HomeMy WebLinkAbout07-11-2006 City Council Minutes MINUTES CITY COUNCIL MEETING CITY OF LAKE ELSINORE 183 NORTH MAIN STREET LAKE ELSINORE, CALIFORNIA TUESDAY, JULY 11,2006 ****************************************************************** CALL TO ORDER The Regular City Council Meeting was called to order by Mayor Magee at 5 :00 p.m. ROLL CALL PRESENT: COUNCILMEMBERS: HICKMAN, KELLEY, SCHIFFNER, MAGEE ABSENT: COUNCILMEMBERS: BUCKLEY Also present were: City Manager Brady, City Attorney Mann, Administrative Services Director Pressey, Community Services Director Sapp, Community Development Director Preisendanz, City Engineer Seumalo, Building & Safety Manager Chipman, Information/Communications Manager Dennis, Public Works Manager Payne, Recreation/Tourism Manager Fazzio, Senior Planner Harris and City Clerk Ray. THE REGULAR CITY COUNCIL MEETING WAS RECESSED AT 5:00 P.M. THE REGULARCITY COUNCIL MEETING WAS RECONVENED AT 7:00 P.M. PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Axel Zanelli. INVOCATION - MOMENT OF SILENT PRAYER Page 2 - City Council Meeting Minutes - July 11,2006 Mayor Magee led the meeting in a moment of silent prayer. ROLL CALL PRESENT: COUNCILMEMBERS: ,HICKMAN, KELLEY, SCHIFFNER, MAGEE ABSENT: COUNCILMEMBERS: BUCKLEY (Councilmember Buckley arrived at 7:02 p.m.) Also present were: City Manager Brady, City Attorney Mann, Administrative Services Director Pressey, Community Services Director Sapp, Community Development Director Preisendanz, Lake & Aquatics Resources Director Kilroy, City Engineer Seumalo, Information/Communications Manager Dennis, Chief of Police Fetherolf, Fire Chief Gallegos, City Treasurer Weber and City Clerk Ray. CLOSED SESSION None. PRESENTATION/CEREMONIALS A. Presentation - Award trophies for the 4th of July Patriotic Boat Parade. Mayor Magee called Lake & Aquatics Resources Director Kilroy to the podium. Mr. Kilroy noted that the City sponsored a patriotic boat parade of lights for the 4th of July. He noted 11 boats participated in the parade. He noted that there was a boat decorating contest. He thanked Ron Hewison, Valerie Sund, John Gonzales and Phil Mendoza for judging the contest. He also thanked LEMSAR for patrolling the lake. Mr. Kilroy invited Phil Mendoza to award the trophies. Mr. Mendoza thanked all the participants in the boat parade. Mr. Mendoza presented 3rd place winner, Jas'on Lopez, with his trophy. Mr. Mendoza presented 1 st place winner, Thomas Eckert, with his trophy. PUBLIC COMMENTS - NON-AGENDIZED ITEMS - 1 MINUTE Barbara Brockman, Lake Elsinore Citizen's Committee, commented on the LECC 3rd quarter general meeting on July 13th at the Tuscany Hills Recreation Center at 7 p.m. She noted that their guest speaker would be County Supervisor Bob Buster. Ruth Atkins, Lake Elsinore Citizen's Committee, noted that Kim Cousins was unable to attend the Council Meeting. She noted that he wanted her to invite everyone, on his behalf, to the Chamber of Commerce Reverse Drawing on July 13th at the Diamond Club at 6 p.m. Ron Hewison, H.O.P.E., noted that he had come to Council in April to request a General Fund donation which Council graciously agreed to. He commented on what was done with the money and the many families they were able to service. He thanked Council for the help. CONSENT CALENDAR ITEMS MOVED BY KELLEY, SECONDED BY SCHIFFNER AND CARRIED BY A UNANIMOUS VOTE TO APPROVE THE CONSENT CALENDAR AS PRESENTED. 1. Received and filed County Donation to Swim Progam. 2. Authorized the City Manager to execute an agreement for the TUMF Zone fund reimbursement. 3. Approved Final Map No. 33164; and authorized the City Clerk to accept all dedications, sign the map and arrange for recordation. PUBLIC HEARINGS None. MOVED BY BUCKLEY, SECONDED BY SCHIFFNER TO ADOPT UPON SECOND READING, BY TITLE ONLY, ORDINANCE NO. 1183. ORDINANCE NO. 1183 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, AUTHORIZING THE LEVY OF A SPECIAL TAX. UPON THE FOLLOWING ROLL CALL VOTE: A YES: COUNCILMEMBERS: BUCKLEY, HICKMAN, KELLEY, SCHIFFNER, MAGEE NOES: COUNCILMEMBERS: NONE ABSENT: COUNCILMEMBERS: NONE ABSTAIN: COUNCILMEMBERS: NONE 32. League of California Cities Annual ConferenceN oting Delegate. MOVED BY BUCKLEY, SECONDED BY SCHIFFNER TO NOMINATE COUNCILMEMBER HICKMAN AS THE VOTING DELEGATE FOR THE LEAGUE OF CALIFORNIA CITIES ANNUAL CONFERENCE. COUNCILMEMBER BUCKLEY MADE THE FOLLOWING AMENDED MOTION. MOVED BY BUCKLEY, SECONDED BY HICKMAN TO NOMINATE COUNCILMEMBER HICKMAN AS THE VOTING DELEGATE AND COUNCILMEMBER BUCKLEY AS THE ALTERNATE FOR THE LEAGUE OF CALIFORNIA CITIES ANNUAL CONFERENCE. Councilmember Hickman commented on the item. He noted that Mike Norkin was an excellent choice. Mayor Pro Tern Schiffner agreed with Councilmember Hickman's recommendation. MOVED BY KELLEY, SECONDED BY BUCKLEY AND CARRIED BY A UNANIMOUS VOTE TO APPOINT MIKE NORKIN TO THE PUBLIC SAFETY ADVISORY COMMISSION. 34. Continuance of authorization to prepare CEQA compliance documents for Specific Plan Amendment (SPA), Residential Design Review (RDR) No. R- 2005-27, Tentative Tract Map (TTM) No. 34346 and Conditional Use Permit (CUP) 2005-26 for Mission Trail Condominium Complex. Community Development Director Preisendanz commented on the item. He noted that it was a continuation of an item that was before Council previously. He noted that it was staffs recommendation to authorize the City Manager to execute an agreement with HDR Engineering Inc. to prepare CEQA compliance documents. Peter Bachmann and Jason Hamm, Ari Lake Elsinore, noted that they were available for questions. Councilmember Buckley reminded the developers to continue community outreach and to continue to receive input from the community. MOVED BY BUCKLEY, SECONDED BY HICKMAN AND CARRIED BY A UNANIMOUS VOTE TO AUTHORIZE THE CITY MANAGER TO EXECUTE AN AGREEMENT WITH HDR ENGINEERING INC. TO PREPARE THE CEQA COMPLIANCE DOCUMENTS IN THE AMOUNT OF $91,679. 35. Amendment to Lake Elsinore Municipal Code, Chapter 9.42 regarding regulation of large parties. He noted that the amended Ordinance would help the community and Law Enforcement. Councilmember Kelley thanked the PSAC for their efforts. MOVED BY KELLEY, SECONDED BY SCHIFFNER TO ADOPT UPON FIRST READING, BY TITLE ONLY, ORDINANCE NO. 1184. Councilmember Buckley commented on the definition of "large party". He suggested that in the future, the definition could also be defined by decibel level. Mayor Magee complimented the PSAC. He commented on the value of the Commission. ORDINANCE NO. IJ84 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, AMENDING AND RESTATING CHAPTER 9.42 OF THE LAKE ELSINORE MUNICIPAL CODE REGARDING LARGE PARTIES. CITY MANAGER COMMENTS City Manager Brady commented on the following: 1) Announced the following upcoming events: July 16th - Open Air Farmer's Market July 17th - Swim lessons and "open swim" begin at Lakeside High School. CITY ATTORNEY COMMENTS No comments. COMMITTEE REPORTS None. CITY TREASURER COMMENTS No comments. CITY COUNCIL COMMENTS Councilmember Kelley commented on the following: 1) Thanked staff for ajob well done on the 4th of July celebration. 2) Noted that the Concert in the Park Series was coming in August. 3) Gave her condolences to the family of A.A. "Bud" Attridge. Councilmember Hickman commented on the following: 1) Gave his condolences to the family of A.A. "Bud" Attridge. 2) Complimented staff for the 4th of July celebration. 3) Noted that there was a property tax rebate and rental assistance program at the Senior Center for individuals over the age of 62. Councilmember Buckley commented on the following: 1) Gave his condolences to the family of A.A. "Bud" Attridge. Mayor Magee commented on the following: 1) Commented on graffiti in the City. He requested that the PSAC review the graffiti ordinance and take a look at increasing the fines and penalties to violators. 2) Gave his condolences to the family of A.A. "Bud" Attridge. He noted that he had known Mr. Attridge for 20 years. He noted Mr. Attridge was involved in Lake Elsinore politics and was a hands-on elected official serving with EVMWD for 2 terms. He noted that the City lost a great friend and he would be greatly missed. Mayor Magee closed the City Council Meeting in honor of A.A. "Bud" Attridge.
