DISCUSSION 1; A~enda Review . Mayar Kelley confirmed that there would be someone to do the invocation. She noted that Fire Chief Gallegos added a ; presentation to be done at the begnuiing of the City Council Meeting regarding fire season. : PAGE TWO - STUDY SESSlON - JUNE 25, 2002 Councilman Hickman addressed Item No. 2 regarding the Warrant List. He requested clarification on specific checks. Aduiinistrative Services Director provided a brief explanation of the checks issued and what they were issued for. Councilman Hickman addressed Item No. 4, Resolution Authorizing Continuing Appropriations for fiscal year 2002-03 and indicated that he wanted a 30-day limit for the continuance. Mayar Kelley stated that the purpose of the item was to allow for the use of funds in the event that the budget was not approved by July 1, 2002. He indicated that he did not want to go a whole year without a budget. Assistant City Manager Best expiained that the intent of the Item was to allow extra time, but not necessarily a year. Councilman Hickman addressed Item No. 5, Contract Award for Traffic Signals at Collier Avenue and Riverside Dr., and Collier Avenue and Central Avenue. He indicated that the job did not go the lowest bidder because of an item missing from their bid. Community Development Director Brady explained the bid process and the reason the job did not go to the lowest bidder. There was general discussion regard'mg the time and money required to complete Traffic Signals. Councilman Buckley addressed Item No. 2, Warrant List and requested clarification for checks issued. Administrative Services Director Boone provided clarification. Mayor Kelley stated that due to the subject matter of Item No. 22; Park and Recreation Maintenance Assessment District it might be in the best interest of all parties involved to move the item to the end of the Council Meeting for discussion. Assistant City Manager Best stated that they should go forward with the agenda as presented, but hold Item Na 22 until immediately after RDA. Assistant City Ivlanager Best expiained the nature : of the item anct that there were several Ame~drnents ta consider separately. Mayor Kelley gave an overview of the nature of the business for Vertigo. City Attorney Leibold indicated that each motion for , Item No. 21 should be done separately in the order recommended. Asslstant City Manager explained the order of the Public Hearing ;: c for Item No: 22, Pazk and Recreation Maintenance Assessment District; and the opportunity for the public to speak and/or submrt ballots. She indicated that ballots could be submitted until the official. close of the Public Hearing: : Councilman Schiffner addressed whether Council would take any action on Item No. 22. City Attorney stated that no action would be taken and indicated that the tabulation would follow the Public Hearing and indicated that would occur the following morning at City Ha11 in Conference Rooms A& Br She gave an overview of the officials supervising the tabulation and noted that it would be a secured area open to the public. There was discussion on the issue of ballot tabulation at the Public Hearing as opposed to closing it and begin tabulation the next day. City Attorney Leiboid ga~e an overview of the process of tabulation as per the Implementarion Act in the Constitutional Provision. She indicated that there were other procedures utilized by another City which involved continuing the Hearing to the next day to a11ow for confident tabulation ofballots. PAGE FOUR - STUDY SESSlON - JUNE 25, 2002 Councilman Buckley indicated that if the Public Hearing were continued, ballots could be accepted up until the Hearing was closed. City Attorney Leibold confirmed that once tabulation began, no ballots would be accepted. She stated that as per legislation, there was no violation continuing the Hearing until the next morning to allow for tabulation at that time. Counciiman Buckley addressed Item No. 31, Communications Site Lease Agreement, and stated that there was a tower next to the Chamber Building. He indicated that.he would like Sprint and Cingular Wireless to share a tower as opposed to installing a second tower. Assistant City Manager Best indicated the benefit the City would have with the second tower. She noted the funds generated due to the site locatiom on Gity property: Councilman Hickman addressed Item No. 32; DRC for Automated and Self Serve Car Wash, and noted that there was another car wash close to the proposed project site. There was discussion on the differences between the two car washes and the possible competition. Mayor Kelley indicated that she was opposed to the location of the proposed car wash due to the surrounding vacant lots. Community Development Director Brady indicated that Council could appeal the Conditional Use Permit. There was general discussion regarding the location, layout and the structure of the car wash. REDEVELOPMENT AGENCY Councilman Buckley addressed Item No. 5, Resolution Approving the Agreement for Purchase and Sale - Lakeside Apartments, and clarified the location of the complex. PAGE FIVE - STUDY SESSION - JUNE 25; 2002 He requested that a locator map be included with items addressing property in the future. Assistant Gity Manager Best detailed the location of the complex for Councilmen Buckiey and Hickman. Councilman Hickman addressed the Multi-family Revenue Bond sponsored by the City's Redevelopment Agency. Admniistrative Services Director Boone provided an overview of the bond and how it was secured. City Attorney Leibold indicated that the purpose of this item was to approve the sale of the Lakeside Apartments. Mayor Kelley acknowledged that they were a member of the Crime Free Multi Family Housing and Assistant City Manager Best confirmed. Councilman Buckley noted an error on the header of page 21 of 42, Item Na 5. Councilman Hickman addressed Item No; 8, Park and Recreation Maintenance District Assessment Ballots and clarified that they were to determine the ballots for the RDA. City Attorney Leibold noted that due to possessory interest in the property the Stadium occupied, the ballots needed to be approved for compietion and tabulation. She further noted that when Council originally approved the ballots for the RDA, it was not clear that the Stadium property would be included; therefore she requested the item be approved separately for clarification purposes. There was discussion regarding the total number of ballots from the RDA with the Stadium included. Councilman Buckley questioned the calculation of the ballots. City Attorney Leibold indicated that the Engineer would attend the Regular City Council Meeting to address the method of calculation of the ballots. She noted that the Storm team did not have any voting authority because they were not property owners. PAGE SIX - STUDY SESSION - JUNE 25, 2002 Councilman Buckley clarified that the ballots were new ballots and not replacement ballots as stated in the staff report. City Attorney Leibold confirmed. Councilman Buckley addressed the time frame for ballot issuance for properiy owners. City Attorney Leibold indicated that the property owner could request a ballot any time during the 45-day process as long as they provided proper identification and proof of ownership of the property.
