HomeMy WebLinkAbout12-26-2000 City Council/RDA/PFA Study SessionMINUTES CITY COUNCIL/REDEVELOPMENT AGENCY/ PUBLIC FINANCE AUTHORITY STUDY SESSION CITY OF LAKE ELSINORE 130 SOUTH MAIN STREET LAKE ELSINORE, CALIFORNIA TUESDAY, DECEMBER 26, 2000 :~~:~~~~:~~~~~~~:~~:~*~*,~:~*~~*~:~*,~:~:~~~~:~~~~:~~~:~~~~:~~~~~~~~~~:~~:~~:~~:~~:~~:~~ CALL TO ORDER The Study Session was called to order by Mayor Schiffner at 4:01 p.m. ROLL CALL PRESENT: COUNCILMEMBERS: KELLEY, PAPE, SCHIF'FNER ABSENT: COUNCILMEMBERS: BRINLEY, METZE Also present were: City Manager Watenpaugh, Community Development Director Brady, Information/Communications Manager Dennis and City Clerk/Human Resources Director Kasad. PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Information/Communications Manager Dennis. DISCUSSION ITEM a. A~endaReview. (F:44.1) Mayor Schiffner inquired if there was a need to discuss any of the items on the Consent Calendar. Councilwoman Kelley noted that the Granite Homes item was an example of where Fish and Wildlife had reneged and requested more land. She questioned how they could do that, and there was general Council discussion of the lack of fairness in cases like this. Councilman Pape questioned page 2 of the agreement, which discusses $5,500 per acre. City Manager Watenpaugh indicated that issues had not yet been resolved, but the City Attorney was working with the other attorneys and the Community Development Director was working with a partner of Granite Homes to negotiate the agreement. He indicated that it was the general feeling that they would like to see the balance of the 112 lots developed, and it was a shame that Fish and Wildlife could continue to stop the proj ect for additional property. He noted that there would be some benefit to not being required to maintain the property in the future. Councilwoman Kelley expressed concerns that the demands were being made based on something that had not been adopted. City Manager Watenpaugh concurred that they were mandating it anyway. PAGE TWO - STUDY SESSION MINUTES - DECEMBER 26, 2000 Mayor Schiffner noted that this was an attempt to keep them satisfied; and referenced an article in San Diego where there was an approved plan and a new species had been identified. City Manager Watenpaugh noted that the situation could be the same here, even when the plan is adopted; but noted that staff would be moving forward to meet with Murrieta after the first of the year. He noted that some of the other conditions being requested, are almost to the point of ludicrous, such as small mesh fences to keep cats out of the area; and ultimately the home buyers will pay for these requirements. I~e noted the need for an endowment for preservation of the property in perpetuity. Community Development Directar Brady noted that it was originally requested that the CC & R's include that certain property owners could not own cats. The City Council questioned the ability to enforce such a condition. Mr. Brady indicated that he was not sure it was in place, but it was originally proposed. Councilwoman Kelley expressed concern that there had been no study on the property to determine that the species e~st; and questioned the other conditions. City Manager Watenpaugh advised that the developer was required to buy 80 acres of mitigation land, plus 29 acres from the City, and now this additional four acres. He fizrther advised that there was $120,000 in escrow and approximately $1 million lost in down time far the 422 total units. Mayor Schiffner questioned the size of the parcel being discussed. City Manager Watenpaugh clarified. Councilman Pape expressed concern that the developers were over a barrel; and noted a meeting with Fish and Wildlife regarding a deadline and their attitude of "so sue us". Mayor Schiffner noted that recent changes in Washington, might help with this situation. Councilman Pape questioned the $1,000 and $5,000 per unit fees regarding the Forecast Homes item. City Manager Watenpaugh explained the agreement, which will come back to eatend the development; and the DAG fees of $1,000 will be paid when the homes are built, which can be used for public facilities. He also explained that $5,000 per lot will go into the CFD and go to trustee to assure the reserves are in place for the debt payment on the CFD. He explained that this would put the property back on the t~ rolls and assist in resolving the final CFD for TMP. Mayor Schiffner commented that this was a good outcome, but the best news was that it would get the property developed. Councilman Pape noted that the project would include larger lots and homes. Mayor Schiffner concurred and contrasted it to the current mess on the property. City Manager Watenpaugh addressed the Report on the Initiative and PAGE THREE - STUDY SESSION MINUTES - DECEMBER 26, 2000 indicated that the Attorney would be present at the meeting this evening to give a report and recommendations. I City Manager Watenpaugh noted that the meeting would need to be recessed, so the Public Finance Autharity could take action on the bonds in concurrence with the Council for Forecast Homes. He advised that they could then adjourn back to the Council Meeting for Public Comments and one Closed Session Item of five minutes or less; and adjourn the Closed ' Session, report the action and have cake following that for the Council and Audience. Mayor Schiffner questioned the Redevelopment Agency Meeting. Redevelopment Agency Chairwoman Kelley indicated that there was nothing for the Redevelopment Agency, the but Public Finance Authority Meeting would be called to order. City Manager Watenpaugh noted that Mayor Schiffner would make the presentation to former Mayor Brinley. He expressed appreciation to the Council for their willingness to hold the Regular Meeting for the community, but assured them that it should be brief. Chris Hyland questioned the homes being discussed. City Manager Watenpaugh e~lained that the property was just below Withrow Elementary School; and was one of the last undeveloped pieces of land on that end of the City. Mayor Schiffner noted the current condition of the property.
