BOSINESS ITEM 1. Memorandum of Understandina with Public Employees Association of Riverside Countv. Ync. (F:116.2) City Manager Molendyk explained that fhis is the annual Memorandum of Understanding with the Riverside County Public Employees Association; and noted that the representative was in the audience to respond to any questions from Council. Iie advised that Management and the Association have reached agreement and recommended approval of the proposed Memorandum of Understanding. MOVED BY CHERVENY, SECONDED BY WASHBURN AND CARRIED BY UNANIMOUS VOTE TO APPROVE THE MEMORANDUM OF UNDERSTANDING WITH THE PUBLIC EMPLOYEES ASSOCIATION OF RIVERSIDE COUNTY, INC. F2ECESSED TO REDE~IELOPMENT AGENCY MEETING AT 2:37 P.M. RECONVENED THE SPECIAL CITY COUNCIL MEETING AT 2:47 P.M. BIISINE88 ETEM 2. City Manager Molendyk explained that the applicant had not planned to be at ~his meeting and thought that he had been continued. Mr. Schleuniger, the applicant, indicated that he does not have his engineers available for this meeting and felt that he needed one more meeting with staff before he was ready ~o come before Councile Mr. Molendyk stated that he understood that there would be a presenta~ion regarding their alternative to the original plan af this ~ime. MOVED BY ALONGI, SECONDED BY CHERVENY TO DENY THE REQUES'`P FOR PAGE TWQ SPECIAL CITY COIINCIL MEETIN(3 ~ECEM~ER 6s ].993 MODIFICATION TO THE RETAINING WAd,L IN CONJUNCTION WITH THE LAKE ELSINORE CYTY CENTER. Councilman Winkler stated tha~ Council had nothing in front of them for a decision at this time. Councilman Alongi statea3 ~ha~ ghe item appeared on the Agenda ~o give the Council the opportunity to review the changes that they are proposing; however they are not present and his motion was to deng the request. Councilman Winkler aslced why it woulci not be possible to give ~hem a change to presen~ their idea. Iie explained that they are already on record as having to continue what they are doing. Councilman Alongi explained that when they were present the last time, he thought this issue was settled. He commented that he was under the impression that they were on a tight ~ime line, and a decision had to be reached. That time has passecl and now they are back with more plans, but no costs, no scaled drawings of the proposed project and again it proposes to move the wall forward which is not what he wants to see for the project. Councilman Alongi further commented that Councilman Winkler stated that he did not want to hear the project again unless the applicant had a dramatic change for considera~ion. He s~a~ed that because the Ci~y of Lake Elsinore is a partner in this pro~ect with oak Grove Equities, through sales tax and tax incremento in the amount of $3,000,398.56, the City should make evidenf to Oak Grove Equi~fes that the original plan is what has been accep~ed and nothing else. Mr. Alongi explained that if they want to modify the project he ffeels that they should file an a~pplication with the Planning Department and proceed in the regular routine, just like any other developer. Councilman Winkler stated that fie met with the developers, ancl loolced at their proposal and it is substantially different ~han wha~t ~hey talked about at the las~ meeting. He sta~ed that it appeared that it would actually be an improvement over the other proposals. MOVED BY V1%NKLER, SECONDED BY DOMINGUEZ AND CARRIED BY A 3-2 VOTE WITH ALONGY AIdD CHERVENY CAS`9'ING THE DaSSENTING VOTES TO CONTINUE TFIE %tEQUEST TO AMEND DESYGN REVIEW APPROVAY, (C 93-3) TO ALLOiJ d+IODIFIED RETAINING WALL IN CONJUNCTION WITH THE LAKE ELSINORE CITY CENTER ON GRAPE STREET (APPLICANT: OAK GROVE EQUITIES) TO THE NEXT MEETING. There was general discussion in regarci to size and set-back of retaining walls and their appearance.
