RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE
ELSINORE, CALIFORNIA, AUTHORIZING THE INITIATION OF
PROCEEDINGS TO ESTABLISH UNDERGROUND UTILITY DISTRICT
NO. 3, LAKESHORE DRIVE FROM MOHR STREET TO CHANEY
STREET
WHEREAS, Chapter 12.16 of Title 12 of the Lake Elsinore Municipal Code
establishes procedures for the creation of underground utility districts and requires as
the initial step in such procedure the holding of a public hearing to ascertain whether
public necessity, health, safety, or welfare requires the removal of poles, overhead
wires and associated overhead structures and the underground installation of wires and
facilities for supplying electric, communication, or similar associated service in any such
district; and
WHEREAS, it has been recommended that such as underground utility district,
hereinafter called District, be formed in that area along Lakeshore Drive between Mohr
Street and Chaney Street as shown on Exhibit 'A' attached hereto and made a part
hereof; and
WHEREAS, the Director of Public Works, along with the Underground Utility
Advisory Committee, has conducted preliminary studies and made investigations
concerning the feasibility of the establishment of an underground utility district to
convert existing facilities form overhead to underground and these studies and
investigations indicate that further proceedings under Chapter 12.16 are warranted to
determine whether or not the district should be established; and,
WHEREAS, the City Council of Lake Elsinore finds that it is in the public interest
and general welfare to pursue continued efforts at encouraging the conversion of
overhead facilities to underground and that the initiation of proceedings to form
Underground Utility District No 3 is necessary and desirable.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE
DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. Notice is hereby given that a public hearing will be held by the City
Council of the City of Lake Elsinore on August 13th, 2013, at 7:00 pm, in the Board
Room of Elsinore Valley Municipal Water District building at 31315 Chaney Street, Lake
Elsinore, CA 92530, to ascertain whether the public necessity, health, safety or welfare
requires the removal of poles, overhead wires, and associated overhead structures and
the underground installation of wires and facilities for supplying electric, communication
or similar associated services in the District hereinabove described.
SECTION 2. At such hearing, all persons interested shall be given an
opportunity to be heard and are invited to appear at the time and place set for the
hearing and present their views concerning the creation of the district. Persons who
wish to object to the formation of the district should state their views in writing and file
them with the City Clerk no later than the time set for the public hearing.

SECTION 3. The area to be included within the proposed boundaries of
Underground Utility District No 3 is shown in Exhibit A attached to this Resolution and
incorporated in it by this reference.
SECTION 4. The City Clerk shall notify all affected property owners as shown on
the last equalized assessment roll and utilities concerned of the time and place of such
hearing by mailing a copy of this resolution to such property owners and utilities
concerned at least ten (10) days prior to the date thereof.
SECTION 5. Prior to holding such public hearing, the City Engineer shall
prepare a report for the City Manager and shall consult with all affected utilities, and
shall prepare such report for submission at such public hearing containing, among other
information, the extent of such utilities participation and estimates of the total cost to the
City and affected property owners. Such report shall also contain an estimate of the
time required to complete such underground installation and removal of overhead
facilities.
