HomeMy WebLinkAbout02-25-2003 Joint City Council /RDA Study SessionMINUTES JOINT CITY COUNCIL/REDEVELOPMENT AGENCY STUDY SESSION CITY OF LAKE ELSINORE 183 NORTH MAIN STREET LAKE ELSINORE, CALIFORNIA TUESDAY, FEBRUARY 25, 2003 ~~~~:~~~~~**~*,~~~~~~*~,~~~~~*:~***~*~*:~~**~:~~~~*~*~~**~~~~~~*:~~~ CALL TO ORDER Mayor Brinley called the Joint Study Session to order at 4:07 p.m. ROLL CALL PRESENT: COUNCILMEMBERS: BUCKLEY, HICKMAN, KELLEY,SCHIFFNER BRINLEY ABSENT: COUNCILMEMBERS: NONE Also present were: City Manager Watenpaugh, Assistant City Manager Best, City Attorney Leibold, Community Development Director Brady, Community Services Director Sapp, Infarmation/Communications Manager Dennis, Finance Manager Magee, Public Works Manager Payne, Planning Manager Villa, Lake Operations Manager Kilroy and Deputy City Clerk Paredes. DISCUSSION ITEMS Agenda Review (F:44.1) Councilman Hickman addressed Item No. 2, regarding the Warrant List. He clarified the purpose of several warrants. Councilman Hickman addressed Item No. 5, regarding Professional Services Agreement - Noble Consultants far the Design, Fabrication & Installation of Axial Flow Pump Destratification System. He asked if it was required by the State to utilize all the consultants that the City uses. City Manager PAGE TWO - STUDY SESSION - FEB. 25, 2003 Watenpaugh stated that it was not required. He explained that the item in question was a recommendation by staff to hire Noble Consultants because of his experience with the Lake Master Plan; the Lake Feasibility Study; the Boat Launch; and the Draft Proposal for the Boat Launch for the Campground. He further explained that he has the Lake background and by using Noble Consultants it would provide the City with a consultant without going over all the background material to bring the consultant up to speed. Councilman Hickman questioned why the City could not use the previous study on the System. Lake Operations Manager Kilroy explained that Lake Elsinore has a unique situation because there would be docking stations and the power system would be unique. He explained that each system was an individual system designed for each specific lake. He commented that it would be necessary to have someone look at the anchoring and electrical systems for the docking stations. He gave an overview of the needs to provide for the project. Mayor Brinley addressed Item No. 21, regarding Amendment No. 1 to the La Laguna Estates Specific Plan and Tentative Tract Map No. 30788. Community Development Director Brady stated that there were issues the applicant had regarding the traffic signal requirements and explained that the applicant was not opposed to installing the signals, but was concerned with how they would be funded. He suggested that Council might wish to continue the item until the terms of the Development Agreement were considered. City Manager Watenpaugh asked if the concerns were considered at the Planning Commission Meeting. Community Development Director Brady stated that the conditions had been addressed at the Planning Commission level. Mayor Pro Tem Schiffner stated that he was not happy with the recommendation from the Planning Commission regarding the closure of Sunswept Drive. He noted that it involved six or seven existing property owners who felt that they were entitled to not have traffic come through that area and he felt that it would be to the detriment of approximately forty or fifty homes in the tract. He indicated that they would have to go all the way around the tract to exit the tract. He questioned how those six or seven homeowners would feel if the City closed the tract off to PAGE TH12EE - STUDY SESSION - FEB. 25, 2003 Lincoln Street. He indicated that the Fire Department wants the street kept open for public safety and he felt that it would not be fair to the new homeowners to prevent access to Grand Avenue for the benefit of the six or seven homeowners. He stated that he was in favor of having the street open. Councilwoman Kelley stated that she was surprised that the Planning Commission allowed the street to be closed. She noted that it was not a cul- de-sac and there were very few houses on Sunswept. She commented on the fliers that the homeowners were distributing to keep the street closed. She questioned how the street could be closed and still be used for emergency vehicles. Community Development Director Brady explained that it would be open to pedestrians and would have rolled curbs to allow the emergency vehicles to make entrance. Councilwoman Kelley commented that a similar problem in the future could occur with Sandpiper, which would be in the next phase of development. Councilman Hickman suggested that the area becomes a gated tract and they could take care of their own responsibilities. Mayor Pro Tem Schiffner stated that the developer could have proposed that action, however they did not. Councilman Buckley questioned the design of the tract. Community Development Director Brady stated that the tract had not gone through the Design Review Process; and presented an overview of the possible design. He explained that the item before Council was the Amendment to the Specific Plan and the first tract map, which approved 110 lots. Councilman Buckley questioned the size of the lots 51 through 61, versus the usable amount of footage that would be available to be built upon. He commented that when he thinks about lot size, he thinks buildable pad and a great deal of the building lots mentioned were slopes and could not be utilized. Community Development Director Brady presented an overview of the utilization of building lots and the required setbacks. He explained the fencing that might be used throughout the project. Councilman Buckley questioned the maintenance of the slopes. Community Development Director Brady stated that the maintenance of the slopes would be done by the Homeowners Association. He presented an overview of the procedure used for slopes. City Manager Watenpaugh stated that should Council wish PAGE FOUR - STUDY SESSION - FEB. 25, 2003 to change the requirements for building lots the topic should go to Study Session and revisions made to the General Plan; however the tract map meets the current code. City Attorney Leibold stated that the project was subject to a Development Agreement, which would limit some of the flexibility the Council had to make modifications, rules, conditions, actions, and fees that could be applied to the project. She explained that if Council wished to modify some of the conditions to the Specific Plan, it would likely require some evaluation of the Development Agreement prior to a recommendation to proceed. Councilman Hickman asked if the developer was required to use drought resistant materials on the slopes. Community Development Director Brady stated that a landscape plan had not been submitted; however consideration could be given to requirements for drought resistant plants. City Manager Watenpaugh stated that the Landscape Architect would be making a review of the plans and EVMWD had requested that the City use drought tolerant plants as well. Councilman Buckley clarified that the development would participate in the CFD for Public Safety. Community Development Director Brady stated that the developer was not in opposition to the CFD, however the condition was reworded. He stated that the developer was concerned with the maintenance of the trail and wished to have the City maintain the trail. He indicated that the trail system was maintained by each development; however they were concerned about liability for the Homeowners Association. There was general discussion regarding the maintenance of the trails. City Attorney Leibold suggested for purposes of the public record to emphasize that the trails were a requirement that had been uniformly applied so where there were Trails, they would be maintained by the Homeowners Association. She clarified it was not an installation issue, but rather an operations and maintenance issue. There was discussion regarding other developments and their requirements to maintain the trail system. City Manager Watenpaugh noted that the trail system connects into the regional trail system throughout the County. PAGE FIVE - STUDY SESSION - FEB. 25, 2003 Mayor Brinley addressed Item No. 31, regarding the request for Waiver of Fees for the Walk for Life. City Manager Watenpaugh presented an overview of the request. Community Services Director Sapp recommended requiring the $1,000 deposit and utilizing a portion of the money for any applicable fees. He indicated that any money that was not used would be returned to the applicant. Councilman Hickman questioned the maintenance of the park. Community Services Director Sapp stated that the concessionaire at the park was responsible for maintenance. There was general discussion regarding costs. City Attorney Leibold encouraged Council to follow their set policy to avoid any consideration of support for the issues involved with the organization. Mayor Brinley addressed Item No. 32, regarding Commercial Project No. 2002-03 "Washington Mutual Bank". City Manager Watenpaugh presented an overview of the item. Councilman Hickman questioned the tax increment for RDA. City Manager Watenpaugh stated that the tax increment would belong to the City and RDA. Councilman Buckley noted that there was no vault or safety deposit. Community Development Director Brady stated that the trend was to eliminate the vault and safety deposit boxes. Mayor Brinley addressed Item No. 33, regarding the appointment of City Treasurer. She noted that there was no time to hold a Special Election and indicated that she would call for names to consider for appointment at the Council Meeting. City Attorney Leibold noted the options that Council had in regard to the position. She stated that they could appoint someone to the position or leave it vacant. Redevelopment Agency Boardmember Hickman addressed Item No. 2 regarding the Warrant List. He clarified the purpose of a warrant.
