CALL TO ORDER
Mayor Magee called the Joint Study Session to order at 4:00 p.m.

Also present were: City Manager Brady, City Attorney Leibold, Administrative Services
Director Pressey, Lake & Aquatic Resources Director Kiiroy, Public Works Director
Seumalo, Community Development Director Preisendanz, Parks & Recreation Director
Gonzales and Interim City Clerk Soto.
DISCUSSION ITEMS
Mayor Magee gave an overview of the presentations and confirmed that the awardees
would be present at the 7:00 p.m. meeting.

CONSENT CALENDAR
1. Warrant List - Auqust 15, 2007
Mayor Pro Tem Hickman requested clarification of various checks issued on the
warrant list. Staff clarified the items.
2. Claims aqainst the Citv

Mayor Pro Tem Hickman inquired on the Lake Elsinore West Marina claim.
Lake & Aquatic Resources Director Kilroy indicated the City was providing
algaecide application services to Elsinore West Marina, at their direction, while
two individuals were trying to launch their boats.
3. Status of the General Plan Update and Environmental Impact Report for the Citv
of Lake Elsinore
No comments.
4. Authorization for the CitV Manaqer to enter into contract with Templeton Planninp
Group to prepare CEQA compliance documents for the residential development
proiect known as "Classic Pacific Courtvard Estates"
Mayor Pro Tem Hickman inquired if any of the residents from the Butterfield
Village Mobile Home Park had any comments related to the item.
Mayor Magee indicated he did not receive a single phone call.
Mayor Magee thanked staff for notifying all of the residents of the Mobile Home
Park.
5. Adopt a Resolution of Intention to establish Communitv Facilities District No.
2007-4 (Makenna Court) and Resolution of Intention to incur bonded
indebtedness
Mayor Pro Tem Hickman inquired if the tax rate would be 2% or 1.9%. He
suggested the percentage should be lower due to foreclosures in the housing
market.
Administrative Services Director Pressey indicated the tax rate was 1.2%. He
noted the tax rate would hedge against future anticipated reductions in home
prices.
Mayor Pro Tem Hickman inquired if the City currentiy tracked foreclosures.
Administrative Services Director Pressey confirmed.
6. Approve Professional Services Aqreement with Harris & Associates for
assessment enqineerinq and speciai tax consultinq services
City Treasurer Weber inquired if any other firms were considered.
Administrative Services Director Pressey stated past work was reviewed when
renewing contracts. He noted the work the firms had done were taken into

consideration. He stated that Harris & Associates had done an excellent job thus
far. He indicated that sometimes it was a economic benefit to renew contracts.
He commented on how Harris & Associates reduced their fees by 10%. He
recommended approval of the item.
7. Notice of Completion for "Citv Park" restauranUrestroom buildinq
Mayor Magee noted the project came in under budget. He indicated he noticed a
big change over the course of the last several months.

34. Response to 2006-07 Grand Jury Report: Eisinore Vallev Cemeterv flood control
Mayor Pro Tem Hickman inquired why the City had to respond.
Mayor Magee indicated it was a legal requirement that whomever was named in
the report, was required to respond within 90 days.
Mayor Magee stated staff did an exceptional job with the response and to help
rectify the situation.

City Manager Brady noted staff had visited the site and did an inspection. He
indicated City staff had initiated a meeting with the Flood Control District to
discuss the issue.
35. Consideration of Commercial Design Review No. 2006-10 for the prolect known
as "Lake Elsinore RV Resort"
Mayor Pro Tem Hickman inquired if the Lake Elsinore RV Resort was going to
develop the area.
Lake & Aquatic Resources Director Kilroy indicated the plans were what was
being presented to Council at the 7 o'clock meeting.
Councilmember Kelley stated she was pleased with the landscaping and
amenities. She noted she was not in favor of the design of the building. She
inquired how willing the applicant would be to go back and review the exterior of
the building.
Community Development Director Preisendanz noted the applicant was present.
He commented that one of the illustrations was not very ciear and did not offer a
true perspective of the building.
Mayor Magee indicated the item could be continued in order to have the
applicant enhance the design of the building significantly.
Councilmember Kelley suggested having a discussion with the applicant in
regard to the design of the building.
Mayor Magee stated he was pleased to see more campers enjoying the facility.
He indicated the applicant had pulled their grading permit; however, no grading
had been done thus far. He noted his disappointment with the prolonged delay
of the project and inquired when the project would start.
Lake & Aquatic Resources Director Kilroy indicated the project needed to be
completed by April 15, 2009.
36. Commercial Desiqn Review No. 2007-11 for a proposed shell retail buildinq and
fast food restaurant with a drive-thru located at 29541 Central Avenue
Mayor Pro Tem Hickman inquired if there was a particular franchise in mind to be
utilized by the shell.
City Manager Brady indicated one franchise has expressed an interest.

Mayor Magee inquired if there was adequate parking if both units were utilized as
a restau~ant. He further inquired if the parking lot met the Parking Code
requirements.
Community Development Director Preisendanz confirmed.
Mayor Magee inquired if the drive-thru met the City's stacking requirements.
Community Development Director Preisendanz confirmed.
37. Extension of time for Tentative Parcel Map No. 32674 for condominium purposes
(Riverlake Villas)
Mayor Magee stated the property was in horrible condition. He inquired if the
item could be continued to allow the applicant to bring the property up to
presentable standards.
Community Development Director Preisendanz confirmed.
A representative for the applicant stated landscaping maintenance was done to
the property on an annual basis. He indicated they worked with Code
Enforcement on a monthly basis due to the trees and transients on the property.
Mayor Magee indicated the property's current condition was unacceptable.
The representative for the applicant commented that they would assess the land
and make sure everything was acceptable.
38. Infrastructure and Facilities Reimbursement Aqreement
City Manager Brady introduced the item. He noted representatives from Toyota
were present to give a presentation and answer questions.
Will Nicholas, Toyota Motor Sales, indicated Toyota was hoping to establish
retail representation in southern Riverside County along the I-15 corridor. He
gave a presentation on the dealership, the benefits, location and projected sales
tax revenue.
Mayor Pro Tem Hickman inquired on the sales tax revenue and what Toyota
would be asking for as an incentive.
Mr. Nicholas indicated Toyota was looking for 50% of the sales tax for the first
six years split.
Mayor Pro Tem Hickman inquired if there were adequate parking spots for the
employees.
Mr. Nicholas responded Toyota has very high parking standards: He noted,
unfortunately, they were a little shy of their standard with the Lake Elsinore
facility.
Mayor Pro Tem Hickman inquired if there was a chance Toyota would do a sales
tax agreement for five years instead of six.
Mr. Nicholas indicated it would not be likely. He stated the 6~h year was crucial
and was when the store would break out with an operating profit.
City Treasurer Weber inquired if the project would be compiete in 2010.
Mr. Nicholas confirmed.
Mayor Pro Tem Hickman inquired if Lexus would come to the City.
Mr. Nicholas stated Lexus generally trailed Toyota.
Mayor Magee inquired on Toyota's philosophy toward charitable and civic
donations and involvement. He further inquired if Toyota would get involved in
community activities.
Mr. Nicholas indicated Toyota encouraged their dealership operators to be
members of the community. He indicated Toyota had a program which created
affiliations with local trade schools to help train technicians.
Mayor Magee stated it was important to give back to the community.
Councilmember Kelley noted the importance of a dealership conducting public
outreach for construction.
Mr. Nicholas stated Toyota would be pro-active in that regard.

PUBLIC COMMENTS
Marie Tulasosopo, Lake Elsinore resident, stated her concerns with her
neighborhood. She indicated two major constructions projects went up on the west side
of her neighborhood. She commented on the negative impacts of the construction and
how the construction workers had abused her neighborhood's dirt road. She stated it
was important to have the road paved.
Mayor Magee thanked Ms. Tulasosopo for her comments and directed her to speak with
Public Works Director Seumalo in regard to having the developer pay for repairs to her
house. He commented on the 6-year plan for the dirt streets paving program and
indicated he would like to have Elm Street added to the plan. He stated the City had an
obligation to ensure that a developer was a good neighbor.
Mayor Pro Tem Hickman inquired on the identity of the developer.
Community Development Director Preisendanz indicated the developer was Alliance.
City Manager Brady pointed out the Engineering Department has already started
working on an estimate for the cost of paving Elm Street.
