ROLL CALL PRESENT: ABSENT: COUNCILMEMBERS: BUCK, DOMINGUEZ, STARKEY, WASHBURN, WINKLER COUNCILMEMBERS: NONE Also present were: City Manager Molendyk, Assistant City Manger Rogers, City Attorney Harper, Administrative Services Director Wood, Community Services Director Watenpaugh, Senior Civil Engineer O'Donnell (representing Public Services Director), City Planner Thornhill, Chief Building Official Shear and City Clerk Kasad. PUBLIC COMMENTS - John Cox, 15600 Half Moon Drive, presented a petition signed by 60 residents of the MacyjLakeridge area protesting Tentative Tract Map 24235, Morrison Homes. He expressed specific concerns with the development including the number of children in the neighborhood, the lack of public recreation facilities, increased traffic, and problems with excessive speed and other traffic related violations endangering the children and animals. Ed Stewart, Stewart Ranches, requested permission to address Council when Item #12 regarding Weed Abatement Contractor is considered. Council concurred to allow him to speak at that time. PRESENTATIONS/CEREMONIALS A. Presentations ~ Sheriff's Department. Recipients not present; postponed to May 23, 1989. . B. Proclamation ~ Older Californian's Month ~ representative of Golden Spectrum. Mayor Winkler read the Proclamation recognizing Older Californian'~ Month and presented it to Arta Valenzuela, representing Golden Spectrum. Arta thanked Council for its recognition of Senior Citizens and commented on the Senior services being provided thanks to the City's support. Proclamation ~ Transit Appreciation Day ~ representative of Riverside Transit Authority. ,...... C. Mayor Winkler read the Proclamation recognizing Transit Appreciation Day and presented it to Bob Boston, Assistant General Manager of Riverside Transit Authority. Mr. Boston thanked the Council for this recognition and encouraged the PAGE TWO - CITY COUNCIL MINUTES - MAY 9, 1989 citizens to utilize the transportation services available to the Community. CONSENT CALENDAR The following items were pulled from the Consent Calendar for further discussion and consideration: Item Nos. 9, 10, 12, 15, and 17. Councilman Washburn advised that he would be abstaining from vote on Item #19. ~ MOVED BY STARKEY, SECONDED BY DOMINGUEZ AND CARRIED BY UNANIMOUS VOTE TO APPROVE THE BALANCE OF THE CONSENT CALENDAR AS PRESENTED. 1. The following Minutes were approved: a. April 25, 1989 - Regular City Council Meeting. b. April 29, 1989 - City Council Study Session. The following Minutes were received and filed: c. April 18, 1989 - Planning Commission Minutes. 2. Received and filed Building Activity Report for April, 1989. 3. Received and filed Structure Abatement Activity Report for April, 1989. 4. Approved Streetscape Maintenance Contract with J & R Landscape Maintenance Co., in the amount of $21,713. 8. Approved Right of Way Acquisition Services Contract with MacFarlane & Associates, for work on Railroad Canyon Road from 1-15 to Canyon Lake. Total cost of contract not to exceed $33,000, to be reimbursed by Assessment District participants. 11. Authorized Advertisement for Bids on the Yarborough Park Restroom Project, to be received on June 1, 1989. 13. Accepted Notice of Completion for 1988 Slurry Seal Project from Doug Martin. 14. Approved Outdoor Activity Permit 89-1 for the Chamber of Commerce, Frontier Days Events based on the following Findings; and subject to the following Conditions: Findings 1. The proposed Outdoor Activity Permit is a temporary use and is a Class 4.e. exemption under the California Environmental Quality Act. I' ...J 2. Adequate conditions and safeguards pursuant to Section 17.98.060 have been incorporated into this approval of the Major Temporary Outdoor Activity Permit to insure PAGE THREE - CITY COUNCIL MINUTES - MAY 9, 1989 r- that the use is carried out in a manner envisioned by these findings for the term of the temporary use. 3. The proposed temporary use will not be detrimental to the general health, safety or welfare of persons residing or working within the neighborhood of the proposed use or the City, or injurious to property or improvements in the neighborhood or city. Conditions 1. Obtain grading permission from all property owners affected, prior to any grading operation. 2. Secure electrical permits from the Building Division for inspection of all electrical equipment and set up an appointment for a full site inspection. 3. Enter into an agreement with the Sheriff's Department to adhere to their proposed schedule and provide information to the City that this agreement has been reached by May 19, 1989. ~ 4. Meet all County Health Department requirements including: a. Pull required Health Permits for food service by May 19, 1989. b. Pump out holding tanks by May 24, 1989. c. Provide grease holding and disposal method to the County Health Department by May 24, 1989. d. Clean and screen food booth by May 24, 1989. e. Provide adequate drinking water facilities for the public by May 24, 1989. 5. Install improved lighting at both sides of the crosswalk and provide additional lighting to the parking lot across the street by May 24, 1989. 6. Clear and chalk the parking aisles and emergency lane by May 25, 1989, and rechalk the mornings of May 27, 28, and 29, 1989. 7. Post "No Alcohol" signs in all parking lots by May 24, 1989. 8. Indicate location of the First Aid/Information Booth that will be operated by Red Cross. 9. Submit information to the City by May 19, 1989, that Paladin, or other security agency, will provide ten to twelve (10-12) employees and that there will also be volunteers for traffic control and all of these personnel will be issued orange vests. In addition, these personnel are to be informed of the basic operations of the parking layout and traffic control plan. ..... 10. Incorporate any recommendations not discussed above from the City prepared Traffic Control Plan. 11. Please note that this includes the chalking of parking aisles and the provision of sufficient number of PAGE FOUR - CITY COUNCIL MINUTES - MAY 9, 1989 personnel from Paladin, or other security agency, and volunteers to direct vehicles into specific parking spots. It is critical that parking be controlled to get as many vehicles on-site with adequate egress and that no vehicles be permitted outside designated areas, especially in brush areas. 12. All brush, weeds, litter and similar combustibles shall be cut and removed from all parking areas not later than May 24, 1989, and a 20-foot (20') wide disked area should be provided around the entire perimeter of all parking areas. 13. Provide verification of State certification of all carnival rides prior to opening of carnival. 14. Clear and grade carnival area of rocks and ensure that all electrical cords are covered. .....J 15. Provide for a car phone if reception is available near the office area. County Fire Department Conditions 16. Prior to the commencement of this year's Frontier Days Rodeo, the following conditions must be met: a. Provide access for emergency vehicles: 1) A designated 12-foot (12') fire lane around the perimeter of the rodeo and carnival grounds shall be maintained at all times. 2) Provisions must be made for the ingress and egress of emergency vehicles to and from the rodeo grounds due to the possibility of vehicular traffic backing up disabling emergency vehicles to access. ..... b. All brush, weeds, litter and similar combustibles shall be cut and removed from all parking areas not later than May 22, 1989, and a 30-foot (30') wide disked area should be provided around the entire perimeter of all parking areas. c. Prior to the commencement of any rodeo grounds activities, a fire safety inspection shall be conducted by the County Fire Prevention staff. Approved Staff Recommendations Relative to Fencing Requirements at 1301 Heald Street as follow: 1) Concur that a solid fence or wall is not required along the alley behind 1301 Heald Street. 2) Direct staff to release the applicant's bond requiring him to construct said fence or wall. ..... 18. Approved Request for Extension of Time on Tentative Tract Map 20139 Revised - Morrison Homes, to May 9, 1990, based on the following Findings: . Findings 1. The land use is consistent with the Goals, Policies, and General Objectives of the General Plan. 19. Accepted Street Restoration Bonds for Ayres Industrial Complex - Industrial #88-1. (As mentioned above, Councilman Washburn abstained from vote on this item, so the vote was 4 ayes with Washburn abstaining. 20. Accepted Off-Site Improvement Bonds for In-N-Out Burger relating to Commercial Project #88-5. 21. Accepted a Ten Foot Street Dedication for Single-Family Residence Project at 1303 Pottery from Thomas Frank. 22. Accepted of a Two and One Half Foot Alley Dedication for Single Family Residence Project at 315 Lowell Street from Edward Winger. 23. Accepted a Two and One Half Foot Alley Dedication for Single Family Residence Project at 408 Lowell Street from Steven J. Lauriano. ~ 24. Accepted Quitclaim Deeds for Water Rights for Single- Family Residences at 1303 W. Pottery Street from Thomas Frank and at 1201 W. Heald Avenue from Myron Johnson. 25. Adopted Resolution of Intention No. 89-14 to Vacate a Portion of Collier Avenue, Northwest of Third Street Abandonment No. 88-4, and set public hearing for June 13, 1989. RESOLUTION NO. 89-14 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE DECLARING ITS INTENTION TO VACATE A PORTION OF COLLIER AVENUE SOUTHEAST OF THIRD STREET AND SETTING A PUBLIC HEARING THEREON. 26. Approved Public Hearing date of May 23, 1989 for the following: a. Zone Change 89-6 ~ George WimQy (Morrison Homes). A request to rezone 10.4 acres from C-1jC-P (Neighborhood Commercial and Tourist Commercial) to R-1 (Low Density Residential) for Tract' , 20139-1. The project is located on the southwest corner of Grand Avenue and Ortega Highway. b. Tentative Tract MaD 24138 ~ Suncal. ,A request to divide a 20 acre parcel into 72 lots. The project is located north of Grand Avenue, west of Skylark Drive and east of Ontario Way. c. Tentative Tract Map 24139 ~ Suncal. A request to divide a 20 acre site into a 75 lot subdivision. The project is located north of Grand Avenue, west of Skylark Drive and east of Ontario Way. d. Tentative Tract Map 24215 ~ Suncal. A request to divide a 16 parcel, 20 acre site into 74 lots. The project is located north of Grand Avenue, west of Skylark Drive and east of Ontario Way. PAGE SIX - CITY COUNCIL MINUTES - MAY 9, 1989 ITEMS PULLED FROM CONSENT CALENDAR 9. E.V.M.W.D. Financial Participation Aqreement. City Manager Molendyk requested that this item be deferred to after the Redevelopment Agency meeting, so the Council can approve concurrent action. City Attorney Harper advised that it would be best to recess at the end of the Council meeting and come back to this item after adjournment of the Redevelopment Agency meeting. ... Council consensus was to defer this item as recommended. 10. Land Acquisition Reqardinq M-1 Plan. City Manager Molendyk requested that this item be deferred to after the Redevelopment Agency meeting, so the Council can approve concurrent action. City Attorney Harper advised that it would be best to recess at the end of the Council meeting and come back to this item after adjournment of the Redevelopment Agency meeting. Council consensus was to defer this item as recommended. 12. Award of Contract ~ Weed Abatement Contractor ~ Greg Smith. Mayor Winkler requested clarification as to why the second lowest bidder was being recommended. Chief Building Official Shear advised that the requested references had not been supplied and thus it was difficult to determine the background of the lowest bidder. Mayor Winkler inquired into the validity of this requirement. City Attorney Harper advised that this type of reference request was not uncommon to municipal projects, and that it provides an objective position from which to compare the applicants.. Ed Stewart, representing Stewart Ranches, advised that they had been the lowest bidder at the time of bid opening, however they were informed that they had not met the requirements. He detailed the experience of his company including work previously done for the City and the Water District. He expressed concern with the new policy requiring the above mentioned references, in that only people who had done work would be able to do work, creating a monopoly. Councilman Washburn inquired of the City Attorney, if in fact this requirement would create a monopoly. City Attorney Harper advised that this did not create a monopo)y, but protected the City, by not allowing companies with unknown background to gain their experience on this City. He also reiterated to Council that it would be their prerogative to waive this requirement and accept the low bid. Councilman Starkey inquired if in fact this was the first yeai for the requirement in question. Chief Building Official Shear confirmed that it is the first year. Councilman Dominguez inquired whether this requirement was clearly worded in the bid request, and whether it stated references for work on Weed Abatement Projects. Chief Building Official Shear advised that it did not state "Weed Abatement Projects". ... ~ Councilman- Starkey question cost difference between the bids. Chief Building Official Shear advised that it ranged between $1 and $5 difference per lot. City Attorney Harper reminded PAGE SEVEN - CITY COUNCIL MINUTES - MAY 9, 1989 Council that these costs would only be passed on to those persons who do not clear their own weeds. Mayor Winkler commented that this would not ultimately effect the general fund, however he inquired into the penalty clause of the contract and its enforceability. City Attorney Harper advised that while the application could be clearer, it is still enforceable. He suggested that if the Council would so desire, they could request supplemental material and leave review and the final decision up to staff to meet deadlines. Greg Smith, the second lowest bidder, detailed his prior experience and background. He cautioned Council that $2 per lot was not a big variable, but quality and timeliness of work were important points to consider. Councilman Washburn stressed the importance of awarding the contract tonight to alleviate fire danger liabilities. He commented that while both contractors are local and he knows both of them, he felt the requirements should be strictly adhered to and suggested that future specifications include more specific language. Parade Permit/Street Closure. Councilman Dominguez handed out a letter from the Downtown Business Association changing the request from closure of the block from Graham to Peck; to the closure of Peck to Heald. MOVED BY DOMINGUEZ, SECONDED BY WASHBURN AND CARRIED BY UNANIMOUS VOTE TO APPROVE THE CLOSURE OF MAIN STREET FROM PECK TO HEALD FOR ONE-HALF HOUR FOLLOWING THE PARADE. 17. Request from Morrison Homes ~ On-site Construction and Sales Trailers. Councilman Buck advised that he felt trailers should be allowed, in that it provides an office area and allows for on-site supervision and reduces liability factors. Gary Kaiser, representing Morrison Homes, advised that they have made arrangements to place a sales trailer on Mr. Salata's property, and questioned the inability to do so. He advised that they are already receiving inquiries and would like to have a central place from which to disburse information. ..... Councilman Washburn inquired at what point in the process a sales trailer would normally be allowed. Chief Building Official Shear advised that when building permits are issued, would be the appropriate time. Councilman Starkey inquired whether grading could be construed as construction. Chief Building Official Shear confirmed that it could in most cases, however, this tract map had not even received final consideration. They had given special consideration to allow grading to mitigate PAGE EIGHT - CITY COUNCIL MINUTES - MAY 9, 1989 drainage problems. MOVED BY DOMINGUEZ, SECONDED BY BUCK AND CARRIED BY UNANIMOUS VOTE TO ALLOW A CONSTRUCTION TRAILER BUT NOT A SALES TRAILER TO BE PLACE ON SITE. City Attorney Harper advised Council that this action was an indication to staff that issuance of a grading permit would allow for placement of a construction trailer on site. PUBLIC HEARINGS ....,j 31. Tentative Parcel Map 24401 ~ Brookstone Development, Inc. Proposal to subdivide an existing 4.23 acre shopping center into four (4) separate parcels ranging in size from .48 to 1.6 acres on the northeast corner of Riverside Drive and Lincoln Street. City Planner Thornhill detailed this proposal and advised that it was being done primarily for financial purposes. He further advised that the applicant had requested waiver of Condition #4 relating to in-lieu fees for the future median; the Planning Commission had deferred this decision to City Council. He offered to answer any questions from Council. The City Clerk reported no written comments or protests. Mayor Winkler opened the public hearing at 7:59 p.m. asking those in favor of Tentative Parcel Map 24401 to speak. The following person spoke: Steve Brown, 35721 Capistrano Beach Road, Capistrano Beach, representing the applicant, advised that they are in concurrence with the recommendations except with regard to condition #4. He further advised that no construction will take place at this time, as this is strictly for financial purposes. Mayor Winkler asked those in opposition to speak. Hearing no one, the public hearing was closed at 8:03 p.m. - Councilman Buck inquired whether the recent Irvin Palmer project had been required to pay this fee. Senior Civil Engineer O'Donnell advised that this fee had been waived by Council in that case, in that the Palmer project was considered to be a remodel rather than a new project. Mayor Winkler commented that new projects should have more impact on this matter than upgrades of existing projects. Councilman Buck agreed that new developments should be . required to pay the fees, however, he did not feel this was the appropriate time to assess the fees. Councilman Starkey inquired why fees were waived for the original project. Senior Civil Engineer O'Donnell advised that they were not required at the time of the original project. Councilman Starkey felt that under the circumstances, the fees would be after the fact. -- Councilman Washburn inquired what this cost represents and since the project is complete, when would payment be due. Mr. O'Donnell advised that this cost represents one-half of the cost of the median, and would be due following Council approval. PAGE NINE - CITY COUNCIL MINUTES - MAY 9, 1989 ...... Steve Brown, expressed concern that while his company was being required to pay these fees, he did not feel the State Park would be paying their half of the median, and the median they are funding half of would never be built. Councilman Starkey inquired of Mr. Brown, in the event that the median were to be built would he be willing to pay the fees at a later date. Mr. Brown advised that they would be wi 11 i ng to pay. MOVED BY DOMINGUEZ, SECONDED BY WINKLER AND CARRIED BY A VOTE OF 3 TO 2 WITH BUCK AND STARKEY CASTING THE DISSENTING VOTES TO ADOPT NEGATIVE DECLARATION 89-11; ADOPT THE FINDINGS LISTED BELOW: - Findinqs 1. The project site is in an urbanized area zoned for commercial use and, as conditioned, complies with the Goals and Objectives of the General Plan, and the General Commercial Zoning District. 2. As conditioned, the Tentative Map complies with the requirements of Article 3 of the Subdivision Map Act. 3. As conditioned, the proposed subdivision complies with the zoning standards for the C-2 Zoning District. 4. Conditions and safeguards pursuant to Section 16.24.010 including guarantees and evidence of compliance with conditions, have been incorporated into the approval of the project in accordance with Chapter 16.24.040 and the Planning District in which it is located. AND APPROVE TENTATIVE PARCEL MAP 24401 SUBJECT TO THE FOLLOWING CONDITIONS: Planninq Division Conditions 1. Tentative Parcel Map 24401 shall expire two (2) years from date of approval unless extended pursuant to State and Local Law oOr recordat i on of fi na 1 map occurs. 2. The total requirement for all uses combined on Parcel 1, 2, 3, and 4 shall not exceed the sum of the requirements for the various uses computed separately. Prior to the issuance of any Certificate of Occupancy or new Business License on any parcel, the applicant shall provide to the Planning Department a site plan. with all of the uses listed in all spaces. - EnGineering Department Conditions 3. The applicant shall cause to be recorded an irrevocable reciprocal parking, drainage, circulation, loading and landscape maintenance easement in favor of all lots, subject to the approval of the Director of Community Development. In addition, CC & R's shall be approved by the City Attorney and Director of Community Development which enforce standards of building maintenance, participation in landscape maintenance, prohibition of outside vehicle or material storage. 4. Contribute $23,145.00 for the design and construction of half a median on Riverside Drive along the property frontage. . 5. All existing public work improvements shall remain in place, any changes will require plan r~view and appropriate fees and permits (Lake Elsinore Municipal Code, Chapter 16.34). 7. Provide all necessary utility easements. 8. Dedicate underground water rights to the City (Municipal Code, Title 16, Chapter 16.52.030). ... 32. Vesting Tentative Tract Map 24010 ~ Pacific Scene. A request to subdivide two (2) parcels into 117 lots (115 residential units) on 44.34 acres, located approximately 2,550 feet west of Robb Road between Mountain Street and Running Deer Road. City Planner Thornhill detailed this request and commented on the extensive work between staff, the developer and the residents to mitigate perceived problems. He advised that the developer had consented to do major work to aid the traffic circulation in the area, including extension of Running Deer down to Robb Road; and to mitigate flooding concerns. City Manager Molendyk thanked the developer and residents for their efforts to work together and mitigate the traffic concerns. The City Clerk reported no written comments or protests. Mayor Winkler opened the public hearing at 8:20 p.m. asking those in favor of Tentative Tract Map 24010 to speak. The following persons spoke: ... Jay Summers, representing Pacific Scene, advised that they are in concurrence with staff's recommendations, but requested minor modifications of Conditions 51 a. thru 51 c. He thanked the residents and staff for their input and willingness to work with his company to mitigate the flooding and traffic concerns. He showed diagrams and site plans and explained the proposed traffic circulation in detail. He advised that the concerns previously expressed by Elsinore Ready Mix are being worked out privately. K.S. Chin, Golden State Land Company, explained that his company's 300 acres neighbors, Pacific Scenes pro~erty and discussed drainage and traffic flow in the immediate area. Mayor Winkler asked those in opposition to speak. The following persons spoke: Jack Hennessey, 29052 Forest View, commented on the developers willingness to work with the property owners. He explained the problems which have been worked out, and expressed concern with one remaining issue being the need to widen the lower portion of Mountain Street from Rolando to Running Deer. This section is still too narrow with poor lighting and limited visibility. He requested that this matter be resolved prior to construction of the homes. ... John Sellers, 16510 Mountain Street, concurred with Mr. Hennessey and thanked Pacific Scene for their assistance in mitigating problems. He suggested that the applicant has probably mitigated more than enough on their own, and maybe PAGE ELEVEN - CITY COUNCIL MINUTES - MAY 9, 1989 ..... the City should work to resolve the remalnlng concerns on Mountain Street. He requested that the work on Running Deer be required to begin prior to construction of the homes. Daniel Castalena, 16518 Mountain Street expressed the need for street lights to improve visibility. Nina McCubre, 16509 Mountain Street expressed concern with the lower section of Mountain Street and reiterated the need to resolve this problem as soon as possible. She thanked the developer for working with the residents. Mayor Winkler closed the public hearing at 8:50 p.m. Gary Thornhill suggested that Condition 51a. be reworded as follows: Prior to issuance of first Certificate of Occupancy the applicant shall improve Running Deer Road from Rolando to Robb Road to provide for two (2) travel lanes (26 feet). Mayor Winkler questioned the ability to wide Mountain Street as requested. Senior Civil Engineer O'Donnell advised that currently this property has individual owners, and depending on their willingness to cooperate, it might require eminent domain to obtain the right-of-way. MOVED BY DOMINGUEZ, SECONDED BY BUCK AND CARRIED BY A VOTE OF 4 TO o WITH WASHBURN ABSTAINING TO ADOPT NEGATIVE DECLARATION 88-37, ADOPT FINDINGS LISTED BELOW: ~ Findinqs 1. The project, as conditioned, will not have a significant impact on the environment and will contain a mitigation monitoring system as part of the approval. 2. The project, as conditioned, meets the Goals. and Objectives of the General Plan and the R-1 Zoning Standards. 3. The project, as conditioned, complies with the City's subdivision standards. 4. The proposal will be compatible with existing and proposed developments in the vicinity and, therefore, will not create any adverse effect on abutting property. AND APPROVE VESTING TENTATIVE TRACT MAP 24010 SUBJECT TO THE FOLLOWING CONDITIONS: Planning Division Conditions ..... 1. Vesting Tentative Tract Map 24010 approval shall be subject to the approval of Annexation #45, General Plan Amendment 88-6 and Zone Change 88-10. 2. Vesting Tentative Tract Map 24010 shall expire two (2) years from date of approval unless extended pursuant to State and Local Law or recordation of final map occurs. 3. A parcel map or lot line adjustment shall be approved by the County prior to recordation of the final map for the 4.34 acre site. 4. CITY MANAGER COMMENTS City Manager Molendyk advised that he had been contacted by the Parks and Recreation Districtr.:.~questing a joint study session with. the City Council and recommended May 25, 1989 at 7:00 p.m. It was determined that the Mayor would have a conflict with this time and staff was directed to attempt scheduling it at 6:00 p.m. the same night. CITY COUNCIL COMMENTS Councilman Dominguez requested that staff pursue replacement of the Pottery Street bridge, in that the future plan is to tie it in to Casino Drive. He also requested that staff investigate a clearer method of marking the intersection of Lakeshore Drive and Graham Street. Councilman Washburn requested that the Engineering and Planning Departments include conditions of approval which would require developers to tell potential buyers that future development around them is a possibility due to the rapid growth in the area.
