ROLL CALL PRESENT: COUNCILMEMBERS: BUCK, DOMINGUEZ, STARKEY, WINKLER, WASHBURN ABSENT: COUNCILMEMBERS: NONE Also present were: City Manager Molendyk, Assistant City Manager Rogers, City Attorney Harper, Administrative Services Director Boone, Community Services Director Watenpaugh, Public Services Director Basham and City Clerk Kasad. PUBLIC COMMENTS Chris Hyland, 15191 Wavecrest Drive, expressed concern with the ongoing battle over jurisdiction o£ the lake. She felt the City could not survive without the use of the lake for recreation and suggested that the public familiarize themselves with Title 22 and the type of water that could be allowed in the lake. She advised that a petition is currently being circulated by a new organization called "Save our Lake" and the positive comments received to date. (F:92.1) Dick Knapp, 29690 Dwan Drive, reminded Council that he will be requesting that Resolution No. 87-64 be rescinded, and suggested June llth consideration. Emerson Brigham, 33500 McGrew Drive, expressed concern with delays in development which have and continue to impact his ability to use his property. He advised that he has agreed to sell his property and agreed to the appraisal, but seems to be ignored to date. He questioned the City's justification to impact his property rights in this way. PRESENTATIONS/CEREMONIALS A. Proclamations _ Respect for Law Week - Optimist Club & Lake Elsinore Police Explorers. (F:122.1) Roger Mills introduced John Del Valle to explain the work of the Explorers. O£ficer Del Valle detailed the program and introduced the Explorers present. Mayor Washburn read the proclamation for the Explorers post and presented it to John Del Valle. Roger Mills explained the Optimist Club programs and their recognition of Law Enforcement programs. (F:122.1) Mayor Washburn read the Proclamation and presented it to Buck Cheatham representing the Veteran's of Foreign Wars and Diana Winlund representing the Women~s Auxiliary. The representatives presented Mayor Washburn with Buddy Poppies on behalf of each organization. C. Proclamation = Small Business Week. (F:122.1) The representative was not present for presentation. D. Presentation - Certificates of Recoanition - Internal Revenue Service - Volunteer Income Tax Counselina for the Elderlv. (F:56.1) Volunteers were not present for presentation. CONSENT CALENDAR The following item was pulled from the Consent Calendar for further discussion and consideration: Item No. 6. Approved City Support of County-wide Integrated Waste Management Plan AB 1423 & SB 235 requiring manufacturers of containers composed of certain materials use minimum percentages of recycled content; and Adopted Resolution No. 91-34. (F:163.1) RESOLUTION NO. 91-34 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE SUPPORTING ASSEMBLY BILL 1423 AND SENATE BILL 235. 9. Approved City Support of County-wide Integrated Waste Management Plan - AB 75 adding wine and liquor containers to the California Beverage Container Recycling Act; and Adopted Resolution No. 91-35. Traffic Control._ Chamber of Commerce Rodeo & Carnival. (F:108.4) Councilman Dominguez expressed concern with the proposed closure of Franklin Street. He suggested that barricades be placed so they would cause the least inconvenience for people not attending the Rodeo. Community Services Director Watenpaugh explained the concerns for pedestrian safety during the event. Dave Steele, President, Chamber of Commerce, advised that they are willing to accommodate the direction of the Council. Extensive Council discussion ensued with regard to potential alternatives for notification of the road closure. MOVED BY WINKLER, SECONDED BY BUCK AND CARRIED BY UNANIMOUS VOTE TO APPROVE STAFF'S RECOMMENDATION TO AUTHORIZE CLOSURE TO THROUGH TRAFFIC FROM 4:00 P.M. TO MIDNIGHT ON MAY 23-24 AND 12:00 NOON TO MIDNIGHT ON MAY 25-27, 1991; WITH THE AMENDMENT THAT TRAFFIC BE STOPPED OR ALERTED AT THE LAST INTERSECTION. PUBLIC HEARINGS 31. Tentative Tract Map 26065; Annexation No. 58~ Zone Chanae 90-14 = Tozai, Inc. (F:160.2) (X:20.2) (X:172.2) City Manager Molendyk advised that a continuance to May 28, 1991 has been requested by the applicant rather than the June llth day suggested in the staff report. MOVED BY WINKLER, SECONDED BY DOMINGUEZ AND CARRIED BY UNANIMOUS VOTE TO CONTINUE THIS ITEM TO MAY 28, 1991. 32. Communitv Facilities District 91-2 (SUmmerhill) - Chanae in Facilities. Resolution No. 91-37 & 91-38. (F:22.3) City Attorney Harper explained that this action allows for the addition of facilities left out in the original materials; and detailed the procedure for Council to follow. The City Clerk reported no written comments or protests. Mayor Washburn opened the public hearing at 7:40 p.m. askinq those persons interested in this item to speak. THE CITY CLERK bPENED THE BALLOT AND ADVISED THAT IT WAS IN FAVOR OF THE CHANGE'OF FACILITIES. MOVED BY bOMINGUEZ, SECONDED BY STARKEY AND CARRIED BY UNANIMOUS VOTE TO ADOPT RESOLUTION NO. 91-38: RESOLUTION N0. 91-38 A RESOLUTION DECLARING RESULTS OF SPECIAL ELECTION, DETERMINING VALIDITY OF PRIOR PROCEEDINGS, AND DIRECTING RECORDING OF AMENDED NOTICE OF SPECIAL TAX LIEN. BUSINESS/DISCUSSION ITEMS 51. Residential Project 89-18 = Joseph Fitzpatrick. (F:138.2) A request to appeal the Planning Commission decision to deny a Design Review request for a twenty unit apartment complex on 1.01 acres, located on the west side of Robertson Street between Riverside Drive and Shrier Drive. City Manager Molendyk introduced the project and explained the appeal and asked that Council adopt Negative Declaration 89-51, and approve Residential Project 89-18 subject to the findings and conditions. Mayor Washburn called upon Mr. Dick Knapp to address Council. Mr. Knapp, 29690 Dwan, Lake Elsinore, questioned Condition No. 36.a and 36.b and further pointed out the problems with roads, infrastructure, traffic circulation problems and drainage. He further stated that he was opposed to the project. Mayor Washburn then called upon Mr..Chris Bachman who represents the applicant. Mr. Bachman, 1322 June Street, Fallbrook, addressed Council and stated that the applicant does have the intent to meet the conditions stated in the agenda and he would be available to Council for further questions. Councilman Dominguez stated that all the items that concerned Mr. Knapp were addressed by the conditions set by the Engineering Department. Mayor Washburn questioned a cul-de-sac in this project. Ray O'Donnell stated that there would be no cul-de-sac, but rather the street would dead end in a barricade. This would make it possible for the City to do this without more dedicated right-of-way. Mayor Washburn further questioned the traffic circulation Councilman Buck stated that due to the applicant doing all of the improvements on the project it would not be fair to expect the entire neighborhood to be done. Mayor Washburn suggested a reimbursement agreement might be used to pay back the applican~ for the improvements. PAGE FIVE - CITY COUNCIL MINUTES - MAY 14, 1991 Mayor Washburn questioned the sewer connections. He further questioned the rear elevations and the design quality of the project. Councilman Starkey stated that Mr. Knapp had brought up some good points and that the Engineering aspect of the project should have further review. Mr. Bachmdn stated that this project has gone through two and one-half years going through the planning and design review process. The presented project was what the project was refined to. He further offered to go 30 feet of right-of-way paved. Mayor Washburn suggested a 30 day continuance to further study and consider the concerns of Council. Councilman Buck stated that he would like to see the drainage addressed in a more in depth manner. MOVED BY WASHBURN, SECONDED BY WINKLER AND CARRIED BY UNANIMOUS VOTE TO CONTINUE RESIDENTIAL PROJECT 89-18 - JOSEPH FITZPATRICK FOR THIRTY DAYS. 53. Exterrsion of Time = Tract 19344 - Crowell Industries. (F:160.2) A request for Extension of Time on a 309 unit residential development located westerly of the intersection of Union Street & Corydon. City Manaqer Molendyk explained the background of the project and stated that he would like to see the park developed as soon as possible. Mr. Molendyk stated that staff recommends an extension of time adding Condition No. 70 based on the findings and conditions. Community Services Director Watenpaugh explained the need of the parks and their development for this tract. Councilman Winkler stated that he understood that this development was adjacent to another area and the City could also add on to the park site. Mr. Watenpaugh stated that there was area now slated as buffer for the park that could be developed at a later date. Councilman Dominguez asked if the maintenance of the buffer zone was part of the project. Mr. Watenpaugh stated that maintenance was not part of the projeot. He further stated that it would be up to the City to development this area or leave it as a buffer. Councilman Buck suggested that this proposed buffer zone be used as a parking area since there is a need for this park project. Mr. Harry Crowell, President of Crowell Industries stated that his oompany inherited this project and has gone through some substantial additions and it is well above City requirements. This project was delayed due to the Storm Drain. He further requested that Council award an extension of time with no further conditions due to time and cost of this project. Mayor Washburn asked for Council comments. PAG~ SIX - CITY COUNCIL MINUTES - MAY 14, 1991 Councilman Winkler stated that the residents in that area have been asking for the park and in the last two or three years the City has been requiring other developers to provide parks. He stated that he was satisfied that we do not require the 3eveloper to do the parking lot. He further suggested that ~ondition No. 70 be changed to 5 acres. Councilman Buck stated that he was in agreement with Councilmari Winkler. He further stated that the primary concern was to get the park. Councilman Dominguez stated that he was under the impression that we were getting a complete park at this time. City Manager Molendyk clarified the 2.7 acres split. Council is asking for the total of 5 acres to be developed and the City would be responsible for the 8 acre buffer. Mr. Crowell stated that the additional acreage would make the cost prohibitive. Council had general discussion in regard to cost and requirements with a suggestion that Councilman Buck and i:ouncilman Winkler meet with the developer and come to an agreement. MOVEp BY WINKLER, SECONDED BY BUCK AND CARRIED BY UNANIMOUS VOTE TO CONTINUE THE PROJECT TO THE NEXT REGULAR COUNCIL MEETING. 54. Extension of Time for Industrial Proiect 90-2 and Variance .~0=2 = Dexter Partners I. (F:86.2) A request for a one (1) year extension for a Design Review of ten (10j industrial buildings with a total floor area of 87,900 square feet on 6.25 gross acres, and a request for relief from Section 17.56.100.B of the Lake Elsinore Municipal Code for landscape buffer zone for both the northeast and raorthwest property lines, located at the northwest corner of Dexter Avenue and Second Street. City Manager Molendyk detailed this request. MOVED BY BUCK, SECONDED BY STARKEY AND CARRIED BY UNANIMOUS VOTE TO APPROVE THE REQUESTED EXTENSION OF TIME TO MARCH 27, 1992 FOR INDUSTRIAL PROJECT 90-2 AND VARIANCE 90-2; RE-AFFIRM NEGATIVE DECLARATION 90-2, BASED ON THE FOLLOWING FINDINGS AND SUBJECT TO THE FOLLOWING CONDITIONS OF APPROVAL WITH AMENDMENT PROPOSED BY STAFF. FINDINGS = DESIGN REVIEW 1. The project, as approved, complies with the Goals and Objectives of the General Plan and the Zoning District in which the project is located. 2. This project complies with the design directives contained in Chapter 17.82.060 and all other applicable provisions of the Lake Elsinore Municipal Code. 3. Conditions and safeguards pursuant to Chapter 17.82.070, including guarantees and evidence of compliance with conditions, have been incorporated into the approval of the subject project to ensure development of the property in aacordance with the Objectives of Chapter 17.82. PAGE SEVEN - CITY COUNCIL MINUTES - MAY 14, 1991 FINDINGS - VARIANCE 1. That adequate conditions and safeguards pursuant to Section 17.76.050 have been incorporated into the approval of the Variance to insure development of the property in accordance with the objectives of the General Plan and the purpose of the planning district in which the site is located. 2. That there are special circumstances, pursuant to the purpose of this Chapter, applicable to the subject property which do not apply generally to other properties in the neighborhood, and, therefore, granting of the variance shall not constitute a grant of special privilege inconsistent with the limitations upon other properties in the vicinity and district in which the subject property is located. 3. That in approving the Variance, any reductions authorized from the strict interpretation of the Zoning Ordinance represents the minimum deviation from the Code necessary to fulfill the purpose of this Chapter and enable reasonable development of the property. PLANNING DIVISION CONDITIONS 1. Approval of Industrial Project 90-2 is contingent upon the approval of Variance 90-2. 2. Design Review approval for Industrial Project 90-2 & Varianoe 90-2 will lapse and be void on September 11, 1991, unless building permits are issued prior to that date. However, Industrial Project 90-2 and Variance 90-2 will be automatically be extended to March 27, 1991 if Parcel Map 23411 is recorded or a time extension is granted to said map. 3. Al1 Conditions of approval shall be fully implemented within the project design in all phases and/or adhered to strictly. 4. These Conditions of Approval shall be attached or reproduced upon Page One of building plans prior to their acceptance by the Division of Building and Safety. 5. All site improvements shall be constructed as indicated on the approved plot plan and elevations. Revisions to approved site plans or building elevations shall be subject to Design Review. All plans submitted for Building Division Plan Check shall conform with the submitted plans as modified by Conditions of Approval or the Planning Commission through subsequent action. 6. Materials and colors depicted on the materials board shall be used unless modified by the Community Development Director or his designee. 7. Buildings shall be constructed as depicted on plans or as modified by the Community Development Director or his designee. 8. A revised site plan and elevation plan shall be submitted to the Planning and Building Departments by the applicant prior to Building Division issuance of permits which reflects all conditions of approval. PAGE EIGHT - CITY COUNCIL MINUTES - MAY 14, 1991 These revised plans shall become the approved plot plan only upon the review and approval by the Community Development Director or his designee. 9. Applicant shall meet all Conditions of Approval prior to the issuance of a Certificate of Occupancy and release of utilities. 10. Utility releases and Certificates of Occupancy shall be granted for logical blocks or groups of units for which construction activity is complete and all Conditions of Approval met. Construction activities shall be completed for all units in each block prior to any releases. 11. Applicant shall comply with all requirements of the City's Grading Ordinance. Construction generated dust and erosion shall be mitigated in accordance with the provisions of Municipal Code, Chapter 15.72 and using accepted techniques. Interim erosion control measures shall be provided 30 days after the site's rough grading, as approved by the City Engineer. 12. A final grading plan shall be submitted and shall be subject to the approval of the Chief Building Official. 13. Applicant is to meet all applicable City Codes and ordinances. 14. Applicant is to meet all applicable State Handicap Requirements. 15. Meet all Riverside County Health Department requirements. 16. No outdoor storage shall be allowed for any tenant. 17. Trash enclosures shall be constructed per City standards as approved by the Community Development Director. 18. No roof ladders shall be permitted. 19. Applicant shall use roofing materials with Class "A" fire rating. 20. The design and construction of the project shall meet all County Fire department standards for fire protection and shall include emergency vehicle turning radius, and fire resistance requirements for all buildings including sprinklers where required, and any additional requirements requested by the Fire Marshal. A fire detector check assembly shall be required for any interior fire lines and hydrants. A letter shall be submitted verifying compliance prior to issuance of building permits. 21. All roof mounted or ground support air conditioning units or other mechanical equipment incidental to development shall be screened so that they are not visible from neighboring property or public streets. Any roof mounted central swamp coolers shall also be screened. 22. All roof mounted equipment shall be at least PAGE NINE - CITY COUNCIL MINUTES - MAY 14, 1991 six-inches (6") lower than the parapet wall or top of equipment wall and shall be painted to match the building. Evidence of compliance shall be included in building plans. 23. DELETED. 24. All°exterior downspouts shall be painted to match the building. 25. Any proposed metal mailboxes shall be treated to blend with the center's design theme. Mailboxes shall be submitted for approval prior to issuance of building permits, subject to the approval prior to issuance of building permits, subject to the approval of the postal service and the Community Development Director or his designee. 26. Brick pavers or texture pavement treatments shall be laid in bank designs and shall be located at the driveway approaches and crosswalks. 27. The final landscaping/irrigation plan is to be reviewed'and approved by the City's Landscape Architect Consultant and the Planning Mnaager or designee, prior to the issuance of building permit. A Landscape Plan Check Fee will be charged prior to final landscape approval based on the Consultant's fee plus twenty percent (20%). a) All planting areas shall have permanent and automatic sprinkler system with l00% watering coverage. b) Applicant shall plant street trees, selected from the City Street Tree List, a maximum of 30-feet apart and at least 24" box in size. c) All planting areas shall be separated from paved areas with a six-inch (6") high and six-inch (6~~) wide concrete curb. d) Planting within fifteen feet (15') of ingress/ egress points shall be no higher than thirty-six inches (36"). e) The Landscape plan shall provide for ground cover, shrubs and trees and meet all requirements of the City's adopted Landscape Guidelines. f) Landscape planters shall include an appropriate parking lot shade tree to provide for 50~ parking lot shading in fifteen years. g) Any transformers and mechanical or electrical equipment shall be indicated on landscape plan and screened as part of the landscaping plan. h) All landscape improvements shall be bonded 120% Faithful Performance Bond, and released at completion of installation of landscape requirements approval/acceptance, and bond 100% for material and labor for one (1) year. i) All landscaping and irriqation shall be installed within affected portion of any phase at the time a Certificate of Occupancy is requested for any building. PAGE TEN - CITY COUNCIL MINUTES - MAY 14, 1991 j) Final landscape plan must be consistent with approved site plan. k) Final landscape plans to include planting and irrigation details. 28. Prior to issuance of Certificate of Oocupancy and rel'ease of utilities, an approved landscape plan shall reflect the following: a) Landscape berms a maximum of two feet (2') in height shall be incorporated along the Second Street frontage and along Dexter Avenue and the interior cul-de-sac where parking is visible from their right-of-way. b) All proposed five (5) gallon "Euclayptus Citriodora" be upgraded to minimum fifteen (15) gallon size. c) Required street trees shall be "Magnolia Grandiflora". d) The 17 ash trees will all be 24" box or better. 29. DELETED. 30. All exposed slopes in excess of three feet (3') in heiqht shall have a permanent irrigation system and erosion control vegetation installed, approved by the Planning Commission. 31. All exterior on-site lighting shall be shielded and directed on-site so as not to create glare onto neighboring property and streets or allow illumination above the horizontal plane of the fixture. The light fixture proposed is to match the architecture of the building. No wall pack units shall be permitted. 32. Any security lighting located on-site shall be ornamental and shall be shown on building plans, subject to the approval of the Community Development Director or his designee. 33. Applicant shall annex project into a City Landscape and Lighting District. 34. All signage shall be by City permit. 35. The applicant shall develop a Master Signage Program for the center which specifies harmonious and consistent colors, materials and specifications which will enhance thE :_anter's design and meet the provisions of L<>;cE: Elsinore Municipal Code Chapter 17.94. The Masi.e~ Signage Program shall be reviewed and approved by ti,=a Planning Commission. All signage including free-::cz;;zding signs shall be by City Permit and in cc.z armance with the approved Master Signage Program. :'he Master Signage Program shall be approved prior to issuance of Certificate of Occupancy or release of utilities. Individual sign permits are required prior to the erection of each sign. 3G. The project shall connect to sewer and meet all requirements of the Elsinore Valley Municipal Water PAGE ELEVEN - CITY COUNCIL MINUTES - MAY 14, 1991 District (EVMWD). Applicant shall submit water and sewer plans to the EVMWD and shall incorporate all district conditions and standards. 37. Painted arrows on the asphalt shall be located at all internal one-way drive aisles. 38. Al1 loading zones shall be clearly marked with yellow striping and shall meet City standards for loading zones. 39. A six-foot (6') high masonry wall shall be constructed along.the side and rear property lines and shall conform to Section 17.14.080 (Fences and Walls), walls depicted in the rendering 3790-1. 40. The rear perimeter wall shall be six-feet (6') in height and provide a visual transition (step-down) in order to assure proper visibility. The wall shall be constructed of decorative block. 41. Trailer utilized during construction shall be approved by Planning Division. 42. On-site surface drainage shall not cross sidewalks. 43. Any additional required dedications for public right-of-way shall be provided for on site plan. 44. Prior to issuance of any grading permit or building permits, the applicant shall sign and complete an "ACknowledgment of Conditions" and shall return the executed original to the Community Development Director for inclusion in the case records. a) All areas or pads graded during the grading operation shall be landscaped if permits are not issued for building within 120 days. ENGINE~RING DEPARTMENT CONDITIONS 45. Prior to issuance of building permits, applicant shall comply with all Conditions of Approval for Tentative Parcel Map 23411 (following). The conditions shall be complied with at building permit if not completed when the Parcel Map is recorded. PLANNING DIVISION CONDITIONS - PARCEL MAP 23411 1. Tentative Parcel Map 23411 will expire two (2) years from the date of approval. 2. Any development on any lot contained within this map shall be connected to sewer. 3. Prior to recordation of the final map, the applicant shall sign and complete an "Acknowledgment of Conditions" statement and shall return the executed original to the Community Development Department for inclusion in the case records. ELSINORE VALLEY MUNICIPAL WATER DISTRICT CONDITIONS: 4. Any future development will require the applicant to design and construct all water facilities to Elsinore Valley Municipal Water District Standards. PAGE TWELVE - CITY COUNCIL MINUTES - MAY 14, 1991 5. All domestic and irrigation service lines will require six (6) reduced pressure principle backflow devices. EERING DEPARTMENT CONDITIONS: 6. All roof mounted equipment shall be at least six-inches (6") lower than the parapet wall or top of equipment wall and shall be painted to match the building. Evidence of compliance shall be included in building plans. 19. All outdoor ground or wall mounted utility equipment shall be architecturally screened along with substantial landscaping, subject to the approval of the Community Development Director. 20. All exposed slopes in excess of three feet (3') in height shall have a permanent irrigation system and erosion control vegetation installed, approved by the Planning Division. 25. All exterior on-site lighting shall be shielded and directed on-site so as not to create glare onto neighboring property and streets or allow illumination above the horizontal plane of the fixture. Plans for the proposed exterior light fixtures shall be included with building plans and shall be subject to the approval of the community Development Director or his designee prior to the issuance of building permits. 26. Any security lighting located on-site shall be ornamental and shall be shown on building plans, subject to the approval of the Community Development Director or his designee. 27. Applicant shall annex project into the City's Landscape and Lighting District. 2~. The applicant shall develop a Master Signage Program for the center which specifies harmonious and consistent colors, materials and specifications which will enhance the center's design and meet the provisions of the Lake Elsinore Municipal Code, Chapter 17.94. The Master Signage Program shall be reviewed and approved by the Planning Commission. Al1 signage including free-standing signs shall be by City Permit and in conformance with the approved Master Signage Program. The Master Signage Program shall be approved prior to issuance of Certificate of Occupancy or release of utilities. Individual sign permits are required prior to the erection of each sign. 29. The project shall connect to sewer and meet all requirements of the Elsinore Valley Municipal Water District (EVMWD). Parking stalls shall be double-striped with four-inch (4") lines two-feet (2') apart. 31. A~1 loading zones shall be clearly marked with yellow st~iping and shall meet City Standards for loading zones. This project shall be designed so that every unit is provided with a loading space as required by the City's Municipal Code. 32. A six-foot (6'j high masonry wall shall be constructed along the north side property line and shall conform to section 17.14.080 (Fences and Walls), subject to the approval of the Community Development Director. Said wall shall be constructed of the split-face masonry to match the masonry of building. In lieu of the construction of said wall applicant shall provide to the City a guarantee of funds sufficient to construct said wall in a manner approved by the City Attorney. 33. Trailers utilized during construction shall be approved by Planning Division. 34. On-site surface drainage shall not cross sidewalks. 35. Any additional required dedications for public right-of-way shall be provided for on site plan. 36. Prior to issuance of any grading permit or building permits, the applicant shall sign and complete an "Acknowledgment of Conditions" and shall return the executed original to the Community Development Department for inclusion in the case records. Enaineerina Department Conditions: 37. All Public Works requirements shall be complied with as a condition of development as specified in the Lake Elsinore Municipal Code at the time a building permit is issued. 38. Pay all Capital Improvement and Plan Check fees (Municipal Code, Title 16, Chapter 16.34, Resolution No. 85-26). 39. Submit a"Will-Serve" letter to the City Engineering Department, from the applicable water agency, stating that water and sewer arrangements have been made for this project. Submit this letter prior to applying for a building permit. 40. If the existing street improvements are to be modified, existing street plans on file shall be modified accordingly and approved by the City Engineer prior to issuance of building permit. An encroachment permit will be required to do the work. 41. The conditions shall be complied with at building permit stage if not completed when the Parcel Map was recorded. Countv Fire Department Conditions: 50. The Fire Department is required to set a minimum fire flow for the remodel or construction of all commercial buildings using the procedure established in Ordinance 546. 51. Provide or show there exists a water system capable of delivering 2500 GPM for a 2 hour duration at 20 PSI residual operating pressure, which must be available before any combustible material is placed on the job site. 52. A combination of on-site and off-site super fire hydrants, on a looped system (6"X4"X2-1/2"X2-1/2"), will be located not less than 25 feet or more than 165 feet from any portion of the building as measured along approved vehicular travelways. The required fire flow shall be available from any adjacent hydrant(s) in the system. 53. Applicant/Developer shall furnish one copy of the water system plans to the Fire Department for review. Plans shall conform to the fire hydrant types, location and spacing, and, the system shall meet the fire flow requirements. Plans shall be signed/approved by a registered engineer and the local water company with the following certification: "I certify that the design of the water system is in accordance with the requirements prescribed by the Riverside County Fire Department". 5~?. The required fire flow may be adjusted at a later point in the permit process to reflect changes in design, construction type, area separation or built-in fire protection measures. A statement that the building(s) will be automatically fire sprinklered mu~t be included on the title page of the building plans. 56. Install a supervised water flow fire alarm system. Plans must be submitted to the Fire Department for approval prior to installation, as required by the Uniform Building Code. 57. He suggested that this growth would warrant a second cable company. City Attorney Harper detailed the Court's direction on this issue requiring that the franchise be granted on the same terms as those required of King Video. He explained that the additional concerns with constitutionality of the City's ordinance have been taken under submission and the City will be notified of the findings at a later date. Council questioned trie details of the franchise. City Attorney Harper clarified the provisions set by the franchise. He also read the following amendment to the franchise requirements: #3. For the purposes of Section 5.40.080 (c), Franchisee shall be required to provide ~~universal service" to all areas within the territorial boundaries of the City of Lake Elsinore. ~~Universal Service'~ shall be defined as service availability to all areas being served by the existing Franchisee, King Video, Inc. as of the date of the granting of the Franchise.
