Evans, Interim City ana� Attachment: Ordinance No. 2012 -1308 AGENDA ITEM NO. 14 Page 1 of 9 Page 2 of 9 ORDINANCE NO. 2012 -1308 ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, AMENDING THE OFFICIAL ZONING MAP, CHANGING THE ZONING OF VARIOUS PARCELS IN THE CITY TO RMU - RESIDENTIAL MIXED -USE, CMU - COMMERCIAL MIXED -USE, OR R -3 - HIGH DENSITY RESIDENTIAL WHEREAS, the City of Lake Elsinore adopted an update to its General Plan on December 13, 2011, which established mixed -use designations on various properties throughout the City, as presented on the General Plan Land Use Plan; and WHEREAS, Ordinance No. 2012 -1300 was adopted on April 10, 2012, which put in place the RMU — Residential Mixed Use Zoning District and the CMU — Commercial Mixed Use Zoning District in the Lake Elsinore Municipal Code (LEMC) that provide development standards for the mixed -use designations; and WHEREAS, the City's Housing Element requires that the necessary zone changes related to mixed use and high density residential uses be adopted by December 31, 2012; and WHEREAS, Government Code Section 65103 empowers the legislative body to implement the General Plan through actions including, but not limited to, the administration of zoning ordinances; and WHEREAS, Government Code Section 65860 requires that a city's zoning ordinances be consistent with its general plan; and WHEREAS, Resolution No. 2004 -11 of the City of Lake Elsinore, which establishes procedures and requirements for implementation of the Western Riverside County Multiple Species Habitat Conservation Plan, specifically exempts the adoption or amendment of any land use or zoning ordinance in Section IV — Exemptions; and WHEREAS, after considering Zone Change No. 2012 -03 at their regular meeting held on August 21, 2012, the Planning Commission of the City of Lake Elsinore recommended that the City Council approve Zone Change No. 2012 -03; and WHEREAS, public notice of Zone Change No. 2012 -03 has been given and the City Council of the City of Lake Elsinore has considered the evidence presented by the Community Development Department and other interested parties at a public hearing held on September 23, 2012, with respect to this item. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. The City Council has reviewed and analyzed the proposed zone changes pursuant to the California Planning and Zoning Laws (Cal. Gov. Code §65000 Page 3 of 9 ORDINANCE NO. 2012 -1308 PAGE 2 of 7 et seq.), the Lake Elsinore General Plan and the Lake.Elsinore Municipal Code and finds and determines that the proposed zone changes are consistent with the requirements of California Planning and Zoning Law and with the goals and policies of the Lake Elsinore General Plan. SECTION 2. Pursuant to Section 21080 (c) (2) of the California Environmental Quality Act (CEQA), the City Council determines that the Recirculated Program Environmental Impact Report certified for the update to the General. Plan is adequate and prepared in accordance with the requirements of CEQA which analyzes environmental effects of the Project. Because Zone Change No. 2012 -03 implements the General Plan update with the appropriate zoning districts for development within the mixed -use and high density residential designations, no additional environmental review is required. SECTION 3. That in accordance with the State Planning and Zoning Law, the City Council hereby makes the following findings for the approval of Zone Change No. 2012 -03: 1. The proposed zone changes will not be a) detrimental to the health, safety, comfort or general welfare of the persons residing or working within the neighborhood of the proposed zone changes or within the City, or b) injurious to the property or improvements in the neighborhood or within the City. a. The proposed zone change implements the adopted General Plan Update of December 13, 2011, which was analyzed relative to its potential to have detrimental effects. b. The proposed zone change will eliminate inconsistencies with the adopted General Plan Update. C. The proposed zone change will be beneficial to the public health, safety, comfort and welfare and will improve the property in the neighborhood and the City by allowing a variety of residential and commercial uses to be established in mixed use districts within the City. 2. The proposed zone changes will permit reasonable development of the area consistent with its constraints and will make the area more compatible with adjacent properties. a. The proposed zone change enables the implementation of the CMU — Commercial Mixed Use and RMU — Residential Mixed Use Ordinances adopted on April 10, 2012. These Ordinances provide a Table of Uses that are permitted, permitted by conditional use permit, permitted by temporary use permit, or prohibited, thereby enabling a property owner to determine the highest and best use of his land if it is designated for residential mixed use or commercial mixed use. The proposed zone change enables implementation of the mixed use ordinances which provide detailed development standards where necessary to ensure that uses are compatible with adjacent properties and recognize its constraints in a mixed use environment. C. The proposed zone change enables implementation of the R -3 High Density Residential Ordinance which provides detailed development standards for multiple- family residential projects at densities up to 24 dwelling units per acre, and also provides a density bonus to encourage consolidation of lots of an infill nature. 3. The proposed zone changes would implement a land use density, intensity and usage more in character with the subject property's location, access, and constraints consistent with the adopted General Plan Update and subsequent text amendments to the zoning code. By implementing the CMU Commercial Mixed Use and RMU Residential Mixed Use Ordinance adopted on April 10, 2012, the proposed zone change provides the City and property owners detailed development standards where necessary to ensure that uses are compatible with adjacent properties and recognize its constraints in a mixed use or high density residential environment. 4. The proposed zone changes implement goals to encourage pedestrian - friendly urban centers by allowing a greater number of potential dwelling units that may be developed on the sites. a. The mixed use designations were adopted specifically to encourage a combination of residential units within commercial projects, that are vibrant, pedestrian- friendly, urban centers. Density bonuses are available to increase the number of potential dwelling units on sites designated for residential mixed use. 5. The proposed zone changes will not have a significant effect on the environment. a. The potential impacts of the General Plan update have been analyzed in the Recirculated Environmental Impact Report (SCH #2005121019) prepared for the General Plan ( "General Plan EIR') and its related cases, and adequate mitigation measures have been prepared where necessary. Accordingly, the impacts of the proposed zone change have been disclosed, analyzed and mitigated to the extent feasible in the General Plan EIR. A copy of the General Plan EIR is available for inspection in the City of Lake Elsinore Community Development Department, 130 S. Main Street, Lake Elsinore, CA. Based upon the evidence presented, both written and testimonial and such other matters as reflected in the record, and the above findings, the City Council hereby adopts Zone Change No. 2012 -03, making the following zone changes to the City of Lake Elsinore Official Zoning Map, and as shown in Exhibits '1' thru '11' attached: Area 1 - Southerly and easterly portions of Assessor's Parcel No. 390 - 110 -007, a southwesterly and a southerly portion of 390 - 110 -006, the west half of 390 - 120 -015 and a central portion of 390 - 120 -016 from FSP Future Specific Plan to R -3 High Density Residential; Assessor's Parcel Nos. 391 - 170 -005 and -007, the south half of 391 - 200 -007, the southwest corner and easterly half of 391 - 200 -004, the northeast corner of 391 -230- 002, 391 - 230 -003, the northeasterly portion of 391 - 230 -004, the northern three -fourth of 390 - 130 -020, 390 - 130 -021, and a small northerly portion of 390 - 160 -001 from M -3 Mineral Resources to CMU Commercial Mixed Use; The southern fourth of Assessor's Parcel No. 390 - 130 -020, a small northerly portion of 390 - 160 -001, and a north central portion of 390 - 170 -001 from M -3 Mineral Resources to RMU Residential Mixed Use; The northeasterly portion of 391 - 230 -009, a diagonal half portion of 391 - 230 -002, the west half of 391 - 230 -004, the easterly half of 391- 230 -005, the northern portions of 391 - 240 -001, a northern portion of 390 - 170 -001, and the southeast corner of 390 -160- 001 from M -3 Mineral Resources to R -3 High Density Residential; And the southeasterly half of Assessor's Parcel No. 390 - 190 -019, and the northeasterly corner of 389 - 020 -063 from M -3 Mineral Resources to CMU Commercial Mixed Use; as shown on Exhibit 1. SECTION 5. If any provision, clause, sentence or paragraph of this Ordinance or the application thereof to any person or circumstance shall be held invalid, such invalidity shall not affect the other provisions of this Ordinance and are hereby declared to be severable. SECTION 6. This Ordinance shall take effect thirty (30) days after the date of its final passage. The City Clerk shall certify as to adoption of this Ordinance and cause this Ordinance to be published and posted in the manner required by law.
