SUBJECT: TEMPORARY RIGHT OF ENTRY AND CONSTRUCTION EASEMENT
AGREEMENT
Recommendation
Approve the Temporary Right of Entry and Construction Easement for use in the
construction of a pedestrian and bicycle path along Grand Avenue and Riverside Drive
primarily serving Lakeside High School.
Background
The City has been awarded SB821 grant monies to be combined with Gas Tax,
Measure A funding and a Rubberized Asphalt grant to construct a path along Riverside
Drive to Grand Avenue ending at Lakeside High School. The project included new
concrete sidewalks where existing curb and gutter exists with ADA access ramps and a
pedestrian bridge over the existing Flood Control channel. Temporary asphalt
sidewalks are being placed where the ultimate street improvements are missing. The
installation of the new sidewalk segments will provide a safe pedestrian access to
Lakeside High School between Grand Avenue and the west entrance to Lakeside High
School.
Discussion
City staff has been processing an encroachment permit with Caltrans to perform the
construction detour and work relating to the installation of the path. In this process it
was discovered that Caltrans right -of -way did not extend as far as initially anticipated
and permission of the private land owner was required. Staff contacted the property
owner, Sunwood Lakeview, LLC, an investment group, and obtained a temporary right-

of- entry/Construction Easement agreement to allow the City's project to move forward.
Staff has reviewed the document and is recommending approval of the terms.
Fiscal Impact
The cost of processing the temporary easement is restricted to staff time which will be
borne through the funding for the project.

Subject: TEMPORARY RIGHT -OF -ENTRY / CONSTRUCTION EASEMENT
Sunwood Lakeview, LLC as the owner of Assessor's Parcel Number 379 - 050 -034,
have examined the construction plans for the project known as Bicycle and Pedestrian
Improvements Riverside Drive, Project No.4356, and hereby consent to permit the
City of Lake Elsinore, a municipal corporation in the State of California, its officers,
agents and employee and persons under contract with said City and their employees,
the privilege and right to enter upon or across the above described parcel (s) for the
purpose of constructing planned improvements as shown on the construction plans.
The City shall save harmless and indemnify the undersigned against any and all claims,
demands, suits, judgments, expenses and costs, on account of injury to, or death of
persons, or loss of, or damage to property of others incurred during or approximately
caused by acts of omission of City or City's contractor connected with the construction
or the maintenance of any improvements located on the above referenced property
during the period of this temporary right -of -entry.
Upon completion of construction the site shall be left in a reasonably neat and graded
manner.
