HomeMy WebLinkAbout03-20-2003 City Council Study SessionMINUTES CITY COUNCIL STUDY SESSION CITY OF LAKE ELSINORE 183 NORTA MAIN STREET LAKE ELSINORE, CALIFORNIA TUESDAY, MARCH 20, 2003 ~~~:~~~~~~~~~*:~~~r:r~r:rx:~*:~:~:~:~~:~~~x~:~~:~x~:~~:~~:~~:~~~:~x~:~~:~~:~~*~~~:~~: CALL TO ORDER Mayor Brinley called the Study Session to order at 3:07 p.m. ROLL CALL PRESENT: COUNCILMEMBERS: BUCKLEY, HICKMAN, SCHIFFNER, BRINLEY ABSENT: COUNCILMEMBERS: KELLEY Also present were: City Manager Watenpaugh, Assistant City Manager Best, City Attorney Leibold, Community Development Director Brady, Community Services Director Sapp, Information/Communications Manager Dennis, Lake Operations Manager Kilroy, Director of Administrative Services Boone, and Deputy City Clerk Gibbons. TRANSPORTATION UNIFORM MITIGATION FEE - TUMF (F:140.1) City Manager Watenpaugh introduced Rick Bishop, Executive Director of WRCOG. He presented an overview of the TUMF and the ways it could affect the City. Councilman Hickman questioned whether the TUMF could be separate from the Habitat Fees. Mr. Bishop stated that the approval would include both. Mayor Brinley inquired into the possibility of a lawsuit with the City for MSHCP. Mr. Bishop stated that TUMF litigation would be defended by WRCOG, however MSHCP was a separate issue. There was further discussion regarding the issues involving potential lawsuits and the funding shortfalls. Mayor Pro Tem Schiffner indicated that he could see the benefits to the TUMF however, he would like a commitment from WRCOG for legal protection. Mr. Bishop referred to the Nexus Study and noted how PAGE TWO - STUDY SESSION - MARCH 11, 2003 it provided support in the event of litigation. Mayor Pro Tem Schiffner requested clarification as to whether the defense covered losses and Mr. Bishop could not clarify. Ciry Attorney Leibold noted her doubts as to WRCOG's strong legal standing. City Attorney Leibold addressed the issue of funds running out prior to the completion of a project. Mr. Bishop stated that if that occurred they could use State and Federal funds. There was discussion regarding the long term effects if they chose not to participate. There was further discussion regarding when the fees would be imposed. Mr. Bishop indicated that they would be imposed at the issuance of a building permit or as the law allowed. He noted that many jurisdictions adopted ordinances to approve the TUMF fee. City Manager Watenpaugh gave a brief overview of the voting structure in the TUMF. There was discussion regarding the voting structure. Frans Bigelow, Castle & Cooke (Murdock Properties), questioned what the impact would be to Lake Elsinore if they did not adopt the TUMF. He noted that Riverside County had adopted the TUMF. MULTI-SPECIES HABITAT CONSERVATION PLAN - MSHCP City Manager Watenpaugh addressed where Riverside County was in the process. Mr. Lashbrook, Executive Director for the Riverside County MSHCP, stated that the County closed the service comment period on March 14, 2003 and a tentative Public Hearing was scheduled for late April or early May. He noted that the Nexus Study was under review and if the numbers were consistent, it would be ready for review in three to four weeks. There was discussion regarding the loss of land to the City as well as the potential loss of LLMD revenues and property values. Mayor Brinley inquired why the MSHCP was tied to Measure A. Mr. Lashbrook noted that Measure A was approved by RCTC and they set the ground rules for Measure A. There was discussion regarding the loss of potential sales tax revenues and lack of development. There was further PAGE THREE- STUDY SESSION - MARCH 11, 2003 discussion on the fiscal impact to the City. Mr. Lashbrook compared the open space uses with those of the Santa Rosa Plateau. Councilman Buckley left the meeting at 4:24 p.m. Mayor Brinley noted her concern for legal issues if other agencies had control of the community. She further indicated that agencies had more influence and jurisdiction than Council. Councilman Buckley returned to the table at 4:25 p.m. City Manager Watenpaugh addressed the impact if the City Council did not adopt the MSHCP Plan. Mr. Lashbrook stated that the plan would be re- evaluated. He further noted that the goal was to give the City control, not take the control away. PUBLIC COMMENTS Frans Bigelow, representing Castle & Cooke noted the impact of the MSHCP on commercial property. He further noted the property owners' potential loss of control. Bill Kennedy, Barratt Homes, stated that the only benefits outlined in the Nexus Study were in favor of Riverside County. He addressed the potential lawsuits and where the funds would come from if a judge ordered a refund. Don Summers, Realty Center, noted his opposition to the MSHCP due to the growth issues. Glen Dagle, Oak Grove Equities, addressed the land use issues and Riverside County's policy for steep elevation areas City Manager Watenpaugh provided an overview of the Nexus Study and the cells.
