SPECIAL CITY COUNCIL MEETING
CITY OF LAKE ELSINORE

CALL TO ORDER
The Special City Council Meeting was called to order by Mayor Washburn
at 2:15 p.m.
PLEDGE OF ALLEGIANCE
The Pledge of Allegiance was led by Mayor Washburn.

CONSENT CALENDAR
1. Fiscal Year 1994-95 Budqet .:. Interim Action. (F~30.1)
City Manager Molendyk explained that this item is being presented
to the Council to authorize the payment of bills, contracts,
payroll and debt service.
Councilman Winkler stated that he felt that activities such as
the 4th of July Auto show, Kids on Track and other projects are
not sacred and that co not pay for themselvrs. He explained that
they should find sponsors to continue their activities.
MOVED BY WINKLER, SECONDED BY DOMINGUEZ AND CARRlrD BY UNANIMOUS VOTE
OF THOSE PRESENT TO AUTHORIZE THE CITY MANAGER/EXlCUTIVE DIRECTOR TO
PAY BILLS, CONTRACT PAYMENTS, PAYROLL AND DEBT SERVICE THAT WILL BE
ASSOCIATED WITH THE FISCAL YEAR 1994/95 BUDGET.
PUBLIC HEARING
2. Approval of Amended Town of Lucerne Final Map .:. Inco Homes.

City Attorney Harper explained that this is an amendment to the
original map which was recorded in the late 1800's. He stated
that the map was approved and this amendment was an improvement
over the original map. He further explained that the amendment
allows the City to make certain improvement~ and conditions to
the project as well a; eliminating the deliquency problem with the
CFD 88-3 for that arpa.

Mayor Washburn opened the public hearing at 2:20 p.m. and asked
for persons interested in the project to speak. Hearing no one,
Mayor Washburn closed the public hearing at 2:21 p.m.
Mayor Washburn noted that the number of lots for the project have
decreased from 1977 to 178 and this is a vast improvement.
Councilman Winkler asked how many of the lots were below 7,200
square feet. The applicant stated that all but ten of the lots
are 7,200 square feet or more.

Mayor Washburn asked about the berm and wanted to know about its
removal. Engineering Manager O'Donnell stated that it is a part
of the conditions of the project to remove the berm.
MOVED BY DOMINGUEZ, SECONDED BY WINKLER AND CARRIED BY UNANIMOUS VOTE
OF THOSE PRESENT TO APPROVE THE FINAL MAP SUBJECT TO THE CITY
ENGINEER'S ACCEPTANCE AS BEING TRUE AND ACCURATE, AUTHORIZE CITY CLERK
TO SIGN SAID MAP, ACCEPT DEDICATIONS AND RECORD, AUTHORIZE THE MAYOR TO
SIGN THE AGREEMENT, ADOPT THE MITIGATED NEGATIVE DECLARATION NO. 94-4
AND WAIVE THE DRAINAGE FEES FOR THE INCO HOMES PROJECT WITH THE
FOllOWING CONDITIONS:
1. The Tract Map shall comply with the State of California
Subdivision Map Act and shall comply to all applicable
requirements of the lake Elsinore Municipal Code, Title 16.
2. The City's Noise Ordinance must be met during all site
preparation activity.
3.
Street names for lots A thru G shall be approved by the Planning
Division.

4. All lots within this subdivision shall conform to the minimum
dimensional standards of the R-l Zoning District.
5. Comply with all requirements of the Riverside County Fire
Department. The applicant/developer shall provide written
certification from the appropriate water company that the
required fire hydrants are provided prior to issuance of building
permits.
6. Applicant must meet all requirements of Elsinore Valley Municipal
Water District (EVMWD). The applicant shall provide connection
to public sewer for each lot within the subdivision on a
construction phase basis subject to the Water District's
approval. No service laterals shall cross adjacent property
lines and shall be delineated on engineering sewer plans and
profiles for submittal to the EVMWD.
7. Meet all requirements of Southern California Edison Company.
8. Meet all requirements of Southern California Gas Company.
9. Meet all requirements of General Telephone.
10. Trailers or mobile homes utilized during the construction phase
of this project shall be subject to approval of the Community
Development Manager or designee, prior to issuance of building
permit .

11. Applicant shall submit and receive approval of landscape and
irrigation plans for model homes (if such are desired), back-up
wall areas, street trees and slope planting in accordance with
the City Landscape Guidelines, prior to issuance of the first
building permit on Phase I.
12. Subdivider shall record CC & R's for the project prohibiting
on-street storage of boats, motorhomes, trailers and trucks over
one (1) ton capacity. CC & R's shall also include screening any
ground base disk antenna and no roof-mounted or front yard disk
antenna shall be allowed. CC & R's shall be subject to the
approval of the Community Development Director or his designee,
prior to recordation of any deeds or final map. CC & R's shall
be recorded prior to issuance of any Certificate of Occupancy
for the units when developed in the future.
13. House plotting, architectural drawings, floor plans and
landscaping plans shall require Design Review approval prior to
issuance of building permits for Phase I. Design amendments to
subsequent phases shall also require Design Review approval prior
to issuance of building permits for that phase. All standards of
development and procedural steps in effect at the Design Review
submittal shall apply for this project.
14. A six (6) foot decorative masonry wall shall be constructed
consistent with the existing decorative wall along Grand Avenue
and Lakeshore Drive. Precise design, materials, color and
location to be determined through the Minor Design Review Process
for Phase I.

15. Any alterations to the topography, ground surface, or any other
site preparation activity will require the appropriate City
permits. A Geologic Soils Report with associated recommendations
will be required for grading permit approval, and all grading
must meet the City's Grading Ordinance, subject to the approval
of the Chief Building Official and Planning Division. Interim
and permanent erosion control measures are required. The
applicant shall bond 100% for material and labor for one (1) year
for erosion control landscaping at the time the site is rough
graded.
16. All phased development associated with this map requires separate
Design Review approval, in accordance with Section 17.82 of the
Municipal Code prior to building permit approval and shall be
subject to further environmental review and project conditions in
accordance with the provisions of the California Environmental
Quality Act (CEQA) Guidelines.
17. Prior to issuance of any grading permit or building permit,
subdivider shall sign and complete an "Acknowledgment of
Conditions" and shall return the executed original to the
Community Development Department.
18. All residences shall be served by a sidewalk along lot frontage.
19. Conceptual and Final Landscape and Irrigation Plans for all
project slope areas and fire breaks shall be approved by the
Community Development Manager or designee prior to issuance of
building permits for any phase of development. Improvements
shall be installed prior to Certificate of Occupancy on a per
phase basis.

20. All required off-site improvements shall be completed prior to
release of utilities and issuance of Certificate of Occupancy for
any units as it applies on a phase basis.
21.
Applicant shall plant trees at 30-foot intervals along the front
yards of the newly created lots. Street trees shall be 15 gallon
minimum size and selected from the City Tree List, subject to the
approval of the Community Development Director or designee on a
phase basis.
22. Approval of the New Amended Map will be conditioned on payments
of funds in the amount of $289,991.16 adjusted for accrued
interest of 67.50 per day to be debited fro or credited to such
amounts based on the date of payment prior to July 1, 1994,
respectively, representing full payment of the Delinquent Special
Taxes. Payment shall be made within fifteen (15) days after City
Council approval of the New Amended Map, but no later than July
6, 1994.

23. All Public Works requirements shall be complied with as a
condition of development as specified in the Lake Elsinore
Municipal Code per phase.
24. Construct all off-site improvements per approved street plans
(Municipal Code, Title 12), which must be approved and signed by
the City Engineer prior to issuance of building permit (L.E.M.C.
16.34) on phase basis.
25. Street improvement plans and specifications shall be prepared by
a civil engineer and improvements shall be to Riverside County
Road Department standards and City Codes (L.E.M.C. 12.04 and
16.34).
Pay all fees and meet requirements of encroachment permit issued
by the Engineering Department for construction of public works
off-site improvements (Municipal Code, Title 12, Chapter 12.08
and Resolution No. 83-78) on phase basis.
27. Dedicate underground water rights to the City (Municipal Code,
Title 12, Chapter 16.52.030).

28. Provide a "will-serve" letter guaranteeing water and sewer
service from serving agency, prior to building permit.
29. Meet all requirements of Riverside County Fire Department for
fire protection.
30. All compaction reports, grade certification, monument
certification (with tie-notes delineated on 8 1/211 X 11" mylar)
shall be submitted to Engineering Department before final
inspection of off-site improvements will be scheduled and
approved.

Applicant shall insure that a qualified engineering/soils
geologist is retained to explore and evaluate the project area
to determine the presence of fault extensions of the Lucerne or
Glen Ivy Faults which trend into this property. Should faults be
defined, lots shall be reduced accordingly and construction shall
occur subject to similar limitations for Alquist Priolo Zones.
Grading plans shall note presence and location of discovered

faults. CC & R's shall explain and disclose location and
associative hazards to any identified fault traces affecting
individual lots.
32. The required Soils and Geology Report shall include street design
recommendations. A final Soils Report showing compliance with
Preliminary Report and Finish Grade certification shall be
provided prior to issuance of any Certificate of Occupancy.
33. Install street lights and indicate on street improvement plans,
subject to the approval of the City Engineer on a phased basis.
34. Provide street improvements 12 feet beyond centerline on
perimeter street (Washington) for 32 foot paved roadway in Phase
2 & 3.
35. Provide grant deed easement for sewer line and waterline in
perimeter street (Washington) outside project boundary or place
in street dedicated right-of-way.
36. The intersection of Massachusetts and Belmont shall be knuckled
intersection in Phase I.
37. Enter into a subdivision agreement with the City for public works
improvements and post appropriate bonds per phase. Letters of
Credit to be approved by the City Attorney.
38. All improvement plans and tracts shall be digitized. At
certificate of occupancy applicant shall submit tapes and/or
discs which are compatible with the City's ARC Info/GIS or
developer to pay $1,000 per sheet for City digitizing per phase.
39. Developer shall provide No Parking and Street Sweeping sings for
streets within tract or pay a fee for installation by the City.
40. Developer shall install blue reflective pavement markers in the
street at all fire hydrant locations.
41. Applicant shall obtain all necessary off-site easements for
off-site grading from the adjacent property owners prior to
grading permit.
42. Submit Hydrology and Hydraulic Study for sphere of tract for
review and approval by City Engineer prior to approval of
grading plan. Developer shall mitigate any flooding and/or
erosion downstream caused by development of site and diversion of
drainage, subject to City Engineer approval.
43. All drainage facilities in this tract shall be constructed to
Riverside County Flood Control District standards per phase.
44. If grading exceeds 50 cubic yards, grading plans shall be
prepared by Civil Engineer and approved prior to any grading;
applicant shall obtain a grading permit and post appropriate
security.
45. The owner shall provide the City with proof of his having filed a
Notice of Intent with the Regional Water Quality Control Board
for the National Pollutant Discharge Elimination System (NPDES)
with a storm water pollution prevention plan prior to issuance of
grading permits.

46. Storm drain facilities shall be designed and installed to be
compatible with the existing CFD 88-3 storm drain facilities per
phase.
47. Provide a phasing plan for construction of public work
improvements to be approved by City Engineer prior to building
permits.
48. Make sufficient dedications along Lakeshore Drive to provide for
a 102 feet right-of-way. Provide improvements for half a street
on Lakeshore Drive along tract boundary and pay for a half median
on Lakeshore Drive along tract boundary in Phase I.
49. The earthen berm shall be removed during the first phase of
construction and shall not be used as an interim flood control
fac il ity.
50. Provide a traffic control plan showing all traffic control
devices to be installed to be approved by the City Engineer.

BUSINESS ITEM
3.
Reoort on Temoorary Boat Launch Facilities. (F;q;;',lj
City Manager Molendyk stated that at the meeting of June 14,
several Councilmembers requested that staff re-evaluate the
possibility of reopening the Temporary Boat Launch Facility. He
explained that in order to launch a boat or jet ski, there must be
at least 48 inches of water depth at approximately 22 feet from
shore. With evaporation still taking place it is staff's opinion
that it would not be worth the cost to implement the launch. If
Council wishes to open the launch the expenditure would be
$11 ,393.

Mayor Washburn stated that he and Councilman Dominguez had
inspected the boat launch area and even with EVMWD pumping water
from the back basin into the lake, it may have a positive
impact, but not enough. He stated that a few more questions were
answered, he would like to see this item tabled indefinitely.
MOVED BY WASHBURN, SECONDED BY WINKLER TO TABLE THE ISSUE OF THE
TEMPORARY BOAT INDEFINITELY.
Councilman Dominguez stated that he felt that the launch should
be opened. He explained that the water quality is good and boats
are looking for a place to launch. He stated that he felt that
$11,000 was not that much to pay to have launching.
Mayor Washburn stated that he would like to see this item tabled
to allow the new Council an opportunity to deal with the issue.
THE FOREGOING MOTION WAS APPROVED BY A VOTE OF 2 - 1 WITH DOMINGUEZ
CASTING THE DISSENTING VOTE.
