HomeMy WebLinkAbout08-13-1991 City Council MinutesMINUTES REGULAR CITY COUNCIL MEETING CITY OF LAKE ELSINORE 545 CHANEY STREET LAKE ELSINORE, CALIFORNIA TUESDAY, AUGUST 13, 1991 **************,t********************~***,t*************,t************ CALL TO ORDER The Regular City Council Meeting was called to order by Mayor Washburn at 7:00 p.m. PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Councilman Winkler. ROLL CALL PRESENT: COUNCILMEMBERS: BUCK~ DOMINGUEZ, STARKEY, WINKLER, WASHBURN ABSENT: COUNCILMEMBERS: NONE Also present were: City Manager Molendyk, Assistant City Manager Rogers, City Attorney Harper, Administrative Services Director Boone, Community Services Director Watenpaugh, Public Services Director Tecca, Community Development Manager Shear and City Clerk Kasad. PUBLIC COMMENT5 None. PRESENTATIONS/CEREMONIALS A. Video Presentation = Communitv Facilities District 88-3 Update. (F:22.3) City Manager Molendyk gave a brief overview of Community Facilities,District 88-3 and its impact on the West End developments. Public Services Director Tecca detailad the locations of various improvements for ease in identification.in the Video. He presentad the Video and explained the pro~ects including work completed thus far and time lines and delays with other projects. Councilman Buck inquired whether landscaping is proposed around the water tank shown. Mr. Bolton of Keith Company advised that it is planned. Councilman Buck also questioned the County section of Grand Avenue and whether it would be completed as well. Public Services Director Tecca advised that an agreement has been reached with the County and it will be improved to the full 32 feet in that section as well. Mayor Washburn inquired how the land acquisitions for Grand Avenue were proceeding. Public Services Director Tecca advised that oondemnation is proceeding at the Robb/Lakeshore intersection. Councilman Winkler questioned the timing for Grand Avenue. Mr. Tecca advised that once tha contract is in place the project should take about 60 days. City Manager Molendyk emphasized the sensitivity to the potential for heavy rains, and advised that planning is underway for use of sandbags. CONSENT CALENDAR The following item was pulled from the Consent Calendar for further discussion and consideration: Item No. 4. MOVED BY BUCK, SECONDED BY STARKEY AND CARRIED BY UNANIMOUS VOTE TO APPROVE THE BALANCE OF THE CONSENT CALENDAR AS PRESENTED. l. The following Minutes were approved: a. Approved Grant Deed relating to Outlet Center'Project. (F:10.2) 8. Approved public hearing date of August 27, 1991, for the following: a. Tentative Parcel Map 26890 _ A res Construction. A request to subdivide 2.02 acres into three (3) parcels. The project is located at the terminus of Avenue 12 and south of Casino Drive. (F:110.2) ITEM PULLED FROM CONSENT CALENDAR 4. Structure Abatement Activitv Report _ Julv' 1991. (F:32.4) Mayor Washburn requested an update on current abatement activity. Community Development Manager Shear advised that one structure has been added recently, seven houses are being rehabilitated, five houses are at second notice and nearing abatement. He further advised that staff is working with the City of Montclair to review their program for implementation here. In addition an ordinance has been forwarded to the Board of Realtors for comment with regard to inspections when rental property is sold. City Manager Molendyk added that the City is currently working to hire four part time code enforcement officers to assist the current efforts and cover weekend enforcement. Briahton Homes _ General Plan Amendment 91-1: Specific Plan 89-2 Amendment No. 1~ Zonina Reaulations and Develobment Aareement Amendment No. 1. (F:150.2)(X:83.2)(X:68.1) City Manager Molendyk explained that staff is recommending a 30 day continuance to allow-for resolution of pending concerns. Councilman Buck advised that he is aware of discussions and feels the concerns can be resolved in two weeks. MOVED BY BUCK, SECONDED BY WINKLER AND CARRIED BY UNANIMOUS VOTE TO CONTINUE THIS ITEM FOR TWO WEEKS. 32. General Plan Amendment 91-4 and Zone Chanae 91-6 - East of I-15. South of Highway 7~ and South of Wasson Canyon. (F:83.2) (X:172,2) MOVED BY WINKLER, SECONDED BY BUCK AND CARRIED BY UNANIMOUS VOTE TO CONTINUE THIS ITEM TO SEPTEMBER 24, 1991. 33. Ado tion of the Master Plan of Drainaae. (F:100.2) Ordinance No. 919 and Resolution No. 91-63. Engineering Manager O'Donnell detailed the review of City territory as well as sphere of influence to determine drainage needs and impacts for this consideration. He explained that the area is divided in 51 districts and explained the fee calculations. He also explained that this effort will assist in meeting the AB 1600 requirements. He requested clarification from the City Attorney with regard to existing development agreements. City Attorney Harper advised that it would depend on each development agreement independently. The City Clerk reported no written comments or protests. Mayor Washburn opened the public hearing at 7:31 p.m. asking those in favor of this action to speak. The following person spoke: Ken Meddock, Brighton Homes, supported the proposed fee and suggested that the traffic impact fee also be pursued in the near future. He questioned the l0 year reimbursement agreement term and suggested 15 years might be more reasonable. Mayor Washburn asked those in opposition to speak. Hearing no one, the public hearing was closed at 7:34 p.m. Mayor Washburn commented on the effort to enact this fee and what it seeks to provide. Engineering Manaqer O'Donnell advised that the 10 year contract period is common, but 15 years would be acceptable. City Attorney Harper clarified tha process and the timing - considerations, and how the actual figures can be ascertained. BUSINESS/DISCUSSION ITEMS 51. Commercial Project 89-9 = Extension of Time - Pinnacle Partnershib. (F:58.2) - A reques~ to construct a commercial center consisting of three (3) buildings totaling 28,770 square feet on five (5) gross acres,located approximately 1,200 feet east of Main Street, north of Lakeshore Drive. City Manager Molendyk detailed this project and recommended extension of time as requested. MOVED BY STARKEY, SECONDED BY WASHBURN AND CARRIED BY A VOTE OF 4 TO 0 WITH BUCK ASSTAINING TO APPROVE THE REQUESTED ONE YEAR EXTENSION OF TIME. 52. Revised Disaster Plan and Disaster Relief Ordinance. (F:74.1) Ordinance No. 920 & Resolution No. 91-64. City Manager Molendyk introduced Division Chief Scott, Emergency Services; Division Chief Wright, Western Division; Chief Terry Schmutz of the Lake Elsinore Station and Mary Moreland, County Disaster Coordinator, representing the Riverside County Fire Department. Mary Moreland commented on the 1 year and 5 months invested in the proposed plan and explained the plan itself. She detailed the training session held with staff and the countywide preparations being made toward the September 12, 1991 Earthquake Exercise. She thanked staff for their assistance and advised the Council that the City is very well prepared for that exercise. BUSINESS ITEMS 53. Appointment of Plannina Commissioner. (F:60.2) Mayor Washburn explained the interview process undertaken for this appointment and thanked the applicants for their involvement and interest in the prooess. He commented on past involvements in the Community and recommended Robert C. Sellevold for the unexpired term continuing to June, 1994. Councilman Starkey,commented on the difficulty of this deoision based on the interviews. Mayor Washburn further commented on the collective consideration given to this recommendation. MOVED BY WINKLER, SECONDED BY BUCK AND CARRIED BY UNAN?i`~IUUS VOTE TO APPOINT ROBERT C. SELLEVOLD TO THE UNEXPIRED TERM TO JUNE, 1994. Mayor Washburn advised that Mr. Sellevold woulfl officially be sworn in at the next Planning Commission Meetang. CITY MANAGER COMMENTS City Manager Molendyk requested a 5tudy Session for the purpose of discussing public safety and budget 1991-92, and suggested Auqust 22nd from 3-5 p.m. Councilman Winkler expressed concern with this time frame and requested either evenings or weekends. After further discussion the requested Study 5ession was scheduled for August 20, 1991 from 4-6 p.m. CITY COUNCIL COMMENTS Councilman Winkler questioned the status of Terra Cotta Park Improvements. Community Services Director Watenpaugh advised that the contractor was authorized to start work on Monday and will begin soon. He explained that the bulk of the improvements would be completed before September 3rd when school starts, however, the lights are on order and will take approximately 6 weeks to receive. Councilman Winkler advised that he was glad for the Study Session on Public Safety and requested a report on the potential for a security system ordinance. He oommented on the increasing use of Lakepoint and Machado Parks. He questioned the timing for flood control improvementa and the traffic signal in the Machado/Lakeshore intersection. Public Services Director Tecca detailed the time frames and procedure. PAGE SIX - CITY COUNCIL MINUTES - AUGUST 13, 1991 Mayor Pro Tem Starkey thanked staff for their assistance in resolving the weed problems mentioned at the last meeting. Mayor Washburn advised that the 404 permit for Collier Avenue had been granted and work would begin while protecting the Least Bell's Vireo. He stressed the need for public input on matters of concern to the Community. THE CITY COUNCIL MEETING WAS RECESSED AT 7:55 P.M. THE CITY COUNCIL RECONVENED AT 7:57 P.M. CLOSED SESSION THE CITY COUNCIL ADJOURNED TO CLOSED SESSION AT 7:57 P.M. TO DISCUSS MATTERS OF LITIGATION INVOLVING ADAMS ADVERTISING, LAKE ELSINORE ASSOCIATES~ E.V.M.W.D. AND MATTERS OF POTENTIAL LITIGATION. THE CITY COUNCIL RECONVENED AT 8:45 P.M. NO ACTION TAKEN.
