INVOCATION The Invocation was provided Pastor Fred Macias, representing First Assembly of God Church of Lake Elsinore. ROLL CALL PRESENT: COUNCILMEMBERS: BRINLEY, P APE, SCHIFFNER, KELLEY ABSENT: COUNCILMEMBERS: METZE Also present were: City Manager Watenpaugh, Assistant City Manager Best, City Attorney Leibold, Administrative Services Director Boone, Community Development Director Brady, Community Services Director Sapp, Fire Chief Seabert, Police Chief Walsh, City Engineer O'Donnell and City Clerk Kasad. PRESENTATIONS a. Proclamations - Eagle Scout Mikhail D. Hunzeker and Eagle Scout Chris Olson. (F: 122.1) Mayor Kelley read and presented the Proclamation to Chris Olson and detailed his accomplishments and efforts for this award. She congratulated him on his work. Mikhail Hunzeker was not present for presentation. Chris expressed appreciation to his family, friends and fellow scouts for their assistance in this proj ect. b. Proclamation - 50th Anniversary - World Town Planning Day. (F: 122.1 )(X:60.1) Mayor Kelley read and presented this Proclamation to Planning Commissioners Wilsey, Sands and Polk. Planning Commission Chairman Wilsey expressed appreciation for the Proclamation and indicated that the Community can be proud of the City's Planning Staff and other City Staff, PAGE TWO - CITY COUNCIL MINUTES - NOVEMBER 9, 1999 noting that they frequently hear commendations for staff. Ratified Warrant List for October 28, 1999. (F: 12.3) BUSINESS ITEMS 31. Second Reading - Ordinance No. 1053 - Amending the Municipal Code relating to Fishing & Lake Speed Limits. (F:92.1) City Manager Watenpaugh noted that this was the second reading of the previously discussed ordinance which corrects a duplication in the municipal code and clarifies the fishing ordinance. UPON THE FOLLOWING ROLL CALL VOTE: AYES: COUNCILMEMBERS: BRINLEY, P APE, SCHIFFNER, METZE NOES: COUNCILMEMBERS: NONE ABSENT: COUNCILMEMBERS: METZE ABSTAIN: COUNCILMEMBERS: NONE 32. 1999 Masters of Freestyle Hang Gliding Event. (F:62.1) - Community Services Director Sapp detailed this request for an event on December 11 th and 12th at the campground. He explained that this would be a Master's Freestyle Hang Gliding Competition which will bring about 10 to 15 competitors and about 200 spectators to the community. He further explained that this would be a conceptual approval, but was needed due to the short time frame. He clarified that the event will still go through the special events process. Dino Dinaso, 22021 Covello Street, Canoga Park, explained that he was first drawn to Lake Elsinore as a competition pilot, and noted his involvement in freestyle hang gliding. He detailed the other locations used for this type of competition; and noted an event planned for Mission Bay which was changed due to airport restrictions. He explained that they utilize a method known as Aerotowing, which allows the pilots to place the hang gliders in proper position for specific manuevers. He further explained that the manuevers are typical of what would be seen at an airshow, and stressed that they have highly trained judges and committed pilots for the event. He indicated that Lake Elsinore is key in the origins of the sport and noted that what one would typically see from the local mountains would be presented over the Lake. He commented that it fits nicely with the past events in the area and stressed their efforts to make it a safe event. - Councilwoman Brinley inquired how high these events would occur. Mr. Dinaso indicated that the manuevers would be presented at about 2,500 feet, which is not considered high in hang gliding events. Mayor Kelley inquired how far off shore the manuevers would occur. Mr. Dinaso indicated that they are looking at requiring that manuevers be 500 feet over water and within a set area of the Lake. He noted existing landmarks which would most likely be used for identifying the manuever area. He detailed the requirements for participation in this event. Mayor Kelley questioned the number of competitors. Mr. Dinaso reiterated PAGE FOUR - CITY COUNCIL MINUTES - NOVEMBER 9, 1999 that they anticipate 10 or 15 people. Mayor Kelley inquired if they would use smoke flares for visibility. Mr. Dinaso confirmed, noting that it assists the judges and dramatizes the path of the hang gliders. He stressed the competitive nature of the event, but expressed confidence that the risks would be minimal. Councilwoman Brinley inquired how many spectators - routinely follow this type of event. Mr. Dinaso noted the Aspen, Colorado games last year and indicated that the on the biggest day there were 250 people present. Councilman Schiffner noted that this type of event works well with the other programs occurring in the City. He thanked the applicant for considering Lake Elsinore and hoped for future consideration for more events. Councilman Pape concurred that this event was complimentary to other events and indicated he would be present to watch the event. Councilwoman Brinley concurred that she would be present as well. Mayor Kelley questioned the consideration of this item in concept only. Community Services Director Sapp confirmed, noting that there are some additional details to work out. MOVED BY BRINLEY, SECONDED BY P APE AND CARRIED BY UNANIMOUS VOTE OF THOSE PRESENT TO APPROVE THE 1999 MASTERS OF FREESTYLE HANG-GLIDING COMPETITION AT THE CITY CAMPGROUND WITH THE REQUIREMENT THAT THE APPLICANT MEET WITH THE SPECIAL EVENTS COMMITTEE AND ABIDE BY THE REQUIREMENTS DETERMINED FOR EMERGENCY RESPONSE, POLICE NEEDS OR ANY REQUIREMENTS IMPOSED BY THE CITY MANAGER. ITEM PULLED FROM THE CONSENT CALENDAR 3. Change Order for Underground Storage Tank Removal at the Campground $1.413.00. City Manager Watenpaugh noted a transposition on the change order on page 3 of 4; and indicated that the increase amount should be $1,413.00, which changes the total amount to $7,399.93. MOVED BY BRINLEY, SECONDED BY SCHIFFNER AND CARRIED BY UNANIMOUS VOTE OF THOSE PRESENT TO APPROVE CHANGE - ORDER NO.1 IN THE AMOUNT OF $1,413.00, RELATING TO THE REMOVAL OF THE UNDERGROUND STORAGE TANK AT THE CAMPGROUND. THE REGULAR CITY COUNCIL MEETING WAS RECESSED AT 7:29 P.M. PAGE FIVE - CITY COUNCIL MINUTES - NOVEMBER 9, 1999 THE REGULAR CITY COUNCIL MEETING RECONVENED AT 7:31 P.M. PUBLIC COMMENTS - NON-AGENDIZED ITEMS Donna Morin, representing the Lake Elsinore Historical Society, presented the Council with historical photos for City Hall, which were donated by Jerry & Nadine Harmatz. She noted that they have drawn much interest at the Museum. She announced the upcoming Melodrama and introduced players from the production. She indicated that the play will be presented on November 19th and 20th, at the Women's Club, with the ticket price being a $5 donation. She noted that they would be serving sasparilla. Jerry Harmatz, noted the 1887 aerial photograph and noted that it was taken in the year his father was born, stressing the changes which have occurred in only two generations. Mayor Kelley thanked Mr. & Mrsa. Harmatz for their generosity. - Diana Lovegren, 17503 Sunnyslope, congratulated the Council on their reelection. She noted photos of Sunnyslope and indicated that it is the worst street in town. She expressed concern that the dirt roads have not been maintained, and stressed the need for a new permanent road. She further stressed the difficulties of driving on the road as it is. She noted that her understanding that the City had a goal of having a developer address the area, which would be fine, but until then they need a paved road. She further noted that a thin layer was placed on the road a few years ago, but it was not adequate. She indicated that they don't want curbs, gutters or a study, they simply want the road paved so they can get to their homes. She suggested that this road was an accident waiting to happen and requested that they not be insulted or ignored for a fifth year in a row. She indicated that they want and deserve a commitment and would like to know the plans by the next meeting. Dolores Hartzheim, 17455 Sunnyslope, indicated that she was present because she wanted the Council to know that this is not the first time the roads have been brought to the City's attention. She commented that she has talked to the City for the last eight years and driven the road with street maintenance staff to point out the conditions on Sunnyslope. She stressed that this problem has been brought to the City's attention many times and staff admits that this is the worst street in the City. She indicated that it would be unacceptable to continue with no action being taken; and stressed that some potholes are so deep they could send a car over the sides. She invited the Council to drive Sunnyslope to see the conditions. John Pitt, 17561 Sunnyslope, noted that their neighborhood was developed in the 1920's, based on a dream. He detailed the trees, granite lightposts and clubhouse, and noted that one of their first residents was Amy Simple McPherson. He noted that the neighborhood is about 70 years old and stressed the needed repairs. He stressed the potential danger caused by the potholes and the difficulty of driving the roads. He requested that the Council drive the area and look at the conditions. Chris Vanover, 300 N. Ellis, noted that he is a new resident of Lake Elsinore and likes the community. He stressed the small town charm and Main Street, suggesting that if people like the community they should stay; but if they don't PAGE SIX - CITY COUNCIL MINUTES - NOVEMBER 9, 1999 like it they should look for solutions to the problems they see. He indicated that he was appalled to hear a candidate call a voter ignorant, and suggested that everyone should try harder to give credit and respect where it is due. He stressed the importance of homeowners letting the City know where there are specific problems. He noted that the campground belongs to the City now, and efforts should be made to make the most of it. He suggested if residents buy property on a dirt road, they should not complain about it, noting that there are more important issues. He commented that the reduced crime rate is phenomenal, but his vehicle has been vandalized four times. He suggested that downtown should be turned into affordable housing, and indicated that the City needs a marina with slips, a restaurant and shops. She encouraged residents to take pride in the City and get involved with area organizations. He also encouraged residents to get out and vote. Daryl Hickman, 19 Corte Madera, congratulated the Council on their reelection victory. He noted that the election was quite an experience. He commented that he met a lot of nice people and the City's constituents are its greatest asset. He noted that there are still concerns to be addressed including a stop sign for the school in Tuscany Hills, improvements for Sunnyslope, etc. He thanked the voters who supported him. Minnie Brown, 312 N. Langstaff Street, congratulated the Council on the election. She expressed thanks on behalf of the Friends of the Library to all who support their programs, and announced their next general meeting on November 18th. She noted a mistake in the Mayor's Pumpkin Bread recipe in the Friends of the Library Cookbook; and announced that the cookbooks are available at the library or Java Junction. She announced the Lake Elsinore NAACP holiday meeting schedule with meetings on November 18th at 1 p.m. for final instructions on the Unity in the Community parade, December 16th at 1 p.m. for Christmas feast, with participants donating an unwrapped gift for the Police Department efforts. She noted that Council Meetings are for public attendance and that there should be a notification of meetings in the newspaper. She further noted that she had received clarification on this matter from Mr. Buckley of the Press Enterprise. She requested a review of the fees for home improvements, and suggested that the costs are excessive. She further requested review of the possibility of replacing the Pottery Street Bridge. Kenny Niemi, 17032 McBride, congratulated the Council on the Election. He noted the privilege and positive experience of running for office; and commented that he met many citizens in Lake Elsinore. He commented that there is a large amount of open space in Lake Elsinore and noted an upcoming symposium at UCR regarding the Endangered Species Act. He noted the proposed hang gliding event and expressed support for the presenters. He suggested that the Council take the time to read the article he presented about land use planning and endangered species. He indicated that he would be present at future meetings to address areas of the community which should be preserved. He again congratulated the Council on their election and offered his assistance to them. He noted a street problem at Robertson and Highway 74 and suggested that the dirt at that intersection should be cleaned up to prevent slipping. -- - - PAGE SEVEN - CITY COUNCIL MINUTES - NOVEMBER 9, 1999 CITY MANAGER COMMENTS City Manager Watenpaugh commented on the following: - 1) Indicated that he was aware of the situation on Sunnyslope and has been to the area many times. He further indicated while it might not be possible to solve the problem, staff has put together numbers and options. He expressed appreciation for the neighborhood input and noted that staff even got information on putting another access off of Riverside Drive to allow for two entries. He explained that it would require about 3.3 miles of paving and drainage, which would cost about $198,000. He further explained that staff was in the process of looking at an overlay district or rezoning the properties to allow for a different type of street. He advised that the current staff does not feel that the full 40 foot streets are necessary for that area. He further advised that staff would be bringing the information to the Council prior to budget review for possible modifications to zoning and street requirements. He stressed that it is not possible to do all of the work at once, but the City could address a little at a time. He noted that there is about another $8 million in projects to be address with about $1 million. He reiterated that there would be a number of study session on Capital Projects and the Budget. He addressed requests from the last Council meeting regarding Stevens Street, noting that the work would cost about $46,000. He also noted a section on McPherson Street which would cost about $19,000. He reiterated that these recommendations would be presented for mid-year budget review. He offered to meet with the residents to discuss the projects further. 2) Addressed Mr. Hickman's comments and clarified that the City did not have a windfall, but it had made a commitment to a financial plan and stuck to it. He commended the Council on sticking to their plan. 3) Noted that with Winter coming up, there would be no paving until mid-year. He advised that the study session on Capital Improvements would probably be held the 3rd week in January, as part of a series of study sessions. 4) Addressed the issues regarding the EIR on the Alberhill project and noted that staff is not in control of when that document will be available for review. He indicated that the applicants would need to produce the information for review, and it would be available, as soon as possible. 5) Addressed the Summerhill Development and noted the concerns on the landscaping completion. He explained that the Granite and Cornerstone developers are obligated to landscape from the Bridge to the Tuscany Development. He indicated that they will be providing the landscaping and maintaining it for three years. He also noted that the property owners would be reminded to abate dumpage on the PAGE EIGHT - CITY COUNCIL MINUTES - NOVEMBER 9, 1999 vacant lots. 6) Noted the concerns for the intersection of Summerhill/Canyon Estates Drive, and noted that the request is similar to the request on Summerhill near the school. He suggested that violating on code violation to prevent another would not solve the issue. He indicated that the City was concerned with the false sense of security a stop sign would provide. He noted that staff is working to resolve these problems through the freeway off/on ramps. He indicated that an alternative would be provided in February. He further indicated that aside from additional signs and continued enforcement, the staff would not be recommending a stop sign at the requested location. He indicated that he would be happy to meet and discuss the issues further with the residents. - 7) Thanked the Community for their support of the incumbents and indicated that it is ajoy to work here. CITY ATTORNEY COMMENTS City Attorney Leibold congratulated the Council Incumbents on their reelection. COMMITTEE REPORTS No Reports. - CITY COUNCIL COMMENTS Councilman Pape commented on the following: 1) Requested updates when the Del Rey Development is closer to completion so residents can be updated. 2) Noted comments regarding the Endangered Species Act and suggested that it has been abused and misused for years. He indicated that it should not be used for land planning and that it is no good for California. 3) Noted the upcoming GFI motorcycle race and encouraged the public to attend and view this free event. 4) Indicated that it was hard to believe that it was only a couple of weeks until Winterfest. He announced that the tree lighting ceremony and Winterfest on Main Street would be on December 3rd at 5 p.m. He encouraged participation in this event. He further announced that Santa would be present for breakfast at the community center on December 11 tho - PAGE NINE - CITY COUNCIL MINUTES - NOVEMBER 9, 1999 Councilman Schiffner commented on the following: 1) Commended all candidates on their timely removal of political signs; and indicated that it was gratifying to see the signs gone within a couple of days of the election. He expressed his appreciation for this action. - 2) Addressed the Sunnyslope area and requested that City staff study and look at the possibility of a zone change and overlay district to allow for the building of narrower streets than would currently be required. He suggested that this would be an appropriate first step and star the ball rolling. He noted that he couldn't guarantee when there would be pavement in place. He indicated that he has met with the neighbors in that area and is fully aware of the bad road condition. He noted that Sunnyslope is a beautiful area and expressed hopes at starting the process and finding methods to address the problem. He indicated that regardless of where the money comes from, it will still require the change in zoning to allow for narrower streets; and stressed that this would be a required procedure. Requested that staff schedule a study session to look at modifying the policy regarding pre-council meetings for agenda reviews. He indicated that he would like a public meeting prior to the Council meeting, and requested that staff investigate the options. 3) 4) Thanked his family, friends and supporters for their confidence in him and pledged to represent all who supported him and those who didn't. He stressed that he will represent everyone with integrity, dignity and fairness. Councilwoman Brinley commented on the following: 1) Concurred with Councilman Schiffner regarding the Sunnyslope area and noted past discussions about a developer looking at the area. She noted that streets were a concern at that time, as they were anticipated to be quite costly. She expressed support for consideration of new guidelines to allow some form of street improvement to occur. She indicated that the Council wants to and will address this issue if the residents can bear with them until the mid-year review. 2) Concurred with Mr. Niemi that Lake Elsinore is a wonderful community. She noted that she walked the neighborhoods and talked to the residents and listened to what they had to say. She indicated that all are very positive about the future of Lake Elsinore, but everyone wants all of the amenities including streets, curbs, gutters, shopping, good schools and an community to call home and be proud of. PAGE TEN - CITY COUNCIL MINUTES - NOVEMBER 9, 1999 3) Thanked the community for their vote of confidence and support. She expressed thanks to individuals for their campaign support. She also expressed thanks to her family and friends who worked hard to succeed. She indicated that she was proud to serving the City of Lake Elsinore. - Mayor Kelley commented on the following: 1) Reiterated that the GFI Races were this weekend and announced that there would also be a Street Fair on Main Street both days from 7 a.m. to 6 p.m. 2) Announced the Historical Society Pancake Breakfast on Saturday and Sunday from 5 a.m .to 9 a.m. near the Fire Engine across from City Park. She noted that the proceeds would benefit the fire engine project. 3) Announced the Unity in Community Parade on November 20th at 10 a.m. on Main Street. She indicated that potential participants could contact Jeanie Corral for information. She announced that the City Council would be riding in the Parade on a boat towed by a truck. 4) Announced the Winterfest event on December 3rd which will include the Christmas Tree lighting and the Temescal Canyon High School choir. She noted that the Elsinore Valley Arts Network will participate by presenting entertainment at the Cultural Center with talent acts. - 5) Noted an upcoming meeting about CDBG funds on November 16th at 5 :30 p.m. at the Cultural Center. 6) Noted that Girls Softball sign-ups would be held at Terra Cotta Middle School on November 13th from 9 a.m. to 2 p.m. 7) Reannounced the Historical Society Melodrama on November 19th and 20th. She noted that there would be a Community Sign before the production. 8) Noted that she met with the residents of Sunnyslope, and took the City Manager to the area the next day. She reiterated that Council's direction was for staff to put together solutions for the mid-year budget review in mid-January. She stressed that the Council wants to address the citizen concerns and concurred that constituents are the City's most valuable resource. - 9) Thanked the voters for their support, and congratulated all candidates of their efforts.
