PROJECT REQUEST
The applicant is requesting a Commercial Design Review to add a 3,531 square -foot
warehouse, facade improvements, parking, and landscape for the existing Cardenas
Market located at 31952 Mission Trail within the Mission Trail Shopping Center.
BACKGROUND
On February 20, 2007; the Planning Commission approved the exterior renovation of the
Mission Trail Shopping Center, including facade enhancements, parking facility upgrades,
and landscaping improvements.
On March 23, 2007; the proposed renovation was approved by the City Council with minor
modifications to the conditions of approval.

Cardenas Market moved into the location formerly occupied by Stater Bros. Market and
celebrated their "Grand Opening" on August 31, 2012.

PROJECT DESCRIPTION
Site Design
Cardenas Market has been very successful since the grand opening that occurred on
August 31, 2012 and due to their success Cardenas Market is now proposing a 3,531
square -foot warehouse addition for the storage of dry goods. The proposed warehouse
addition will be located at the west side of the existing 25,630 building; increasing the total
square footage of the existing building to 29,161 square feet.
Onsite Circulation and Parking
The proposed 3,531 square foot warehouse addition will not cause any changes in the
existing circulation pattern related to customer traffic and delivery trucks. The location on
the project site where the proposed warehouse addition would be constructed is currently
occupied by 15 parking spaces. However, ten parking spaces will be replaced and only five
(5) parking spaces will be lost by the proposed development. This loss of parking will not
have any negative impact related to parking at the Mission Trail Shopping Center because
the Center has a shared parking agreement with a total of 367sparking spaces and only
346 parking spaces are required for shopping center.
The replacement parking spaces will be designed at 90- degree angle, with a twenty -six foot
(26') two -way drive aisle and typical parking space dimensions of nine feet (9') by eighteen
feet (18') with a two foot (2) double stripping as required by the Lake Elsinore Municipal
Code (LEMC).

Architecture
The applicant is proposing to continue the "Contemporary Tuscan" architectural style of the
Mission Trail Shopping Center, including the use of false arches achieved by cornices and
arch elements. The false arches will be painted with an accent color to create a contrast
with the rest of the building elevations. The four (4) columns in front of the store entrance
and the two (2) false arches that face the parking lot of the shopping center will be
enhanced with decorative stone veneer.
Colors and Materials
The applicant will continue to use those colors and materials that are currently approved in
the association with the previously approved Mission Trail Shopping Center renovation.
The contrasting colors are complimentary and have been chosen to enhance architectural
elements within the project.
Landscaping
Given the configuration of the building and adjacent parking lot areas, the applicant is
proposing to incorporate two (2) planter areas at each end of the proposed parking lot.
The planter areas will be enhanced by a minimum of a 24 -inch box "Bradford Pear' trees
and either "Pittisporum" or "Indian Hawthorn" shrubs as foundation plantings as found in
the rest of the Mission Trail Shopping Center.
ANALYSIS
The proposed 3,531 square foot warehouse addition, facade improvements, parking, and
landscape have been found to be in conformance with all applicable development
standards of the Lake Elsinore Municipal Code. In addition, the project has been designed
with enhanced architectural characteristics such as roof line cornices, raised parapets,
varying color treatments and materials, and wall breaks to create interesting building
elevations.
ENVIRONMENTAL DETERMINATION
Staff has determined that the proposed project is exempt from the California Environmental
Quality Act (Cal. Publ. Res. Code § §21000 et seq.: "CEQA ") and the State CEQA
Guidelines (14. Cal. Code Regs § §15000 et seq.), specifically pursuant to Section 15332
(Class 32 — In -Fill Development Projects) because the Project is consistent with the
applicable General Plan designation and policies, as well as zoning designation and
regulations, the Project is within the City's boundaries and on a site less than five acres
surrounded by urban uses, the Property has no value as habitat, and approval of the
Project will not result in any significant effects relating to traffic, noise, air quality, or water
quality and the Project is adequately served by all required utilities and public services.

RECOMMENDATION
Adopt Resolution No. 2012 - recommending that the City Council approve Commercial
Design Review No. 2012 -08 for the construction of a 3,531 square foot warehouse
addition, fagade enhancements and associated improvements, based on the Findings and
Exhibits and subject to the attached Conditions of Approval.

RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
LAKE ELSINORE, CALIFORNIA, RECOMMENDING CITY COUNCIL
APPROVAL OF COMMERCIAL DESIGN REVIEW NO. 2012 -08, FOR
THE 3,531 SQUARE FOOT WAREHOUSE ADDITION TO THE EXISTING
CARDENAS MARKET LOCATED AT 31952 MISSION TRAIL (APN: 363-
172 -022)
WHEREAS, Jesus Cardenas /Cardenas Market (the "Developer "), filed an
application with the City of Lake Elsinore requesting approval of Commercial Design
Review No. 2012 -08 ( "the Project "), and
WHEREAS, the Developer proposes the Project on property located at the
31952 Mission Trail within the Mission Trail Shopping Center, also known as Assessor's
Parcel No.'s 363 -172 -022 (the "Site "); and
WHEREAS, the Developer proposes the addition of a 3,531 square -foot
warehouse, facade improvements, parking, and landscape to the existing Cardenas
Market at the identified location; and
WHEREAS, the Planning Commission of the City of Lake Elsinore has been
delegated with the responsibility of making recommendations to the City Council
pertaining to Design Review of commercial projects; and
WHEREAS, on December 18, 2012 at a duly noticed public hearing, the
Planning Commission considered evidence presented by the Community Development
Department and other interested parties respect to this item.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF LAKE
ELSINORE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. The Planning Commission has considered the Commercial Design
Review prior to making a decision to recommend that the City Council approve the
application. The Planning Commission finds that the Commercial Design Review
satisfies all requirements set forth in Chapter 17.184 of the Lake Elsinore Municipal
Code.
SECTION 2. The Planning Commission hereby finds and determines that the
Project is categorically exempt from the California Environmental Quality Act (Public
Resources Code Sections 21000 et seq.: "CEQA ") and the Guidelines for
Implementation of CEQA (14 California Code of Regulations, Sections 15000 et seq.:
"CEQA Guidelines ") pursuant to a Class 32 categorical exemption for in -fill development
projects. Specifically, the Planning Commission finds that the Project:
1. Is consistent with the applicable general plan designation and all applicable
general plan policies as well as with applicable zoning designation and
regulations as set forth herein below.

2. Will occur within the City limits. The Project Site is less than (5) acres and is
substantially surrounded by urban uses.
3. The Project Site currently consists of a paved parking area and has no value as
habitat for endangered, rare or threatened species.
4. Approval of the Project will not result in any significant effects relating to traffic,
noise, air quality or water quality.
5. The Project Site can be adequately served by all required utilities and public
services.
SECTION 3. That in accordance with State Planning and Zoning Law and the
Lake Elsinore Municipal Code, the Planning Commission makes the following findings
for the approval of Commercial Design Review 2012 -08:
The Project, as approved, will comply with the goals and objectives of the
General Plan, and the Zoning District in which the Project is located.
The Project complies with the goals and objectives of the General Plan because
it will assist in achieving the development of a well balanced and functional mix of
residential, commercial, industrial, open space, recreational, and institutional land
uses. The Project will serve to greater diversify and expand Lake Elsinore's
economic base.
2. The Project complies with the design directives contained in the General Plan
and all other applicable provisions of the Lake Elsinore Municipal Code.
The Project is appropriate to the site and surrounding developments in that the
retail shell building has been designed in consideration of the size and shape of
the property. Sufficient setbacks and enhanced onsite landscaping have been
provided thereby creating interest and varying vistas as a person moves along
abutting streets and within the center. In addition, safe and efficient circulation
has been achieved onsite.
The Project will compliment the quality of existing development and will create a
visually pleasing, non - detractive relationship between the proposed development
and existing projects through the use of architectural design that is similar to
existing buildings in the shopping center. A variety of materials and colors are
proposed including architectural stone accents and earth tone colors that blend
with surrounding developments and provide evidence of a concem for quality and
originality.
Subject to the attached conditions of approval, the Project is not anticipated to
result in any significant adverse environmental impacts.
Notwithstanding the fact that the Project is exempt from CEQA provisions
pursuant to a Class 32 exemption, the Project was reviewed and conditioned by

all applicable City departments to ensure that the project blends into existing
development, creates the least amount of disturbance, and does not negatively
impact the residents or businesses of Lake Elsinore. The Project will not have a
significant effect on the environment.
4. Conditions and safeguards pursuant to Chapter 17.184.070 of the Municipal
Code, including guarantees and evidence of compliance with conditions, have
been incorporated into the approval of the Project to ensure development of the
property in accordance with the objectives of Chapter 17.184.
Pursuant to Section 17.184.070 of the Lake Elsinore Municipal Code, the Project
was considered by the Planning Commission at a duly noticed public hearing on
December 18, 2012.
SECTION 4. Based upon the evidence presented, the above findings, and the
attached Conditions of Approval, the Planning Commission hereby recommends that
the City Council approve Commercial Design Review No 2012 -08.
SECTION 5. This Resolution shall take effect from and after the date of its
passage and adoption.

PLANNING DIVISION
General Conditions
1. The proposed project (Commercial Design Review No. 2012 -08) consists of the addition
of a 3,531 square -foot warehouse, facade improvements, parking, and landscape for
the existing Cardenas Market located at 31952 Mission Trail within the Mission Trail
Shopping Center.
2. The applicant shall defend (with counsel acceptable to the City), indemnify, and hold
harmless the City, its Officials, Officers, Employees, and Agents from any claim, action,
or proceeding against the City, its Officials, Officers, Employees or Agents to attach, set
aside, void, or annul an approval of the City, its advisory agencies, appeal boards, or
legislative body concerning the project attached hereto.
3. Commercial Design Review No. 2012 -08 approval will lapse and be void unless building
permits are issued within two (2) years.
4. All construction shall comply with these Conditions of Approval and those provisions
and requirements contained in the Municipal Code, prior to issuance of certificate of
occupancy and release of utilities.
5. All site improvements shall be constructed as indicated on the approved building
elevations and site plan for the proposed project.
6. Any revisions to approved site plan or building elevations shall be reviewed and
approved by the Community Development Director or designee.
7. Materials and colors depicted shall be used unless modified by the Community
Development Director or designee.
8. The applicant shall comply with all requirements of the City's Grading Ordinance.
Construction generated dust and erosion shall be mitigated in accordance with the
provisions of Municipal Code, Chapter 15.72 and using accepted techniques. Interim
erosion control measures shall be provided 30 days after the site's rough grading, as
approved by the City Engineer.
9. The applicant shall comply with all applicable City Codes and Ordinances.
10.The applicant shall pay school fees to the Lake Elsinore Unified School District prior to

issuance of building permit.
11.All outdoor ground or wall mounted utility equipment shall be consolidated in a central
location and architecturally screened along with substantial landscaping, subject to the
approval of the Community Development Director, prior to issuance of building permit.
12.All exterior on -site lighting shall be shielded and directed on -site so as not to create
glare onto neighboring property and streets or allow illumination above the horizontal
plane of the fixture. All light fixtures shall be consistent with the architectural style of the
building.
13.All building signage shall comply with the Lake Elsinore Municipal Code or Uniform Sign
Program submitted to the Planning Division.
14.All drive aisles and loading areas shall be kept and maintained free and clear of any
materials /merchandise so as not to obstruct on -site circulation and deliveries.
15. Parking stalls shall be double- striped with four -inch (4 ") lines two feet (2') apart.
16.A 12 -inch concrete paver shall be provided along the side of parking stalls that are
adjacent to planters (paver to include curb width).
17.Applicant shall meet Americans with Disabilities Act (ADA) requirements.
18. No exterior roof ladders shall be permitted.
19.All service and loading doors shall be painted to match the building.
20. On-site surface drainage shall not cross sidewalks.
21.Three (3) sets of the Final Landscaping /Irrigation Detail Plan shall be submitted,
reviewed and approved by the City's Landscape Architect Consultant and the
Community Development Director or designee, prior to issuance of building permit. A
Landscape Plan Check & Inspection Fee will be charged prior to final landscape
approval based on the Consultant's fee plus 25 percent City fee.
a) All planting areas shall have permanent and automatic sprinkler system with
100% landscape coverage using a combination of drip and conventional
irrigation methods.
b) All planting areas shall be separated from paved areas with a six inch (6")
high and six inch (6") wide concrete curb.

c) Planting within fifteen feet (15') of ingress /egress points shall be no higher
than thirty -six inches (36 ").
d) Landscape planters shall be planted with an appropriate parking lot shade
tree pursuant to the LEMC and Landscape Design Guidelines.
e) Any transformers and mechanical or electrical equipment shall be indicated
on landscape plan and screened as part of the landscaping plan.
f) The landscape plan shall provide for ground cover, shrubs, and trees and
meet all requirements of the City's adopted Landscape Guidelines.
g) All landscape improvements shall be bonded 100% for material and labor for
two years from installation sign -off by the City. Release of the landscaping
bond shall be requested by the applicant at the end of the required two years
with approval /acceptance by the Landscape Consultant and Community
Development Director or Designee.
h) All landscaping and irrigation shall be installed within affected portion of any
phase at the time a Certificate of Occupancy is requested for any building.
i) Final landscape plan must be consistent with approved site plan.
j) Final landscape plans to include planting and irrigation details.
22. The applicant shall complete and sign an "Acknowledgment of Conditions" and shall
return the executed original to the Community Development Department — Planning
Division within 30 days of project approval for inclusion in the case records.
23.The Conditions of Approval shall be reproduced on subsequent building plans prior to
issuance of building permit.
24.The applicant shall at all times comply with Section 17.176 (Noise Control) of the Lake
Elsinore Municipal Code.
25.The applicant shall pay all appropriate City fees.

BUILDING DEPARTMENT
Prior to Building Permits
26. All construction plans must be in accordance with the 2010 building codes.
27. Prior to issuance of building permits, the applicant shall provide assurance that all
requirements of the Riverside County Fire Department have been met.
28. Prior to issuance of building permits, the applicant shall provide assurance that all
requirements of the Riverside County Environmental Health Department have been
met.
29. Prior to issuance of building permits, the applicant shall pay all appropriate fees.
30.The applicant shall place a weatherproof 3' x 3' sign at the entrance to the project site
identifying the approved days and hours of construction activity (i.e., 7:00 A.M. — 5:00
P.M., Monday through Friday with no construction activity to occur on Saturdays,
Sundays or legal holidays) and a statement that complaints regarding the operation can
be lodged with the City of Lake Elsinore Code Enforcement Division (951) 674 -3124.
The sign shall be installed prior to the issuance of a grading permit.
ENGINEERING DIVISION
General
31. In accordance with the City's Franchise Agreement for waste disposal & recycling, the
developer shall be required to contract with CR &R Inc. for removal and disposal of all
waste material, debris, vegetation and other rubbish generated during cleaning,
demolition, clear and grubbing or all other phases of construction.
32. Developer shall mitigate to prevent any flooding and /or erosion downstream caused by
development of the site and or diversion of drainage.
33.The project shall process a Lot Line Adjustment or Parcel Merger for the portion of the
existing building that crosses Assessor's Parcel No. 363- 172 -010.
FEES
34.The developer shall pay all Engineering Division assessed Development Impact Fees
and Plan Check and Permit fees. Mitigation fees include:

Transportation Uniform Mitigation Fee (TUMF) — due at Building Permit
Traffic Infrastructure Fee (TIF) — due at Building Permit
35. Mitigation Fees will be assessed at the prevalent rate at time of payment in full.
STORM WATER MANAGEMENT / POLLUTION PREVENTION / NPDES
36. Runoff from project hardscape areas, roof and roof drains shall be treated prior to
discharge into the storm drain system.
37.A Storm Water Pollution Prevention Plan ( SWPPP) is required for this project. A copy
of the current SWPPP shall be kept at the project site, updated as necessary and be
available for review upon request.
38. Prior to grading or building permit the applicant shall demonstrate that compliance with
the permit has been obtained by providing a copy of the Notice of Intent (NOI) submitted
to the State Water Resources Control Board and a copy of the letter of notification of the
issuance of a Waste Discharge Identification (WDID) Number or other proof of filing to
the satisfaction of the City Engineer.
39. Erosion & Sediment Control - Prior to the issuance of any grading or building permit, the
applicant shall submit for review and approval by the City Engineer, an Erosion and
Sediment Control Plan as a separate sheet of the grading plan submittal to demonstrate
compliance with the City's NPDES Program and state water quality regulations for
grading and construction activities. The Erosion and Sediment Control Plan shall
identify how all construction materials, wastes, grading or demolition debris, and
stockpiles of soil, aggregates, soil amendments, etc. shall be property covered, stored
and secured to prevent transport into local drainages or waters by wind, rain, tracking,
or dispersion. The plan shall also describe how the project will ensure that all BMPs will
be maintained during construction of any future right of ways. A copy of the plan shall
be incorporated into the SWPPP as applicable, kept updated as needed to address
changing circumstances of the project site, be kept at the project site and available for
review upon request.
UTILITIES:
40.All overhead utilities shall be undergrounded in accordance with Chapter 12.16 of the
Lake Elsinore Municipal Code (LEMC)
41.The developer shall apply for, obtain and submit to the City Engineering Division a letter
from Southern California Edison (SCE) indicating that the construction activity will not
interfere with existing SCE facilities (aka SCE NIL).

IMPROVEMENTS
42.The site shall be planned and developed to keep surface water from entering buildings
(California Green Building Standards Code 4.106.3).
43. The developer shall provide a truck turning plan for delivery.
44.An Encroachment Permit shall be obtained prior to any work on City and /or State right -
of -way. The developer shall submit the permit application, required fees and executed
agreements, security and other required documentation prior to issuance.
45. Expansion and delivery bay locations shall accommodate delivery trucks. Truck turning
templates (using Caltrans standard templates) shall be sued to validate delivery truck
circulation.
GRADING
46.A grading /drainage plan signed and stamped by a California Registered Civil Engineer
shall be submitted for City review and approval for all addition and /or movement of soil
(grading) on the site. The plan shall include separate sheets for erosion control, haul
route and traffic control. The grading submittal shall include all supporting
documentation and be prepared using City standard title block, standard drawings and
design manual (available at www.lake- elsinore.org).
47.Developer shall execute and submit grading and erosion control agreement, post
grading security and pay permit fees as a condition of grading permit issuance.
48.A preconstruction meeting with the City Public Works Inspector (Engineering Division) is
required prior to commencement of ANY grading activity.
49. Prior to commencement of grading operations, developer is to provide to the City with a
map of all proposed haul routes to be used for movement of export material. All such
routes shall be subject to the review and approval of the City Engineer. Haul route shall
be submitted prior to issuance of a grading permit. Hauling in excess of 5,000 cy shall
be approved by City Council. (LEMC 15.72.065)
50. Export/import sites located within the Lake Elsinore City limits must have an active
grading permit.
51.Applicant to provide to the City a video record of the condition of all proposed public City
haul roads. In the event of damage to such roads, applicant shall pay full cost of
restoring public roads to the baseline condition. A bond may be required to ensure

payment of damages to the public right -of -way, subject to the approval of the City
Engineer.
52.TUMF and TIF fees shall be paid. The TUMF fees shall be the effective rate at the time
of payment in full in accordance with the LEMC.
53.As -built plans for all approved plan sets shall be submitted for review and approval by
the City. The developer /developer /owner is responsible for revising the original mylar
plans.
54. In the event of damage to City roads from hauling or other construction related activity,

10.FIRE.999 USE -#04 -HIGH PILE /RACK STORAGE
59.A separate permit may be required for high -pile storage and /or racks. Sprinkler Plans
and /or sprinkler review must be submitted by a licensed sprinkler contractor with
storage and /or rack plans to Riverside County Fire Department for review and approval
of the 2007 CFC Chapter 24 compliance. Complete information re: all commodities
stored, rack dimensions, placement in building, sprinkler densities, etc. must be
provided with suppression system for racks and /or high -pile storage review. A complete
listing of commodities, Classified using UFC Chapter 24 of the 2007 Edition and NFPA
13, 2002 Edition guidelines by a licensed Fire Protection Engineer (or other consultant
approved by this jurisdiction). (Current plan check deposit base fee is $348.00)
10. FIRE 999 USE - #50 — BLUE DOT REFLECTORS
60. Blue retro - reflective pavement markers shall be mounted on private streets, public
streets and driveways to indicate location of fire hydrants. Prior to installation,
placement of markers must be approved by the Riverside County Fire Dept.
10 FIRE 999 USE - #23 — MINIMUM FIRE (WATER) FLOW
61. Minimum required fire flow shall be 2375 GPM for 2 hours duration at 20 PSI residual
operating pressure, which must be available before any combustible material is placed
on the job site. Average spacing between hydrants 450' and 225' maximum distance
from any point on the street or road frontage to hydrant.
10. FIRE 999 USE - #20 — SUPER FIRE HYDRANTS
62.Super fire hydrants (6" x 4" x 2 -2 1/2 "), shall be located not less than 25 feet or more
than 225 feet from any portion of the building as measured along approved vehicular
travel ways.

80. FIRE.999 USE - #4 — Water Plans
65.Applicant and /or developer shall separately submit 2 sets of water system plans to the
Fire Department for review. Plans must be signed by a registered Civil Engineer and /or
water purveyor prior to Fire Department review and approval. Mylars will be signed by
the Fire Department after review and approval. Two (2) copies of the signed and
approved water plans shall be returned to the Fire Department before release of a
building permit.

66.The applicant shall prepare and submit to the Fire Department for approval, a site plan
designating required fire lanes with appropriate lane painting and/ or signs.
90. FIRE.999 USE - #12A- SPRINKLER SYSTEM
67. Install a complete fire sprinkler system per NFPA 13 2010 edition (13D and 13R system
are not allowed) in all buildings. Sprinkler system (s) with pipe size in excess of 4" inch
diameter will require the project structural engineer to certify (wet signature) the stability
of the building system for seismic and gravity loads to support the sprinkler system. All
fire sprinkler risers shall be protected from any physical damage. The post indicator
valve and fire department connection shall be located to the front, within 50 feet of a
hydrant, and the minimum of 25 feet from the building (s). A statement that the building
(s) will be automatically fire sprinkled must be included on the title page of the building
plans. (Current sprinkler plan check deposit base fee is $614.00 per riser) applicant or
developer shall be responsible to install a U.L. Certified Central Station Monitored Fire
Alarm System. Monitoring System shall monitor the fire Sprinkler system(s) water flow,
P.I.V.'s and all control valves. Plans must be submitted to the Fire Department with our
"Plan Review Form" for approval prior to installation. (Current monitoring plan check
deposit base fee is $192.00)
90. FIRE.999 USE #27 — Extinguishers — Minimum
68. Install portable fire extinguishers with a minimum rating of 2A -1013C and signage. Fire
Extinguishers located in public areas shall be in recessed cabinets mounted 48"
(inches) to center above floor level with maximum 4" projection from the wall. Contact
Fire Dept. for proper placement of equipment prior to installation.
