2. Reco~nition of Outgoing Elected Officers. (F:44.1)
Mayor Schiffner asked Councilman Metze to address the audience:
Counciiman Metze noted that it had been a very strange day knowing
that it was his last day on Council. He commended and thanked staff
and thanked the City Manager, Assistant City Manager, City Cierk
and each of the Depariment Birectors personally. He noted the great
job that City Attorney Leibold and her firm had done. He thanked his
vyife and children for atl their support and introduced his sister. He
thanked the pubic for the opportunity to serve and concluded by
thanking the members of City Council he has served with and the
Planning Commissions he seroed and worked with. He noted that
through all their efforts they helped to rnake Lake Elsinore a better
place to live.

Councilman Pape noted the difference in the community in the last
twenty years since he and his family had moved to Lake Elsinore. He
stated that serving the Ciry of Lake Elsinore had been a great
experience. He commented that one of the perks of the job was the
people that he met and knew throughout the years:
Mayor Pro Tem Brinley thanked Councilman Metze for his service to
ihe City. She noted that Council~nan Metze always placed the
community first and did his homework. She eomtnented tnat they did
not always agree; however they were abie to walk away friends. She
commended his family for their support. She thanked Councilman
Pape for his service and noted his support of the Council and the
community. She commented that it has been a pleasure serving with
him and stated that both Councilmembers were appreciated and loved.
Councilwoman Kelley stated that both Councilman Pape and
Councilman Metze would be sorely missed. She noted a conversation
she had with Councilman Metze regarding what it meant to be a
Councilmember. She indicated that they had decided that if a person
sat on Council for one term or two; made every decision with their
heart; was educated and gathered all the facts; made a personal right
decision; then, when that person left after their term and felt ~roud of
every decision that was made with no regrets, that person had done a
great job. She noted that both Councilman Metze and Counciiman
Pape couid be proud of a11 the decisions they made since they were
made with intelligence, with heart and sincerity and with the
constituents of the City of Lake Elsinore first in their consideration.
She stated that it had been a pleasure to serve with them.
Mayor Schiffner stated that he was involved when Councilman Pape

He noted that the friendship that they had since then had been
ongoing. He compliinented Councilman I~ape's fatnily. He noted -that
a few years a8er meeting Councilinan Pape, he had ~he pleasure of

mm~ing far Council along with Councilman Metze. He stated that in
that race, Councilman Metze won the seat and he had the pl~asure of a
relationship with him ever since. He noted that both Councilmembers
had not pleased everyone and they had some disagreements, however
there had never been a question in his mind that the decisions bofh
gentlemen made had always been for the betterment of the City of
Lake Elsinore. He noted that they had both been his friends as well as
the other members of the CounciL
City Clerk Kasad expiained that outgonig Counciimembers received
mementos of the City. She noted that they receive a scrapbook of
their term in office, a City tile plaque and a money clip. She noted the
difficulty of saying goodbye.
City Clerk Kasad presented City mementos to Councilman Metze and
Councilman Pape.
3. Oath of Office - Newiy Elected Officers. (F:44.1)
City Clerk Kasad administered the Oath of Office and presented
Certificates of Elections to Councilman Buckiey and Councilman
Hickman.
Councilman Suckley and Hickman took their place at the dais.

Councilman Schiffner commented that he appreciated the vote of
confidence from the new Councilmen and appreciated the support
from the various members of the community. He explained that
several years ago prior to being seated on Council, Council had
established a policy to rotate the position of Mayor to a11ow every
member on Council the opportunity to serve as Mayor. He indicated
that because of that policy, he would respectfully decline the
nomination.

PRESENTATIDN
a. Presentation - Student Advisory Board Update. (F:142.1)
Chairman Christopher Facundo, Vice Chaiiman Phison Pham and
Community Liaison Katie Wise presented an overview of the Student
Advisory Board and indicated that they are involved in the "Every 15
Minutes" program, which taught the consequences of drinking and
driving; CitylSchooi Wide Recycling Arogram; and organizing the
Grand Openuig of the McVickers Skate Park. Chairman Facundo
stated that they would be reporting to Council on a periodic basis to
keep Council informed of their activities.
b. Presentation - Certificate of Recognition - San Bernardino Fire
Department Hazardous Materials Division. (F:163.1)
Recreation/Tourism 1vlanager Edelbrock presented a Certificate of
Recognition to Ionie Wallace and Jerry Wong representing the San
Bernardino Fire Department Hazardous Materials Division. She
noted that they had been providing service and training for free for the

last two years and that the contract had expired and the City would be
contracting with the County of Riverside; however their services had
been invaluable.
Ms. Wallace thanked the City Council for the opportunity to work
with the City of Lake Elsinare. Mr. Wong thanked the City Council
and noted that the Ciry of Lake Elsinore was the oniy city in Riverside
County that committed to a fulltime Household Hazardous Waste
Collection Refuse Facility.

ITEMS PULLED FROM CONSENT CALENDAR
9. Warrant List-November 15, 200I. (F:12.3) (X:68.1)
Councilman Buckley stated that he pulled the Warrant List because he
questioned the payment of check no. 6'7435 issued to Molendyk and
Associates. He indicated that he had a copy of the cantract and asked
for clarification.
City Manager Watenpaugh explained that the item in question was a
contcact with Molendyk and Associates to provide assistance with
grants; grant tracking; provide an overview of the Park Bond; monitor
the progress of the City's grant applications; and development of a
strategic plan for different grants that the City might qualify for. He
noted that the contract was put together following a contract that had
been entered into with the Dangermond Group. He further eaplained
that their function was to put together a research paper on the gra~its
that were a~ailable at the State Levei through Proposition 12; other
funds available through the State; and then to continue Phase 11, which
was the development of a strategy and assist in filling out
applications. He noted that the contract was in excess of $25,000. He
indicated that staff took an item to Council seeking a consultant to
assist the City. He noted thatMr. Molendyk had ties to an associate
from Sacramento who was the State Parks Deputy Director in charge
of facilities and direct ties with the entue group of grant writers and
agencies in Sacramento. He further noted that for a grand total of
$18,000 through January 31, 2002, it was staff's recomrnendation to
go with Molendyk and Associates, which included Jack Harrison as
opposed to $25,000 with Dangertnond Group. He indicated that
currently the City had submitted one gant and was in the process of
submitting a grant on February 1, to Wetlands Conservation Board for
acquisition of properties.
Councilman Buckley clarified that staff made the choice. City
Manager Watenpaugh confirmed. Councilman Buckley noted that
the contract could be broken in 30 days without cause. City

Manager Watenpaugti confirmed. Councilman Buckley indicated that
due to Mr. Molendyk's past with the City and his term in Perris. He
noted that the ternl in Perris was currently under investigation by the
F.B.I. and it would not be appropriate to do business with Mr.
Molendyk. He stated that the Dangermond group had a considerably
longer record, and a successful record in fmding park funding; and if
the City was going to spend the money to fmd park funding; then it
should follow with the Dangermond Crroup.

City Attorney asked if the warrant amount was for services rendered.
Ciry Manager Watenpaugh confirmed. Councilman Hickman asked if
Molendyk and Associates had generated any money for the Gity. City
Manager Watenpaugh stated that if the Council wished he could hand
them a copy of the request and what Molendyk and Associates was
hired to do. He read the following:
An overview of the Park Bond Program and detailed
information on available grants.
Monitor program progress and plans at the State Grant Office
and provide the Crty with written monthly status reports.
Phone consultarions with City Staff as needed.
Assist City staff with preparation of competitive grant
application.
Monitor the progress of the City's Proposition 12 applications.
Attend public meetings and other hearings as necessary

Assist City staff in developing strategies for acquisition and
development of additional parks, landscaping of the Outflow
Channei and related traii systems, acquisition of land for habitat
in the Back Basin and identify other potential funding sources
in addition to Proposition 12.
City Manager Watenpaugh stated that what the City was seeking from
the consultant was advise as to what grant programs the City should
spend time trying to get funding from. He explained that all of the
gants were very competitive and most of the grant applications "
require a match, and the City did not have a lot of match money,
therefore staff felt it was necessary to solicit assistance in fmding
other funds, other than State Funds that the City could use to match
the State Funds. He indicated that to date the City has submitted one
grant applicarion and was in the process of working on another one.
Mayor Kelley asked the City Manager to explain why it was so
important and necessary to go with a company that was so tied to the
connections that the City needed in order to move our grant forward.
City Manager Watenpaugh stated that the concern staff had was that
the City needed contact with someone in Sacramento and Jack
Harrisan had the contacts and was very well known. He noted that
Mr. Harrison also dealt with a number of Recreation RV Facilities as
a former General Executive Director. He further noted that Mr. Harris
was very familiar with Parks a~id Recreation; very fanuliar with the
grant application process; and can hand walk the grants through, much
as was done with the State Legislatures or Federal Fund'uig. He stated
that the direct contact was why the City went with the firm in
question. Mayor Kelley asked the City Manager to explain why staff
did not wish to go with Dangermond Group. City Manger
Watenpaugh explained that with a previous contract with the
Dangermond Group, it was found that it took an excessive amount of
time to get the required reports back; the report was somewhat
incomplete; therefore, based on the timeline when the City received
the report the grant applications were due three weeks later. He

further e~plained that staff felt that the City would get better results
having assistance, and ha~ing staff prepare parts of the grants with the
consultant having the direct contact and the ability to wallc the grants
through the process. City Manager Watenpaugh stated that if the City
were hiring someone to do all of the grant writing, research and
preparation, the cost would have been to the pomt where the City
could not have afforded the program.
Councilwoman Brinley commented that Mr. Harris's business had
been a long time in the organization and he was highly respected in
Sacramento. She stated that Mr. Molendyk happened to be an
employee of the company and was not managing or running the
company. She stated that he was actually an employee.
Mayor Pro Tem Schiffner stated that the question before Council was
the approval of the Warrant List and if he understood the Warrant List
it was for services already rendered. Mayar Kelley confirmed.
Mayar Pro Tem Schiffner stated that that there would be some
question as to whether the Council could pay that or not. He further
stated fhat it would nvt be proper to consider the contract since it is
not on the Agenda. He noted that any other action other than the
amount that appears on the Warrant List would be out of order at this
time. Mayor Kelley confirmed.

City Attorney explained that the Administrative Services Department
pays the invoices submitted aud due mider existing contracts to the
extent that the warrant was for services rendered. She indicated that
the amount had been paid and the Council action was to ratify the
amounts paid.

Mayor Kelley explained that if Mr. Buckley wished to reconsider the
contract, then he would have to separate that issue from the
ratification of the Warrant List.

WITHDRAW THE PREVIOUS MOTION.
Mayor Kelley indicated that Councihnan Buckley could request that
the reconsideration of the contract with Molendyk and Associates be
placed on the next regular Agenda. She noted that the action before
Council was the ratification of the Warrant List. She clarified that
what was before Council was the Warrant List and services had been
rendered and the payment would be ratified: She further clari~ed that
the contract would be discussed as a separate Agendized Item. City
Attorney Leibold clarified. Mayor Kelley clarified with Council
Buckiey that he had withdrawn his motion. Councilman Buckley
confirmed.
Mayor Pro Tem Schiffner asked that the Ciry Manager explain how
things are placed on the Agenda. City Manager Watenpaugh stated
that he wouid clarify the issue of items to be placed on the Agenda
during City Manager Comments. He stated that during Council
Comments if staff were directed to bring something back for the next
Agenda, then staff would do their best to bring the item back unless
the majority of Council chooses not ta

Councilman Buckley asked for clarification regarding the Internet,
Electronic Mail and Software policy. He asked if there would be
individual email addresses for each of the Council and how those
would fa11 'mto the City's policy concerning privacy issues.

City Attorney Leibold stated that she did not know if the City was
intending to establish mdividual Council mailbaxes for email
purposes. City Manager Watenpaugh stated that if Council wished to
have individual boxes, staff could set it up, however it currentiy was
not that way. He noted that there were several issues that would need
to be dealt with such as whether Council wished to have their email
come to the City in the Council Chambers and then printed off and
placed in their mailboxes, or if Council wished to have the email
routed through the City's computer system and forwarded to
Council's home computers. He indicated that their staff would have
to address the security of the City's computer. He e~Iainefl that if
Council wished to have individual email addresses tied through the
web page then that could be done. City Attorney Leibold noted that
the second part of the inquiry involved was whether there was any
distinction between Council's emails versus any other staff or Ciry
employee's use of email. She indicated that the privacy policies and
the Public Record policies would apply equally to Council.
Councilman Buckiey noted that the policy stated, "any electronic mail
can be recovered", and could be looked at by staff without any
particular reason. City Attorney Leibold stated that the purpose of
allowing staff to exarnine the email is to assure that it was not being
used for private or commercial purposes. She explained that if
Couucil emaiis were established, there would not be a provision for a
different policy to apply. City Manager Watenpaugh indicated that
the policy could not be implemented, until each individual was
presented with the policy, reviewed the policy and signed off on the
policy. He explained that there was no privacy and staff could not
begin to read emails until a policy was adopted. He further expiained
that the policy had been presented to staff and they signed that they
had received it and they would ha~e to sign that they understood it.
He indicated that the same would be done with Council. Mayor
Kelley indicated that it was the same in the School District. She noted
that when it was a public entity, staff should not expect privacy.

PUBLIC COMMENTS
Donna Morin, President of the Lake Elsinore Historic Society, announced
that the Lake Elsinore Historic Society would be presenting their Christtnas
Home Tour on December 8, 2001, 10:00 a.m. to 3:00 p.m. She noted that
the presale tickets would be $8A0 and tickets the day of the tour would be
$10.00 and would be available at the Lake Elsinore Historic Museum and
the Coilectars CorraL She noted that following the tour there woould be
refreshments served at the Museum. She indicated that for further
information to contact Ruth Attkins at s678-1537.
Bill Tucker, 740 Acacia, stated that there had been a fishing contest
November 17, 2Q01, which awarded $200 in prizes. He thanked all the
sponsors of the contest.
Leroy Tucker, 3532 Cherry Blossom, thanked former Councilman Pape and
former Councilmau Metze for their service to the City and congratulated the
new Councilmen. He asked that the new Councilmembers work in harmony
with the sitting Councilmembers and the sitting Councilmembers to work in

harmony with the new Councilmembers. He noted the amount of work that
the Ciry was facing. He indicated that the Council needed a lot of help and
support. He encouraged the citizens of the community to be invoived.
George Alongi, Representative of the Elsinore Valley Municipal Water
District No. II, noted his respect for Mayor Pro Tem Schiffner and his action
this evening regarding passing the gaeel. He congratulated the two new
members of Council and e~cpressed his hope that it would create a more
harmonious environment between the two agencies in regard to negotrations
on the Lake. He noted that he was a Pit Bull and he wouid not let the issue
go and felt that the City and EVMWD could set problems aside and put
something together for the community. He indicated that he wore his City
pin on a11 his suits and stated his pride in being a citizen of the City. He
stated that he was proud to be a member of EVMWD and he was proud to
ha~e been a member of the Ciry Council.
Sonja Wiison, 30402 Jernigan Street, congratulated the new members of
Council and noted a"job weil done" by the former Councilmembers. She
thanked Public Works far a beautiful job that they did in the a11ey behind her
home. She noted that there was tree debris left behind and when she called
Public Warks they promised to come and clean up the debris and did. She
noted that the a11ey was cleaner than she had ever seen it and wanted to
commend the employees of Public Works for all that they did. She
expressed her excitement in regard to the upcoming trip to Sacramento that
she and Councilwoman Brinley woutd be making. She explained that she
and Councilwoman Brinley would be doing a presentation for the California
Community Collaborative Partnership Distinguished Award. She stated that
she was very proud to be with Chief Walsh, with Councilwoman Brinley,
Community Services Director Sapp and two other School Board Members.
Chris Hyland, 15171 Wa~ecrest Drive, congratulated Councilman Hickman
and Councilman Buckley. She stated that she hoped that she did not have to
wear the shirt that said, "I told you so". She thanked the people that
supported and voted for her in the November 6~' Election. She stated that

she would be changing her focus. She indicated that she would continue to
participate on the Reclaimed Water Task Force, Lake Elsinore A~vanced
Pump Storage Ad~isory Committee, Friends of the Library, the Historical
Society and other worthwhile committees she would be asked to serve on.
She stated that she would wark diligently to find solutions to the water
quality issues that plague our community. She fiuther stated that it was time
for her to r~focus her energies to where her hard work was appreciated. She
firmly stated that there would be no more information to anyone from Chris
Hyiand for the purpose of promoting their political agenda. She noted that
to enfarce her position she will only speak froin legal documents abtained
from many legal sources ar countless hours of research, which led her to
believe that she had been called negative by a vocal minority that show up at
election time. She assured the public that her collection of fact revealing
documents and videotapes of 15 years will not end up in the dead tlle. She
stated that she intended to follow through and pursue justice by revealing
any corrupt or unethical practices contained in the documents. She
commented that the City has faltered and run itself into sawdust and needed
solutions, not excuses. She stated that she was sorry that she couid not take
action as the peoples Councilperson.
Ace Vallejos, 15231 Cobre Street, noted that in a past election there was a
person that ran for City Council that used the slogan "the lake stupid" and he
felt that it was still a probiein. He noted the issues between EVMWD and
the City. He noted the requirements of Title 22 and the evaporation of the
Lake. He stated that he felt that it was tune for someone to start doing away
with silly lawsuits and start taking care of the Lake.
C1TY MANAGER COMMENTS
1. Noted that he would be brn7ging back the contract for Molendyk and
Associ~tes on the next Agenda as Councilman Buckley had requested.

2. Asked Councilman Buckley to coordinate a meeting with the City
Manager's Of~ce to discuss email addresses. He noted that the
previous Council was not interested in email addresses; therefore it
was not included in the Web Page.
3. Stated his excitement regarding the number of developments that were
moving forward as well as the number of hornes that were selling on
the north and west end of the Lake. He noted that there were a
number of developers that were getting ready to start building, since it
would boost economic development and create new jobs.
4. Expressed his appreciation and thanks to former Councilmembers
Metze and Pape far their years of dedicated service to the City. He
noted how difficult it was to try to make everyone happy. He
commented on the sacrifices that the families of the Council have to
make and thanked them.
5. Congratulated Councilman Hickman and Counciiman Buckley and
guaranteed that they would not always agree, hawever the if majority
gave direction it would be followed up as long as it was legal and not
unethical. He stated his appreciation for the time it took to run for
office and hoped that they ga~e consideration to the time it would
require that would take away from their families. He stated that he
would do his best to keep them at home.
6. Cautioned that there would be very few 8:30 p.m. to 9:00 p.m.
Agendas. He noted the amount of issues that wouid be brought
fonvard in the future and expiained that they should plan on 11:00
p.m. to 12:00 p.m.
7. Stated that he had no comment on the lawsuit regarding water.
8. Noted that there was a Study Session scheduled for December 4, 2001
to address CDBG, however it appeared that the Study Session would
be rescheduled to sometime in January. He stated that he would like

to schedule a Special Ciry Council Meeting to address Closed Session.
He indicated that an Agenda would be provided and would be held
from 3:30 p.m. to 5:30 p.m. He noted that the item to be heard on
Closed Session was critical.
CTTY ATTORNEY COMMENTS
Stated that it had heen a real pleasure and honor to serve with
Councilman Pape and Councilman Metze. She further stated that she
had been impressed with their dedication and hard work.
2. Congratulated and Welcomed Councilman Hickman and Councilman
Buckley and looked forward to working with them.
CITY COUNCIL COMIVIENTS
Councilrnan Buckley commented on the following:
Thanked Councilman Ivletze and Councilman Pape for their service to
the City.
2. Thanked the people that warked on his campaign. He commented that
he would not be a Councilman today without their help.
Commented ihat he did not want to see Mrs. Hyland 'ui her "I told you
so" shirt.
4. Cornmented that he felt that the people of the City of Lake Elsinore
chose change, that was their charge and that was his promise. He
stated that it would be a positive change.
Councilman Hickrnan commented on the foitowing:
Thanked the outgoing Councilmembers and commented that they had
done a good job.

4. Thanked all the people that worked on his campaign, as weli as his
wife and son. He thanked the candidates who ran in the November 6`~'
Election because they gave their time and made sacrifices for the
election. He promised to work hard in the next four years and never
degrade or izu~niliate anyone wno came before Council. He indicated
that if a rnember of the public had a City problem, to cail him and that
he was listed in the phone book.
5. Noted that the State of California has an$& to $11 billion dollar short
fall in their revenue and commented that in the last 3tudy Session it
was mentioned that the City could loose il~eir Vehicle License Fee,
which amounts to approlcimately $1.7 million dollars. He asked that a
new budget be created to show a loss of income of $ i 2 millian
dollars, without cutting into City reserves.
6. Noted that the Theater Complex has RDA funds invested in it and
asked that the grass be cut and the trash removed. He noted that it
was an entrance into ihe City of Lake Elsinore and it affected thE
pereeption of the Eity.
7. StaYed that he woutd appreciate it if the City 1vlanager's Office
contacted the local markets to retrieve tiheir shopping carts. He noted
the following locations:

He stated that he had no idea about the other side of the City, however
he was sure that the same problem existed there. He stated that it was
everyone's responsibility and the Ciry belonged to the citizens and
they should inform the manager of a market that there was a discarded
shopping cart and that they needed to pick it up.
8. Noted that there was a big tree that fell over in Tuscany Hills and the
residents got out and cut it up along with John Unsworth from Public
Works. He thanked Mr. Unsworth for his help and wanted him to
know that it was appreciated.
9. Thanked everyone for their support and stated that he would work
hard for the community.
Mayor Pro Tem Schiffner commented on the following:
1. Commented on the past Councilmembers and stated that he hoped that
they woutd continue to be friends.
2. Congratulated ihe new Councilmen. He stated that l~e hoped that
they would be able to work together anci get things done.
3. Commented on the support that he had regarding the position of
Mayar. He stated that the programs he supported and the ideas that he
had would not be any different. He noted that any of the things tliat
he would help to move ahead wouid continue the same way. He
hoped that he had not disappointed anyone.

Counsilwoman Brinley commented on the following:
1. Stated that former Councilman Pape and Cbuncilman 1Vletze have
done a good joB. She commented tliat they were truly appreciated"and
the community appreciated them.
2. Congratulated the new Councilmembers and looked forward to
working together in a forward motion with a positive attitude.
3. Commented that she was excited about the trip to Sacramento with
Sonja Wilson. She stated that it was an honor to be invited to the
State Conference and recognized for the community efforts through
CAP. She noted the strong alliance that had developed between the
School District and the City.
Mayor Kelley commented on the following:
1. Announced the Open Air Market, Sunday, December 2°d, Downtown
Main Street from 9:00 a.m. to 3:00 p.m.
2. Announced 2001 Winterfest, Friday, December 7'~', Downtown Main
Street from 5:00 p.m. to 9:00 p.m.

purchased at the Community Center.
5. Noted that in the Press Enterprise Reader's Choice the Lake Elsinore
Diamond was voted the best and the most fa~orite Ba11 Field by the
Press Enterprise readers.

6. Congr~tulated the new Councilmembers. She noted that they had
done a good job and had the support of the community; therefore they
had a very serious charge to carry out. She encouraged them to get

7. Thanked the former Councilmemhers for the opportunity to work with
them for the last 6 years. She noted that they were always well
prepared and took their job seriousty. She stated that she would miss
them both very mucli.
8. Thanked the City Council for their vote of support on her position of
Mayor, as we11 as the appointment of the other officers. She stated
that she felt that Council would work together.
9. Invited the audience to share cake and punch.
