VARIOUS PARCELS IN THE BUSINESS DISTRICT OF THE CITY TO
ZONES CONSISTENT WITH THE GENERAL PLAN DESIGNATIONS
THEREIN.
Recommendation
1. Adopt Resolution No. 2013 -018; A Resolution of the City Council of the City of
Lake Elsinore Approving General Plan Amendment No. 2013 -01, based on the
Findings and as shown on Exhibits `A' through 'E.'
2. Waive further reading and introduce by title only: ORDINANCE NO. 2013 -1312
ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE,
CALIFORNIA, AMENDING THE CITY OF LAKE ELSINORE MUNICIPAL CODE,

TO ZONES CONSISTENT WITH THE GENERAL PLAN DESIGNATIONS
THEREIN, by roll call vote.
Background
The City of Lake Elsinore adopted an update to its General Plan on December 13,
2011. On September 25, 2012, the City Council approved Phase I of the Consistency
Zoning Project which identified those properties within the City of Lake Elsinore
designated for Commercial Mixed Use, Residential Mixed Use and High Density
Residential development and changed their zones appropriately.
Phase II of the Consistency Zoning Project will bring the Official Zoning Map of the City
of Lake Elsinore into conformance with the adopted General Plan for the Business
District. The Business District, which is located in the north central areas of the City
along Interstate 15 and State Route 74, was selected for Phase II because it contains
the largest concentration of industrial and commercial uses within the City. Most recent
development inquiries have involved properties in this District, and the Chamber of
Commerce requests that the City promote the use of the Brine Line that traverses this
District. Phase II also includes the establishment of the Public /Institutional zoning
district and "clean -up" amendments to the General Plan.

At their regularly scheduled hearing on March 19, 2013, the Planning Commission
unanimously approved Resolution No. 2013 -45, recommending that the City Council
approve General Plan Amendment No. 2013 -01; unanimously approved Resolution No.
Resolution No. 2013 -46, recommending that the City Council approve Zoning Code
Amendment No. 2013 -03; and unanimously approved Resolution No. 2013 -47,
recommending that the City Council approve Zone Change No. 2013 -01.
Discussion
General Plan Amendment No. 2013 -01
General Plan Compatibility Matrix
General Plan Amendment No. 2013 -01 includes the following changes to the General
Plan Compatibility Matrix (Appendix B), as shown on Attachment 1, Exhibit'A':
1) In the Lakeside designation, removing the R -1 Single Family Residential Zone and
adding the L Lakeshore Zone (which is currently being drafted).
2) Adding the Floodway designation to the matrix, and signifying the OS Open Space
Zone as compatible.
3) Adding the P -1 Public /Institutional Zone to the matrix, and signifying that it is a
compatible zone in every General Plan designation.
4) Adding C -M Commercial Manufacturing and M -1 Limited Manufacturing as a
compatible zone in Business Park designation.
Based upon comments received during the Community Outreach process, Planning
Staff recommended that a wider range of options in the Business Park designation be
established by adding the M -1 (Limited Manufacturing) and C -M (Commercial
Manufacturing) zones to the General Plan /Zoning Compatibility Matrix. With this
addition, the retention of existing M -1 zoning would be feasible, and the City would be
acknowledging and supporting viable industry. The Commission heard testimony from
three property or business owners along Crane Street who concurred with Staff's
recommendation and requested that the Commission retain the existing M -1 (Limited
Manufacturing) zoning on their properties by approving Staff's recommendation.
Planning Commissioners appreciated the feedback from the community, and Staffs
solution.
Redistricting
Phase II covers "cleanup" changes to the boundaries of General Plan districts:
1) With the successful completion of Annexation No. 81 (Third Street Annexation) in
September 2012, changes to the General Plan maps are proposed which would

move the 320 acres from the North Central Sphere District into the adjacent
districts. Residential properties would be moved to the Lake Elsinore Hills District
to the east and non - residential properties (including commercial and industrial
properties) would be moved to the Business District to the west.
2) During its public hearing regarding adoption of the General Plan in December
2011 the City Council directed Staff to include an amendment of the boundaries
between the Lake View District and the Alberhill District as part of the first
amendment to the General Plan. The "clean -up" amendment includes this
change whereby the commercial area on the west side of Lake Street, between
Running Deer and Mountain would be moved from the Lake View District to the
Alberhill District.
These measures are shown on Attachment 4 (the colored 11 X 17 maps distributed
under separate cover), Annexation 81 Redistricting Exhibit 'D' and Alberhill Commercial
Exhibit 'E.' The changes to the General Plan Pages NCS -5, BD -6, LEH -8, AH -6 and LV-
6, which summarize land uses and distribution in table format are shown on Attachment
1, Exhibit'B.'
Zone Code Amendment No. 2013 -03
Phase II includes the creation of a new zone, the P -1 Public /Institutional Zone, which is
proposed for properties owned by the City, County, or public agencies such as the
school and water districts. Such properties are generally not subject to the development
standards of the Lake Elsinore Municipal Code ( "LEMC "). A detailed list of land uses
permitted in the P -1 zone is contained in the text (See Attachment 2, Exhibit 'A').
Phase 11 also proposes to "cleanup" the land use designations at the Elsinore Valley
Cemetery, changing the designation of non - cemetery properties from Public /Institutional
to Limited Industrial, as shown on Attachment 4, Existing Industrial Exhibit 'C.'
Zone Change No. 2013 -01
The proposed zone changes to make zoning compatible with the General Plan
designations in the Business District are shown in three exhibits, Areas 1, 2 and 3.
These exhibits indicate existing zoning, the General Plan designation, and proposed
zone change only. To view the entire Business District proposed zones, please see
Zoning Consistency Business District. All exhibits are part of Attachment 4 Color 11 X
17 Exhibits.
Fiscal Impact
None. With the proper zoning in place consistent with the General Plan, development of
applicable projects are expedited, and may provide positive revenue to the City in the
future.

Environmental Determination
The City certified a Recirculated Program Environmental Impact Report (RP -EIR) for the
update to its General Plan. The proposed General Plan Amendment No. 2013 -01, Zone
Code Amendment No. 2013 -03, and Zone Change No. 2013 -01 to the City's Official
Zoning Map implements the General Plan update, applying appropriate zoning districts
compatible with their land use designations. No additional environmental review is
required.

WHEREAS, the City of Lake Elsinore adopted an update to its General Plan on
December 13, 2011; and
WHEREAS, Government Code Section 65358 empowers the legislative body to
amend all or part of an adopted general plan if to do so would be in the public interest
and so long as no mandatory element of the general plan is amended more frequently
than four times during any calendar year; and
WHEREAS, General Plan Amendment No. 2013 -01 is part of the City's First (1S)
Cycle amendments to the Lake Elsinore General Plan for the 2013 calendar year; and
WHEREAS, on March 19, 2013 at a duly noticed public hearing, the Planning
Commission considered evidence presented by the Community Development
Department and other interested parties with respect to this item and made its
recommendation in favor of General Plan Amendment No. 2013 -01 by adopting
Planning Commission Resolution No. 2013 -45 recommending to the City Council
approval of General Plan Amendment No. 2013 -01; and

WHEREAS, on April 23, 2013 at a duly noticed public hearing, the City Council
has considered the recommendation of the Planning Commission as well as evidence
presented by the Community Development Department and other interested parties with
respect to this item.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE,
CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE AND ORDER AS
FOLLOWS:
SECTION 1. The City Council has reviewed and analyzed the proposed General
Plan Amendment pursuant to the California Planning and Zoning Laws (Cal. Gov. Code
§§ 65000 et seq.), the Lake Elsinore General Plan and the Lake Elsinore Municipal
Code and finds and determines that the proposed General Plan Amendment is
consistent with the requirements of California Planning and Zoning Law and with the
goals and policies of the Lake Elsinore General Plan and the Lake Elsinore Municipal
Code.
SECTION 2. That in accordance with the California Planning and Zoning Law
and the Lake Elsinore Municipal Code, the City Council hereby makes the following
findings for the approval of General Plan Amendment No. 2013 -01:
1. The proposed General Plan Amendment will not be detrimental to the health,
safety, comfort or general welfare of the persons residing or working within the
neighborhood of the proposed amendment or within the City, or injurious to the
property or improvements in the neighborhood or within the City.
a. The proposed General Plan Amendment has been analyzed relative to
its potential to have detrimental effects to ensure that the health, safety
and welfare of surrounding residents will be protected.
b. The proposed General Plan Amendment adds land use designations to
the General Plan Compatibility Matrix and identifies compatible zones
therein.
C. The proposed General Plan Amendment appropriately identifies land
uses on the General Plan Land Use Map.
d. The proposed General Plan Amendment recognizes viable existing
development within the Business District and promotes their continued
use.
2. The proposed General Plan Amendment will permit reasonable development of
the area consistent with its constraints and will make the area more compatible
with adjacent properties.
The proposed General Plan Amendment applies appropriate zones that provide
development standards for reasonable buffering of adjacent uses.

3. The proposed General Plan Amendment would establish a land use density,
intensity and usage more in character with the subject property's location,
access, and constraints.
4. The proposed General Plan Amendment will not have a significant effect on the
environment.
The effects of the General Plan Amendment have been analyzed in the
Recirculated Program Environmental Impact Report (SCH #2005121019)
prepared for the City of Lake Elsinore General Plan and its related cases which
was certified on December 13, 2011, and adequate mitigation measures have
been prepared where necessary.
SECTION 3. Based upon the evidence presented, both written and testimonial,
and the above findings, the City Council hereby approves General Plan Amendment No.
2013 -01, as shown on the attached Exhibits 'A' through 'E'.
SECTION 4. This Resolution shall take effect from and after the date of its
passage and adoption.

The primary land uses are hillside residential and low density residential with nearly sixty-
three percent (62.68 %) and nearly eighteen percent (17.8 %) respectively of the total number of
acres. Table NCS -T1 below summarizes the distribution of land uses designations within the
North Central Sphere District. Chappter Two (2), Section A of the General Plan defines each land
use designation in terms of the allowable uses and density and intensity standards. Figure
NCS -1 illustrates the distribution and location of the land use designations.

The primary land uses are limited industrial and general commercial with approximately nearly
thirty ercent (29.68%) and sixteen percent (16.29%) respectively, of the total number of acres.
Table OT1 below summarizes the distribution of land uses within the Business District,
Chapter Two (2), Section A of the General Plan defines each land use designation in terms of the
allowable uses and density and intensity standards. Figure BD-1 illustrates the distribution and
location of planned land use.

The Primary land use is residential, with high density, hillside, low density, low - medium
density, medium density and residential mixed use totaling over 1,300 acres or thirty -one
percent (31.86 %) of the entire Alberhill District. Almost half of the District (43.83 %) is covered
by City- approved specific plans. Table AH -T1 below summarizes the distribution of land use
designations within the Alberhill District. Chapter Two (2), Section A of the General Plan
defines each land use designation in terms of the allowable uses, density and intensity
standards. Figure AH -1 illustrates the distribution and location of the land use designations.

ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LAKE
ELSINORE, CALIFORNIA, APPROVING ZONING CODE
AMENDMENT NO. 2013 -03, MODIFYING THE CITY OF LAKE
ELSINORE MUNICIPAL CODE, TITLE 17 — ZONING, ADDING
CHAPTER 17.106 "P -I PUBLIC /INSTITUTIONAL DISTRICT."
WHEREAS, the City of Lake Elsinore adopted an update to its General Plan on
December 13, 2011; and
WHEREAS, properties in the City have been designated "Public /Institutional' on
the General Plan Land Use Map; and
WHEREAS, an appropriate zone is not currently available that is entirely
consistent and compatible with the "Public /Institutional' designation; and
WHEREAS, Government Code Section 65103 empowers the legislative body to
implement the General Plan through actions including, but not limited to, the
administration of zoning ordinances; and
WHEREAS, Resolution No. 2004 -11 of the City of Lake Elsinore, which
establishes procedures and requirements for implementation of the Western Riverside
County Multiple Species Habitat Conservation Plan, specifically exempts the adoption
or amendment of any land use or zoning ordinance in Section IV — Exemptions: and
WHEREAS, on March 19, 2013 at a duly noticed public hearing, the Planning
Commission considered evidence presented by the Community Development
Department and other interested parties with respect to this item and made its
recommendation in favor of Zoning Code Amendment No. 2013 -03 by adopting
Planning Commission Resolution No. 2013 -46 recommending to the City Council
approval of Zoning Code Amendment No. 2013 -03; and
WHEREAS, on April 23, 2013 at a duly noticed public hearing, the City Council
has considered the recommendation of the Planning Commission as well as evidence
presented by the Community Development Department and other interested parties with
respect to this item.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE,
CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE AND ORDER AS
FOLLOWS:
SECTION 1. The City Council has reviewed and analyzed proposed Zoning
Code Amendment No. 2013 -03 pursuant to the California Planning and Zoning Laws
(Cal. Gov. Code §§ 65000 et seq.), the Lake Elsinore General Plan and the Lake
Elsinore Municipal Code (LEMC) and finds and determines that the proposed
Amendment is consistent with the requirements of California Planning and Zoning Law
and with the goals and policies of the Lake Elsinore General Plan and the LEMC.

SECTION 2. That in accordance with the California Planning and Zoning Law
and the LEMC, the City Council hereby makes the following findings for the Zoning
Code Amendment to the LEMC:
1. Proposed Zoning Code Amendment No. 2013 -03 will not be detrimental to the
health, safety, comfort or general welfare of the persons residing or working
within the neighborhood of the proposed amendment or within the City, or
injurious to the property or improvements in the neighborhood or within the City.
a. The proposed Zoning Code Amendment will be beneficial to the public
health, safety, comfort and welfare by specifying permitted and
conditionally permitted uses within the Public /Institutional designation
and specifying zoning districts within the City where the
Public /Institutional zone is appropriate.
2. Proposed Zoning Code Amendment No. 2013 -03 will permit reasonable
development of the area consistent with its constraints and will make the area
more compatible with adjacent properties.
a. The proposed Zoning Code Amendment includes a list of permitted
uses.
3. The proposed Zoning Code Amendment No. 2013 -03 would establish a land use
density, intensity and usage more in character with the subject property's
location, access, and constraints.
a. The proposed Zoning Code Amendment has identified existing public
and institutional uses consistent with General Plan land use
designations.
4. The proposed Zoning Code Amendment No. 2013 -03 will not have a significant
effect on the environment.
The potential impacts of the General Plan Update have been analyzed in the
Recirculated Environmental Impact Report (SCH #2005121019) prepared for the
City of Lake Elsinore General Plan and its related cases which was certified on
December 13, 2011, and adequate mitigation measures have been prepared
where necessary.
SECTION 3. Based upon the evidence presented, both written and testimonial,
and the above findings, the City Council hereby approves Zoning Code Amendment No.
2013 -03 to the City of Lake Elsinore Municipal Code, Title 17 — Zoning, adding Chapter
17.106 — PI Public /Institutional Zoning District, as shown on Exhibit "A."
SECTION 4. If any provision, clause, sentence or paragraph of this Ordinance or
the application thereof to any person or circumstance shall be held invalid, such

invalidity shall not affect the other provisions of this Ordinance and are hereby declared
to be severable.
SECTION 5. This Ordinance shall take effect thirty (30) days after the date of its
final passage. The City Clerk shall certify as to adoption of this Ordinance and cause
this Ordinance to be published and posted in the manner required by law.
PASSED, APPROVED AND INTRODUCED at a regular meeting of the City
Council of the City of Lake Elsinore, California, on this 23rd day of April, 2013 and
adopted at a regular meeting of the City Council of the City of Lake Elsinore, California,

There are properties in the City owned and maintained by public agencies
which are not subject to the development standards of the LEMC. Most of these
agencies abide by federal or state requirements, which take precedence over
local laws. However, such uses shall be identified and acknowledged as generally
unsuitable for residential purposes, but may contain a variety of facilities or
campuses for the provision of public services.
The purpose of the Public /Institutional Zoning District is to identify
structures, or campuses and facilities containing structures. Non - structural
facilities may be identified in the OS Open Space Zoning District, or in the R
Recreational Zoning District if the use promotes leisure activities such as sports,
marine preserves, or picnic grounds.

ELSINORE, CALIFORNIA, APPROVING ZONE CHANGE NO.
2013 -01, KNOWN AS THE CONSISTENCY ZONING PROJECT —
PHASE II, AMENDING THE OFFICIAL ZONING MAP, CHANGING
THE ZONING OF VARIOUS PARCELS IN THE BUSINESS
DISTRICT OF THE CITY TO ZONES CONSISTENT WITH THE
GENERAL PLAN DESIGNATIONS THEREIN.
WHEREAS, the City of Lake Elsinore adopted an update to its General Plan on
December 13, 2011, which established designations on various properties throughout
the Business District of the City, as presented on the General Plan Land Use Plan; and
WHEREAS, Ordinance No. 2013 -1312 was introduced on April 23, 2013 and
adopted on May , 2013, which put in place the Public /Institutional Zoning District
in the Lake Elsinore Municipal Code (LEMC) that provides development standards for
the Public /Institutional designation; and
WHEREAS, Government Code Section 65103 empowers the legislative body to
implement the General Plan through actions including, but not limited to, the
administration of zoning ordinances; and
WHEREAS, Government Code Section 65860 requires that a city's zoning
ordinances be consistent with its general plan; and
WHEREAS, Resolution No. 2004 -11 of the City of Lake Elsinore, which
establishes procedures and requirements for implementation of the Western Riverside
County Multiple Species Habitat Conservation Plan, specifically exempts the adoption
or amendment of any land use or zoning ordinance in Section IV — Exemptions; and
WHEREAS, after considering Zone Change No. 2013 -01 at their regular meeting
held on March 19, 2013, the Planning Commission of the City of Lake Elsinore
recommended that the City Council approve Zone Change No. 3013 -01; and
WHEREAS, on March 19, 2013 at a duly noticed public hearing, the Planning
Commission considered evidence presented by the Community Development
Department and other interested parties with respect to this item and made its
recommendation in favor of Zone Change No. 2013 -01 by adopting Planning
Commission Resolution No. 2013 -47 recommending to the City Council approval of
Zone Change No. 2013 -01; and
WHEREAS, on April 23, 2013 at a duly noticed public hearing, the City Council
has considered the recommendation of the Planning Commission as well as evidence
presented by the Community Development Department and other interested parties with
respect to this item.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE,
CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. The City Council has reviewed and analyzed the proposed zone
changes pursuant to the California Planning and Zoning Laws (Cal. Gov. Code §65000
et seq.), the Lake Elsinore General Plan and the Lake Elsinore Municipal Code and
finds and determines that the proposed zone changes are consistent with the
requirements of California Planning and Zoning Law and with the goals and policies of
the Lake Elsinore General Plan and the LEMC.
SECTION 2. Pursuant to Section 21080 (c) (2) of the California Environmental
Quality Act (CEQA), the City Council determines that the Recirculated Program
Environmental Impact Report certified for the update to the General Plan is adequate
and prepared in accordance with the requirements of CEQA which analyzes
environmental effects of the Project. Because Zone Change No. 2013 -01 implements
the General Plan with the appropriate zoning districts for development within the
Business District of the City, no additional environmental review is required.
SECTION 3. That in accordance with the State Planning and Zoning Law, the
City Council hereby makes the following findings for the approval of Zone Change No.
2013 -01:
1. The proposed zone changes will not be detrimental to the health, safety, comfort
or general welfare of the persons residing or working within the neighborhood of
the proposed zone changes or within the City, or injurious to the property or
improvements in the neighborhood or within the City.
a. The proposed zone change implements the adopted General Plan
Update of December 13, 2011, which was analyzed relative to its
potential to have detrimental effects.
b. The proposed zone change will eliminate inconsistencies with the
adopted General Plan Update.
C. The proposed zone change will be beneficial to the public health,
safety, comfort and welfare and will improve the property in the
neighborhood and the City by allowing a variety of commercial and
industrial uses to be established in the Business District within the City.
2. The proposed zone changes will permit reasonable development of the area
consistent with its constraints and will make the area more compatible with
adjacent properties.
a. The proposed zone change places the heaviest industrial zones in
areas adjacent to floodways, thereby buffering heavy industrial uses
from commercial and residential uses.
b. The proposed zone change utilizes light industrial, commercial -
manufacturing and commercial - office zoning as transitional areas.

C. The proposed zone change takes into consideration existing, active
development as well as vacant properties.
3. The proposed zone changes would implement a land use density, intensity and
usage more in character with the subject property's location, access, and
constraints consistent with the adopted General Plan Update and subsequent
text amendments to the zoning code.
a. The proposed zone change places industrial uses in close proximity to
the Inland Empire Brine Line (Santa Ana Regional Interceptor, SARI),
a 93 mile long gravity pipeline that returns brackish water from
industrial uses to the Pacific Ocean.
b. The proposed zone change provides access to Interstate 15 and State
Highway 74, for truck traffic from industrial uses.
C. The proposed zone change offers development of commercial office
and commercial manufacturing as well as general commercial uses at
the hub created by the intersection of Interstate 15 and State Highway
74.
4. The proposed zone changes implement the goal of the Business District to
encourage its position as the industrial and commercial hub of the City, and to
ensure that new growth respects the environmental sensitivity of the natural
wetlands, floodway and floodplain.
a. Floodways are appropriately zoned in the Business District in
accordance with FEMA maps.
b. Public uses are appropriately zoned and identified.
5. The proposed zone changes will not have a significant effect on the
environment.
a. The potential impacts of the General Plan update have been analyzed

Planning Consultant Donahoe presented the staff report. She stated that staff
held a community meeting on February 20, 2013, and had a good turn out. She
reviewed changes /revisions to the zoning maps on PowerPoint and explained the
revisions. Also she stated that staff received a lot of phone calls, front counter
inquiries, and a -mails and she feels comfortable that property owners were
notified of the change.

Planning Consultant Donahoe noted that property owners, Michael Cargile, Said
Cohen, Eric Lent of Time Warner Cable, and Michael Gordon currently have M -1
zoning and would like to retain the M -1 zone instead of going to a C -O zone.
Planning Consultant Donahoe stated that after reviewing the Compatibility Matrix,
the Business Professional designation had a limited number of possible zones in
it. Therefore, she stated that staff is proposing that they expand the options by
adding the M -1 and C -M zones, as compatible zones in the Business
Professional Designation. She indicated that it would enable existing industrial
uses in the Business Professional designation of the General Plan to continue.
Planning Consultant Donahoe also stated that in a similar instance, there was M-
1 zoning originally on Flint Street on an existing set of industrial buildings and
because staff wants to encourage industrial uses in the Business District, they
believe they should restore these properties back to an M -1 zone. Therefore,
they are requesting that, as part of the cleanup of the General Plan Amendment,
they put this property back to the Limited Industrial designation; thereby allowing
the M -1 zone on that property, as well.

Chairman Morsch asked Planning Consultant Donahoe to explain why staff had
originally proposed changing zoning to C -O. Planning Consultant Donahoe
stated that during the consistency zoning, staff had to look at the General Plan's
compatibility matrix to see what options were available. That is why Staff is
recommending the change to the matrix to add the M -1 as a permitted zone in
the Business Professional land use designation.

Commissioner Gray stated that he appreciated staffs work and thinks that it is
well done.
Commissioner Jordan seconded Commissioner Gray's comment and indicated
that Planning Consultant Donahoe did a great job.
Vice Chairman O'Neal stated that he had a question about the Public /Institutional
zone and asked that as a courtesy, whether it is possible to get the Lake Elsinore
School District to review the plans before the traffic jams happen. He indicated in
particular, the problems at Rice Canyon Elementary. He asked if the City can get
a response from the School District. Planning Consultant Donahoe stated that
she agreed that the problem is horrendous and although it only lasts for an hour
in the morning and an hour in the afternoon, it is still very bad. She stated that
asking that the City request of the School District to help them with their planning,
has not been well received in the past and noted that the issue is that when the
District receives funding for a site and a design they are stuck with that design
and do not take into consideration what the City sees as possible conflicts. Vice
Chairman O'Neal stated that the design is unsafe with regards to the entrances
and exits, and when people are picking up their children, they double park which
is dangerous. Planning Consultant Donahoe stated that the City at one time had
a relationship with the Planning Department of the Lake Elsinore Unified School
District who on occasion, coordinated with the City regarding planning and
approval of maps. She suggested that the City can approach them again.
Chairman O'Neal stated that someone is going to get hurt or killed there. Public
Works Director Seumalo responded that the City has a good working relationship
with the School District but when it comes to building a school, if the funding is
there, they want it to be completed right away. He stated that they have
coordinated with a few "Safe Routes to School" funding grants but the City is on
the verge of losing the "Safe Routes to School" grant because the School District
wasn't prepared to do their share of the work and all the City can do is offer our
help and noted that the City will work with the School District as much as
possible.
Vice Chairman O'Neal stated that the Public Works Department adjusted traffic
lights for left turns, at Machado. Public Works Director Seumalo stated that are
looking into re- stripping the road on Lincoln to provide a left turn pocket.
Chairman Morsch asked if the School District's participation is mainly financial.
Public Works Director Seumalo stated no and explained that it requires them to
do some construction as well. He indicated that they are going to reconfigure
their on -site circulation and widen their driveway and the City's portion is to widen
the entrance in the right -of -way, as well as reduce the size of the median and put
in an additional signal.
Linda Ridenour stated that there is no safe way for the kids at Lakeshore High
School to walk to the Lakeland Village area and indicated that someone has

already been killed there. Public Works Director Seumalo stated that the City
has been working on a project for almost a year and noted that the City has been
trying to process an encroachment permit through Caltrans to allow them to start
work on that project. He stated that the City received word that the contractor will
be receiving the encroachment permit from Caltrans later in the week. Work will
begin within two weeks. The project will provide a pathway on Riverside Drive
and Grand Avenue to Lakeside High School. He indicated that there will be a
Phase II to the project which is currently in design but there is no construction
funding at this time. He stated that there will be a signal light at Grand Avenue
and Riverside Drive which will facilitate pedestrian crossing and at the lake side
of the intersection.
Chairman Morsch asked if a sidewalk will be part of the "Safe Routes to School.
Public Works Director Seumalo stated that the City applied for "Safe Routes to
School in that area but were not successful. Therefore, the City applied for the
Senate Bill 821 grant funding which was successful.
Commissioner Blake stated that the report that Planning Consultant Donahoe did
was very impressive and thanked her for her work. 'He` asked what the process
was for determining Public /Institutional zones. Planning Consultant Donahoe
stated that staff took a look at the existing buildings_ that may not remain as
Public /Institutional uses and they kept their existing zoning rather than forcing
them into a Public /Institutional zone. City ;Attorney Leibold stated that if there
was a Public /Institutional General Plan designation, then it changed for zoning
consistency. She stated that if those parcels want to change the use of the
property, they would have to go through a General Plan Amendment and a zone
change and noted that staff did make sure that the zoning designations matched
the General Plan desiqnations.
Chairman Morsch asked Planning Consultant Donahoe to explain why under
Zone Code Amendment No. - 2013 -03, where staff is adding Chapter 17.106
Public /Institutional District to the "Municipal Code. The Motion states that an
appropriate zone is not currently available but is entirely consistent and
compatible with the Public /Institutional designation. Planning Consultant
Donahoe explained that the City didn't have a Public /Institutional zone and the
only current options would be Recreation or Open Space and neither of those
applied. She stated that the City needs a zone that clearly states that these are
public uses, or institutional uses that generally are not governed by the Municipal
Code.
Chairman Morsch asked that when the City adopts a Specific Plan for an area,
why there isn't a zone change concurrently processed with that Specific Plan
adoption. City Attorney Leibold stated that the Specific Plan is the zoning
designation and noted that zoning provides for specific land use designations
and the alterative to zoning is a Specific Plan which also provides for specific
land use designations.

Planning Consultant Donahoe clarified the changes that will be made to the
General Plan /Zoning Compatibility Matrix to the Commission, as noted in the
staff report.
Motion by Commissioner Jordan and seconded by Commissioner Gray to
approve Resolution No. 2013 -45, a Resolution of the Planning Commission of
the City of Lake Elsinore, California, recommending that the City Council of the
City of Lake Elsinore approve General Plan Amendment No. 2013 -01, modifying
the General Plan Compatibility Matrix (Appendix B) by adding the "Floodway"
Designation, the "L Lakeshore" and "P -1 Public /Institutional' zones, adding the
"M -1 Limited Manufacturing" zone as a compatible zone in the 'Business Park"
designation, and changing the Compatible zone in the "Lakeside" designation
from "R -1 Single - Family Residential' to "L Lakeshore;" relocating the Non -
Residential areas of Annexation No. 81 from the North Central Sphere District to
the Business District; relocating the Residential Areas of Annexation No. 81 from
the North Central Sphere District to the Lake Elsinore Hills District; relocating the
Commercial Area on the west side of Lake Street,. between Running Deer and
Mountain, from the Lake View District to the Alberhill District; changing the Land
Use designation of Non - Cemetery properties from "Public /Institutional' to
"Limited Industrial ;" and changing the Land Use designation of existing industrial
Properties on the south side of Flint Street from "High Density Residential' to
"Limited Industrial. "; Motion passed 5 -0.
Motion by Commissioner Gray and seconded by Commissioner Jordan to
approve Resolution No. 2013 -46, a Resolution of the Planning Commission of
the City of Lake Elsinore,' California, recommending that the City Council of the
City of Lake Elsinore, California approve Zoning Code Amendment No. 2013 -03,
modifying the City of Lake Elsinore Municipal Code, Title 17 — Zoning, adding
Chapter 17.106_ "P /I Public /institutional District. ": Motion passed 5 -0.
Motion by Commissioner Gray and seconded by Commissioner Jordan to
approve Resolution No. 2013 -47, a Resolution of the Planning Commission of
the City of Lake Elsinore, California, recommending that the City Council of the
City of Lake Elsinore, California approve Zone Change No. 2013 -01, known as
the Consistency Zoning 'Project — Phase II, changing the zoning of various
parcels in the Business District of the City to zones consistent with the General
Plan designations therein, and as amended in Area 2; Motion passed 5 -0.

17.106.010 Purpose.
There are properties in the City owned and maintained by public agencies
which are not subject to the development standards of the LEMC. Most of these
agencies abide by federal or state requirements, which take precedence over
local laws. However, such uses shall be identified and acknowledged as generally
unsuitable for residential purposes, but may contain a variety of facilities or
campuses for the provision of public services.
The purpose of the Public /Institutional Zoning District is to identify
structures, or campuses and facilities containing structures. Non - structural

VARIOUS PARCELS IN THE BUSINESS DISTRICT OF THE CITY TO
ZONES CONSISTENT WITH THE GENERAL PLAN DESIGNATIONS
THEREIN.
Background
The City of Lake Elsinore adopted an update to its General Plan on December 13,
2011. On September 25, 2012, the City Council approved Phase I of the Consistency
Zoning Project.
Proiect Description
The City now proposes to undertake Phase II of the Consistency Zoning Project,
bringing the Official Zoning Map of the City into conformance with the adopted General
Plan for the Business District (BD).
The BD was selected for Phase II because it contains the largest concentration of
industrial and commercial uses within the City. Most recent development inquiries have
involved properties in this District, and the Chamber of Commerce requests that the City
promote the use of the Brine Line that traverses this District.
Discussion & Analysis
Notification and Community Meeting
On February 1, 2013, Staff mailed 214 notifications to the property owners of the 432
parcels proposed for this zone change. There were several duplicative owners,
particularly the Elsinore Valley Municipal Water District, the Elsinore Valley Cemetery
District, Riverside County and the City. The notification invited property owners to attend
a Community Meeting on February 20, 2013 at the Senior Center, to meet Staff and
hear about the Consistency Zoning Project, to obtain detailed information on the various
zones proposed, and to voice their concerns and ask questions. The
notification /invitation letter is Attachment 5 to this Staff Report. Subsequent to the
mailing, Staff received approximately 15 -20 phone and e-mail inquiries and front
counter visits, and 25 -30 people attended the Community Meeting.
Existing Industrial Buildings
Staff spoke with Michael Cargile at the Community Meeting, who indicated that he did
not want the existing M -1 (Limited Manufacturing) zone changed on his already
constructed and occupied building on Crane Street. He and his neighbor Said Cohen
subsequently sent written requests, which are attached to this Staff Report as
Attachment 6. Staff desires to honor these requests, and recommends that the
Compatibility Matrix provide a wider range of options in the Business Park designation
by adding the M -1 zone as compatible. With this addition, Mr. Cargile and Mr. Cohen
will retain the existing M -1 zoning on their properties.

In a similar instance, Staff is recommending that the M -1 zoning on the west side of Flint
Street be restored because there are existing industries on these properties. Returning
these properties to a Limited Industrial designation on the General Plan Land Use Map
is part of the "cleanup" GPA in Phase II. Its current GP designation is High Density
Residential, as are the properties west and south. See Attachment 2, Existing Industrial
Exhibit 'C.'
In both instances Staff believes that existing viable industry should be recognized and
supported as the highest and best use of property in the Business District. While the
existing businesses could have continued to operate as a non - conforming use if given
another zone, the businesses would not been allowed to expand.
Request for Zoning based on Future Realignment of Nichols Road
Staff spoke with Mr. George Koliber by phone and e-mail regarding his properties at the
southwest corner of Nichols Road and Collier. He referred to the realignment of Nichols
Road proposed by Castle and Cooke for their Alberhill project on the north side of
Pierce, which would bisect his property. He requests that the portion of his property that
would result on the north side of Nichols and Pierce be zoned commercial. Staff has
determined that the proposed design for the realignment is premature at this time, and
may not reflect the ultimate alignment of Baker, Pierce, Nichols and Collier roadways in
this area. Until such time as the alignments of these streets come to fruition, the
unknown scope, size, and adjacent uses precludes Staff from recommending a zone
change that split -zones Koliber's parcel. At a future time if a realignment actually bisects
this property, the City could entertain a change to the Commercial Manufacturing.
Redistricting
Phase II covers three "cleanup" changes to the boundaries of General Plan districts:
1) The properties recently added to the City's boundaries as a result of the
successful completion of Annexation No. 81 (Third Street Annexation), are
proposed to be removed from the North Central Sphere District. Residential
properties are proposed to be added to the Lake Elsinore Hills District adjacent to
the east.
2) Non - residential properties within the Annexation No. 81 area, both commercial
and industrial, are proposed to be added to the Business District to the west.
3) At the Council's direction in December 2011 during the adoption of the General
Plan Update, the commercial area on the west side of Lake Street, between
Running Deer and Mountain, is proposed to be removed from the Lake View
District, and added to the Alberhill District.
These measures are shown on Attachment 2 (the colored 11 X 17 maps distributed
under separate cover), Annexation 81 Redistricting Exhibit 'D' and Alberhill Commercial
Exhibit'E.' The changes to the General Plan Pages NCS -5, BD -6, LEH -8, AH -6 and LV-

6, which summarize land uses and distribution in table format are shown on Attachment
1, Exhibit 'B.'
P -1 Public /Institutional Zoning
Phase II includes the creation of a new zone, the P -1 Public /Institutional Zone, which is
proposed for properties owned by the City, County, or public agencies such as the
school and water districts. Such properties are generally not subject to the development
standards of the LEMC. The Draft Resolution for ZCA No. 2013 -03 and its attached
Exhibit 'A' describing the P -1 zone is attached to this Staff Report in Attachment 2.
Phase II proposes to "cleanup" the land use designations at the Elsinore Valley
Cemetery, changing the designation of non - cemetery properties from Public /Institutional
to Limited Industrial, as shown on Attachment 4, Existing Industrial Exhibit'C.'
General Plan Amendment — Compatibility Matrix
Phase II includes the following changes to the General Plan Compatibility Matrix
(Appendix B), as shown on Attachment 1, Exhibit'A':
1) In the Lakeside designation, removing the R -1 Single Family Residential Zone
and adding the L Lakeshore Zone.
2) Adding the Floodway designation to the matrix, and signifying the OS Open
Space Zone as compatible.
3) Adding the P -1 Public /Institutional Zone to the matrix, and signifying that it is a
compatible zone in every General Plan designation.
4) Adding M -1 Limited Manufacturing as a compatible zone in Business Park
designation. See Staffs discussion above under "Existing Industrial Buildings."
Zone Change No. 2013 -01
The proposed zone changes to make zoning compatible with the General Plan
designations in the Business District are shown in three exhibits, Areas 1, 2 and 3.
These exhibits indicate existing zoning, the General Plan designation, and proposed
zone change only. To view the entire Business District proposed zones, please see
Zoning Consistency Business District. All exhibits are part of Attachment 4 Color 11 X
17 Exhibits.
Environmental Determination
The City certified a Recirculated Program Environmental Impact Report (RP -EIR) for the
update to its General Plan. The proposed General Plan Amendment No. 2013 -01, Zone
Code Amendment No. 2013 -03, and Zone Change No. 2013 -01 to the City's Official
Zoning Map implements the General Plan update, applying appropriate zoning districts
compatible with their land use designations. No additional environmental review is
required.

Recommendation
Staff recommends that the Planning Commission take the following action:
1. Approve Resolution No. 2013 - recommending to the City Council approval
