THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA).

Proiect Request/Location
The applicant is requesting approval of Amendment #4 to the Outlet Center Specific
Plan and a Uniform Sign Program for the Lake Elsinore Outlet Center. The project site
is generally located on the east side of Collier Avenue approximately 600 linear -feet
south of Nichols Road. (APN's: 389 - 210 -063, 064 & 066).
Environmental Setting
The site is bounded on the north by existing commercial businesses, the 1 -15 Freeway
to the east, vacant land to the south, and U.S. Army Corps of Engineers (ACOE)
Jurisdictional Waters to the west.
Background
Lake Elsinore Outlet Center Specific Plan was adopted in June of 1990. There were
three subsequent amendments to the plan which were approved and adopted.
Amendment No. 1 was approved in June of 1993 allowing an increase of the square
footage of Retail to the Center. Amendment No 2 was approved in August of 1994 for
Signage amendments. Amendment No. 3 further amended Signage Guidelines and
amended Land Use and was approved in September 2001.

Specific Plan
Specific Plan Amendment (SPA) No. 4 proposes to amend those Architectural and
Signage Guidelines and Standards contained in the Specific Plan so as to better
respond to the Outlet Center's design enhancements and improvements by simplifying
the sign guidelines and standards. The intent is to provide more flexibility in the
interpretation, and to ensure that the design, material and signs better compliment the

colors and materials found at the Outlet. The following describes the proposed changes
within the Specific Plan Amendment:
1. Revise the Land Use Development Guidelines of the approved Specific Plan with
amendments to Section 4 for:
a. The removal of two existing buildings and two partial existing buildings to
open up the center at each end for greater visibility into the Pedestrian
Concourse and Stores and, with the removal of two partial existing
buildings, allowing greater space between two sets of buildings creating
two additional areas for on -site dining opportunities and /or site "living
rooms" along with greater visibility into the Pedestrian Concourse itself,
b. The addition of a new building pad for a retail building in a current open
space /parking field to replace some of the retail square footage lost due to
the removal of existing buildings and two partial existing buildings and to
attract a single retail tenant,
c. The relocation of the curb cut on Collier Road for a new entry and egress
in close proximity to the new building pad location ( "New Pad Building ") for
circulation,
d. To revise the curbs and parking fields. The removal and addition of
buildings requires parking and curb adjustments to the overall site which
will create more interesting parking fields and pedestrian and vehicular
circulation. (Revised Section 4.1 and 4.2.)
2. To revise Architectural Design Guidelines Section 5.3. Amendments include
revisions for:
a. The updating of the look of the center with new style finishes, materials
and colors
b. The Design Guidelines for the New Pad Building
c. The additions of Site Amenities creating site "living rooms" allowing for
focal points, rest and shade places, and creating transition points to break
up the monotony of the Pedestrian Concourse.
3. To revise the Signage Guidelines and Standards of the approved Specific Plan
and its subsequent Amendments 1 through 3 with amended Signage Guidelines
and Standards (Revised Section 5.5). The amendments included are as follows:
a. Addition of Super Graphics along the Freeway for visibility enhancement
b. Addition of Graphic Panels at the Concourse Promenade (the interior
walkway of the Center) for advertising visibility and interest
c. Addition of Graphic Panels facing Collier Road for advertising visibility and
creating a refreshing "fagade"
d. Addition of Graphic Panels added to the Building Towers for advertising
visibility and interest

e. Addition of Graphic Banners throughout the Pedestrian Concourse,
Parking and Drive Entries for creating seasonal interest, advertising, way
finding
f. Design Standards and placement criteria are revised to update the
signage styles, lighting and placement of signs.
Uniform Sign Program No. 2013 -02
Entry Pylon Sign
The entry pylon signs will be constructed to a total height of twenty four feet (24') from
the finish grade. The pylon signs will identify the outlet title and six (6) tenant panels.
Two entry pylon signs are proposed along Collier Avenue at the north and south project
entries respectively.
Freeway Tower Sign
The Sign Program will allow for the redesign of the existing freeway tower structure and
associated tower mounted signage. The freeway tower structure is located in the central
portion of the project site. The freeway tower signage will include tenant name and
logo, graphic advertising as well as third party, seasonal and special events.
Internal Concourse Graphic Panels and Tenant Banners
The Sign Program includes internal graphic panels and tenant banners to identify
advertising of a tenant name and logo, products as well as third party, seasonal and
special events. The graphic panels will range in size from ten (10), twenty (20) and
thirty (30) feet wide up to ten (10), eighteen (18) and possibly twenty (20) feet in height.
The panels and banners are proposed internally throughout the mall.
Building Mounted and Pole Mounted Graphic Panels
These graphic panels may be mounted against building walls or cantilevered from the
walls and existing poles. These panels will face the parking lot and Collier Avenue.
The panels will range in size between ten (10) and twelve (12) feet by thirty (30) to thirty
six (36) feet.
Super Structure Freeway Graphic Panels & Signage
The purpose of the stand alone structure with graphics and signs is to give the Outlets a
new presence for passing freeway traffic. The content will include tenant name and
logo, product advertisement as well as third party, seasonal and special events. The
structure will include twenty five (25) graphic panel signs ranging in size with an
average of approximately twelve (12) by forty (40) feet. In addition, two (2) "V" shaped

billboards approximately twelve (12) by thirty six (36) feet in size spaced 500 feet apart
will be used for third party advertising. Proposed in the middle of the structure are
illuminated channel letters to read "Outlets at Lake Elsinore ". The letters in the word
"Outlet" are proposed to be eight (8) feet in height. Lastly, the structure itself is
proposed of metal poles and cables located approximately five (5) feet off of the back
(freeway side) of the outlet center buildings and will stand approximately sixty five (65)
feet in height (from finish grade) and stretch approximately 1000 feet in length.
ANALYSIS
Specific Plan Amendment No. 2013 -01 - Amendment No. 4 to the Lake Elsinore
Outlet Center Specific Plan
Staff has reviewed the SPA No. 4 document and has no major concerns regarding the
proposed building demolition as well as the amendments to the architectural and
signage guidelines and standards, if the Conditions of Approval are satisfied. SPA No.
4 will provide the applicant with more flexibility in regards to design and signs while still
giving the City final approval of all signs. The amendment will result in a better design
and advertising of stores and greater visibility of the Outlet Center itself which will
benefit both the Outlet Center and the City. .
Uniform Sign Program No. 2013 -02
The objective of the proposed sign program is to provide standards and specifications
regarding quality, composition, size and placement of signage in order to ensure
consistency throughout the Outlet Center. Moreover, the sign program would be used
by staff when reviewing sign permit applications for the proposed signage in the Lake
Elsinore Outlet Center. Finally, the Sign Program will assist the landlord and /or
Property Management Group in selection and approval of the proposed signage.
The proposed sign program is consistent with the goals and objectives of Chapter
17.196 of the Lake Elsinore Municipal Code in that it will avoid the indiscriminant and
substandard assembly, location, illumination, coloring and size of signs and will
mandate proper maintenance within the Outlet Center. Additionally, the Sign Program
complies with Section 17.196.180.D of the Lake Elsinore Municipal Code, which
requires that; "Businesses in an integrated development shall comply with a uniform sign
program approved by the Planning Commission."
Staff is in general support of the proposed sign program with the exception of the length
of the proposed "super structure ". Staff feels that the freeway "super structure"
proposed at approximately 1,000 feet in length is too long and may create a wall -like
effect along Interstate 15. Staff's preference would be that the freeway signage be two
500 -foot structures with ample separation between each structure. Staff is proposing

Condition of Approval No. 15 to require the "super structure" freeway sign to consist of
two approximately 500 -foot structures.
Environmental Determination
Amendment No. 4 to the Lake Elsinore Outlet Center Specific Plan
Environmental clearance and analysis for the proposed application is provided by Final
Environmental Impact Report (FEIR) for Lake Elsinore Outlet Center Specific Plan.
Said environmental document was prepared in accordance with the CEQA Guidelines
and was certified by the City Council in June 1990. The proposed project is consistent
with Lake Elsinore Municipal Code (LEMC) and does not conflict with the findings and
discussions contained in the FEIR. No further environmental clearance is necessary.
It should also be noted that the Lake Elsinore Outlet Center Specific Plan for which the
project is located is an existing outlet retail mall. Since the project is an existing center
with existing structures no further action is necessary relating to the Multiple Species
Habitat Conservation Plan (MSHCP).
Recommendation
Staff recommends that the Planning Commission:
Adopt Resolution No. 2013- recommending to City Council approval of
Specific Plan No. 2013 -01 as the fourth amendment to the Lake Elsinore Specific
Plan which proposes to demolish two buildings, address on -site circulation
issues, update and add signage and add site amenities such as outdoor living
rooms, furnishings, water features and fire places as well as associated
improvements based on the Findings and Exhibits, and subject to the proposed
Conditions of Approval.
2. Adopt Resolution No. 2013- approving Uniform Sign Program No. 2013 -02
for the Lake Elsinore Outlet Center proposing to amend the signage guidelines
and standards to include the addition of a super graphics wall along the freeway
side of the project as well as add graphic panels and banners to existing
buildings within the Outlet center and associated improvements based on the
Findings and Exhibits, and subject to the proposed Conditions of Approval

RESOLUTION NO. 2013-
RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
LAKE ELSINORE, CALIFORNIA, RECOMMENDING TO THE CITY
COUNCIL OF THE CITY OF LAKE ELSINORE APPROVAL OF
SPECIFIC PLAN AMENDMENT NO. 2013 -01, AMENDMENT NO. 4 TO
THE LAKE ELSINORE OUTLET CENTER SPECIFIC PLAN
WHEREAS, Jeff Lochner, Athena Property Management, has filed an application
with the City of Lake Elsinore requesting approval of Specific Plan Amendment No.
2013 -01, Amendment No. 4 to the Lake Elsinore Outlet Center Specific Plan (the
"Project "); and
WHEREAS, the Lake Elsinore Outlet Center Specific Plan site is generally
located on the east side of Collier Avenue approximately 600 linear -feet south of
Nichols Road; and
WHEREAS, the Planning Commission of the City of Lake Elsinore has been
delegated with the responsibility of making recommendations to the City Council for
approval of specific plans and any amendments thereto; and
WHEREAS, public notice of the Project has been given, and the Planning
Commission has considered evidence presented by the Community Development
Department and other interested parties at a public hearing held with respect to this
item on June 18, 2013.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF LAKE
ELSINORE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. Prior to making a recommendation to the City Council, the Planning
Commission has reviewed and analyzed Specific Plan Amendment No. 2013 -01,
Amendment No. 4 to the Lake Elsinore Outlet Center Specific Plan pursuant to the
Planning and Zoning Laws (Cal. Gov. Code §§ 65000 et seq.) and Chapter 17.204 of
the Lake Elsinore Municipal Code ( "LEMC ").
SECTION 2. That in accordance with State Planning and Zoning Laws and the
Lake Elsinore Municipal Code, the Planning Commission makes the following findings
for the approval of Specific Plan Amendment No. 2013 -01, Amendment No. 4 to the
Lake Elsinore Outlet Center Specific Plan:
1. The location and design of the proposed development shall be consistent
with the goals and policies of the City's General Plan and with any other
applicable plan or policies adopted by the City.
Specific Plan No. 2013 -01, Amendment No. 4 to the Lake Elsinore Outlet
Center Specific Plan Amendment meets the City's Specific Plan criteria for
content and required implementation of the General Plan established by
Section 65450 et sea. of the California Government Code and Section

17.204 of the City of Lake Elsinore Municipal Code. Accordingly, the
proposed Specific Plan Amendment No. 4 complies with the objectives of
the General Plan and the purpose of the planning district in which the site
is located.
2. The proposed location shall allow the development to be well- integrated
with or adequately buffered from its surroundings, whichever may be the
case.
The Project is appropriate to the site and surrounding developments in
that implementation of the Project will result in the demolition of two
buildings, address on -site circulation issues, update and add signage and
add site amenities such as outdoor "living rooms ", furnishings, water
features and fire places as well as associated improvements. The
amendment will result in a better design and advertising of stores and
greater visibility of the Outlet Center itself which benefits both the Outlet
Center and the City.
3. All vehicular traffic generated by the development, either in phased
increments or at full build -out, is to be accommodated safely and without
causing undue congestion upon adjoining streets.
The width and type of pavement needed to carry the type and quantity of
traffic generated that will result from implementation of Specific Plan
Amendment No. 2013 -01, Amendment No. 4 to the Lake Elsinore Outlet
Center Specific Plan has been reviewed and accounted for The City has
conditioned the Project to be served by roads of adequate capacity and
design standards to provide reasonable access by car, truck, transit, and
bicycle.
4. The Specific Plan Amendment shall identify a methodology(s) to allow
land uses to be adequately serviced by existing or proposed public
facilities and services. In appropriate circumstances, and as provided
elsewhere by the Municipal Code, the City may require that suitable areas
be reserved for schools, parks and pedestrian ways; or public open
spaces shall be dedicated or reserved by private covenant for the
common use of residents, establishments or operations in the
development.

Specific Plan No. 2013 -01, Amendment No. 4 to the Lake Elsinore Outlet
Center Specific Plan identifies methodologies to allow land uses to be
adequately serviced by existing or proposed public facilities and services.
The Specific Plan Amendment No. 4 identifies necessary streets and
circulation to support the proposed land use allocations, as well as all
necessary wet and dry utilities for proper and adequate infrastructure
services. In addition, the amendment will result in a better design and
advertising of stores and greater visibility of the Outlet Center itself which
benefits both the Outlet Center and the City.
5. The overall design of Specific Plan Amendment No. 2013 -01, Amendment
No. 4 to the Lake Elsinore Outlet Center Specific Plan will produce an
attractive, efficient and stable development.
Specific Plan Amendment No. 2013 -01, Amendment No. 4 to the Lake
Elsinore Outlet Center Specific Plan has been designed in consideration
of the size and shape of the property, thereby, strengthening and
enhancing the immediate areas. The Project will complement the quality
of neighboring existing and future uses by creating visually- pleasing
development.
Specific Plan Amendment No. 2013 -01, Amendment No. 4 to the Lake
Elsinore Outlet Center Specific Plan will not be detrimental to the health,
safety, comfort or general welfare of the persons residing or working near
the Project or within the City, nor will it be injurious to property or
improvements in the project area or within the City. In addition, staff has
substantiated that all applicable City Departments and Agencies have
been afforded the opportunity for a thorough review of the Specific Plan
Amendment No. 4 and have incorporated all applicable comments and /or
conditions related to installation and maintenance of landscaping, street
dedications, regulations of points of vehicular ingress and egress and
control of potential nuisances, so as to eliminate any negative impacts to
the general health, safety, comfort, or general welfare of the surrounding
neighborhood or the City.
6. In accordance with the requirements of the California Environmental
Quality Act (CEQA), impacts have been reduced to a less than significant
level, or in the case where impacts remain, a statement of overriding
considerations must be adopted to justify the merits of project
implementation.

Environmental clearance and analysis for the proposed application is

Lake Elsinore Outlet Center Specific Plan.
SECTION 4. This Resolution shall take effect from and after the date of its
passage and adoption.

WHEREAS, Jeff Lochner, Athena Property Management, has filed an application
with the City of Lake Elsinore requesting approval of Uniform Sign Program No. 2013-
02 for the commercial retail development known as "The Lake Elsinore Outlet Center
Specific Plan ", which is generally located on the east side of Collier Avenue
approximately 600 linear -feet south of Nichols Road ( "Project "); and
WHEREAS, the Planning Commission of the City of Lake Elsinore has been
delegated with the responsibility of considering, approving, conditionally approving, or
denying Uniform Sign Programs; and
WHEREAS, public notice of the Project has been given, and the Planning

NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF LAKE
ELSINORE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. The Planning Commission has reviewed and analyzed Uniform
Sign Program 2013 -02 according to the standards and guidelines set forth in Lake
Elsinore Municipal Code Chapter 17.196 and the proposed Amendment No. 4 to the
Lake Elsinore Outlet Center Specific Plan.
SECTION 2. The Planning Commission finds and determines that this project,
as conditioned, is consistent with the Lake Elsinore Municipal Code and the proposed
Amendment No. 4 to the Lake Elsinore Outlet Center Specific Plan. In addition,
environmental clearance and analysis for the proposed application is provided by Final
Environmental Impact Report (FEIR) for Lake Elsinore Outlet Center Specific Plan.
Said environmental document was prepared in accordance with the CEQA Guidelines
and was certified by the City Council in June, 1990, and does not conflict with the
findings and discussions contained in the FEIR. No further environmental clearance is
necessary.
SECTION 3. That in accordance with State Planning and Zoning law and the
City of Lake Elsinore Municipal Code, the Planning Commission makes the following
findings for the approval of Uniform Sign Program No. 2013 -02:
1. The project, as approved, will comply with the goals and objectives of the General
Plan, and the Zoning District in which the project is located.
The Project complies with the goals and objectives of the General Plan and the Lake
Elsinore Outlet Center Specific Plan in that the approval of this Sign Program will

assist in achieving the development of a well - balanced and functional mix of
residential, commercial, industrial, open space, recreational and institutional land
uses, diversifying Lake Elsinore's economic base, in that the proposed signage will
enhance the quality of development in the immediate area.
2. The project complies with the design directives contained in Section 17.184.080 and
all other applicable provisions of the Municipal Code.
The Project is appropriate to the site and surrounding developments. The project
has been designed in consideration of the size and shape of the property, thereby
creating interest and varying vistas as a person moves along the streets. Further
the project as conditioned will complement the quality of existing development and
will create a visually pleasing, non - detractive relationship between the proposed and
existing projects in that the architectural design, color and material and site designs
proposed by the subject sign program evidence a concern for quality and originality,
in that the applicant has creatively included designs that will raise the standards
within the community for on -site signage.
3. The proposed project will not result in any significant adverse environmental
impacts.
Environmental clearance and analysis for the proposed application is provided by
Final Environmental Impact Report (FEIR) for Lake Elsinore Outlet Center Specific
Plan. Said environmental document was prepared in accordance with the CEQA
Guidelines and was approved by the City Council in June, 1990. The proposed
project is consistent with Lake Elsinore Municipal Code (LEMC), and does not
conflict with the findings and discussions contained in the FEIR. No further
environmental clearance is necessary.
4. Conditions and safeguards pursuant to Section 17.184.070 of the Municipal Code,
including guarantees and evidence of compliance with conditions, have been
incorporated into the approval of the subject project to ensure development of the
property in accordance with the objectives of Chapter 17.184.
The Planning Commission has considered the Project at a duly noticed public
hearing and finds that, the Project complies with the purposes and objectives of the
General Plan, the Lake Elsinore Outlet Center Specific Plan and the Municipal Code.
SECTION 4. Based upon all of the evidence presented, the above findings, and
the conditions of approval imposed upon the Uniform Sign Program, the Planning
Commission hereby approves Uniform Sign Program No. 2013 -02.
SECTION 5. This Resolution shall take effect from and after the date of its
passage and adoption.

GENERAL
Specific Plan No. 2013 -01 is the fourth amendment to the Lake Elsinore Outlet Center
Specific Plan which proposes to demolish two buildings, address on -site circulation
issues, update and add signage and add site amenities such as outdoor living rooms,
furnishings, water features and fire places. Uniform Sign Program No. 2013 -02 for the
Lake Elsinore Outlet Center proposes to amend the signage guidelines and standards
to include the addition of a super graphics wall along the freeway side of the project as
well as add graphic panels and banners to existing buildings within the Outlet center.
The project site is generally located on the east side of Collier Avenue approximately
600 linear -feet south of Nichols Road. (APN's: 389 - 210 -063, 064 & 066).
2. The applicant shall defend (with counsel acceptable to the City), indemnify, and hold
harmless the City, its Officials, Officers, Employees, and Agents from any claim, action,
or proceeding against the City, its Officials, Officers, Employees or Agents to attach, set
aside, void, or annul an approval of the City, its advisory agencies, appeal boards, or
legislative body concerning the project attached hereto.

3. The Draft Lake Elsinore Outlet Center Specific Plan Amendment No. 4 shall be revised
to incorporate any corrections and changes required by the Planning Commission
and /or City Council. A Final Lake Elsinore Outlet Center Specific Plan Amendment No.
4 document shall be submitted for review and approval by the Community Development
Director or designee within 30 days of approval by the City Council. No permit shall be
issued until the Lake Elsinore Outlet Center Specific Plan Amendment No. 4 document
and any required revisions are administratively approved by the Community
Development Director or designee. The applicant shall provide the Community
Development Department — Planning Division with five bound (3 -ring binders) copies
and one PDF electronic version of the approved Final Lake Elsinore Outlet Center
Specific Plan Amendment No. 4 document within 14 days of the administrative approval
of the document.
4. Future development shall comply with those standards and guidelines of the Elements
contained in the Lake Elsinore Outlet Center Specific Plan Amendment No. 4 document.

to Chapter 17 — Zoning shall be utilized to address those issues, standards, guidelines,
etc. not addressed in the Lake Elsinore Outlet Center Specific Plan Amendment No. 4.
6. The applicant shall comply with all mitigation measures identified in the Mitigation
Monitoring Program for Lake Elsinore Outlet Center Final EIR.
7. At least 30 days prior to seeking a grading permit, the project applicant shall contact the
appropriate Native American Tribal Representative (Representative) to notify the
Representative of the initiation of the grading, excavation and the monitoring program, and
to coordinate with the City of Lake Elsinore and the Representative to develop a Cultural
Resources Treatment and Monitoring Agreement. The Agreement shall address the
responsibilities and participation of Native American Tribal monitors during grading,
excavation and ground disturbing activities; project grading and development scheduling;
terms of compensation; and treatment and final disposition of any cultural resources,
sacred sites and human remains discovered on the site.
*It is anticipated that the Pechanga Tribe will be the "appropriate" Tribe due to
prior and extensive coordination with the City in determining potentially
significant impacts and appropriate mitigation measures due to its demonstrated
cultural affiliation with the project area.
8. No buildings are approved with this project. All future building or buildings will be
subject to the City's development and environmental review process.
UNIFORM SIGN PROGRAM NO. 2013 -02
9. The decision of the Planning Commission shall be final fifteen (15) days from the date of
the decision, unless an appeal has been filed with the City Council pursuant to the
applicable provisions of the Lake Elsinore Municipal Code (LEMC).
10. Within 30 days of project approval, the applicant shall sign and complete an
"Acknowledgment of Conditions" and shall return the executed original to the
Community Development Department for inclusion in the case records.
11. No individual signs are approved as part of this Uniform Sign Program. The applicant or
designee shall submit an application for a sign permit, pay appropriate fees and receive
approval from the Community Development Department for any sign installed at the
project site.

12. Within 30 days of project approval, the applicant shall submit three (3) bound copies
and one PDF electronic version of a Final Uniform Sign Program to the Community
Development Department.
13.The location, size, style, and color for all signs shall comply with the Sign Program
(approved herein).
14. No portion of the proposed signs shall be located closer than five feet (6) to any
property line, nor be located in such a manner as to constitute a hazard to pedestrian or
vehicular traffic.
15.The freeway "super structure" along Interstate 15 shall be limited to two (2)
approximately 500 -foot structures with ample separation between each structure.
16.The approval for Uniform Sign Program No 2013 -02 will lapse and be void unless
building permits are issued within one (1) year.
17.Any alteration or expansion of this Sign Program approval shall be reviewed according
to the provisions of Chapter 17.196 (Signs- Advertising Structures) of the Lake Elsinore
Municipal Code.
18.All exterior sign lighting shall be reviewed and approved by the Community
Development Director or designee.
ENGINEERING
GENERAL
19. In accordance with the City's Franchise Agreement for waste disposal & recycling, the
developer shall be required to contract with CR &R Inc. for removal and disposal of all
waste material, debris, vegetation and other rubbish generated during cleaning,
demolition, clear and grubbing or all other phases of construction.
20. Developer shall mitigate to prevent any flooding and /or erosion downstream caused by
development of the site and or diversion of drainage.
21.Any grading that affects "waters of the United States ", wetlands or jurisdictional
streambeds, shall require approval and necessary permits from respective federal

and /or State agencies.
22. The developer shall provide a copy of an encroachment permit or any approval
documents from the Riverside County Flood Control District and /or Caltrans for
encroaching, grading, or discharging into County flood control facilities or Caltrans right
of way.
23.All required soils, geology, hydrology and hydraulic, and seismic reports shall be
prepared by a Registered Civil Engineer.
FEES
24.The developer shall pay all plan check, permit and Development Impact fees, including
but not limited to: Transportation Uniform Mitigation Fee (TUMF), Traffic Infrastructure
Fee (TIF), Stephens' Kangaroo Rat Habitat Conservation Plan (SKR), and Area
Drainage Fees.
25. Mitigation fees will be assessed at the prevalent rate at time of payment in full.
FLOOD PLAIN
26. Site development along the wetlands shall require special grading and erosion control
requirements (LEMC Title 15).
27. The Project lies within a FEMA mapped special flood hazard zone and within the
Floodplain Management area as defined at LEMC 15.68.
28. The developer shall comply with all requirements of LEMC 15.68 regarding floodplain
management. Finish floor elevation of all future buildings shall be a minimum of 3 ft
above Base Flood Elevation (BFE). Any fill placed in the 100 -year flood plain for the
purposes of elevating the building floor out of the flood plain shall require a
CLOMR /CLOMR -F and LOMR /LOMR -F to be processed with FEMA.
29. The developer shall provide written approval of construction activity within the wetlands
from the U.S. Department of Fish and Game and U.S. Army Corp of Engineers.
STORM WATER MANAGEMENT / POLLUTION PREVENTION / NPDES

30. The project developer is responsible for complying with the Santa Ana Region NPDES
Permits as warranted based on the nature of development and /or activity. These
Permits include:
• General Permit - Construction
• General Permit - Industrial
• Scrap Metal
• Deminimus Discharges
• MS4
31.The 2010 SAR MS4 Permit requires implementation of LID Principles and LID Site
Design, where feasible, to treat the pollutants of concern identified for the project, in the
following manner (from highest to lowest priority) : (Section XII.E.2, XII.E.3,and XII.E.7)
• Preventative measures (these are mostly non - structural measures, e.g.,
preservation of natural features to a level consistent with the MEP standard;
minimization of Urban Runoff through clustering, reducing impervious areas, etc.)
• The Project shall `Infiltrate, harvest and use, evapotranspire and /or bio -treat the
Design Capture Volume (DCV).
• The Project shall consider a properly engineered and maintained bio- treatment
system only if infiltration, harvesting and use and evapotranspiration cannot be
feasibly implemented at the project site.
• Any portion of [the DCV] that is not infiltrated, harvested and used, evapotranspired,
and /or biotreated shall be treated and discharged in accordance with the
requirements set forth in Section XII.G.
32. The project shall implement LID practices that treat the 85th percentile storm.
33. Parking lot landscaping shall be designed to provide for treatment, retention or
infiltration of runoff.
34. Project hardscape areas shall be designed and constructed to provide for drainage into
adjacent landscape.
35. Hydromodification /Hydraulic Conditions of Concern — The project shall identify potential
Hydraulic Conditions of Concern (HCOC) and implement measures to limit disturbance
of natural water bodies and drainage systems; conserve natural areas; protect slopes,
channels and minimize significant impacts from urban runoff.
36. The project shall use either volume -based and /or flow -based criteria for sizing BMPs in

accordance with NPDES Permit Provision XII.D.4.
Construction:
37. Both a Storm Water Pollution Prevention Plan ( SWPPP) and a Water Quality
Management Plan (WQMP) for post construction are required for this project.
38. SWPPP - A copy of the current SWPPP shall be kept at the project site, updated as
necessary and be available for review upon request. Projects that are not subject to
coverage under the General Permit — Construction will prepare and implement an
Erosion and Sediment Control Plan in compliance with the California Building Code and
Local Ordinances.
39. Prior to grading or building permit the applicant shall demonstrate that compliance
with the permit has been obtained by providing a copy of the Notice of Intent (NOI)
submitted to the State Water Resources Control Board and a copy of the letter of
notification of the issuance of a Waste Discharge Identification (WDID) Number or other
proof of filing to the satisfaction of the City Engineer.
40. Erosion & Sediment Control - Prior to the issuance of any grading or building
permit, the applicant shall submit for review and approval by the City Engineer, an
Erosion and Sediment Control Plan as a separate sheet of the grading plan submittal to
demonstrate compliance with the City's NPDES Program and state water quality
regulations for grading and construction activities. The Erosion and Sediment Control
Plan shall identify how all construction materials, wastes, grading or demolition debris,
and stockpiles of soil, aggregates, soil amendments, etc. shall be property covered,
stored and secured to prevent transport into local drainages or waters by wind, rain,
tracking, or dispersion. The plan shall also describe how the project will ensure that all
BMPs will be maintained during construction of any future right of ways. A copy of the
plan shall be incorporated into the SWPPP as applicable, kept updated as needed to
address changing circumstances of the project site, be kept at the project site and
available for review upon request.
Post Construction:
41.A. preliminary WQMP shall be submitted during the project entitlement stage. The level
of detail in a preliminary Project- Specific WQMP will depend upon the level of detail
known about the overall project design at the time project approval is sought. At a
minimum, the preliminary Project- Specific WQMP shall identify the type, size, location,

and final ownership of Stormwater BMPs adequate to serve new roadways and any
common areas, and to also manage runoff from an expected reasonable estimate of the
square footage of future roofs, driveways, and other impervious surfaces on each
individual lot.
42. The applicant shall use the Water Quality Management Plan for the Santa Ana Region
of Riverside County guidance document and template for preparation of both the
preliminary and final WQMP.
43. The project shall complete and submit for review and approval to the Engineering
Division a final WQMP, incorporating the LID Principles and Stormwater BMPs
committed to in the preliminary Project- Specific WQMP. The final WQMP shall be
approved prior to issuance of any grading or building permit.
44. WQMP — The Water Quality Management Plan (WQMP) specifically identifying Best
Management Practices (BMPs) that will be used onsite to control identified pollutants of
concern. The applicant shall utilize the MS4 Permittee Drainage Area Management Plan
(DAMP), Model WQMP, and LID Guidance Manual for reference, and the MS4
Permittee's WQMP template for submittal. This WQMP shall include the following:
• Detailed site and project description
• Potential stormwater pollutants
• Post - development drainage characteristics
• Low Impact Development (LID) BMP selection and analysis
• Structural and Non - Structural source control BMPs
• Site design and drainage plan (BMP Exhibit)
• Vector issues are addressed in the BMP design, operation and maintenance.
• GIS coordinates for all LID and Treatment Control BMPs
• HCOC - demonstrate that discharge flow rates, velocities, duration and volume for
the post construction condition from a 2 year and 10 year 24 hour rainfall event will
not cause significant adverse impacts on downstream erosion and receiving waters,
or measures are implemented to mitigate significant adverse impacts to downstream
public facilities and water bodies. Design goal to replicate pre - development
hydrologic regime.
45. Operation and Maintenance (O &M) Plan that (1) describes the long -term operation and
maintenance requirements for BMPs identified in the BMP Exhibit; (2) identifies the
entity that will be responsible for long -term operation and maintenance of the referenced
BMPs; and (3) describes the mechanism for funding the long -term operation and
maintenance of the referenced BMPs

46.AI1 storm drain inlet facilities shall be appropriately marked "Only Rain in the Storm
Drain" using the City authorized marker to prevent illegal dumping in the drain system.
47. Prior to the issuance of a certificate of use and /or occupancy, the applicant shall
demonstrate compliance with applicable NPDES permits for construction,
industrial /commercial, MS4, etc. to include:
• Demonstrate that all structural Best Management Practices (BMP's) described in the
BMP Exhibit from the project's approved WQMP have been implemented,
constructed and installed in conformance with approved plans and specifications.
• Demonstrate that the project has complied with all non - structural BMPs described in
the project's WQMP.
• Provide signed, notarized certification from the engineer of work that the structural
BMP's identified in the project's WQMP are installed and operational.
• Submit a copy of the fully executed, recorded Operations and Maintenance (O &M)
Plan for all structural BMPs.
• Demonstrate that copies of the project's approved WQMP (with recorded O &M Plan
attached) are available for each of the initial occupants (commercial /industrial) or
HOA as appropriate.
• Agree to pay for a Special Investigation from the City of Lake Elsinore for a date
twelve (12) months after the issuance of a Certificate of Use and /or Occupancy for
the project to verify compliance with the approved WQMP and O &M Plan. A
signed /sealed certification from the engineer of work dated 12 months after C of O
will be considered in lieu of a Special Investigation by the City.
• Provide a recorded copy of one of the following:
a. CC &R's (they must include the approved WQMP and O &M Plan) for the project's
Home Owners Association.
b. A water quality implementation agreement has the approved WQMP and O &M
Plan attached; or
c. The final approved Water Quality Management Plan and Operations and
Maintenance Plan.
UTILITIES:
48. All arrangements for relocation of utility company facilities (power poles, vaults, etc.) out
of the roadway shall be the responsibility of the property owner or his agent.
49.AI1 overhead utilities shall be undergrounded in accordance with Chapter 12.16 of the
Lake Elsinore Municipal Code (LEMC)

50. The developer shall apply for, obtain and submit to the City Engineering Division a letter
from Southern California Edison (SCE) indicating that the construction activity will not
interfere with existing SCE facilities (aka SCE NIL).
IMPROVEMENTS
Design
51. Sight distance into and out of the project location shall comply with CALTRANS
Standards. Approval is required from the City Traffic Engineer on all proposed
circulation /parking /traffic related changes.
52. Provide a copy of any applicable Caltrans approval for signage visible from freeway.
53. The developer shall install blue dot markers in the roadway at a right angle to Fire
Hydrant locations per Lake Elsinore Standards.
54.All natural drainage traversing the site shall be conveyed through the site, or shall be
collected and conveyed by a method approved by the City Engineer. All off -site
drainage, if different from historic flow, shall be conveyed to a public facility, accepted
by adjacent property owners by a letter of drainage acceptance, or conveyed to a
drainage easement.
55. Roof drains shall not be allowed to outlet directly through coring in the street curb.
Roofs should drain to a landscaped area.
56.All existing storm drain inlet facilities adjacent to the subject properties shall be
retrofitted with a storm drain filter; all new storm drain inlet facilities constructed by this
project shall include a storm drain filter.
57. All Public Works requirements shall be complied with as a condition of development as
specified in the Lake Elsinore Municipal Code (LEMC) and Lake Elsinore Public Works
Standard Plans.
58. The owner shall process through the City Engineering Division for plan check, approval
a parcel merger for APN 389 - 220 -001 & 389 - 220 -002 prior to building permit for the
new building pad.

59.An Encroachment Permit shall be obtained prior to any work on City and /or State right -
of -way. The developer shall submit the permit application, required fees and executed
agreements, security and other required documentation prior to issuance.
GRADING
Design:
60.A grading plan signed and stamped by a California Registered Civil Engineer shall be
submitted for City review and approval for all addition and /or movement of soil (grading)
on the site. The plan shall include separate sheets for erosion control, haul route and
traffic control. The grading submittal shall include all supporting documentation and be
prepared using City standard title block, standard drawings and design manual
(available at www.lake- elsinore.orq).
61.All grading plan contours shall extend to minimum of 50 feet beyond property lines to
indicate existing drainage pattern.
62. If the grading plan identifies alterations in the existing drainage patterns as they exit the
site, a Hydrology and Hydraulic Report for review and approval by City Engineer shall
be required prior to issuance of grading permits. All grading that modifies the existing
flow patterns and /or topography shall be approved by the City Engineer.
63. The developer shall obtain all necessary off -site easements and /or permits for off -site
grading and /or drainage acceptance from the adjacent property owners.
Permit/Construction:
64. Developer shall execute and submit grading and erosion control agreement, post
grading security and pay permit fees as a condition of grading permit issuance.
65.A preconstruction meeting with the City Public Works Inspector (Engineering Division) is
required prior to commencement of ANY grading activity.
66. Developer shall provide the city with a copy of the Notice of Intent (NOI) and Waste
Discharge Identification (WDID) letter issued by the Regional Water Quality Control
Board for the National Pollutant Discharge Elimination System (NPDES) program.
67. Prior to commencement of grading operations, developer is to provide to the City with a

map of all proposed haul routes to be used for movement of export material. All such
routes shall be subject to the review and approval of the City Engineer. Haul route shall
be submitted prior to issuance of a grading permit. Hauling in excess of 5,000 cubic
yards (cy) shall be approved by City Council. (LEMC 15.72.065).
68. Export sites located within the Lake Elsinore City limits must have an active grading
permit.
69. Applicant to provide to the City a video record of the condition of all proposed public City
haul roads. In the event of damage to such roads, applicant shall pay full cost of
restoring public roads to the baseline condition. A bond may be required to ensure
payment of damages to the public right -of -way, subject to the approval of the City
Engineer.
70. Submit an approved environmental clearance document to the Engineering Division.
This approval shall identify and clear all proposed grading activity anticipated for this
project.
PRIOR TO ISSUANCE OF BUILDING PERMIT
71. Provide final soils, geology and seismic report, including recommendations for
parameters for seismic design of buildings, and walls prior to building permit.
72.Approval of a letter of map revision (LOMR) or letter of map revision based on fill
(LOMR -F) must be received from FEMA.
PRIOR TO OCCUPANCY
73.TUMF fees shall be paid. The TUMF fees shall be the effective rate at the time of
payment in full in accordance with the LEMC.
74. As -built plans for all approved plan sets shall be submitted for review and approval by
the City. The developer /developer /owner is responsible for revising the original mylar
plans. All plan sets shall be digitized and provided on CD /DVD as follows:
• Improvement Plans —tif of approved as built mylar.
• Grading Plans - .tif of approved as built mylar.
75. Developer shall provide FEMA elevation certificates for all buildings (includes trailers
and storage facilities) prior to final approvals. If a LOMR -F has been processed and

approved by FEMA, the letter of determination and certification may be in the form of a
letter signed and sealed by a licensed civil engineer.
76. Prior to grading or building permit close -out and /or the issuance of a certificate of use or
a certificate of occupancy, developer shall:
• Demonstrate that all structural BMPs have been constructed, installed and are
functioning in conformance with approved plans and specifications and the WQMP;
• Demonstrate that they are prepared to implement all non - structural BMPs included
in the conditions of approval or building /grading permit conditions;
• Demonstrate that an adequate number of copies of the approved project specific
WQMP are available for the future owners /occupants; and
• The developer shall provide all education guidelines for Water Quality Management
Practices to the tenants, operators and owners of the businesses of the
development, regarding the environmental awareness on good housekeeping
practices that contribute to protection of storm water quality and meet the goals of
the approved WQMP in the Riverside County NPDES Drainage Area Management
Plan. Contact the City NPDES Coordinator for handout/guideline information.
77. It is the responsibility of the recipient of these Fire Department conditions to forward
them to all interested parties. The permit number (as it is noted above) is required on

78. The following fire protection measures shall be provided in accordance with the Lake
Elsinore Municipal Code and /or recognized fire protection standards:
Super Fire Hydrants- Super fire hydrants (6" x 4" x 2 -2 1/2 "), shall be located
not less than 25 feet or more than 250 feet from any portion of the building as
measured along approved vehicular travel ways.
Hydrant System- A combination of on -site and off -site super fire hydrant (s) (6" x
4" x 2" x 2. ") will be located not less than 25 feet or more than 250 feet from any
portion of the building as measured along approved vehicular travel ways. The
required fire flow shall be available from any adjacent hydrant (s) in the system
Average spacing between hydrants 210' and 350' maximum distance from any
point on the street or road frontage to hydrant.

• Automatic / Manual Gates- Gate (s) shall be automatic or manual operated,
minimum 20 feet width, with a setback of 35 feet from face of curb /flow line. Gate
access shall be equipped with a rapid entry system. Plans shall be submitted to
the Fire Department for approval prior to installation. Automatic /manual gate pins
shall be rated with shear pin force, not to exceed 30 foot pounds. Automatic
gates shall be equipped with emergency backup power. Gates activated by the
rapid entry system shall remain open until closed by the rapid entry system.

PRIOR TO BUILDING PERMIT ISSUANCE
79. Building plan check fee shall be made payable to The City of Lake Elsinore, and shall
be submitted to the Lake Elsinore Fire Protection Planning Division at the time building
plans are submitted.
80. Applicant and /or developer shall separately submit 2 sets of water system plans to the
Fire Department for review. Plans must be signed by a registered Civil Engineer and /or
water purveyor prior to Fire Department review and approval. Mylars will be signed by
the Fire Department after review and approval. Two (2) copies of the signed and
approved water plans shall be returned to the Fire Department before release of a
building permit.
PRIOR TO BUILDING FINAL INSPECTION
81. The applicant shall prepare and submit to the Fire Department for approval, a site plan
designating required fire lanes with appropriate lane painting and/ or signs. Fire lanes
path of travel shall no less than 24 feet in width and provide fire department vehicular
access to within 150 feet of all portions of all buildings. Appropriate turn - arounds or
circulation shall be approved by the fire department where the length of the fire lane
exceeds 150 feet.
82. Display Boards will be as follows: Each complex shall have an illuminated diagrammatic
representation of the actual layout which shows name of complex, all streets, building
designators, unit members, and fire hydrant locations within dimension and located next
to roadway access.
83. Portable fire extinguishers complying with Section 906 of the 2010 California Fire Code
with a minimum rating of 2A -10BC and signage shall be installed. Fire Extinguishers
