CALL TO ORDER
Mayor Schiffner called the City Council Study Session to order at 3:21 p.m.

DISCUSSION ITEM
Fiscal year 2001-2002 Capital Projects. (F30.2)
City Manager Watenpaugh indicated that this Study Session was in
response to Council's request that staff present the list of Capital
Projects for review. He explained that the staff report provided to
Council listed the Capital Projects and their statues.
City Manager. Watenpaugh noted the postponement of the Lake Street
Pavement Rehabilitation due to the Brine Line Project. Community
Development Director Brady stated that the bids would be opened on
May 9, 2001, and the Award of Contract will be placed before
Council at the Meeting of May 22, 2001.
Mayor Schiffner requested clarification that the funds had all been
budgeted for the listed projects. City Manager Watenpaugh
confirmed.

City Manager Watenpaugh indicated the following were on going

Councilman Pape asked if the City was getting cooperation from Cal
Trans regarding the I-15 Diamond Drive Freeway Study. City
Engineer O'Donnell stated that staff had submitted the formal
proposals and explained that it would have to go tl~rough the review
process. Mayor Schiffner clarified that it was all four proposals. City
Engineer O'Donnell confirmed. Councilman Pape asked if there was
a time-line. City Engineer O'Donnell stated that it would take at least
60 days.

Mayor Schiffner asked if the $250,000 for the Mission Trail Right-of-
Way included the property acquisition. City Manager Watenpaugh
stated that it included all the property acquired on the City's behalf.
City Manager Watenpaugh addressed the Outflow Channel
Improvements and indicated that staff anticipated approval from the
State by May 22nd. Councilman Pape asked about the funding for the
project. City Manager Watenpaugh stated that portions of the funding
would be from the Park Fund, the Traffic Safety and from a 221
Grant.
Councilman Pape asked if acquisition of property was necessary for
Traffic Signalization. City Engineer O'Donnell stated that it would
not been necessary to acquire property if Cal Trans approved the plans
as proposed, however if they require the City to install for handicap
improvements, the City would have to acquire property to allow for
the handicap access ramp and pad.
City Manager Watenpaugh addressed the Suirunerhill Drive Bridge
Approach Repair project and asked for a status report. City Engineer
O'Donnell indicated that his department was in the process of getting
a Soils Engineer to investigate the site and there should be more
information in the neat month ar two. City Manager Watenpaugh
clarified that it would be a carryover into next year's budget. City
Engineer O'Donnell agreed.
City Manager Watenpaugh questioned the time line for the bid
opening for the Swick/Matich Parking Lot. Community Development
Director Brady stated that the bid opening would occur on May 16th,
and bids would be taken to Council for Award of Bid on May 22,

Mayor Schiffner clarified that the $6,397,000 was in the current
Capital Improvement budget. City Manager Watenpaugh confirmed
and indicated that the funds for any project that was not complete
would be carried over to neat year's budget.
Councilman Pape asked when the bid would occur for the Grand &
Lakeshore Drive Entry. City Engineer O'Donnell explained that dirt
would have to be moved from the Swick/Matich Parking lot to raise
the elevation prior to bidding the project. Mayor Schiffner clarified
that palm trees would be moved to that site as well. City Engineer
O'Donnell confirmed and explained that it would go out to bid in
June. Mayor Schiffner asked if the money that was budgeted for the
project included the cost of removing and planting the palm trees.
City Manager Watenpaugh stated that he would check on the cost
trees and ascertain if it was included in the budget.

City Manager Watenpaugh presented an overview of the funding
available for 2001-2002. He noted that if a traffic mitigation fee were
imposed, additional funds would be available for improvements.
Councilman Pape asked if the Council imposed a City Wide Fee,
would it affect the projects that have already been approved. City
Manager Watenpaugh explained that the City could not go back and
assess fees on projects that have already been approved. City
Engineer O'Donnell explained that the fee staff was trying to develop
was only a fee for Capital Improvements and not for maintenance. He
noted that if a development had a DDA, Development Agreement or
approved plan they could not be charged retroactively. He noted that
all of the Specific Plans do not have approved maps. City Attorney
Leibold stated that all the Development Agreements she had reviewed
contained provisions that vested the rights of the Developer to build a
project and should they have an approved plan they would be exempt.
Mayor Schiffner stated that it would behoove the City to move of a
TUMF Fee as soon as possible. Councilwoman Kelley stated that she
would like to see a breakdown of cost on infrastructure done at the
City level versus what it would cost to be a part of the Regional
program.
Mayor Schiffner asked on which projects staff recommended to spend
the available $1,426,000 in funds.
City Manager Watenpaugh indicated that staff recommended Collier
Ave. rehabilitation between SR 74 & Chaney Street; Grand Ave.
rehabilitation between Lake Street and Lincoln; and Lincoln
rehabilitation between Machado St. and Terra Cotta. He suggested
that the three projects be funded for $400,000 each and presented an
overview of the three proposed projects. He indicated the three
projects were recommended by Traffic and Engineering, because
without this work the City stands to loose those roadways. Mayor
Schiffner stated that he respected the recommendations of staff,
however there was one project that was carried from last year and was
a roadway that he considered the worst in the City, and that was
Stickland. He stated that he would like to see something done with
that roadway. He asked if staff could find the money in Capital
Improvements to address Strickland. City Manager Watenpaugh
stated that if Council wished to have Strickland addressed, staff would
find a way to fund the improvements. Mayor Pro Tem Brinley stated
that Strickland Ave. was used as an alternate route should Riverside
Drive or Chaney be closed, and improvements to that roadway would
be of benefit to the City. She stated that she would like to see
attention given to Collier as well. Councilman Pape asked if an
accurate traffic count had been done on Collier and on Machado. He
stated that Machado had a lot of traffic and the road was in poor
shape. City Engineer O'Donnell stated that the first seven listed were
all in need of immediate repair, however the three selected were the
warst. Councilman Pape asked if there were any industrial complexes

planned that would be conditioned to put curb and gutter in at Collier
and Highway 74. Community Development Director Brady stated
that at this time there was nothing planned for that area. Mayor
Schiffner stated that there was no question that there were a lot of
streets that needed work, however the City had only so much money
and the Engineer had reviewed all of the roads and made the
recommendations based on immediate need. He stated that he had no
reason to disagree, except if there was money left, he would like to
see Strickland Avenue addressed. Councilwoman Kelley noted the
area that washes out in front of Vista Donuts. City Engineer
O'Donnell stated that the Engineering Department had inspected that
area and it was decided that the drainage would have to be addressed
prior to doing any major road construction. Councilman Pape stated
that if the City were to come into some extra money, he would like to
see Machado addressed. Mayor Schiffner asked if the $400,000
estimates were firm. City Engineer O'Donnell indicated that they
were conservative estimates to make sure there was enough funding to
address the tlu~ee proposed streets, and there might be some funds left
at the completion of the projects. Councilman Pape questioned the
amount of the bids for Lake Street. City Engineer O'Donnell
e~cplained that the project had been delayed and the bids would not be
submitted or opened until May 9th.
City Manager Watenpaugh stated that the Lake Street project would
be before the Council on May 22, 2001.
Chris Hyland, 15191 Wavecrest, questioned the Collier to Highway
74 project and asked if there were plans to place a traffic light in that
location. City Manager Watenpaugh noted that plans had been
submitted to Cal Trans for traffic lights at Highway 74 and Collier and
Collier and Riverside Drive. He e~lained that it would be a City
project, however the City needed approval from Cal Trans prior to
moving forward.
City Manager Watenpaugh noted the possible realignment of
Highway 74.
City Manager Watenpaugh presented an overview of the Park Projects
and suggested that staff move forward with the Skate Park, including
Landscaping of the Park Area.
Councilman Pape addressed the property at Lincoln and Terra Cotta.
He commented that the property had been vacant for the last ten years
and felt that it should be made a priority. City Manager Watenpaugh
indicated that staff had discussions with a developer that has indicated
that they would like to buy the old Fire Station Site and subject to the
funds being spent in the CFD area, it was felt that the money could be
used to develop the proposed property. City Manager Watenpaugh
clarified the location of the park site. Mayor Schiffner asked about

the development of the old Fire Station property. City Manager
Watenpaugh stated that the entire site would be developed.
Councilman Pape stated that he would like to see the Skate Park
developed as soon as possible.
Councilwoman Kelley noted that the Skate Park was very much
needed and there was still communication with the County and
Canyon Lake, however Canyon Lake was more interested in how
many of their youth would use the park. She noted that the park
would be supervised and a fee charged. She indicated that the flier
that was circulated within the City was fizll of incorrect information.
She noted that the flier stated that the Skate Park should have been
located ne~ to the BMX Park, however there has been a lot of
problems in that area and she felt that the location would not haee
been good for the kids. Councilman Pape stated that anyone could
talk about developing a park, however if the money was not a~ailable,
then it was only talk. Mayor Schiffner asked if a private Skate Park
had been presented to the City. Councilwoman Kelley stated that a
concept had been presented to the Planning Department, however the
Planning Department instructed them to bring in something more
specific. She noted that she met with Mr. Buck and he presented the
concept to her, however it was very general and nothing specific had
been offered. She commented that since then, there had been a lot of
problems at the BMX track. Councilman Pape stated that it would
have been better to have private enterprise do the project, however
there was no one legitimately stepping up to do the project. He
commented that the Skate Park would be supervised and controlled.
City Manager Watenpaugh indicated that there had been no formal
presentations made to the City; nor were they planning to comply with
the requirements of the existing planned facility. He further indicated
that there had been previous interest in putting a Skate Board Park in
the old K-Mart building, however it fell through; and it had been the
consensus that private industry was not willing to do the project to the
City's specifications. He noted that a local person with experience
had eapressed interest in being the concessionaire for the Skate Park.
Councilman Pape stated that he felt the flier was a piece of campaign
literature that was trying to misdirect the public. Councilwoman
Kelley stated that there was a lot of support for the Skate Park.
City Manager Watenpaugh stated that there had been a suggestion to
sell some of the lots from the proposed 888 Development park site
and he noted that it was staf~s recommendation to not sell. He
indicated that if the City was able to sell the Old Fire Station site and
lceep the Park fixll size, then use other funding for operations and
maintenance, then there would be no other issues involved. He stated
that they would bring the item back to Council for direction, but he
wanted to keep Council informed.

Mayor Schiffner asked if the BMX track was operating on a
Conditional Use Permit. Community Development Director Brady
stated that staff and the Planning Commission had concerns regarding
the way the BMX track was operating, as well as problems with
access to the site. He indicated that if the problems were not
addressed to comply with the Conditions of Approval, then the City
would have to shut the operation down. He explained that they were
due to apply for their next Conditional Use Permit, and compliance
with the Conditions of Approval would be the main issue. Mayor
Schiffner commented that there had been complaints from people in
the neighborhood regarding different issues.
Councilman Pape suggested that Council wait until Mid-Year Budget
Review before considering Traffic Signal Conversions. He noted that
there was a Bill pending in Sacramento that would allocate some
funds to do Traffic Signal Conversions. He indicated that the City
should wait and see if the Bill passes. Mayor Schiffner asked if there
was a substantial reduction in the energy cost for the lights. City
Manager Watenpaugh stated that it was based on the amount that the
diodes use versus the regular lights. He indicated that approximately
$15,000 a year that would be saved on 12 signals. Public Works
Manager Payne indicated that it would be a 60% savings in energy
costs. Mayor Schiffner commented that it would be worth waiting if
the funding could come from some other source. Councilman Pape
noted that the City would lrnow by July l, 2001, if the State adopts the
budget. Mayor Schiffner asked if it was going to be an issue to wait.
City Manager Watenpaugh stated that the conversion was to be
funded through the Traffic Signals money and the funds would still be
there if the bill is not passed. Mayor Schiffner questioned the Traffic
Signal Fund. City Manager Watenpaugh stated that the Fund was for
Traffic Signals only and could not be used for any other purpose.
Mayor Pro Tem Brinley stated that she felt that the community should
be better educated regarding the mitigated funds and that they could
only be used for the purpose intended and not for other projects. She
noted the amount of misinformation that is given to the public and she
felt that the residents did not understand that there were certain funds
that could not be spent on any other item than what they were
intended for since the use of funds were mandated by the State and the
City had no option.
City Manager Watenpaugh noted the spreadsheet in the Agenda
Report that presented an overview of each project account by account
and the funds available, which could not be transferred. Mayor Pro
Tem Brinley asked that the spreadsheet be attached to the Agendas for
the public the second City Council Meeting of May. City Manager
Watenpaugh stated that they would have the spreadsheet attached to
the Agenda.

PUBLIC COMMENTS
Chris Hyland, 15191 Wavecrest Dr., commented that it was her flier
on the Skate Park and she had done her research. She stated that she
had talked to Sacramento and had talked to Mr. Shipplet. She
indicated that she received a lot of information from Mr. Shipplet
regarding the Skate Park. Councilman Pape stated that the
information was not accurate regarding the Skate Park. Ms. Hyland
disagreed and stated that the people from the State told her that the
$262,000 could also haee been used for development, improvement,
rehabilitation, and restoration that could have been used on the
e~sting parks. She noted that the assessment that the Council was
hoping to levy against the taa~payers was proposed, instead of using
the $262,000 to restore the parks and maintain them. City Manager
Watenpaugh stated that the proposed assessment would be for
operation and maintenance and not for development and restoration of
parks. He further explained that the $262,000 could not be used for
operations and maintenance. He stressed that the dollars that would
be used to develop the Skate Park were capital dollars and could not
be used for operations or maintenance.
