a 404 permit by anyone
wishing to develop below the 1260' elevation.
Councilman Washburn confirmed that this was an assurance the
Corps had requested prior to issuance of the Lake Management 404
permit. He suggested that the following portion of the
Ordinance. be deleted, because it is repetitive of requirements
already in place:

"...including, without limitation, Section 1603 of the
California Fish and Game Code, the Federal Emergency
Management Agency floodplain regulations (Title 15,
Chapter 64, Section 15.64.140 and Title 44 CFR Section
60.3; (d) (3),..."
Councilman Washburn also requested that the Ordinance include a
map defining the affected area to include only the Lake
Perimeter.
MOVED BY WASHBURN, SECONDED BY BUCK AND CARRIED BY A VOTE OF 4 TO 0
WITH WINKLER ABSTAINING TO AMEND THE ORDINANCE AS RECOMMENDED AND
AUTHORIZED THE MAYOR PRO TEM TO SIGN ON BEHALF OF THE CITY.
