HomeMy WebLinkAbout10-08-1991 City Council MinutesMINUTES REGULAR CITY COUNCIL MEETING CITY OF LAKE ELSINORE 545 CHANEY STREET LAKE ELSINORE, CALIFORNIA TUESDAY, OCTOBER 8, 1991 *****~***********************************~******~***~************* CALL TO ORDER The Regular City Council Meeting was called to order by Mayor Washburn at 7:00 p.m. PLEDGE OF ALLEGIANCE The Pledge of Allegiar.ce was led by Mayor Washburn. ROLL CALL PRESENT: COUNCILMEMBERS: BUCK, DOMINGUEZ, STARKEY, WASABURN ABSENT: COUNCILMEMBERS: WINKLER (Arrived at 7:03 p.m.) Also present were: City Manager Molendyk, City Attorney Harper, Administrative Services Director Boone, Community Services Director Watenpaugh, Public Services Director Tecca and City Clerk Kasad. PUBLIC COMMENTS None. PRESENTATIONS/CEREMONIALS Public Services Director Tecca showed a Video and updated the following Capital Improvement Projects: 1) Riverside/Lakeshore Intersection work, 2) Gas Lines in Lakeshore Drive from Elliot to Elm, 3) Railroad Canyon Road work, 4) Joy Street Storm Drain, 5) Lakeshore/Machado Traffic Signals. A. Proclamation = Red Ribbon Week. (F:122.1) Mayor Washburn read the Proclamation recognizing October 19-27, 1991 as Red Ribbon Week and presented it to Captain Reynolds, Sheriff's Department. Captain Reynolds thanked the Council for this recognition and emphasized the importance of this type of program toward solving community problems. CONSENT CALENDAR MOVED BY WINKLER, SECONDED BY BUCK AND CARRIED BY UNANIMOUS VOTE TO APPROVE THE CONSENT CALENDAR AS PRESENTED. 1. The following Minutes were approved: a. City Council Meeting - September 24, 1991. (F:44.4) The following Minutes were received and ordered filed: b. Planning Commission Meeting - September 18, 1991. (F:60.3) 2. Received and ordered filed the Building Activity Report for September, 1991. (F:32.2) 3. Received and ordered filed the Code Enforcement Activity Report for September, 1991. Ratified Warrant List for September 30, 1991. (F:12.3) 6. Rejected and referred to Claims Administrator the Claim submitted by Floyd Marvin Follings (CL #91-11). (F:52.2) 7. Rejected and referred to Claims Administrator the Claim submitted on behalf of Linda Bridwell (CL #91-16). (F:52.2) 8. Reaffirmed the Designation of the Local Solid Waste Management Enforcement Agency (LEA) for the County of Riverside. (F:163.1) 9. Approved an Agreement apportioning the costs for signal and lighting systems on jointly owned intersections between the City of Lake Elsinore and the California Department of Transportation and authorized the Mayor to sign. (F:68.1) 10. Approved public hearing date of October 22, 1991 for the following: a. Tentative Parcel Map 26890 = A res Construction. (F:110.2) A request to subdivide 2.02 acres into three (3) parcels. The project is located at the terminus of Avenue 12 and south of Casino Drive. BUSINESS ITEMS 51. Abolition of the Citv Parkina and Business Improvement Area. (F:34.2) Ordinanca No. 927. City Attorney Harper detailed discussions with the Downtown Business Association in regard to this item. He explained that while this item has not received agreement from the D.B.A., it is the belief of the Council that the goals_of the Business Improvement District have been accomplished and it is no longer necessary to collect double business license fees in this area. Mayor Washburn commented on the rarity of this type of action to abolish an existing tax structure, but further stressed that the original intent had been accomplished. MOVED BY BUCK, SECONDED BY STARKEY TO ADOPT ORDINANCE NO. 927: ORDINANCE NO. 927 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA ABOLISHING A PARKING AND BUSINESS IMPROVEMENT AREA IN THE CITY OF LAKE ELSINORE. UPON THE FOLLOWING ROLL CALL VOTE: AYES: COUNCILMEMBERS: BUCK, STARKEY, WINKLER, WASHBURN NOES: COUNCILMEMBERS: NONE ABSENT: COUNCILMEMBERS: NONE ABSTAIN: COUNCILMEMBERS: DOMINGUEZ 52. MOVED BY DOMINGUEZ, SECONDED BY BUCK TO ADOPT ORDINANCE NO. 924: ORDINANCE NO. 924 AN ORDINANCE OF THE CITY OF LAKE ELSINORE, CALIFORNIA, REZONING 169.1 ACRES LOCATED APPROXIMATELY TWO MILES EASTERLY FROM INTERSTATE 15 AND STATE ROUTE 74 JUNCTION, JUST 50UTHERLY AND EASTERLY OF WASSON CANYON FROM R-R (MAXIMUM 0.5 DWELLING UNITS PER ACRE) TO R-1 (MAXIMUM 6 DWELLING UNITS PER ACRE) (ZONE CHANGE 91-6: TUSCANY OAKS/TMP). Second Readina = Ordinance No. 925. (F:32.3) Relating to Building Security Provisions. ~ity Manager Molendyk detailed correspondence received from developers and B.I.A. expressing concern with the portion of the Ordinance which requires alarm system installation. He suggested that second reading of this Ordinance be postponed to the next meeting to allow staff to meet with the concerned developers. MOVEll BY WINKLEIt, SECONDED BY BUCK TO CONTINUE TIiIS ITEM TO THE NEXT MEETING. Councilman Winkler commented that the Council originally requested input from B.I.A. and the developers and he felt that two weeks would allow time for that input. He further commented that Council is aware of the increased cost factor, but he was not aware of any further concerns. City Manager Molendyk advised that B.I.A.'s input was requested previously, however they have just responded to that request: Councilman Winkler offered to meet with the developers and staff. Councilman Buck was also willing to meet with this group. THE FOREGOING MOTION FOR CONTINUANCE CARRIED BY UNANIMOUS VOTE. 54. Second Readina = Ordinance No. 926. (F:114.1)(X:120.1) Relating to Rules & Regulations for City Parks and Beaches. MOVED BY WASHBURN~ SECONDED BY WINKLER TO ADOPT ORDINANCE N0. 926: ' Councilman Dominguez reminded Council of his feeling that dogs should be completely prohibited from City Parks. He summarized a report on other cities policies in this area. Councilman Buck concurred with the recommendation of Councilman Dominguez. Mayor Washburn commented for the record that "seeing-eye" dogs would be exempt in any case. He stressed his feeling that dogs should be allowed in City Parks with the responsibility placed on the owners to keep them leashed and clean up after them. ouncilman Buck commented on complaints received from user roups and parents of children participating in sports. ;ayor Washburn expressed his concern with this item being ~laced on the agenda at all. :ouncilman Starkey questioned the enforcement of this ~rdinance and expressed concern that L.E.A.F. would not have he manpower and would find it very difficult to enforce. NO. 926 N ORDINANCE OF THE CITY OF LAKE ELSINORE, CALIFORNIA, MENDING SECTION 8.40.010 AND ADDING SECTION 8.40.040 OF THE AKE ELSINORE MUNICIPAL CODE REGARDING THE CLOSURE TIMES AND JLES AND REGULATIONS FOR CITY PARKS AND BEACHES. Comm"nity Services Director Watenpaugh advised that the City will be p esenting a Haunted Hall and Halloween Carnival on Halloween NigY;! as a safe alternative to the traditional activities. Comn! nity Services Manager Sapp detailed the games and activities prop ~ed for the Carnival and stressed the nominal charge for this even:. Captain Reynolds supported this event and further stressed that this is a safe way to spend Halloween. CITT COUNCIL COMMENTS Cour ilman Dominguez commented on Item #9 on this agenda regarding a ce.:perative agreement with Caltrans, and commended staff for worlcing out a cost saving, innovative approach to this situation. Maya Pro Tem Starkey commented on the United Way Fund Raising Drit for this year including the Walk-a-Thon and Telethon, as wel"1 is the payroll deduction program and encouraged Community part ~ipation. He explained that this year's goal for this area is $50,000. He also explained that last year approximately $63, 00 came back to this community through United Way supported proc ims . Maye Washburn further commented on United Way's efforts and than:~d the volunteers throughout the Community and City Staff for thei assistance. Mayc Pro Tem Starkey advised that Lake Elsinore is the only City in t' ~ State with a United Way Telethon. PAGE FIVE - CITY COUNCIL MINUTES - OCTOBER 8, 1991 Mayor Washburn commented on previous discussion of a Police Tax and addressed a letter received on that subject. He clari£ied Council's position and salaries in response to that letter. Mayor Washburn also commented on the existing crime problems in the City and stated that he feels the sheriff's department is doing everything possible to address this situation, and reminded the Community of its responsibility in solving the problems. City Attorney Harper requested a joint closed session to discuss ongoing litigation with LEA and with EVMwD. THE CITY COUNCIL MEETING WAS RECESSED AT 7:40 P.M. THE CITY COUNCIL RECONVENED AT 7:43 P.M. CLOSED SESSION THE CITY COUNCIL MEETING WAS ADJOURNED TO A JOINT CLOSED SESSION WITH THE REDEVELOPMENT AGENCY AT 7:43 P.M. TO DISCUSS ONGOING LITTGATION WITH ELSINORE VALLEY MUNICIPAL WATER DISTRICT AND LAKE ELSINORE ASSOCIATES. THE CITY COUNCIL RECONVENED AT 8:10 P.M. NO ACTION TAKEN.
