CLOSED SESSION A. CONFERENCE WITH LEGAL COUNSEL--EXISTING LITIGATION (Subdivision (a) of Gov't Code §54956.9) City of Lake Elsinore v. Elsinore Valley Municipal Water District (Riverside Superior Court Case # 35961) (F:52.2) City Attorney Leibold announced the Closed Session discussion as listed above. THE REGULAR CITY COUNCIL MEETING WAS RECESSED TO CLOSED SESSION AT 5:08 P.M. PAGE TWO - CITY COUNCIL MINUTES - OCTOBER 23, 2001 The City Council Closed Session discussion ended at 6:40 p.m. RECONVENE PUBLIC SESSION (7:00 p.m.~ Mayor Schiffner reconvened the City Council Meeting in Public Session at 7:02 p.m. PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Webelos Scout Pack 99. INVOCATION The Invocation was provided by City Treasurer Ferro. Mayor Schiffner noted an oversight in introducing Mr. Ferro at the recent Mayor's State of the City Breakfast, and introduced him. He also noted that he was unable to introduce Fire Chief Gallegos and introduced him to the public. Horton, City Treasurer Ferro and City CIerWHuman Resources Director Kasad. .~ PAGE THREE - CITY COUNCIL MINUTES - OCTOBER 23, 2001 PRESENTATIONS A. Proclamation - Ea,gle Scout Nicholas A. Romero. (F:56.1) Councilwoman Kelley indicated it was a personal honor to make this presentation, as Nicholas Romero was one of her former student. Councilwoman Kelley called Nicholas Romero, his parents and his brothers to the podium for presentation. She read and presented the Proclamation to Nicholas. Nicholas thanked Lake Operations Manager Kilroy for his help with the project and thanked his parents for their support. Nicholas's father Mr. Romero encouraged participation in scouting and pursuit of the Eagle Scout designation. B. Presentation - Certificates of Recognition - Watershed Trash Clean-u~. (F:56.1) Mayor Schiffner adyised that he would be presenting Certificates of Recognition to one Boy Scout Troop and two Cub Scout Troops, to honor their involvement in the 7'i' Annual Santa Margarita Watershed Clean-up. He advised that they had removed trash and debris from a variety of locations, totaling sixty tons. He detailed the ages of the Troops and the schools they attended. He commended Boy Scout Troop 99, Cub Scout Pack 30 and Cub Scout Pack 332 for their efforts on this program. Mayor Schiffner presented a Certificate to Troop 99. Their representative thanked the Council for this recognition and detailed the types of debris collected such as 1/2 a volkswagon, refrigerators, couches, etc.; and indicated that this was the type of thing they liked to do for their community. Mayor Schiffner presented a Certificate to Troop 30. PAGE FOUR - CITY COUNCIL MINUTES - OCTOBER 23, 2001 Mayor Schiffner presented a Certificate to Troop 332. Their representative indicated that it was an honor to be at the meeting, and noted that some might find it embarrassing to pick up other peoples' trash, but they had fun. PUBLIC COMMENTS - AGENDIZED ITEMS None Requested. CONSENT CALENDAR ITEMS MOVED BY PAPE, SECONDED BY BRINLEY AND CARRIED BY UNANIMOUS VOTE TO APPROVE THE CONSENT CALENDAR AS PRESENTED. Planning Commission Meeting - October 3, 2001. (F:603) 2. Ratified Warrant List for October 15, 2001. (F:12.3) 3. Rejected and referred to Claims Administrator for handling, the Claims Against the City submitted by John Butera (CL #2001-31) & Shannon Morrison/Browne (CL #2001-32). (F:52.2) 4. Approved Communication Site Lease Agreement with Verizon Wireless and authorized the Mayor to sign. (F:68.1)(X:170.7) PAGE FIVE - CITY COUNCIL MINUTES - OCTOBER 23, 2001 PUBLIC HEARING 21. Public Hearing on 2001 Local Law Enforcement Block Grrant Pro~ram Award. (F:84.8) Mayor Schiffner opened the public hearing at 7:20 p.m.. City Manager Watenpaugh explained that this item was a requirement for the grant program, and noted that the request was for $66,260, with a required local match of $7,362. He indicated that the funds would supplement the Police Departments' overtime budget. Police Lt. Horton explained that it was a federal grant to supplement the department for special programs, such as Central Business District Patrol, Traffic Enforcement, City Enhancement & Safety, Off-Road Vehicle Enforcement and Holiday Enforcement. Mayor Schiffner asked those persons interested in this item to speak. There were no public comments on this item. Councilman Metze commented that it was a small investment by the City to assist with good programs and he had no problem with the approval. Mayor Pro Tem Brinley concurred that it was a good thing, as it would assist the Police Department to continue doing a great job. She indicated that she was in support of the item. Councilman Pape commented that the City was aggressive in obtaining all grant moneys possible, particularly when it could increase public safety. He noted the programs it would fund and expressed support. Councilwoman Kelley concurred with support of this item. BUSINESS ITEMS 31. Second Readin~ - Ordinance No. 1078 - Flood Dama~e Prevention Ordinance. (F:81.1) City Manager Watenpaugh noted that this was an update and revision of the existing ordinance to ensure compliance with State and FEMA requirements. THE CTTY COUNCIL MEETING RECONVENED AT 7:30 P.M. PUBLIC COMMENTS - NON-AGENDIZED ITEMS Martin Ayala, American Red Cross Riverside County Chapter, provided a summary of the assistance the American Red Cross offered to the families of the victims in the New York City terrorist attack. He was a volunteer in Service Center 1 at Ground Zero. Dean Pattermann, Diamond Drive Golf Center, expressed the need for the American Red Cross. He announced that on November 16`" at Eagle Glen Golf Center in Corona there would be a fundraiser for the Riverside County Chapter of the American Red Cross, which assisted families in Riverside County who lost, loved ones in the September 11`~' tragedy. He gave a description of the various donations and prizes offered for the event. Chris Hyland, 15191 Wavecrest Drive, indicated that she came forward to offer solutions to the problems in the City. She stated that she would support selection of Council by districts. She noted that, if elected she would make a motion to stop all Capital Projects and expenditures until a balanced budget could be developed. She gave a brief overview of her proposed actions if she was elected to City Council. PAGE EIGHT - CTTY COUNCIL MINUTES - OCTOBER 23, 2001 Pete Dawson, LEMSAR, presented the Lake Elsinore Marine report for September 2001. He noted that to date, the Search and Rescue team had logged over 7000 hours of service and expected to end the year with 10,000 total hours of service to the community. He gave an overview of the services provided last month and the dangers of boating in the autumn months. Ranulfo "Abe" Padilla, 21062 Kimberly Court, addressed the distance between his residence and the neighboring property as 58 inches instead of 60 inches. He expressed concern over the City inspectors approving the lot size. He questioned the reason the inspector approved the lot and why that the City did not protect him from this situation. He indicated that he was not able to utilize his entire lot because the remainder of the land was protected for the bird. He indicated that the residents were upset about the lack of action from the City and Grranite Homes. Mayor Schiffner indicated that he would like to know the answers to Mr. Padilla's concerns and that staff would investigate them. Barbara Ward, 751 Sesame St., Chula Vista, stated that she owned the property located at 30300 Hirsch St. She gave an overview of the improvements made to the property and the house and indicated that due to an illegal addition made to the house by the previous owner, the City stopped her from any construction. She stated that there was no construction being done to the house, and she paid the fines incurred for permits and new construction. Mrs. Ward met with the City over the room addition and the permits. After coming to the conclusion that the room had not been permitted, she stated that she wanted to bring it to code, however she needed more time. She indicated that if the house had so many permit problems, the City should have addressed them prior to her purchasing the property. She expressed concerned about the accruing fines and her inability to pay. She requested that Council address this issue. Mayor Schiffner stated that staff would be contacting her in order to resolve the matter. Phillip Sanders, Castellina homeowner, stated that he was concerned about Granite Homes failure to build the fence around the rear of his property. He indicated that Granite Homes used the area to the rear of his and his neighbor's PAGE NINE - CITY COiTNCIL MINUTES - OCTOBER 23, 2001 property to dump their broken concrete and waste. He requested that Council address this issue. Bill Dixon, 21067 Kimberly Court, stated that he was a Granite Home owner and addressed the fact that the rear fence did not surround his entire lot, he indicated that the exposed area was used by Granite Homes as a dumpsite and a potential liability for himself and the neighboring properties. Daryl Hickman, 19 Corte Madera, stated that he was running for City Council, and addressed the lake level. He gave a brief overview of the lawsuit between the City and EVMWD and explained the process of releasing water from Canyon Lake into Lake Elsinore. He questioned why Council preferred potable drinking water, as opposed to recycled water to fill the lake. He indicated that EVMWD was installing filters that would be working in March, 2002; and asked the people to vote on November 6`~. Thomas Buckley, 106 S. Lowell, indicated that the residents he had spoken to throughout his campaign wanted to put the City on a new path of accountability and respectability. He stated that the residents wanted the leadership in the City to change and it would change on November 6`". He detailed his proposed actions if elected to City Council and asked the citizens for their support. Paul Van Duzee, 21058 Kimberly Court, stated that he was a Granite Home owner and that five of the homes on his street had land dedicated to the gnat-catcher bird. He described the debris left on the land by Granite Homes. He stated the he observed the men sent by Granite Homes to clean up the debris but they were ineffective. He described the retaining, and erosion problem, and the effects they would have on the neighborhood now and in the future. He thanked the Council for looking into those problems and advising the Kimberly Court residents as to how to deal with them. Mayor Schiffner directed staff to investigate the situation. Chris McColley, Executive Director, Chamber of Commerce, 132 W. Graham Ave., announced that the Mini Grand Prix was scheduled for Saturday, October PAGE TEN - CITY COUNCIL MINUTES - OCTOBER 23, 2001 27"'. She stated that a portion of the donations from the event would be sent to the American Red Cross. She gave a brief description of the races and activities. She thanked Councilwoman Brinley and City staff for the City's participation in the event. She thanked all of the sponsors of the event and stressed how important it was for the community. Bill Tucker, 740 Acacia Ave., announced Safe Candy Night on Main Street for Halloween. He stated that a fishing tournament was approaching in the coming months. He commended the graffiti removal staff far a job well done. Donald Foster, 29256 North Pointe St., congratulated the scouts for their presentation and expressed his support of scouting. He stated his support for the current City Council and candidate David Cheney and his opposition to the remaining candidates. He thanked City staff and Council for the new landscaping at Lakeshore and Grand Ave. CITY MANAGER COMMENTS City Manager Watenpaugh commented on the following: 1) Stated that the City won the lawsuit between the City and EVMWD. He explained that the issue was more than just a few inches of water this year, but rather the last ten years and the ne~ several years of water for the lake from the reservoir built for agricultural purposes. He indicated that more details would be provided once the court order was signed. 2) Expressed his appreciation to Pete Dawson far the LEMSAR report. 3) Acknowledged the concerns of the Granite Homes residents and the habitat. He stated that those concerns would be addressed and those residents would be contacted by staf£ He indicated that Granite Homes would clean up the debris and hydro-seed the property as the habitat is in PAGE ELEVEN - CTTY COUNCIL MINUTES - OCTOBER 23, 2001 another nearby location. He stated that he would meet with staff regarding the spacing issues. 4) Explained that the City supported recycled water and the Recycled Water Task Force, however water with a high phosphorus count could not be added to the lake because of habitat issues. He explained the federal nutrient requirements for the lake, noting it was a federal requirement that the water used was not recycled water. He detailed the higher standards of testing and monitoring of runoff by the Regional Water Quality Board. He gave a summary of the Tilley Agreement which allowed Lake Elsinore to receive water from the San Jacinto River, and also allowed the dam to be built in Canyon Lake. He provided information as to the details involved with adding water to the lake during the winter or summer months. 5) Noted his disagreement with the comments from candidate Tom Buckley who accused the City Council and staff of being dishonest, unaccountable and unfair. He stated that the issues of the City had been faced by the City Council and staff directly and he challenged the candidate to pay off debts with an empty pocketbook. He challenged Mr. Buckley's ability to fulfill his campaign promises. 6) Indicated that the graffiti removal was an ongoing issue and the WeTip Program offered rewards to kids who were willing to turn in the taggers. 7) Congratulated Nicholas Romero and his parents for his achievement of Eagle Scout. CITY ATTORNEY COMMENTS City Attorney Leibold commented on the following: PAGE TWELVE - CITY COUNCIL MINUTES - OCTOBER 23, 2001 1) Announced the Closed Session as listed on the Agenda, noting that there was no reportable action. 2) Expressed the willingness of the City staff to assist residents with the issues concerning Granite Homes. 3) With regard to the lawsuit, City Attorney Leibold stated that she would summarize the causes of action and review the proceedings to date. She stated that the judge ruled in the City's favor and issued a preliminary injunction in favor of the City mandating the release of 1500 acre feet of water into Lake Elsinore immediately. 4) Addressed the negative connotation presented by Chris Hyland regarding attorneys in the City of Lake Elsinore and expressed her disagreement with the remark. She indicated that the Council and staff for the City of Lake Elsinore was dedicated and devoted to solving the problems and addressing local issues in support of their City. COMMITTEE REPORTS None. CITY COUNCIL COMMENTS Councilman Metze commented on the following: 1) Invited the public to attend the Terra Cotta Middle School production of Bye Bye Birdie. 2) Noted that the Scouts were always a pleasure to have present colors at Council meetings and he would like it if they attended every Council meeting. PAGE THIRTEEN - CITY COUNCIL MINUTES - OCTOBER 23, 2001 3) Noted that if the City Council were elected by districts, the Granite Home owners would only have the ear of one Councilperson rather than the entire City Council. He noted that the voters of the City currently had the opportunity to vote on every vacant Council position but if the City were divided into districts, their votes would only fill one position instead of all vacancies. He indicated that without a majarity vote on an issue, nothing could be accomplished and the situation would be that of competition between districts, instead of unity for the greater good of the City. He indicated that districts were not the answer for this City. 4) Explained that funds far capital projects were allocated only to capital projects and it was illegal to use those funds to balance the budget or for any other purpose. 5) Addressed the lawsuit between the City and EVMWD and clarified that EVMWD was found in violation of their license, the Tilley Agreement, the Fill and Operate Agreement; and they did not dispute those facts. He explained what the water in Canyon Lake could be used for and the limits the community was facing with regard to the availability of water. 6) Noted the possibility of a citizens Board with regard to the Diamond Stadium and indicated that a citizens Board would not be as effective as the professional consultants providing solutions to the issues surrounding the Stadium. He further noted that the City was currently renegotiating issues that would help the situation. 7) Addressed the suggestion from candidates Buckley, Hickman and Hyland regarding their support of the use of reclaimed water to fill the Lake. He gave an overview of the condition of reclaimed water and the negative effects it would have on the Lake. PAGE FOURTEEN - CITY COUNCIL MINUTES - OCTOBER 23, 2001 Mayor Pro Tem Brinley commented on the following: 1) Stated that the City Manager would look into the problems experienced by the Granite Home owners, and resolve the situation. 2) Addressed the derogatory comments from candidates regarding developers and gave a summary of all of the donations they give to community organizations. 3) Stressed the goodness and generosity of the businesses in the community. 4) Stated that a Councilperson's first obligation is to the community and meeting the needs of the community. 5) Noted that the lawsuit was about water rights and the need for Lake Elsinore to defend their water rights. She explained the differences between the contracts in question and the violations the Water District had committed. She addressed the comments made by the candidates about the value of the lake and the water issues. 6) Noted that through the years Council had worked on the budget and the RDA was in the black, however the press neglected to report it properly. She stated that the press focused on the negative as opposed to the positive accomplishments of the Council. She noted that through hard work and a team effort, they came together with the City's best interests in mind to address difficult issues. 7) Asked the voters of the City to vote for the candidate who would be a positive asset to the community. Councilman Kevin Pape commented on the following: PAGE FIFTEEN - CITY COiTNCIL MINUTES - OCTOBER 23, 2001 1) Addressed the Granite Home owners and noted that he had been in their neighborhood discussing their concerns. He indicated that the City Council and staff would work to resolve their issues. 2) Announced that the sales tax revenue report was up by 2.7% for the last quarter. 3) Stated that auto sales were increasing and noted the positive effects. 4) Stated that the purpose of City Council meetings was to conduct City business and the political aspect of it should be conducted at another place and time. 5) Suggested that EVMWD was misleading in regard to reclaimed water issues. He indicated that they did not provide the details and effects of reclaimed water in a lake. He gave a brief overview of the agreements and the order of the court for EVMWD to abide by those agreements. Noted that when the Water District released the water into the lake, water rates would likely increase. He detailed the process EVMWD used to justify rate increases as opposed to their actual cost to release the required water supply into the lake. Councilwoman Kelley commented on the following: 1) Noted that many of the public comments lacked true facts and magnified the importance of the voter to do proper research prior to voting in order to understand the issues and the platforms of the different candidates. 2) Announced the Historical Society Melodrama "Her Fatal Beauty" on Friday November 16~' at 7:00 p.m., Saturday November 17`h at 2:00 p.m. and 7:00 p.m. at the Elsinore Women's Club and she noted the address, cost of admission and contact information. PAGE SIXTEEN - CITY COUNCIL MINiTTES - OCTOBER 23, 2001 3) Congratulated Nicholas Romero on his achievement of Eagle Scout and noted the work involved in the Osprey Nesting Platform. 4) Addressed the Granite Home owners and reiterated that if Council were elected in districts, only one Councilmember would be concerned with their situation as opposed to all five members listening. She requested that the City Manager meet with them and resolve their issues. Mayor Schiffner commented on the following: 1) Addressed the Granite Home owners and assured them that they had come to the right place to express their issues and hoped that they would be satisfied with the assistance staff provided. 2) Noted the past elections he participated in and those results. He also stated that he was not currently running far re-election, however he was looking forward to working with whomever was elected. 3) He addressed the comments made by Candidate Daryl Hickman and stated that the only factual phrase in his comments was "I don't know." He wished him luck in the upcoming election. 4) Announced the Chamber Mixer at Coco's Restaurant on October 25`~' at 530 and encouraged attendance. 5) Announced the Mini Grand Prix on Saturday, October 27`h from 9a.m. to 4 p.m. 6) Announced Cruise Night on October 27'~' from 4 p.m. to 9 p.m. and noted the nice cars involved in that event. 7) Announced Safe Candy Night on October 315t from 5 p.m. to 8 p.m. on Main Street and noted that the businesses would stay open late to PAGE SEVENTEEN - CITY COUNCIL MINUTES - OCTOBER 23, 2001 participate including City Hall. He invited all parents and children to come to enjoy the evening and the festivities. He noted that Main Street would be closed to traffic to ensure safety. 8) Announced the Household Hazardous Waste Collection on November 3`d at the City Yard on Langstaff and encouraged the public to utilize the service. 9) Announced the Open Air Market on November 4`h from 8 a.m. to 3 p.m. on Main Street. 10) Announced the Fall Art Show on November 4`~' in the afternoon. 11) Announced the 28~' Year CDBG Program and noted that the City had applications available for the 2002/2003 CDBG Program. Noted the Citizen Participation meeting scheduled for Monday, November Sth at the Cultural Center and noted that the application deadline was Monday November 26'~'. He referred any questions to the Community Services Department. City Attorney Leibold gave an overview of the negotiations the City was involved in with EVMWD, in order to comply with the agreements relating to Lake Elsinore water quality and water level maintenance. She noted that the negotiations were not successful, therefore the City filed a lawsuit in June of 2001. She explained the issuance of a preliminary injunction which resulted in an order to immediately release water into the lake or else the lake would suffer irreparable harm. She noted that the City drafted the formal order anci submitted it to the EVMWD attorneys who had provided commenYs, and all documentation had been submitted to the court and a formal ordez was anticipated. She reviewed the individual agreements involved in detail and how they affected the lake elevation. She noted the admission of EVMWD's violation and their failure to comply with the agreements. She noted all of the judge's findings in the lawsuit and ordered EVMWD to release 1500 acre-feet PAGE EIGHTEEN - CITY COUNCIL MINUTES - OCTOBER 23, 2001 of water, and explained how they came to that amount of water. She addressed the issues involved with using reclaimed water and indicated that was not yet considered a solution for low water levels and water quality because it was not clean enough to put into the lake. She stated that the Fill and Operate Agreement required EVMWD to maintain the lake level of 1240 feet. She stated that EVMWD requested the City's assistance in obtaining an emergency permit for reclaimed water, however they did not explain the purpose of the permit or the quality of the water. She stated that the City could not agree to something that was not defined. She asked for the community's support for the lake and noted that the City was looking forward to working with EVMWD to find a comprehensive, long term solution that would benefit all of the public agencies, businesses and residents and guarantee a healthy, stable lake. Mayor Schiffner referred any further questions to the City Manager and the City Attorney during City business hours. DISCUSSION Aeenda Review ~F:44.1) Councilwoman Kelley addressed Item No. 31, regarding the Declaration of Surplus Property for the former Fire Station site located at Terra Cotta Street and Lincoln Avenue and asked for an overview of the item. Assistant City Manager Best stated that since the Fire Station is being built at McVicker Park it was staff's perspective that the City no longer needed the parcel. She indicated that it was zoned Single PAGE TWO - JOINT STUDY SESSION - NOVEMBER 13, 2001 Family Residential, which was consistent with neighboring uses. She indicated that it would benefit the City to return the parcel to the tax rolls. Councilwoman Kelley asked if the parcel had been appraised. Community Development Director Brady stated that it had not. Mayor Schiffner noted that there had been some interest in the parcel by an outside source. Councilwoman Kelley asked what use was proposed for the parcel. Community Development Director Brady stated that six houses were proposed far the parcel. Councilwoman Kelley asked about the price of the property. Assistant City Manager Best eaplained that the property was paid for by the CFD and the amount that would be realized by the sale of the property would be less than the original cost. There was discussion regarding the park that would be developed by 888 Development. Assistant City Manager Best explained that the property must be declared surplus prior to an appraisal and then there would have to be several legal steps taken prior to the possible sale of the property. Mayor Schiffner stated that the configuration of the property would create a challenge for development and he felt that it would be to the benefit of the City to declare the property surplus. CITY MANAGER COMMENTS Assistant City Manager Best indicated that she would distribute a memorandum by Community Development Director Brady that addresses some of the public concerns regarding Forecast Homes and the concerns of Barbara Ward.
