CALL TO ORDER
The Regular City Council Meeting was called to order by Mayor
Winkler at 7:00 p.m.
PLEDGE OF ALLEGIANCE
The Pledge of Allegiance was led by Councilman Buck.

PUBLIC COMMENTS
-
Arta Valenzuela, 412 E. Hill Street, commented on her partici-
pation on the March Air Force Base Community Council and thanked
Council for the opportunity to represent the City on this Council.
She also thanked Staff for their assistance in preparing for a
presentation to the Council regarding Economic Development in the
city.
Hal Heywood, 1948 North E Street, San Bernardino, commented on
problems he has encountered with the City in attempting to place a
billboard in the I-15 corridor between Central Avenue and Main
Street. He requested Council approval to maintain the billboard
at or near the present location. He also presented a bill for
$63,600 for compensation for Outdoor Advertising Structure over a
five year period for which he will loose business.
Bill Gray, 1115 17th Street, Hermosa Beach, questioned proposed
Zone Code Amendment 88-10 (Item #34 on this agenda), and the
requirement for deeding of front ten foot of lot to City for
widening of street. He requested clarification as to whether this
would be a ten foot piece of property or a ten foot slope
easement.
Dick Knapp, 29690 Dwan Drive, commented on the activities of the
Country Club Heights Advisory Committee and requested that Council
~ continue consideration of this area. He also presented a letter
detailing his concerns.
PRESENTATIONS/CEREMONIALS
A. Proclamation - Chris Taylor, Riverside County Sheriff's
Department, Lake Elsinore station.
Mayor Winkler presented a proclamation honoring Chris Taylor
for his years of service to the City and congratulating him on
his promotion to sergeant effective January 12, 1989.

B. Melodie Earickson, coordinator for Project Literacy sponsored
by the local Library, explained the program and requested that
persons interested in becoming a tutor or student of this
program contact her at the Lake Elsinore Library, 674-8071.
C. Presentation - Mayor's Gavel Throwing Trophy.
Councilman Starkey, explained the Gavel Throwing event ~
sponsored by the Mayors' & Councilmembers Conference of
Riverside county and commented on the expertise shown by Mayor
Winkler. He also presented a trophy commemorating this honor
to the Mayor.

THE ACQUISITION OF LAND FOR THE EXPANSION OF CITY PARK.
10. Approved Amendment to Agreement for Acquisition for the Canyon
Lake Hills Project (Tuscany Hills - Homestead Land Development
corporation, Inc.), and authorized the Mayor to execute
amendment.
11. Approved public hearings date of February 14, 1989 for the
following:
a. General Plan Amendment 88-1 = Pardee Construction.

A request to amend the General Plan Land Use Map to
designate the project area as Specific Plan Area, with
an overall residential density of 2.2 dwelling units per
acres. This project is located along Railroad Canyon,
Cottonwood and Holland Roads, one-half mile south of
Canyon Lake.
b. Specific Plan 88-1 = Pardee Construction.
A request to approve a Specific Plan for development of
4,275 dwelling units conditioned upon annexation to the
City of Lake Elsinore on 1968.7 acres. This project is
located along Railroad Canyon, Cottonwood and Holland
Roads, one-half mile south of Canyon Lake.
PUBLIC HEARINGS
31. Zone Chanqe 89-1 = Manfredi/Summers.
A request to rezone 0.19 acres of land located south of
Lash Street approximately 150 feet west of Riverside Drive
from R-3 (High Density Residential) to C-l (Neighborhood
Commercial) Zoning District (Zone Change 89-1 -
Manfredi/Summers).
City Planner Thornhill summarized the requested rezoning.
The City Clerk reported no written comments or protests.
Mayor Winkler opened the public hearing at 7:22 p.m. and
asked those in favor of Zone Change 89-1 to speak. No one
spoke. He asked those in opposition to speak. Hearing no
one, the public hearing was closed at 7:22 p.m.

1. The proposed project is not anticipated to have a

this zoning designation into compliance with the General

32. vestinq Tentative Tract Map 24010 = Pacific Scene.
A request to subdivide two parcels into 117 lots (115
residential units) on 44.34 acres located approximately
2,550 feet west of Robb Road between Mountain Street and
Running Deer Road.
City Planner Thornhill advised that staff is requesting a
continuance to allow time to address some additional
environmental concerns.

33. Tentative Tract Map 22912 = Premier Homes.
A request to subdivide five (5) parcels into 187 residential
lots for development with single-family homes, on 51.93
acres located along the west side of Terra Cotta at the
terminus of Lincoln Street, south of the future alignment of
Washington Avenue, in an R-1 (Single-Family Residential)
Zone District.
City Planner Thornhill summarized the project and commented
on the circulation plan for the project with possible
alternatives.
The city Clerk reported no written comments or protests.
Mayor Winkler opened the public hearing at 7:25 p.m. asking
those in favor of the project to speak. The fOllowing
persons spoke:

Frank Webb, representing Premier Homes, 1787 W. Pomona,
Corona, commented on development of the proposed plan and the
problems which had been worked out with the neighboring
residents. He advised that Condition #45 had been requested
by City Staff, however the residents were opposed to it. He
also advised that there were concerns with Conditions 35, 37,
18 and 27.

Pam Eriser, 15042 zieglinde, advised that they have worked
with Premier Homes to resolve the problems, and thanked Frank
Webb and the City Staff for their cooperation. She expressed
concern with the proposed easement in Condition No. 45,
particularly that it would leave a loop hole for the city to
later make a thru street and reintroduce problems which have
been mitigated.
Sue Schultz, 157 South Terra Cotta, advised that she is now
in favor of the project with the exception of Condition No.
45. She also reiterated prior concerns with traffic
circulation for the entire area.

Mike Priske, 15015 Le Gaye, suggested that the wall in
Condition No. 12 be continued beyond lots 8 and 9. He also
expressed concern with the variable elevations between
existing lots and the new project. He was also in opposition
to Condition No. 45.
Mayor Winkler asked those in opposition to speak. Hearing no
one, the public hearing was closed at 7:57 p.m.
THE CITY COUNCIL MEETING WAS RECESSED AT 7:58 P.M.
THE CITY COUNCIL MEETING RECONVENED AT 8:03 P.M.
City Manager Molendyk suggested that this item be continued
to resolve the major concerns.
City Engineer Kirchner advised that under current standards
Zieglinde is too long to be a cul-de-sac.
There was extensive Council discussion with regard to
resolution of the easement concerns.

Findinqs
1. The project, as conditioned, will not have a significant
impact on the environment and will contain a mitigation
~onitoring program as part of the approval.
2. The project, as conditioned, meets the Goals and
Objectives of the General Plan and R-l zoning Standards.
3. The project, as conditioned, complies with the City's
subdivision standards.
4. The proposal, as conditioned, will be compatible with
existing and proposed development in the area and
provides adequate buffering between larger developed
lots, therefore, it will not create any adverse effe~~ on
abutting properties.

5. The site is physically suitable for this type and density
of development.

AND APPROVE TENTATIVE TRACT MAP 22912, SUBJECT TO THE FOLLOWING --
CONDITIONS WITH CONDITION NO. 45 TO BE MITIGATED BY STAFF AND THE
RESIDENTS.
Planninq Division Conditions
1. The Tentative Tract Map shall comply with the State of
California Subdivision Map act and shall comply to all
applicable requirements of the Lake Elsinore Municipal
Code, Title 16 unless modified by the conditions of
approval.
2. This conditionally approved Tentative. Tract Map No. 22912
will expire two (2) years after the city Council approval
date, unless extended as provided by the State of
California Subdivision Map Act.
3. The triangular shaped remainder of this property created
from the Washington Avenue realignment at Terra Cotta
shall have erosion control cover approved by the Planning
Division.
4. The applicant shall provide connection to public sewer
for each lot within the subdivision. No service lateral
shall cross adjacent property lines and shall be
delineated on engineering sewer plans and profiles for
submittal to the Elsinore Valley Municipal Water
District.

5. A precise survey with closures for boundaries and lots
shall be provided, per City ordinance.
6. Applicant shall record CC & Rls for the project
prohibiting on street storage of boats, motorhomes,
trailers, and trucks over one (1) ton capacity. CC & Rls
shall also include screening of any ground base disk, no
roof mounted or front yard disk to be allowed. The CC &
Rls shall be subject to the approval of the Community
Development Director or his designee prior to recordation
of any deeds or record of survey. CC & Rls shall be
recorded prior to issuance of any Certificate of Occupancy
for the units when developed in the future.
7. Final plotting, architectural drawings, landscaping and
fencing shall require Minor Design Review approval prior
to issuance of grading permit.
8. Applicant shall meet all Conditions of Approval prior to
the issuance of a certificate of Occupancy and release of
utilities.

9. Prior to issuance of any grading permit or building
permits. the applicant shall sign and complete an
"Acknowledgment of Conditions" and shall return the
executed original to the Community Development Department
for inclusion in the case records.
10. Applicant shall submit and receive approval of landscape
and irrigation plans for the model homes, back-up wall
areas, street trees and slope planting in accordance with
the City Landscape Guidelines (April 1988), prior to
issuance of grading permits.

11. The model home complex shall include a landscape screened
parking lot and at least one (1) model home to include a
Xeriscape landscape theme. A landscape, fencing, parking
lot plan for the model homes shall be provided at time of
Minor Design Review.
12. Applicant shall provide a six-foot (6') decorative block
wall with pilasters along the east property line (Lots 77,
95, 182 thru 187 and 28), and south boundary line (Lots
67-76). In addition, a six foot (6') decorative block
wall with pilasters shall be installed along the easterly
side of Terra Cotta Road from "c" Street south to Lincoln
Street. openings in the wall shall be provided as
required by the City Engineer, to provide for equestrain
and pedestrian access to the County Trail easement. All
back-up walls shall be protected with an anti-graffiti
coating to be approved by the City.
13, All trailers utilized during construction, mail boxes,
and signage shall be subject to City Planning review and
approval prior to installation.
14. Applicant shall meet all requirements of the Riverside
County Fire Department for fire protection.
15. Applicant shall meet all requirements of Elsinore
Valley Municipal Water District.

16. Prior to issuance of building permits, applicant shall
provide assurance that all required fees to the Lake
Elsinore School District and the Lake Elsinore High
School District have been paid.
17. Developer shall agree to participate in or contribute to
a benefit assessment district or pay reasonable impact fee
necessary to establish a fully equipped fire station in
the west end area. If the Assessment District is not
formed to construct the station at time of request for
building permits, the applicant shall pay a $450.00junit
fee to the City.
Enqineerinq Department
18. Construct or bond for all public work improvements per
approved street plans (Municipal Code Title 12), plans
which must be approved and signed by the City Engineer
prior to recordation of Map.
19. Street improvement plans and specifications shall be
prepared by a civil engineer and improvements shall be to
Riverside County Road Department standards and City Codes
(L.E.M.C. 12.04 and 16.34).

20. Pay all fees and meet requirements of encroachment permit
issued by the Engineering Department for construction of
public work off-site improvements (Municipal Code, Title
12, Chapter 12.08 and resolution No. 83-78).
21. Dedicate underground water rights to the City (Municipal
Code, Title 16, Chapter 16.52.030).
22. Sign an acknowledgment for City Landscaping and street
Lighting District (Resolution No.'s 86-26, 86-27, 86-36).
23. Submit a letter of verification to the City Engineering
Department, from the applicable water district, stating
water and sewer arrangements have been made for this
project prior to final map approval.
24. Pay all capital Improvement, park-in-lieu fees, and Plan
Check fees (Municipal Code, Title 16, Chapter 16.34;
Resolution No. 85-26).

25. Provide street lighting and indicate on street
improvement plans as required by the City Engineer.
26. Pay Riverside County Flood Control District fees for flood
hazard review (Resolution No. 83-75 and 85-57).
27. Hydrology and hydraulic study shall be submitted for
review and approval by the Engineering Department and
Riverside county Flood Control District, where applicable,
prior to final map approval.
28. Provide 66-foot (66') dedication for Terra Cotta from "c"
Street to Tract boundary and full street improvements.
The eastern right-of-way shall include a l6-foot (16')
parkway that will be utilized for a horse trail. Terra
Cotta shall have a knuckled street connection with "C"
Street.

29. Provide a 60-foot (60') dedication and full street
improvements for Terra Cotta off-site to the north to
existing improvements and off-site to the south to Lincoln
Street. Provide 66-foot (66') dedication and full street
improvements to be completed prior to any certificate of
Occupancy.
30. Secure 60-foot (60') dedication for Washington Avenue
off-site and improve Washington Avenue to provide for two
(2) travel lanes and parking (30-foot) with curb and
gutter and sidewalk on the south side. Improvements to be
completed prior to any Certificate of Occupancy.
31. Developer shall cooperate with Riverside County to provide
access to the alleys (north and south of Zieglinde) and
provide access to Zieglinde to properties fronting
Shirley Drive. In addition, developer shall construct a
three-foot (3') high decorative wall between Terra Cotta
and Shirley Drive to prohibit access onto Terra Cotta
from Shirley Drive.

32. Developer shall improve the north half of Lincoln and
the south half within existing right-of-way from
existing improvements to Terra Cotta. Improvements shall
be curb, gutter and sidewalk on north side and pavement
to south right-of-way line. Developer shall install a
catch basin on the north side of Lincoln outletting in the
existing earthern storm drain channel, location to be
approved by the City Engineer. Improvements to be
completed prior to any certificate of Occupancy.
33. Enter into subdivision agreement for construction of
public works improvements and post appropriate bonds as
determined by the City Engineer.
34. Align Washington Avenue along the northerly tract
boundary to intersect with Terra Cotta with a knuckled
street connection.

35. Le Gaye Street shall terminate east of Terra Cotta with a
standard cul-de-sac design to be approved by Riverside
County Road Department prior to approval of final map.
Construction to be completed prior to any Certificate of
Occupancy.
36. Provide 44-foot (44') dedication for Lincoln Street with
the centerline coincident upon the southerly Tract
boundary at the southwest corner of the Tract. Contribute
to cost of half-street improvements within Tract boundary
for Lincoln. The intersection of Lincoln and Terra Cotta
shall be constructed to provide for turning movements.

37. Improve Le Gaye from terminus at tract boundary to Machado
Street. Improvements shall meet standards of Riverside
County Road Department and plans shall be approved by
Riverside County Road Department prior to approval of
final map. Construction to be completed prior to any
certificate of Occupancy.
38. Street "H" shall have 60-foot (60') right-of-way and 40-
foot (40') curb-to-curb.
39. The developer shall actively participate in the proposed
assessment district for the installation of storm drain
facilities, water facilities, sewer facilities, streets
and other appurtenant infrastructure facilities required
for the area in accordance with methods approved by the
city Engineer.
40. Developer shall pay a share for the design and
construction of the traffic signals at the locations, as
follows:

41. All utilities serving the tract and individual homes to
include telephone and television shall be placed
underground within easements reserved for such utilities.
42. If an assessment district is not formed for the area, the
developer, prior to final map approval, shall enter into
an agreement with the City to mitigate drainage impact by
paYment of drainage mitigation fee at building permit
stage and installation of appropriate facilities.
Whereas, the City is in the process of developing a master
plan for drainage for this area, and the final plan has
not yet been adopted but the previously completed Master
Plan of Drainage for the West End indicates a fee of
$4,000 per acre is in order, the developer shall deposit
$4,000 per acre which may be partially returned if the
indicated drainage fee is lower. PaYment of the fee shall
not exempt the developer from provision of physical
facilities reasonable and necessary to protect his tract
and control downstream drainage.

43. Since the Riverside county Flood Control District Master
Drainage Plan for West Elsinore will not be in place when
the site is developed, the developer will be required to
make the following permanent and interim storm drain
improvements which must be approved by Riverside County
Flood Control District and the Engineering Department
prior to approval of final map:
A. Construct an interim storm drain channel from Robb
Road along Michigan Street and Washington Avenue to an
interim detention basin. Channel shall have capacity
for 100-year storm flows. On Michigan and, if
necessary, on washington, developer shall obtain
proper right-of-way easements for both permanent and
final right-of-way for construction of the channel to
the satisfaction of the City Engineer. Right-of-way
costs will be reimbursed to the developer when an
assessment district is formed for the area.

B. Construct a detention basin northerly of Washington
Avenue with a capacity to contain lOO-year peak flows
from the area northerly ofuWashingtonAvenue. If
property owner north of Washington Avenue does not
allow detention basin on his property, developer shall
place detention basin inside Tract boundary. The use
of temporary detention basin shall include a hold
harmless and drainage acceptance condition from both
the developer and land owner where the detention basin --
is located. This information shall be provided prior
to final map approval.
C. Construct a portion of Line "C" of the Riverside
County Flood Control District's Master Drainage Plan
for West Elsinore. Line "c" storm drain shall provide
a temporary connection to the detention basin, travel
easterly on Washington, through the internal streets
of the Tract, exiting the Tract through an easement
that must be approved by Riverside County Flood
Control District to Le Gaye, southeasterly on Le Gaye
(which is being relocated from Zieglinde) and provide
a temporary connection to Line "B-2" of Riverside
County Flood Control District Master Drainage Plan.
Line "c" shall be designed and constructed to insure
that the capacity will be sufficient to carry the
lOO-year storm flows for run-off tabled by the
Riverside County Flood Control District Master
Drainage Plan for the ultimate system. Developer
shall be reimbursed for costs of installation for
permanent Riverside County Flood Control District
Master Drainage facilities when an assessment district
is formed for the area.
D. Construct Line "B" of the Riverside County Flood
Control District Master Plan from Le Gaye to its
connection with the Lincoln Street Drain. Line "B-2"
shall be designed and constructed to insure that the
capacity will be sufficient to carry the lOO-year
storm flows for run-off tabled by the Riverside County
Flood Control District Master Drainage Plan for the
ultimate system. Developer shall be reimbursed for
costs of installation for permanent Riverside
County Flood Control District Master Drainage
facilities when an assessment District is formed for
the area.

E. prainage swale traversing the westerly boundary shall
be provided with a temporary earthern swale from the
westerly boundary to Terra Cotta. Along Lincoln
Street that is improved, the swale shall be paved with
A.C. and A.C. Dike along the southerly edge and outlet
at the existing earthern channel. The temporary
earthern swale along the southerly boundary of the
Tract shall be provided in an easement or letter of
acceptance from the adjacent property owner.
F. All on-site Tract drainage will enter Line "C" and
not leave Tract boundary as surface flow.
G. Storm drain facilities shall be installed prior to any
Certificate of Occupancy and construction shall
commence at grading permit.

H. Developer shall acquire necessary easements or
right-of-way for installing storm drain in Le Gaye
Street from land owners and/or Riverside County.

the West Elsinore Master Plan Drainage System is

J. Washington Avenue from Terra Cotta to "J" Street must
drain to the west to alleviate sump area at Terra
Cotta and Washington.
44. Applicant shall work with the staff and adjacent residents
to determine whether there shall be a requirement for a
future emergency access road connecting Zieglinde Drive
with Terra Cotta Road and Washington Avenue.
45. Developer shall contribute $467.00 towards the City's
Master Entry sign Program.
46. Drainage requirements are conceptual and final design will
be addressed after a detailed Hydrology and Hydraulic
Study is submitted and approved by the city Engineer.
34. Zone Code Amendment 88-10 = city of Lake Elsinore.
A request to amend the Zoning Code to amend standards
relating to fences, walls, and landscaping in residential
districts; allow for keeping of farm animals; provide
special standards for hillside development; make various
technical corrections; change minimum lot sizes and
permitted densities and setbacks in the R-3 District (High
Density Residential); and change lighting, landscaping
and landscape setback and outside storage requirements in
non-residential districts which would apply City-wide.
City Manager Molendyk suggested that based on concerns
raised this evening, this item be continued.

51. citizens' Committee for Trails. As requested by Mayor
Winkler - Verbal Report.
Rita wilsey, 15015 LincOln, summarized the need for
multi-purpose trails throughout the valley to be used by
equestrains, bicycles and pedestrians. She requested that
Council support formation of an advisory group to work on
Trail Master Planning.

Jane Block, Chairperson for County Trails Committee,
commented on the need for a trails master plan in the Lake
Elsinore Valley. She advised that Supervisor Abraham has
supported the need for efforts in this area.
Norma Johnson, representing the Lake Elsinore Recreation and
Park District, expressed support of this planning effort.
Mayor Winkler advised that he has met with Rita Wilsey and
would like the opportunity to discuss this item more in
depth. He recommended that it be included in the study
session scheduled for February 1, to tie in with the General
Plan effort.

CITY MANAGER COMMENTS
City Manager Molendyk advised that a closed session would be
needed to discuss potential litigation and Lake Management.
He also advised that there would be a Joint study Session with
Planning Commission on February 1, 1989, from 5:00 p.m. to 7:00
p.m. at the Chamber of Commerce Conference Room, to discuss the
updated General Plan.

City Manager Molendyk also provided information on construction
underway at Macy and Grand. He advised that the existing
development and the one under construction were both approved
at the same time in 1984. He further advised that both the
existing and new developments were in compliance with the
approved plans.

Appointment of Planning commissioner.
Mayor Winkler requested that this item be considered at an
Adjourned Meeting on February 14, 1989 at 5:00 p.m.
Desiqnation of city Representative for Joint
Powers Insurance Authority Annual Meetinq.
Mayor Winkler advised that this item would not be necessary
because Councilman Washburn, who is the designated alternate,
will be able to attend.
COMMENTS
Councilman Starkey commented on the success of the Chamber of
Commerce installation last weekend. He also reminded the
public of the upcoming Chamber Carnival to be held January 26
through the 29 at the Rodeo grounds.
Councilman Dominguez advised the public that Machado Street and
Main Street are both being improved and brought up to current
standards.
Councilman Washburn thanked staff for its efforts to prevent
parking in front of Van's Laundromat on Main Street.
Mayor Winkler thanked staff and the residents for working with
Premier Homes to resolve concerns prior to Council
consideration. Mayor Winkler also commented on Planning
Commission applicants willing to serve on the General Plan
Advisory Committee. He requested that those persons be invited
to the February 1, Study Session.
