HomeMy WebLinkAboutPC Reso No 2013-61RESOLUTION NO. 2013 -61 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE, CALIFORNIA, RECOMMENDING TO THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE APPROVAL OF SPECIFIC PLAN AMENDMENT NO. 2013 -01, AMENDMENT NO. 4 TO THE LAKE ELSINORE OUTLET CENTER SPECIFIC PLAN WHEREAS, Jeff Lochner, Athena Property Management, has filed an application with the City of Lake Elsinore requesting approval of Specific Plan Amendment No. 2013 -01, Amendment No. 4 to the Lake Elsinore Outlet Center Specific Plan (the "Project "); and WHEREAS, the Lake Elsinore Outlet Center Specific Plan site is generally located on the east side of Collier Avenue approximately 600 linear -feet south of Nichols Road; and WHEREAS, the Planning Commission of the City of Lake Elsinore has been delegated with the responsibility of making recommendations to the City Council for approval of specific plans and any amendments thereto; and WHEREAS, public notice of the Project has been given, and the Planning Commission has considered evidence presented by the Community Development Department and other interested parties at a public hearing held with respect to this item on June 18, 2013. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. Prior to making a recommendation to the City Council, the Planning Commission has reviewed and analyzed Specific Plan Amendment No. 2013 -01, Amendment No. 4 to the Lake Elsinore Outlet Center Specific Plan pursuant to the Planning and Zoning Laws (Cal. Gov. Code §§ 65000 et seq.) and Chapter 17.204 of the Lake Elsinore Municipal Code ( "LEMC "). SECTION 2. That in accordance with State Planning and Zoning Laws and the Lake Elsinore Municipal Code, the Planning Commission makes the following findings for the approval of Specific Plan Amendment No. 2013 -01, Amendment No. 4 to the Lake Elsinore Outlet Center Specific Plan: 1. The location and design of the proposed development shall be consistent with the goals and policies of the City's General Plan and with any other applicable plan or policies adopted by the City. Specific Plan No. 2013 -01, Amendment No. 4 to the Lake Elsinore Outlet Center Specific Plan Amendment meets the City's Specific Plan criteria for content and required implementation of the General Plan established by Section 65450 et see. of the California Government Code and Section PLANNING COMMISSION RESOLUTION NO. 2013 -61 PAGE 2OF5 17.204 of the City of Lake Elsinore Municipal Code. Accordingly, the proposed Specific Plan Amendment No. 4 complies with the objectives of the General Plan and the purpose of the planning district in which the site is located. 2. The proposed location shall allow the development to be well- integrated with or adequately buffered from its surroundings, whichever may be the case. The Project is appropriate to the site and surrounding developments in that implementation of the Project will result in the demolition of two buildings, address on -site circulation issues, update and add signage and add site amenities such as outdoor "living rooms ", furnishings, water features and fire places as well as associated improvements. The amendment will result in a better design and advertising of stores and greater visibility of the Outlet Center itself which benefits both the Outlet Center and the City. 3. All vehicular traffic generated by the development, either in phased increments or at full build -out, is to be accommodated safely and without causing undue congestion upon adjoining streets. The width and type of pavement needed to carry the type and quantity of traffic generated that will result from implementation of Specific Plan Amendment No. 2013 -01, Amendment No. 4 to the Lake Elsinore Outlet Center Specific Plan has been reviewed and accounted for. The City has conditioned the Project to be served by roads of adequate capacity and design standards to provide reasonable access by car, truck, transit, and bicycle. 4. The Specific Plan Amendment shall identify a methodology(s) to allow land uses to be adequately serviced by existing or proposed public facilities and services. In appropriate circumstances, and as provided elsewhere by the Municipal Code, the City may require that suitable areas be reserved for schools, parks and pedestrian ways; or public open spaces shall be dedicated or reserved by private covenant for the common use of residents, establishments or operations in the development. PLANNING COMMISSION RESOLUTION NO. 2013 -61 PAGE 3OF5 Specific Plan No. 2013 -01, Amendment No. 4 to the Lake Elsinore Outlet Center Specific Plan identifies methodologies to allow land uses to be adequately serviced by existing or proposed public facilities and services. The Specific Plan Amendment No. 4 identifies necessary streets and circulation to support the proposed land use allocations, as well as all necessary wet and dry utilities for proper and adequate infrastructure services. In addition, the amendment will result in a better design and advertising of stores and greater visibility of the Outlet Center itself which benefits both the Outlet Center and the City. 5. The overall design of Specific Plan Amendment No. 2013 -01, Amendment No. 4 to the Lake Elsinore Outlet Center Specific Plan will produce an attractive, efficient and stable development. Specific Plan Amendment No. 2013 -01, Amendment No. 4 to the Lake Elsinore Outlet Center Specific Plan has been designed in consideration of the size and shape of the property, thereby, strengthening and enhancing the immediate areas. The Project will complement the quality of neighboring existing and future uses by creating visually - pleasing development. Specific Plan Amendment No. 2013 -01, Amendment No. 4 to the Lake Elsinore Outlet Center Specific Plan will not be detrimental to the health, safety, comfort or general welfare of the persons residing or working near the Project or within the City, nor will it be injurious to property or improvements in the project area or within the City. In addition, staff has substantiated that all applicable City Departments and Agencies have been afforded the opportunity for a thorough review of the Specific Plan Amendment No. 4 and have incorporated all applicable comments and /or conditions related to installation and maintenance of landscaping, street dedications, regulations of points of vehicular ingress and egress and control of potential nuisances, so as to eliminate any negative impacts to the general health, safety, comfort, or general welfare of the surrounding neighborhood or the City. 6. In accordance with the requirements of the California Environmental Quality Act (CEQA), impacts have been reduced to a less than significant level, or in the case where impacts remain, a statement of overriding considerations must be adopted to justify the merits of project implementation. PLANNING COMMISSION RESOLUTION NO. 2013-61 PAGE 4 OF 5 Environmental clearance and analysis for the proposed application is provided by Final Environmental Impact Report (FEIR) for Lake Elsinore Outlet Center Specific Plan. Said environmental document was prepared in accordance with the CEQA Guidelines and was approved by the City Council in June, 1990. The proposed project is consistent with Lake Elsinore Municipal Code (LEMC), and does not conflict with the findings and discussions contained in the FEIR. No further environmental clearance is necessary. SECTION 3. Based upon all of the evidence presented, the above findings, and the conditions of approval imposed upon the Project, the Planning Commission hereby recommends approval of Specific Plan Amendment No. 2013 -01, Amendment 4 to the Lake Elsinore Outlet Center Specific Plan. SECTION 4. This Resolution shall take effect from and after the date of its passage and adoption. Specific Plan No. 2013 -01 is the fourth amendment to the Lake Elsinore Outlet Center Specific Plan which proposes to demolish two buildings, address on -site circulation issues, update and add signage and add site amenities such as outdoor living rooms, furnishings, water features and fire places. Uniform Sign Program No. 2013 -02 for the Lake Elsinore Outlet Center proposes to amend the signage guidelines and standards to include the addition of a super graphics wall along the freeway side of the project as well as add graphic panels and banners to existing buildings within the Outlet center. The project site is generally located on the east side of Collier Avenue approximately 600 linear -feet south of Nichols Road. (APN's: 389 - 210 -063, 064 & 066). 2. The applicant shall defend (with counsel acceptable to the City), indemnify, and hold harmless the City, its Officials, Officers, Employees, and Agents from any claim, action, or proceeding against the City, its Officials, Officers, Employees or Agents to attach, set aside, void, or annul an approval of the City, its advisory agencies, appeal boards, or legislative body concerning the project attached hereto. PLANNING SPECIFIC PLAN 2013 -01 — LAKE ELSINORE OUTLET CENTER SPECIFIC PLAN AMENDMENT NO. 4 3. The Draft Lake Elsinore Outlet Center Specific Plan Amendment No. 4 shall be revised to incorporate any corrections and changes required by the Planning Commission and /or City Council. A Final Lake Elsinore Outlet Center Specific Plan Amendment No. 4 document shall be submitted for review and approval by the Community Development Director or designee within 30 days of approval by the City Council. No permit shall be issued until the Lake Elsinore Outlet Center Specific Plan Amendment No. 4 document and any required revisions are administratively approved by the Community Development Director or designee. The applicant shall provide the Community Development Department — Planning Division with five bound (3 -ring binders) copies and one PDF electronic version of the approved Final Lake Elsinore Outlet Center Specific Plan Amendment No. 4 document within 14 days of the administrative approval of the document. 4. Future development shall comply with those standards and guidelines of the Elements contained in the Lake Elsinore Outlet Center Specific Plan Amendment No. 4 document. The applicable provisions of the Lake Elsinore Municipal Code including but not limited to Chapter 17 — Zoning shall be utilized to address those issues, standards, guidelines, etc. not addressed in the Lake Elsinore Outlet Center Specific Plan Amendment No. 4. 6. The applicant shall comply with all mitigation measures identified in the Mitigation Monitoring Program for Lake Elsinore Outlet Center Final EIR. 7. At least 30 days prior to seeking a grading permit, the project applicant shall contact the appropriate Native American Tribal Representative (Representative) to notify the Representative of the initiation of the grading, excavation and the monitoring program, and to coordinate with the City of Lake Elsinore and the Representative to develop a Cultural Resources Treatment and Monitoring Agreement. The Agreement shall address the responsibilities and participation of Native American Tribal monitors during grading, excavation and ground disturbing activities; project grading and development scheduling; terms of compensation; and treatment and final disposition of any cultural resources, sacred sites and human remains discovered on the site. *It is anticipated that the Pechanga Tribe will be the "appropriate" Tribe due to prior and extensive coordination with the City in determining potentially significant impacts and appropriate mitigation measures due to its demonstrated cultural affiliation with the project area. 8. No buildings are approved with this project. All future building or buildings will be subject to the City's development and environmental review process. UNIFORM SIGN PROGRAM NO. 2013 -02 9. The decision of the Planning Commission shall be final fifteen (15) days from the date of the decision, unless an appeal has been filed with the City Council pursuant to the applicable provisions of the Lake Elsinore Municipal Code (LEMC). 10. Within 30 days of project approval, the applicant shall sign and complete an "Acknowledgment of Conditions" and shall return the executed original to the Community Development Department for inclusion in the case records. 11. No individual signs are approved as part of this Uniform Sign Program. The applicant or designee shall submit an application for a sign permit, pay appropriate fees and receive approval from the Community Development Department and any state or local governmental entity or department (including CalTrans) which exercises iurisdiction over the sign, as applicable, for any sign installed at the project site. (As modified by the Planning Commission at the June 18, 2013 meeting). Within 30 days of project approval, the applicant shall submit three (3) bound copies and one PDF electronic version of a Final Uniform Sign Program to the Community Development Department. 13. The location, size, style, and color for all signs shall comply with the Sign Program (approved herein). 14. No portion of the proposed signs shall be located closer than five feet (6) to any property line, nor located in such a manner as to constitute a hazard to pedestrian or vehicular traffic as determined by the Community Development Department, and all freeway oriented signs shall be subiect to applicable state laws and CalTrans regulations. (As modified by the Planning Commission at the June 18, 2013 meeting). 15. " (As modified by the Planning Commission at the June 18, 2013 meeting). 16.The approval for Uniform Sign Program No 2013 -02 will lapse and be void unless building permits are issued within one (1) year. 17.Any alteration or expansion of this Sign Program approval shall be reviewed according to the provisions of Chapter 17.196 (Signs- Advertising Structures) of the Lake Elsinore Municipal Code. 18.All exterior sign lighting shall be reviewed and approved by the Community Development Director or designee. 19. The Owner shall maintain all signs in good condition and repair. Signage shall not be faded, torn, tattered, sagging or otherwise unsightly or illegible (As modified by the City Council at the July 9, 2013 meeting). 20.The City may require periodic review of the Uniform sign program subject to request and review by the Community Development Director. The Director at his discretion may forward the Sign Program to the Planning Commission and /or City Council (As modified by the City Council at the July 9, 2013 meeting). Gate access shall be equipped with a rapid entry system. Plans shall be submitted to the Fire Department for approval prior to installation. Automatic /manual gate pins shall be rated with shear pin force, not to exceed 30 foot pounds. Automatic gates shall be equipped with emergency backup power. Gates activated by the rapid entry system shall remain open until closed by the rapid entry system. Contact the Fire Planning office for current plan check fees. PRIOR TO BUILDING PERMIT ISSUANCE 81. Building plan check fee shall be made payable to The City of Lake Elsinore, and shall be submitted to the Lake Elsinore Fire Protection Planning Division at the time building plans are submitted. 82.Applicant and /or developer shall separately submit 2 sets of water system plans to the Fire Department for review. Plans must be signed by a registered Civil Engineer and /or water purveyor prior to Fire Department review and approval. Mylars will be signed by the Fire Department after review and approval. Two (2) copies of the signed and approved water plans shall be returned to the Fire Department before release of a building permit. PRIOR TO BUILDING FINAL INSPECTION 83.The applicant shall prepare and submit to the Fire Department for approval, a site plan designating required fire lanes with appropriate lane painting and/ or signs. Fire lanes path of travel shall no less than 24 feet in width and provide fire department vehicular access to within 150 feet of all portions of all buildings. Appropriate turn - arounds or circulation shall be approved by the fire department where the length of the fire lane exceeds 150 feet. 84. Display Boards will be as follows: Each complex shall have an illuminated diagrammatic representation of the actual layout which shows name of complex, all streets, building designators, unit members, and fire hydrant locations within dimension and located next to roadway access. 85. Portable fire extinguishers complying with Section 906 of the 2010 California Fire Code with a minimum rating of 2A -10BC and signage shall be installed. Fire Extinguishers located in public areas shall be in recessed cabinets mounted 48" (inches) to center above floor level with maximum 4" projection from the wall.
