SUBJECT: PUBLIC HEARING FOR CONSIDERATION OF OBJECTIONS TO THE
CITY'S WEED ABATEMENT PROGRAM
RECOMMENDATION
It is recommended that the City Council open the Public Hearing and consider objections to
the City's weed abatement program.
BACKGROUND
Pursuant to City Municipal Code, Chapter 8.32, Weed and Rubbish Abatement, the City
held a Public Hearing on January 22, 2013, to adopt a resolution declaring weeds, rubbish,
refuse and dirt on private properties to be a nuisance and order the abatement thereof. Per
the code, the City is also required to hold a Public Hearing to consider any objections by
property owners to the proposed removal of weeds, rubbish, refuse and dirt should the
owners neglect to clear their properties.
DISCUSSION
At the regularly scheduled meeting of January 22, 2013, the City Council approved
Resolution 2013 -009, declaring weeds, rubbish, refuse and dirt dumped on private property
a nuisance. Shortly after the Council approval, approximately 7,500 weed abatement
notices were mailed to property owners throughout the City informing them of their
responsibilities to remove the nuisances.
According to the program, property owners have until May 6, 2013, to abate their parcels
before City staff begins weed abatement on �rivate property. Should City's staff abate a
privately owned property beginning May 6f , the owner will be assessed the cost of
abatement at a rate of $0.02 per square foot plus a $306.00 Administrative Fee. This
public hearing provides an opportunity for the property owners to have their protests heard
by the City Council.
