Discussion The applicant is proposing the construction of an 8,320 square foot Family Dollar retail store near the southwest corner of the project site. Two -way circulation and parking will be achieved along the north and east sides of the building with a loading area located on the north side. The main entrance will be located along the east face of the building (facing toward Riverside Drive). In addition, the project has been designed with enhanced architectural characteristics such as raised parapets, varying color treatments and materials, and wall breaks to create interesting building elevations. Staff reviewed and analyzed the proposed Family Dollar retail store and has determined that it is in AGENDA ITEM NO. 11 Page 1 of 26 Commercial Design Review No. 2012 -06 December 11, 2012 Page 2 of 2 conformance with all applicable development standards of the Lake Elsinore Municipal Code. Staff has concluded that the proposed project will compliment the existing and proposed development in the surrounding area. Environmental Determination Staff has determined that the proposed project is exempt from the California Environmental Quality Act (Cal. Publ. Res. Code § §21000 et seq.: "CEQK) and the State CEQA Guidelines (14. Cal. Code Regs § §15000 et seq.), specifically pursuant to Section 15332 (Class 32 — In -Fill Development Projects) because the Project is consistent with the applicable General Plan designation and policies, as well as zoning designation and regulations, the Project is within the City's boundaries and on a site less than five acres surrounded by urban uses, the Property has no value as habitat, and approval of the Project will not result in any significant effects relating to traffic, noise, air quality, or water quality and the Project is adequately served by all required utilities and public services. Fiscal Impact The proposed retail store will have a positive fiscal impact on the community and the City in that the commercial facility will serve to provide a wide range of retail services to address the ever expanding needs of the City's residents. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. The City Council has considered the proposed request for Commercial Design Review No. 2012 -06 for the establishment and operation of an 8,320 square foot Family Dollar retail store prior to recommending approval to the City Council. The City Council finds and determines that the Commercial Design Review request is consistent with the Lake Elsinore Municipal Code. SECTION 2. The California Legislature has determined that certain classes of projects do not have a significant effect on the environment and are therefore exempt Page 5 of 26 CITY COUNCIL RESOLUTION NO. 2012- 056 PAGE 2 OF 4 from the California Environmental Quality Act (Cal. Pub. Res. Code §§ 21000 et seq.: "CEQA") and the State Guidelines for Implementation of CEQA (14 C.C.R. §§ 15000 et seq.: the "CEQA Guidelines "). Specifically, the City Council finds that the Project qualifies as a categorical exemption for in -fill development as follows: 1. Is consistent with the applicable general plan designation and all applicable general plan policies as well as with applicable zoning designation and regulations. 2. Will occur within the City limits. The Project Site is less than (5) acres and is substantially surrounded by urban uses. 3. The Project Site has no value as habitat for endangered, rare or threatened species. 4. Approval of the Project will not result in any significant effects relating to traffic, noise, air quality or water quality. 5. The Project Site can be adequately served by all required utilities and public services. Therefore, the City Council hereby finds and determines that the Project is exempt from CEQA and the CEQA Guidelines. SECTION 3. That in accordance with the City of Lake Elsinore Municipal Code, the City Council makes the following findings for the approval of Commercial Design Review No. 2012 -06: 1. The project, as approved, will comply with the goals and objectives of the General Plan and the Zoning District in which the project is located. The proposed Commercial Design Review located at the northwest corner of Riverside and Walnut Drives complies with the goals and objectives of the General Plan, in that the approval of this establishment and operation of an 8,320 square foot Family Dollar retail store will assist in achieving the development of a well - balanced and functional mix of residential, commercial, industrial, open space, recreational and institutional land uses as well as encouraging commercial land uses to diversify Lake Elsinore's economic base. 2. The project complies with the design directives contained in Section 17.82.060 and all other applicable provisions of the Municipal Code. The proposed Commercial Design Review located at the northwest corner of Riverside and Walnut Drives is appropriate to the site and surrounding developments in that the proposed establishment and operation of an 8,320 square foot Family Dollar retail store has been designed in consideration of the size and shape of the property, thereby creating interest and varying vistas as a person moves along the street. Further the project as proposed will complement the Page 6 of 26 CITY COUNCIL RESOLUTION NO. 2012- 056 PAGE 3 OF 4 quality of existing development and will create a visually pleasing, non - detractive relationship between the proposed and existing projects in the area. 3. Subject to the attached Conditions of Approval, the proposed project is not anticipated to result in any significant adverse environmental impacts. Pursuant to State CEQA Guidelines, the project qualifies for a categorical exemption. Accordingly, the proposed application implements the land use objectives and requirements of the General Plan and Zoning District and further environmental evaluation is therefore, unnecessary. 4. Conditions and safeguards pursuant to Chapter 17.184.070 of the Municipal Code, including guarantees and evidence of compliance with conditions, have been incorporated into the approval of the subject project to ensure development of the property in accordance with the objectives of Chapter 17.184. Pursuant to Section 17.184.070 of the Lake Elsinore Municipal Code, the Project was considered by the Planning Commission at a duly noticed public hearing on November 20, 2012 and considered for approval by the City Council at a duly noticed public hearing on December 11, 2012, SECTION 4. Based upon the evidence presented, the above findings, and the attached Conditions of Approval, the City Council approves Commercial Design Review No. 2012 -06. SECTION 5. APPLICANT: FRANCIS CHU, GREENBERG FARROW, 19000 MACARTHUR BLVD., SUITE 250, IRVINE, CA 92612 OWNER/ DAVID MORSE, BOOS DEVELOPMENT, 7114 TH STREET, DAVIS, AGENT: CA 95616 PROJECT REQUEST The applicant is requesting a Commercial Design Review to construct an 8,320 square foot Family Dollar retail store. The store will operate from 8:00 a.m. to 7:00 p.m., Monday through Saturday, and Sunday from 10:00 am to 6:00 pm. The store will employ one manager, 1 to 2 assistant managers, and approximately 3 to 5 employees. The project site is zoned General Commercial C -2. Therefore, the C -2 development standards were applied to the entire site so as to achieve consistency and uniformity. Project review is pursuant to Chapters 17.124 (General Commercial), 17.112 (Non - Residential Standards), and 17.184 (Design Review) of the Lake Elsinore Municipal Code (LEMC). Two -way circulation and parking will be achieved along the north and east sides of the building with a loading area located on the north side. The main entrance will be located along the east face of the building (facing toward Riverside Drive). Onsite Circulation The project site will take access off of three street frontages (Riverside Drive, Walnut Drive, and Fraser Drive). A future reciprocal access driveway is also proposed between the project site and the undeveloped parcel to the north. The applicant is proposing to dedicate additional right -of -way along Riverside Drive so as to achieve required ultimate right -of -way widths and associated street improvements. Thirty three parking spaces will be provided, including two handicap spaces. Customer parking spaces are planned for the front of the building (facing Riverside Drive) as well as along the northern boundary of the project site. Architecture The building is mainly comprised of a combination of smooth and split face block. The building is articulated using a variety of pilasters, trellis elements and canopies to achieve interest. The building's roofline has been broken up with varying parapet heights and an approximate thirty foot (30') tall tower element which creates prominence at the main building entrance facing Riverside Drive (Hwy 74). A smaller tower element has been incorporated on the west side of the building to enhance the building as seen from Walnut Drive. Page 24 of 26 CDR No. 2012 -06 November 20, 2012 Page 3 of 4 Colors and Materials The applicant is proposing five colors on the building including: • "buckskin" and "monastery brown" EIFS color, • "sandpebble" and "cinnamon" and split faced masonry block • red painted smooth faces cmu block. The contrasting colors are complimentary and have been chosen to enhance the architectural elements on the building. The slightly tinted window glazing will further serve to compliment the building's color scheme. In addition, decorative steel grilles, awnings and light fixtures will all be applied along the building elevations. It should be noted that the applicant has identified fabric awnings along the store front and rear elevation. Staff has concerns that the fabric awnings will fade and deteriorate overtime, so a condition has been applied to require metal awnings. In discussions with the applicant, there is no opposition to installing metal awnings. Future drawings will reflect this condition. Signage Proposed signage is for illustrative purposes only. All building and on -site signage will comply with the LEMC. Sign design and material components will be required to match the building architecture and style. Landscaping The applicant is proposing to develop the site with approximately 23 percent landscaping on -site. This exceeds the minimum landscaping coverage requirement of 15 percent per the Lake Elsinore Municipal Code (LEMC). A minimum of 5 percent of the landscaping will be located within the parking and driveway areas per Section 17.148.100.D of the LEMC. The landscape plan includes a "modern" design with drought tolerant material. Much thought has been given to the landscape design and theme which includes a drainage system complimentary of the existing drainage pattern traversing the site from Riverside Drive. Ground mounted HVAC units and equipment are proposed along the rear elevation (facing Fraser Drive). The applicant is proposing a decorative wrought iron fence with climbing vines and additional landscaping to help screen this equipment. ANALYSIS The proposed Family Dollar retail store has been found in conformance with all applicable development standards of the Lake Elsinore Municipal Code. In addition, the project has been designed with enhanced architectural characteristics such as raised parapets, varying color treatments and materials, and wall breaks to create interesting building elevations. Staff feels that the proposed project will compliment the existing and proposed development in the surrounding area. Page 25 of 26 CDR No. 2012 -06 November 20, 2012 Page 4 of 4 Staff has added a condition of approval to replace the two crape myrtle trees in front of the store with canary island palms to enhance the entry of the building. ENVIRONMENTAL DETERMINATION Pursuant to the California Environmental Quality Act (CEQA), Section 15332 (In -fill Development Projects), staff has determined that the proposed project will not have a significant affect on the environment and shall therefore be exempt from the provisions of CEQA. Therefore, no additional environmental clearance is necessary.
