YATES CITY MANAGER DATE: MARCH 26, 2013 SUBJECT: DESIGN CONTRACT CHANGE ORDER TKE ENGINEERING, INC. SB 821 SIDEWALK IMPROVEMENTS FY 12 -13 Recommendations 1. Authorize the acceptance of SB 821 Grant FY 2012/2013 for the addition of Mill Street Sidewalks in the amount of $44,158. 2. Authorize the Design Contract Change Order for the SB 821 Sidewalk Improvements FY 12/13 to include the design of Mill Street between Avenue 6 to Avenue 9 to TKE Engineering, Inc. in the not to exceed amount of $23,800.00. 3. Authorize the City Manager to execute the Design Contract Change Order with TKE Engineering, Inc. 4. Authorize the use of $23,800 from Fund No. 110 Gas Tax. Background At various locations in the City of Lake Elsinore there are locations without sidewalks for students and residents to use to walk to various destinations. Senate Bill 821 or SB 821 is a State level program that provides funding for bicycle and pedestrian facilities including sidewalk infill projects. In 2012, City staff was successful with an application for sidewalk infill located on Heald Avenue and Lowell Street. This project is currently in design. The SB 821 program requires matching funds from the local jurisdiction and for this project, Gas Tax funding was approved as the program match. AGENDA ITEM NO. 6 Page 1 of 6 Discussion On October 23, 2012 City Council awarded the design of the 2012 cycle of SB 821 Sidewalk Improvements to TKE Engineering, Incorporated. On February 4, 2013 the City was notified by Riverside County Transportation Commission staff that supplemental funding was available and additional projects were added to the current SB 821 Grant Cycle. Included with the approved supplemental projects was the sidewalk improvement on Mill Street near Elsinore Middle School in Lake Elsinore. Staff is preparing a Design Contract Change Order to include the improvements on Mill Street to be incorporated in the current SB 821 design contract with TKE Engineering. The revised project scope will involve preparation of additional engineering plans and specifications for the Mill Street sidewalk extending from Avenue 6 to Avenue 9. This design change order will allow the Mill Street Sidewalk Improvements to be included with the construction of the Heald Avenue and Lowell Street Improvements. FISCAL IMPACT Project design funding is from Fund 110, Gas Tax. (TKE) has been requested to provide services beyond those presented in our original agreement. The original limits of design have been extended along Mill Street from Avenue 6 to Avenue 9 to incorporate additional curb, gutter and sidewalk installation. The original contract length of 1,420 linear feet of Street and sidewalk design was amended to include an additional 1,030 linear feet for a total of 2,450 linear feet of street and sidewalk design. The additional length results in scope of services increase of 73% to the following tasks: Task 1 - Records Research To acquire the existing survey data and utility maps for the additional project area, TKE will be required to do additional research and provide letters to all existing utility companies within the project area, requesting they provide the additional maps. TKE will send letters to utility companies and agencies requesting their data and will maintain copies of the letters for future reference. Task 2 — Design Survey TKE will perform additional surveying in accordance with our scope of services and the increased project area limits. Task 5 - Final Design TKE will perform additional final design services in accordance with our scope of services and the increased project area limits. Fee Description Amount Task 1 - Records Research $ 1,340 Task 2 - Design Survey $ 3,650 Task 3 - Base Construction Drawings $ 2,720 Task 4 - Progress Designs $13,080 Task 5 - Final Design $ 3,010 Total: $23,800 Therefore, we request that the City consider adjusting our original SB 821 Sidewalk Improvement FY 12 -13 Design Budget of $38,800 to a total of $62,600.
