CALL TO ORDER
Mayor Magee called the Joint Study Session to order at 4:02 p.m.
ROLL CALL
PRESENT: COUNCILMEMBERS: HICKMAN, KELLEY,
SCHIFFNER, MAGEE
ABSENT: COUNCILMEMBERS: BUCKLEY
Also present were: City Manager Brady, City Attorney Leibold, Administrative
Services Director Pressey, Lake & Aquatic Resource Director Kilroy,
Information /Communications Manager Dennis, Community Services Director
Sapp, Recreation /Tourism Manager Fazzio, City Engineer Seumalo, Planning
Manager Weiner and City Clerk Ray.
DISCUSSION ITEMS
Mayor Magee gave an overview of the presentations; and confirmed that the
awardees would be present at the 7:00 p.m. meeting.

2. Claim against the City.
Mayor Magee inquired if the officer was on administrative leave.
City Manager Brady noted that he would need to get confirmation on that
matter.
3. Library Building Fund contribution for equipment.
No comments.
4. Lease Agreement and Relocation Agreement.
Councilmember Hickman commended staff on their negotiations with the item.
5. Final Map No. 30494 -1.
No comments.
6. Final Map No. 30494 -2.
No comments.
7. Agreement between Caltrans and the City of Lake Elsinore for State over -site
work on the Central Avenue /State Route 74 interim improvement project.
Councilmember Hickman commented that the item would allow the City to
control the State Route 74.
Mayor Magee commented on the agreement. He suggested adding the wording
"timely processing" into the agreement.
City Engineer Seumalo indicated that it could be added. He noted that the
agreement would be going to the State for review and approval. He noted that
it would delay the process.

Mayor Magee inquired if it could be sited in the cover letter.
City Engineer Seumalo confirmed.
Councilmember Hickman inquired what work would be done on State Route
74.
City Engineer Seumalo clarified the work to be done.
PUBLIC HEARINGS
21. Resolution approving the increase of assessments for Lake Elsinore Landscape
and Street Lighting District No. 1 — addition of park landscaping to Serenity —
Zone 4 pursuant to the Landscaping and Lighting Act of 1972.
City Manger Brady commented that a recess would need to take place to count
ballots.
Mayor Magee commented that there was not a map of the park. He noted that
the inclusion was for the new phase of Serenity Homes only. He commented on
the Service Benefit Analysis. He commented on the radius of the mileage used.
Dennis Anderson, Harris & Associates, indicated that the 3 -mile radius was for
a community park. He noted that it was a half -mile radius for a neighborhood
park.
22. Approving a Joint Community Facilities Agreement and a Fund, Construction
and Acquisition Agreement, approving the formation of CFD No. 2006 -8
(Running Deer Estates); calling a special election; canvassing election results;
authorizing levy of special taxes.
Councilmember Hickman inquired on the location of the project.
Mayor Magee noted that the project was adjacent to Rice Canyon Elementary.
23. Approving a Joint Community Facilities Agreement and a Fee Deposit and
Reimbursement Agreement, approving the formation of CFD 2006 -10
(Riverlake Villas); calling a special election; canvassing election results;
authorizing levy of special taxes.

24. Resolution determining the validity of prior proceedings relating to annexation
of property into City of Lake Elsinore Community Facilities District No.
2003 -1 (Law Enforcement, Fire and Paramedic Services); call a special
election; canvassing election results; authorizing levy of special tax for CFD
No. 2003 -1 Annexation Area No. 21 (Riverlake Villas).
No comments.
25. Zoning Ordinance Text Amendment No. 2006 -02; a request to amend portions
of the Lake Elsinore Municipal Code (LEMC).
Mayor Magee inquired if staff notified the building industry regarding the
changes.
Planning Manager Weiner indicated that the only ones that were notified were
current applicants, perspective applicants and applicants that were currently in
the process in the City for commercial and industrial projects.
Mayor Magee inquired if any written responses were received.
Planning Manager Weiner noted that they have had to give a couple of points of
clarification verbally, but no written responses were received.
Mayor Magee commented on page 2 of the staff report. He further commented
about the increase in landscaped area going from 10% to 20% in all commercial
districts. He inquired if there was a City that had a similar standard.
Planning Manager Weiner indicated that the City that was most similar to the
standard was Temecula. He noted that they average 20 -25% depending on the
type of project. He noted that the way the City's Ordinance stood, the standard
was on the lower end.
Mayor Magee inquired if there was a City that had a similar standard for
industrial districts.

Planning Manager Weiner noted that it was very similar to commercial districts.
He noted that it would be in line with what Temecula's commercial districts
look like in terms of landscaping.
Councilmember Hickman inquired if Murrieta was close to those figures.
Planning Manager Weiner noted that the City would be slightly above what
Murrieta requires. He noted that Murrieta was 17% for commercial districts
and 10% for industrial.
Councilmember Kelley noted that she was happy to see this item come forward.
Mayor Pro Tern Schiffner suggested changing the codes for the distance of trees
in landscaping.
Mayor Magee noted that Mayor Pro Tern Schiffner's suggestion was addressed
in the staff report and were a part of the standard Conditions of Approval.
APPEALS
26. Appeal of Condition of Approval No. 35 for a Minor Design Review of a
single - family residence located at 15087 Larson Road (APN: 379 - 080 -050).
Councilmember Hickman inquired about the distance from the sewer line.
Planning Manager Weiner clarified that the distance was approximately 145
feet.
Mayor Magee noted that staff was enforcing the Uniform Plumbing Code.
