HomeMy WebLinkAbout Item No. 12REPORT TO CITY COUNCIL TO: HONORABLE MAYOR MAGEE AND MEMBERS OF THE CITY COUNCIL; AND HONORABLE CHAIRMAN MORSCH AND MEMBERS OF THE PLANNING COMMISSION FROM: GRANT YATES CITY MANAGER DATE: FEBRUARY 12, 2013 SUBJECT: DRAFT 2014 -2021 HOUSING ELEMENT STUDY SESSION RECOMMENDATION It is recommended that the City Council and Planning Commission conduct a Joint Study Session to discuss and receive comments to the draft Housing Element and authorize staff to submit the draft Housing Element to the State Department of Housing and Community Development subject to such modifications as directed. DISCUSSION Please find attached a copy of the Draft Housing Element for the 2014 -2021 planning period which has been prepared by Hogle- Ireland Consultants under the direction of Staff. The Draft analyzes the City's housing with respect to its projected 2014 -2021 Regional Housing Needs Allocation (RHNA). This document reflects the most current and available data and incorporates processes as previously requested by the City Council. The Goals, Policies and Programs as described in the City's current Housing Element (adopted December 13, 2011) have been re- evaluated and refined. The Draft Housing Element is presented to you in a "redlined" format which shows how the current Housing Element has been revised for the Draft. The compact disk included in this packet provides you a clean version of the Draft. The Draft Housing Element is a public record and is available to the public on the City's Website. The document is on track to be submitted to the State Department of Housing and Community Development (HCD) in February 2013 for their review and approval. If the City is successful in obtaining HCD's approval and adopts its Housing Element AGENDA ITEM NO. 12 Page I of 2 Housing Element Study Session February 12, 2013 Page 2 of 2 before the deadline date of October 15, 2013, the Housing Element will be valid for the next eight years. However, should approval occur after the deadline date, the approved Housing Element will be limited to a four -year cycle, after which the City must again expend funds to prepare and submit a new Housing Element before the end of 2017. The following summarizes the applicable statutory framework and planning process: Background The Housing Element is one of seven mandatory components of the General Plan. State law generally requires Housing Elements to be updated every five years to reflect the community's changing housing needs. State law also requires that each draft Housing Element be submitted to the HCD and that the Department's findings be incorporated into the Housing Element prior to adoption or that the community make alternate findings pursuant to a self - certification process. The City's Housing Element consultants, Staff and City Attorney concur that the most defensible Housing Element is one certified by HCD and validly adopted by the City. Process At the Joint Study Session of the City Council and Planning Commission on February 12, 2013 the Draft Housing Element will be introduced to the City's decision - makers, the community, and to interested agencies and developers. The Session will serve as an Outreach Meeting wherein comments may be provided from residents, City leaders and all other interested persons. At the direction of the City Council, the consultants will prepare the final document for submittal to HCD. HCD is entitled to 60 days to review each submitted Housing Element document. Often multiple resubmittals are required. Once HCD notifies the City of its approval, Staff will return the Draft Housing Element to the Planning Commission and City Council for formal adoption.
