City Attorney announced the Closed Session Items as listed. THE REGULAR CITY COUNCIL MEETING WAS RECESSED TO CLOSED SESSION AT 5:02 P.M. WITH COUNCILMEMBERS BUCKLEY, HICKMAN, SCHIFFNER AND KELLEY IN ATTENDANCE. COUNCILWOMAN BRINELY JOINED THE CLOSED SESSION AT 5:28 P.M. Closed Session was completed at 6:15 p.m. RECONVENE PUBLIC SESSION (7:00 p.m.) PAGE TWO — CITY COUNCIL MINUTES — SEPT. 10, 2002 Mayor Kelley called the Regular City Council Meeting to order in public session at 7:01 p.m. PLEDGE OF ALLEGIANCE Councilman Buckley led the Pledge of Allegiance. INVOCATION Pastor John Kleinpeter representing Vineyard Christian Fellowship provided the Invocation. ROLL CALL PRESENT: COUNCILMEMBERS: BRINLEY, BUCKLEY, HICKMAN, SCHIFFNER, KELLEY ABSENT: COUNCILMEMBERS: NONE Also present were: City Manager Watenpaugh, Assistant City Manager Best, City Attorney Leibold, Administrative Services Director Boone, Community Development Director Brady, Community Services Director Sapp, Information/Communications Manager Dennis, City Engineer O'Donnell, Public Works Manager Payne, City Treasurer Ferro and Deputy City Clerk Paredes. PRESENTATIONS A. Proclamation — Coach Bob Burt, Temescal Canyon High School. (F:122.1) Mayor Kelley read and presented a proclamation to Coach Bob Burt commending him for his 41 years as a football coach. Jeanine Martineau representing the Lake Elsinore Unified District School Board thanked Coach Burt, on behalf of the School Board, for his 6 years of dedication to the Titans of Temescal Canyon High School and his dedication to academics for the players. Harvey Ryan thanked Coach Burt on behalf of the parents and Booster Club for all of his hard work and dedication to the students and their parents. Coach Burt thanked the City Council, School Board, parents and Booster Club for the recognition. B. Proclamation — Recognition of September 1 1'' Anniversary. (F:122.1) PAGE THREE — CITY COUNCIL MINUTES — SEPT. 10, 2002 Mayor Kelley read the proclamation in recognition of the September 11th Anniversary and presented it to Chief Walsh in honor of all Firemen and Policemen that dedicated their lives to service. C. Presentation — ATT Broadband Services Update — Del Heintz. (F:170.5) City Manager Watenpaugh noted that there had been several calls regarding the changes in our area regarding AT &T Broadband Cable Television. He stated that he invited Mr. Heintz to address Council to address the changes taking place and what would be available to the community when AT &T has completed the job. Del Heintz, Director of Local Government Affairs, presented an overview of the changes occurring to local cable television. He presented an overview of the new cabling and the services that would be available. He indicated that there would be a new fee schedule and presented an overview of each service available. Mayor Kelley inquired when all the channels would be available to the City. Mr. Heintz stated that they were powering up 250 homes a day and expected to be done by the last week of September or the first week of October. Councilwoman Brinley questioned the availability of Internet. Mr. Heintz noted that it would be available as soon as the cable was powered up to each home. Councilman Buckley asked if the customer already had a receiver, did they have to do something else to use the system. Mr. Heintz stated that they did not. Mayor Kelley questioned the cost per household. Mr. Heintz stated that the customer could get 53 more channels of digital cable for $1 less than the customer was paying for analogue with a cable box and remote. He noted that in the package was a mail piece and for approximately $3 more per month the customer could receive 115 more channels. Mayor Pro Tem Schiffner questioned the type of service that could be received without a box. Mr. Heintz explained that Basic Service was 26 channels for under $10 per month. He noted that he could provide 26 channels plus another 24 channels for $24.95 including the box and remote control. He stated that they were striving to provide more and better service for the customer. Mayor Pro Tern Schiffner clarified that a control box was required for every television in the house. Mr. Heintz stated that for the full 50 channels they would have to have a box, however it the customer wished to have just one box, the rest of the televisions would receive the original 26 channels. He noted that the service would continue until appointments are made to hook up the digital box. PAGE FOUR — CITY COUNCIL MINUTES — SEPT. 10, 2002 Councilman Buckley asked if the appointments were regular appointments or Cable T.V. appointments. Mr. Heintz stated that they are trying to do two hour appointment windows and that was the best they could do. Mayor Pro Tem Schiffner clarified that the boxes must be rented on a monthly basis. Mr. Heintz confirmed. Mayor Pro Tern Schiffner asked if the boxes could be purchased. Mr. Heintz noted that the FCC had mandated that the customer was able to purchase the box, however the cost was prohibitive. Councilman Buckley asked how much it would cost to rent a box. Mr. Heintz stated that it was $5.05 per month with the remote control. City Treasurer Ferro stated that the quotes from Mr. Heintz and the brochure were two different amounts. He noted that the $24.95 was for basic and not expanded basic; and to receive the same service that he was getting for approximately $35, he would now be paying approximately $40 for the same service because he would have to rent a box. Mr. Heintz stated that it was a fair question, however the service would not work without the box to provide all the proper channels. Councilman Buckley questioned if there would be any changes on the Franchise Agreement. Mr. Heintz noted that the Franchise Agreement would expire in 2005, and they would be negotiating with the City over the next three years to develop the next Franchise Agreement promoting a better relationship with the City and the customer. He noted that their customer base grows approximately 18% a year. D. Presentation — Chamber of Commerce Update. (F:108.4) Chris McColley, Executive Director of the Lake Elsinore Valley Chamber of Commerce and announced the following: 1. Congratulated Transwestern Publishing Media America as August Business of the Month. 2. Congratulated Lake Chevrolet as September Business of the Month. 3. Thanked the City of Lake Elsinore for participating in the 5`h Annual EDC Luncheon. 4. Thanked Marlene Best and Mark Dennis for sitting on the EDC Committee. 5. Thanked Councilman Hickman for his efforts as the City Liaison to the Chamber of Commerce. 6. Noted the postponement of the Business Expo. 7. PAGE FIVE — CITY COUNCIL MINUTES — SEPT. 10, 2002 8. Announced the Student of the Month luncheon to be held at the Sizzler Restaurant on Tuesday, September 24th at 12:00 p.m. 9. Announced that the next Business Mixer will be held Thursday, September 26`", from 5:30 p.m. to 7:30 p.m. at Rancho Physical Therapy, located at 32225 Mission Trail. 10. Announced the EDC Luncheon on Thursday, October 10th at 11:30 a.m. at the Diamond Club. 11. Announced the 7th Annual Mini Grand Prix on October 12th at the Diamond Stadium from 9:00 a.m. to 5:00 p.m. 12. Noted the Chamber of Commerce website received 379,000 hits and showed the interest expressed in Lake Elsinore. www.levcc.org. 13. Noted that the Chamber was in the process of producing a new community map and business directory. 14. Indicated that they would continue to upgrade their newsletter. 15. Noted the Chambers participation in the Business Press's supplement for Southwest Riverside County. 16. Indicated that the Lake Elsinore Magazine would be coming out under a new name and the distribution has expanded as well. Ms. McColley stated that if anyone had questions they could contact the Chamber of Commerce Office at (909) 245 -8848. CLOSED SESSION REPORT City Attorney Leibold announced the Closed Session Item A and noted that it involved a lawsuit filed by Mr. Reimbold filed on behalf of himself and "the Citizens of Lake Elsinore" against Councilwoman Brinley. She noted that the statutory provision under which the lawsuit was filed required that the City make a decision whether to proceed with the action. She noted that in Closed Session the Council elected not to proceed with the action. She indicated that she would be notifying the court accordingly. She further indicated that Councilwoman Brinley did not participate in the Closed Session. PUBLIC COMMENTS — AGENDIZED ITEMS None requested. CONSENT CALENDAR ITEMS MOVED BY BRINLEY, SECONDED BY SCHIFFNER AND CARRIED BY UNANIMOUS VOTE TO APPROVE THE CONSENT CALENDAR AS PRESENTED. PAGE SIX — CITY COUNCIL MINUTES — SEPT. 10, 2002 The following Minutes were approved: a. City Council/Redevelopment Agency Study Session — August 27, 2002. b. Regular City Council Meeting — August 27, 2002. (F:44.4) The following Minutes were received and ordered filed: C. Planning Commission Meeting — August 7, 2002 d. Planning Commission Meeting - August 21, 2002. (F:60.3) 2. Ratified the Warrant List for August 30, 2002. (F:12.3) Received and ordered filed the Investment Report for July, 2002. (F:12.5) 4. Rejected and referred to Claims Administrator for handling the Claim Against the City submitted by James Pearce (CL #2002- 14).(F:52.2) 5. Approved the Community Development Block Grant Agreement for the Senior Citizen's Center for FY 2002 -2003, and directed execution of documents. (F:68.1)(X:84.2) 6. Approved the Contract for the Patrol Boat Grant and authorized the Mayor to execute the agreement. (17:68.1)(X:84.1) PUBLIC HEARING 21. Public Hearing on 2002 Local Law Enforcement Block Grant Program Award for Crime Prevention Program. (17:84.8) City Manager Watenpaugh presented an overview of the Local Law Enforcement Block Grant Program and was funded through the Federal Bureau of Justice. He noted that for Fiscal Year 2002 -2003 the LLEBG would fund $57,164.00 with required matching funds of $6,352.00 for a total of $63,516.00. He presented an overview of the services and programs that the funding would help to provide. He recommended that the Mayor and City Council approve use of the grant funds as recommended by the Advisory Board. Mayor Kelley opened the public hearing at 7:45 p.m. Hearing no requests to speak the public hearing was closed at 7:46 p.m. Council concurred that this was a good program. PAGE SEVEN — CITY COUNCIL MINUTES — SEPT. 10, 2002 MOVED BY SCHIFFNER, SECONDED BY BRINLEY AND CARRIED BY UNANIMOUS VOTE TO APPROVE USE OF THE GRANT FUNDS AS RECOMMENDED BY THE ADVISORY BOARD. BUSINESS ITEMS 31. Award of Contract for Railroad Canyon Road — Lane Addition Design. (F:156.2) City Manager Watenpaugh explained that the purpose of the item was a request to an increase in the City's budget in the area of Railroad Canyon Road Lane Addition. He noted that it represented the widening of Railroad Canyon Road right turn stacking lane from Canyon Lake to I -15. He further explained that the increase would be $60,000 and bring the total budget to $260,000. He indicated that of the $260,000, $28,980 would be for design and engineering work. He noted that the funds would come from the Railroad Canyon Road Benefit Reimbursement District funds and not from the General Fund. He recommended the transfer of $60,000 from the Railroad Canyon Road Benefit Reimbursement District to fund the project. Councilman Buckley clarified that the company the City was using was Harris and Associates. City Manager Watenpaugh confirmed. Councilman Buckley asked what the last thing Harris and Associates did for the City. City Manager Watenpaugh stated that they were under regular contract to plan check; perform Assessment Engineering; and they did the Park Ballot Initiative. Councilman Buckley questioned if there were other companies the City had standing existing contracted with. City Manager Watenpaugh stated that the City contracts for planning and design engineering with Berryman and Hennigar, and possibly Scott Fazekas and Associates. Councilman Hickman noted that the purpose of the project was to add a third lane from Canyon Lake to Grape Street for approximately 900 feet. He stated that his concern was the traffic congestion off of I -15 at Grape and Summerhill. He commented that he hoped the people in Canyon Lake appreciated this effort. He stated that he would like to see Railroad Canyon Road widened to three lanes from Canyon Lake to Lake Elsinore and he felt this was a start. Councilwoman Brinley inquired if there was some way that the City of Canyon Lake could be approached to share some costs should the City decide to further develop Railroad Canyon Road. City Manager Watenpaugh stated that staff would be happy to get in contact with Mr. Powers and discuss the potential of PAGE EIGHT — CITY COUNCIL MINUTES — SEPT. 10, 2002 assistance. He noted the recent joint project with the City of Canyon Lake and the County of Riverside on the Greenwald improvements. Mayor Pro Tem Schiffner clarified that it was not another lane, but rather a right - turn lane, and asked what benefit the lane would create. Community Development Director Brady explained that in the morning when traffic was trying to get onto the North I -15, traffic stacks along that side of the road and actually stacks into one of the two travel lanes. The proposed right -turn lane would allow additional stacking area, which would assist in the reduction of congestion and keep the flow of traffic moving. Mayor Kelley stated that she hoped that the right -turn lane would relieve some of the congestion in that area. MOVED BY BRINLEY, SECONDED BY SCHIFFNER AND CARRIED WITH A VOTE OF 4 TO 0 WITH BUCKLEY ABSTAINING TO APPROVE THE TRANSFER OF $60,000 FROM THE RAILROAD CANYON ROAD BENEFIT REIMBURSEMENT DISTRICT FUND; AUTHORIZED HARRIS & ASSOCIATES TO PERFORM ENGINEERING WORK AND AUTHORIZED THE PURCHASE ORDER. Councilman Buckley explained that although he was in favor of the improvements for Railroad Canyon Road, he was concerned with "no bid" intermittent on going contracts and with Harris and Associates, and that was why he abstained. 32. Main Street Tree Lights Replacement. (F: 156.2)(X: 30.1) City Manager Watenpaugh indicated that the matter before Council was for consideration of replacing the lights on Main Street. He noted that staff was in the process of trimming the trees on Main Street, and some of the Council and a number of businesses on Main Street had expressed a desire to see the lights returned to their original status. He explained that the number of lights had diminished due to tree trimming, vandalism, and natural damage. He indicated that the total cost of the project would be approximately $40,000, and would be allocated from the General Fund reserves. He further explained that the project would allow for 400 lights per tree and included the "J" boxes, wiring, installation, equipment and labor. Councilman Buckley noted that after consideration the trees were too big for 200 lights and therefore he felt that it would be best to go with the 400. PAGE NINE — CITY COUNCIL MINUTES — SEPT. 10, 2002 Councilman Hickman commented that he was very proud of the Downtown area and he wanted it to look nice, therefore he was in favor of the light replacement. Councilwoman Brinley stated that part of the ambiance of the Downtown was the lights in the trees and she would like to see it continue. She commented that it made evenings in the Downtown area very special and she was in favor of maintaining the lights. She noted that it was important to continue the investment in the Historic Downtown area. Mayor Pro Tem. Schiffner commented that he was sure that there would be different opinions in regard to the need for the lighting in the Downtown area, however it was a subject that the Council would have to consider and he felt that it would have to be considered every four years. He noted that it was an investment of approximately $11,000 a year. He stated that he felt that it was very attractive and he was in favor of doing it right. He noted that in the past the repairs were done and the lights spread out, therefore they had thinned. Mayor Kelley concurred with Councilwoman Brinley that the Council should maintain the investment in the Downtown area. She indicated that there had been a request by the businesses downtown to restore the lights. She commented that many band -aid jobs had been done in the past and it was now necessary to give attention to the restoration. She indicated that she was in favor of this item. MOVED BY BRINLEY, SECONDED BY SCHIFFNER AND CARRIED BY UNANIMOUS VOTE TO APPROVE THE EXPENDITURE OF $40,000 FROM THE GENERAL FUND RESERVES FOR THE INSTALLATION OF LIGHTS ON MAIN STREET. THE CITY COUNCIL MEETING RECESSED AT 8:00 P.M. THE CITY COUNCIL MEETING RECONVENED AT 8:04 P.M. PUBLIC COMMENTS — NON AGENDIZED ITEMS Andrew Currie, 15 Bella Catrina, expressed his concern regarding the cost of AT &T Broadband. He made a comparison to the previous charges that he paid and the current charges for identical service. He expressed the opinion that the new move by AT &T was a negative and he opposed the action. He submitted a letter to Council expressing his opinions. PAGE TEN — CITY COUNCIL MINUTES — SEPT. 10, 2002 Pete Dawson, 18010 Grand Avenue, commented that he took exception to Mayor Pro Tern Schiffner's previous comments. He stated that he had made an investigation regarding the time frame for making the wells operational and indicated that it could be done in three weeks. He commented on the wells that EVMWD had installed for the Wetlands and stated that the City Council should better examine the explanations and actions of EVMWD. Ruth Atkins, 15237 Lake Trail Circle, announced the Lake Elsinore Historical Society's 2nd Annual Casino Night to be held on September 14`h at the Lake Elsinore Community Center from 7:00 p.m. to 11:00 p.m. She indicated that it was $15 per person and included $200 in chips and food. She commented on AT &T Broadband and stated that it depended on who you talked to as to what answer you received. Max Aragon addressed the fish kill and stated that he found it unacceptable. He stated that he felt that a fish kill should not be allowed to occur. He commended staff on the quick clean-up and indicated that there were a lot of people praying for the City of Lake Elsinore. Loraine Watts, P.O. Box 518, Lake Elsinore, announced that there would be a celebration of Mexican Independence Day Fiesta on September 15`h at Las Palmas Restaurant from 3:30 p.m. to 5:30 p.m. She invited the community to attend. Chris Hyland, 15191 Wavecrest, announced that she was running for the Elsinore Valley Municipal Water District and reminded the audience that she was opposed to increating rates and was in favor of alternate water supplies. She expressed her objection to high voltage lines in the forest. Terry Prijatzl, 14741 Lakeshore Drive, commented on the problem with water in the Lake and stated that the City needed to take quick action to preserve the water level. She disputed the comments from EVMWD regarding the length of time it took to bring the wells on line and stated that it was the City's responsibility to maintain the Lake for both the City and the County. Jim Morris, 15220 Golden Sands, presented a report regarding a real estate sting that had occurred in the Lake Elsinore area. He stated that the person who perpetrated the crime was in jail in Arizona and if anyone was interested he would be glad to provide the information. Les Cameron, 16836 Grand Avenue, addressed the wells and stated that he felt that the City had been given a great deal of misinformation regarding his comments. He encouraged the City to investigate the information and stated that in his opinion the information was correct and he would have appreciated being asked. PAGE ELEVEN — CITY COUNCIL MINUTES — SEPT. 10, 2002 CITY MANAGER COMMENTS City Manager Watenpaugh commented on the following: Stated that he needed more information and asked to meet with Mr. Cameron and Mr. Dawson after the Meeting. 2. Thanked Mr. Aragon for complementing staff and the CCC regarding the clean- up of the fish. He noted that staff and the CCC did an excellent job and the Lake was open for Labor Day weekend with no problems. Commented that there were a lot of positive things were happening, however some were taking longer than staff wanted. He stated that within the next 15 to 30 days there should be news beneficial to everyone. 4. Addressed Mr. Cameron's letter and commented that he was not sure of all the issues, however he would be addressing the cost of the wells and how long it would take to make them operational on the three wells. 5. Congratulated Coach Burt and commended the community for their recognition of Coach Burt. 6. Commended the Storm on a job well done. CITY ATTORNEY COMMENTS No comments. CITY COUNCIL COMMENTS Councilman Buckley commented on the following: Commented on the changes with AT &T Broadband. He further commented that he knew how difficult it was to deal with them and noted his difficulty with his billing. 2. Commented that he attended the COPS for Kids function and it was very successful. Reminded the audience of the Historical Society's Casino Night and confirmed that tickets could be purchased at the door. PAGE TWELVE — CITY COUNCIL MINUTES — SEPT. 10, 2002 Councilman Hickman commented on the following: 1. Indicated that the Rodeo and the Concerts in the Park were great successes. 2. Congratulated Coach Burt and wished Lake Elsinore High School and Temescal Canyon High School a great football season. 3. Addressed 9/11 and thanked America for its resilience. He stated that God had blessed us. 4. Noted that the recycled water should be flowing into the Lake this weekend. 5. Stated that the sidewalks would be power washed to improve the downtown. 6. Reminded the audience that the Beach Boys would be performing at the Stadium on September 215`. Councilwoman Brinley commented on the following: Congratulated Coach Burt and noted that one of his students, Jason Phife, plays for the Oregon State University Ducks. She encouraged everyone to root for him. 2. Commented on the success of the COPS for Kids and noted that it was a lot of fun. She stated that it was a good way for people to get to know the officers when they were not on duty. Commented that the Rodeo was a great success and congratulated the Sheriff's Posse for a job well done. Addressed 9/11 and thanked the Fire Department and the Police Department. She noted that not a lot of thought is given to the danger and long hours of their jobs and thanked them for their dedication. Congratulated the Storm on their winning season. Mayor Pro Tern Schiffner commented on the following: 1. Commented that the COPS for Kids presented a great program and he was glad that they made a lot of money. He noted that the organization did a tremendous amount of good for the children, seniors and people in need. He recognized Chief Walsh and his wife Tammy for their hard work and commitment. He commented PAGE THIRTEEN — CITY COUNCIL MINUTES — SEPT. 10, 2002 that he felt that HOPE and COPS for Kids were the two organizations that deserved recognition. He noted that through Tammy and Chief Walsh's efforts there was consideration being given to organize the program in other cities. 2. Commended the First Assembly of God Church on Grand Avenue for the wonderful program they presented for 9/11. He stated that for anyone that missed the program, should be sure to attend if they plan another event in the future. 3. Commented on the Fish Kill and explained that staff had done all they could to prevent the problem. He commended staff for their quick action in cleaning up the fish kill and stated that they had done a great job. Addressed Mr. Cameron's letter and stated that his concerns regarding the wells could be possible at a price, and that was what he was attempting to find out. He explained that staff was looking into the price of temporary well pumps and the cost of electricity. Addressed the comments made by Ms. Prijatzl, and noted that there were approximately 500 people in the unincorporated area that had use of the Lake and commented that he wished that they would attend the County Supervisor's Meetings and see if the residents could help financially. He noted that the County residents had no problem coming to the City Council Meetings asking for the Council to solve all the problems and yet contribute nothing but your company. He stressed that he wished they would go to the Board of Supervisors, since the City had asked for help, and the Supervisors didn't seem to find the time to address the issues. Mayor Kelley commented on the following: 1. Thanked the Elsinore Valley Arts Network and the Historical Society for a successful summer concert series. Commented on what a great success COPS for Kids function was and congratulated them. Congratulated Coach Burt for a fine career and commented on his success with keeping his football players in school and assisting them in their scholastic endeavors. 4. Commended Pastor Fred Rodriguez of First Assembly of God Church for his 9/11 program. PAGE FOURTEEN — CITY COUNCIL MINUTES — SEPT. 10, 2002 5. Congratulated the Lake Elsinore School Board on the dedication for Cottonwood Middle School and Cottonwood Elementary School. 6. Congratulated the Sheriff's Posse for a successful Rodeo. She noted that riding a bull was a unique experience. 7. Read a letter from the Lake Elsinore Library regarding the October Film and Book Discussion series featuring the Grapes of Wrath. Reminded the audience of Casino Night hosted by the Historical Society at the Lake Community Center. Announced a workshop for Safeguarding our Children. on September 25, at 7:00 p.m., at the First Assembly of God Church. 10. Remind everyone that the first football game would be September 19, 2002 at the Diamond. 11. Reminded the audience to attend the Beach Boys Concert on the 21St. She noted that the tickets were available at the Promenade Mall or the public could call (909) 303 -1222. 12. Announced that the Mexican Independence Day Celebration would be held at Las Palmas, September 15, at 3:00 p.m. 13. Commented that she was presented a copy of a mystery book by an author from Japan, which included Lake Elsinore in the story. She invited Council and the public to see the book. 14. Announced that the City of Lake Elsinore would provide the Cultural Center to the public for a place to pray for the survivors and reflect on the 1St anniversary of 9/11.
