EVANS INTERIM CITY MANAGER DATE: NOVEMBER 13, 2012 SUBJECT: REINSTATEMENT OF NOVEMBER 27, COUNCIL MEETING Recommendation 2012 REGULAR CITY That the City Council provisionally reinstate the regular City Council meeting on November 27, 2012 and authorize the Mayor to cancel the meeting if the Registrar of Voters has not certified the elections results prior to this meeting date. Background While the unofficial results of the November 6, 2012 election have been posted online by the Registrar of Voters, the election result are not expected to be formally certified by the Registrar until November 19, 2012. Following the official certification by the Registrar, the City is required by the Elections Code to swear in and seat the recently elected officials at the next meeting of the City Council. On June 26, 2012, the City Council opted to cancel certain regular City Council meetings for the remainder of 2012 due to various holidays and the additional costs related to holding meetings at the offices of EVMWD during the retrofit of the Cultural Center. The November 27, 2012 regular City Council meeting was one of the meetings cancelled. Staff is requesting that the City Council consider reinstating the November 27, 2012 meeting solely for the purpose of certifying the election results and swearing in our newly elected City officials. Discussion In light of the availability of the Cultural Center through the end of November, and the need to formally certify the election results and swear in four officials (three Council Reinstatement of City Council Meeting November 13, 2012 Page 2 Members and the City Treasurer), staff is requesting the City Council consider reinstating the November 27, 2012 regular City Council meeting for this purpose. Because the Registrar of Voters legally has until November 30, 2012 to certify the election, staff further requests that the Mayor be authorized to cancel the November 27th meeting in the unlikely event that the Registrar has not certified the election prior to that meeting.
