At that time a "public meeting" and a "public hearing" date were set. The "public meeting" was held on April 13, 1993 with no input from the affected property owners. April 27th was the date set for the public hearing, however, it was continued at that time, without opening the public hearing to this meeting, to allow for completion of necessary appraisals. Attached you will find the order of procedure for this public hearing and the applicable Resolutions for adoption. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, OVERRULING AND DENYING PROTESTS AND MAKING CERTAIN FINDINGS IN 'A SPECIAL ASSESSMENT DISTRICT WHEREAS, the CITY COUNCIL of the CITY OF LAKE ELSINORE, CALIFORNIA, has, by Resolution, declared its intention to acquire certain public works of improvement, pursuant to the terms and provisions of the "Municipal Improvement Act of 1913 ", being Division 12 of the Streets and Highways Code of the State of California, in a special assessment district known and designated as ASSESSMENT DISTRICT NO. 93 -1 (Cottonwood Hills) (hereinafter referred to as the-"Assessment District "); and, WHEREAS, at the time set for said Public Hearing, any protests and objections were duly heard and considered, and all matters as to the method and formula of the assessment spread and the determination as to whether or not the property did receive a benefit and whether the assessments were apportioned in accordance to benefit were heard and considered; and, WHEREAS, an initial environmental study has been completed for the project, indicating that the project shall not have a significant effect on the environment and that approval of the Negative Declaration would be appropriate. NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. That the above recitals are all true and correct. 2. That the public hearing on the Assessment District is hereby closed. That all protests and objections of every kind and nature be, and the same hereby are, overruled and denied, and it is further determined that said protests and objections are made by the owners of less than one -half (1/2) of the area .of property to be assessed for said improvements within said Assessment District. 4. That is hereby further determined that all properties within the boundaries of the Assessment District receive a local and direct benefit from the works of improvement as proposed for said Assessment District, and it is hereby further determined and declared that all assessable costs and expenses have been apportioned and spread over the properties within the boundaries of the Assessment District in direct proportion to the benefits received thereby. ;a s> .T. .F 2�. r. That the Engineer's method of spread and apportionment of all costs is hereby approved and adopted as being a correct and proper apportionment and distribution of all assessable costs for these works of improvement. 6. The Negative Declaration, as presented, has been prepared in accordance with the provisions of the California Environmental Quality Act and the guidelines thereto, and is hereby approved and adopted. Estimate of costs; Diagram of Assessment District; 4. An assessment according to benefits; 5. A description of the works of improvement; 6. Valuation information; and, :z. AGENDA ITEMQ�O. PAGE —CF. 1�:: WHEREAS, all protests have been heard and considered, and a-full hearing has been given, all in the manner provided by law; and, WHEREAS, all notices of said hearing were duly and regularly, posted, mailed and published in the time, form and manner required by law. and as evidenced by affidavits on file with the transcript of these proceedings; and, WHEREAS, the owners of one -half (1/2) of the area assessed for the cost of the project did not file written protests against. the said proposed improvements and acquisition where appropriate, and this legislative body did, after providing a full hearing, overrule and deny all protests and objections; and, WHEREAS, this legislative body is now satisfied with the assessment and all matters contained in the "Report" as now updated and submitted. NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: RECITALS 1. That the above recitals are all true and correct. PROTESTS F 2. That all protests and objections of every kind and nature be, and the same hereby are, overruled and denied, and it is further determined that.said protests and objections are made by the owners of less than one -half of the area of property to be assessed for said improvements within said Assessment District. BENEFITS RECEIVED 3. That it is hereby determined that all properties within the boundaries of the Assessment District receive- a local and direct benefit from the works of improvement as proposed for said Assessment District, and it is hereby further determined and declared that all assessable costs and expenses have been apportioned and spread over the properties within the boundaries of the Assessment District in direct proportion to the benefits received thereby. That the public interest and convenience require the proposed improvements to be acquired, and therefore it is hereby ordered the said improvements to be acquired, together with appurtenances and appurtenant work in connection therewith, in said Assessment District, as set forth in the Resolution of Intention -2- AGENDA ITEM NO i R PAGE OF s_- previously adopted and as set forth in the "Report" presented and considered, and as now submitted. That the "Report", as now updated and submitted, consisting of the assessment and diagram for the improvements, together with appurtenances and appurtenant work in connection therewith, is hereby confirmed, and the assessment contained in said "Report" is hereby levied upon the property contained within the Assessment District as set forth in said "Report". The assessments contained in the final Engineer's "Report" are hereby levied and approved as follows: A. The final assessments to represent the costs and expenses to finance the public works of improvement, as authorized for these proceedings. B. The annual assessment to pay for administrative costs in an amount not to exceed the maximum annual assessment as set forth in said "Report". 6. That this legislative body hereby finds and determines that the total amount of the principal sum of all unpaid special assessments proposed to be levied, as well as any outstanding special assessments, does not exceed 1/2 the total true value of the parcels proposed to be assessed under these proceedings, and this finding shall be final and conclusive. This legislative body further finds that the project is feasible and that the lands to be assessed will be able to carry the burden of the proposed assessment, and it is hereby further determined, if and as applicable, that the limitations of the amounts of assessments provided for in Division 4 of the Streets and Highways Code of the State of California be disregarded both with respect to the limitation on the Assessment District as a whole, and as to the limitation on individual specific assessments, as applicable. 7. That the City Clerk shall forthwith deliver to the Superintendent of Streets the said assessment, together with the diagram attached thereto and made a part thereof, as confirmed, with the certificate of such confirmation attached and the date thereof; and that said Superintendent of Streets shall then immediately record said diagram and assessment in the Superintendent's Office in a suitable book to -3- AGENDA ITEM NO. FADE 10 4 be kept for that purpose and 'attach thereto his certificate of the 'date of such recording. coUN Y RECORDER NOTICE 8. Upon confirmation of the assessments and recordation of the assessment roll and diagram, a certified copy of the assessment diagram shall be immediately filed in the Office of the County Recorder. Immediately thereafter, a copy of the notice of assessment shall be recorded in the ?Office of the 'County Recorder in the manner and form as set forth by law and specifically Section 3114 of the Streets And Highways Code of the State of California. V 9.. That said City Clerk, upon the recording of said diagram and assessment, shall mail to each owner of real property within the Assessment District at their last known address, as the same' appears on the tax rolls of the County or on file in the Office of the City Clerk, or to both addresses if said address is not the same, or to General Delivery when no address so appears, a statement containing a designation by street number or other' description of the property assessed sufficient to enable the owner to identify the same, the amount of the assessment, the time and place of payment thereof, 'the effect of failure to pay within such time, and a statement of the fact that bonds will be issued on unpaid assessments pursuant to the "Improvement Bond Accof 1915 ". PUBLICATION 10. That said City Clerk shall also give notice by publishing a copy of a notice of recording of assessment in the newspaper previously selected to publish all notices as provided by law, giving notice that said assessment has been recorded in the Office of the Superintendent of Streets, and that all sums assessed thereon are due and payable immediately, and that the payment of said sums is to be made within thirty (30) days after the date of recording the assessment, which date shall be so stated in said notice, and of the fact that securities will be issued upon unpaid assessments. 11. The County Auditor is hereby authorized and directed, in accordance with the provisions of Section 8682 of the Streets and Highways Code of the State of California, to enter into his assessment I roll on which property taxes will next become due, opposite each lot or parcel of Ind affected, in a space, marked "public improvement assessment" or by other suitable designation, the next and several installments of such assessment coming due during'the ensuing fiscal year -4- R: F: AGENDA ITEM NO.�_ PAGE OF =4 covered by the assessment roll and that said entry then shall be made each year during the life of the bonds for the proceedings for the above-referenced Assessment District. This authorization is continual until all assessment obligations have been discharged and the bonds terminated. As an alternate, and when determined to be in the best interests for bondholders of the Assessment District, this legislative body may, by Resolution, designate an official other than the County Tax Collector and /or other agent, to collect and maintain records of the collection of the assessments, including a procedure other than the normal property tax collection procedure. 12. In accordance with the provisions of Section 8685 of the Streets and Highways Code, if any lot or parcel of land affected by any assessment is not separately assessed on the tax roll so that the installment of the assessment to be collected can be conveniently entered thereon, then the Auditor shall enter on the roll a description of the lot or parcel affected, with the name of the owners, if known-, but otherwise the owners may be described as "unknown owners ", and extend the proper installment opposite the same. 13. The County Auditor shall, within 90 days after any special assessment installment becomes delinquent, render and submit a detailed report showing the amounts of the installments, interest, penalties and percentages so collected, for the preceding term and installment date, and from what property collected, and further identify any properties which are delinquent and the amount and length of time for said delinquency, and further set forth a statement of percentages retained for the expenses of making such collections. This request is specifically made - pursuant to the authorization of Section 8683 of the Streets and Highways Code of the State of California. 14.. That the Treasurer is hereby authorized at this time, if not previously done, to establish the following funds as necessary for the payment of costs and expenses and administration of the proceedings for this Assessment District: A. IMPROVEMENT FUND: All monies received from cash collection, proceeds from the sale of bonds and applicable contributions shall be placed into the Improvement Fund. B. RESERVE FUND: All monies as designated to assist in the payment of delinquencies shall be placed into the Reserve Fund. -5- Y. S ?E. AGENDA ITEM 140. -a PACE OF u C. REDEMPTION FUND: All monies received from the payment of assessments shall be placed in the Redemption Fund. For particulars as to the administration and handling of the Funds, the specific terms and conditions shall be set forth in the Bond Indenture and approved through the Resolution Authorizing the Issuance of Bonds. The total amount, as near as may be determined, of the total principal sum of all unpaid special assessments and special assessments required or proposed to be levied under any completed or pending assessment proceedings, other than that contemplated for the Assessment District, which would require an investigation and report under the "Special Assessment Investigation, Limitation and Majority Protest Act of 1931" against the total area proposed to be assessed. C. The total true value, as, near as may be determined, of the parcels of land and improvements which are proposed to be assessed. PART IV The proposed maximum annual assessment to be levied upon each subdivision or parcel of land within the Assessment District to pay the costs incurred by the City, and not otherwise, reimbursed, resulting from the administration and collection of assessments or from the administration and registration of any associated bonds and reserve or other related funds. PART V A map showing the boundaries of the Assessment District, and a diagram showing the exterior boundaries of the Assessment District, the lines and dimensions of the subdivisions of land within said Assessment District, the assessment numbers, and the acreage of each parcel, as the same existed at the time of the passage of the Resolution of Intention, are filed herewith and made a part hereof, and part of the assessment. The statute does not specify the method or formula that should be used in any special assessment district proceedings. The responsibility rests with the Assessment Engineer, who is appointed for the purpose of making an analysis of the facts and determining the correct apportionment of the assessment obligation. For these proceedings;: the .City: has retained. the services of BSI CONSULTANTS, INC., which has appointed Jeffrey M. Cooper, P.E., as Engineer of Work. The Assessment Engineer then makes his recommendation at the public hearing on the Assessment District, and the final authority and action rests with the City Council after hearing all testimony and evidence presented at that public hearing. Upon the conclusion of the public hearing, the City Council must make the final action in determining whether or not the assessment spread has been made in direct proportion to the benefits received. In accordance with the law, it is necessary to initially identify the benefit that the public improvements will render to the properties within the boundaries of the Assessment District. The purpose of this Assessment District is to provide the financing to acquire the improvements constructed for Railroad Canyon Road, as described in Ordinance No. 870 of the City Council of the City of Lake Elsinore, adopted on November 14, 1989, which established Area of Benefit No. 89 -1 for the improvement of Railroad Canyon Road, including acquisition of right -of -way, grading, drainage, surface improvements, and utilities within, or adjacent to, the Cottonwood Hills Specific Plan Area to satisfy conditions of development for site improvements. The improvements are necessary and required for development of specific plan site improvements. The construction conforms to existing City standards and master plans. The improvements will improve access to the properties (ingress and egress), traffic safety and aesthetic appearance, for the proposed development. By virtue of such benefits, the;impovements will enhance the value of the parcels in the Assessment District. Therefore; the, improvements are of direct and special benefit to these properties. ASSESSMENT FORMULA In order to apportion the assessments in proportion with the special and direct benefit that each parcel will receive from the improvements, an`in -depth analysis has been made and has been used as the basis for apportioning costs to each property within the assessment district. All properties within the, Assessment District receive benefit from the improvements to Railroad Canyon Road, including acquisition of right -of -way; grading, drainage, widening, paving, curbs and gutters, street lighting, signing and striping, landscaping, appurtenances and appurtenant work. These improvements will provide improved access to the property (ingress and egress), aesthetic appearance, and traffic safety and a corresponding increase in value of the properties within, the development. The widening of the streets and intersections have been designed to accommodate future development within the Cottonwood Hills Specific Plan Area and improve traffic circulation. As a condition of development, the City required the developer to construct the improvements to Railroad Canyon Road. Since all properties within the Assessment District will benefit from these improvements, the costs have been spread to all parcels within the District. As development occurs, and the individual phases are recorded, each new phase wilk.be reapportioned according to its prorata share of the assessment. Residential parcels will be reapportioned based on the number and type of dwelling units located on the parcel, and commercial. parcels, will be reapportioned on the basis of Equivalent Single Family Residential Dwelling Units. The Single Family Residential unit has been selected as the basic unit for reapportionment calculations. The Cottonwood Hills Specific Plan Area has the following residential types: SFI, SF2, SF3, MFl and MF2. Each phase will be reapportioned upon the earlier of: (i) the request of the then owner of record of the property, or (ii) the division of the parcel. The prorata share of the assessment will be determined at any time by dividing the rtotal number of anticipated Equivalent Dwelling Units (EDU) expected, to be generated by the phase to be reapportioned by the total number of anticipated EDUs expected to be generated by all property which has not yet been reapportioned (including the property that is about to be reapportioned). Each residential type will receive the following EDUs: SF1 _ 2.O EDU SF2 = 1.5 EDU SF3` " = 1.0 EDU MFl = 0.8 EDU MF2 = 0.5 EDU The EDUs for Commercial and Institutional properties will be calculated for each acre or portion of an acre of the parcel's gross area, based'on the estimated average land density of Single Family Residential (SFI, SF2 and SF3) dwelling units per acre within the Cottonwood Hills Specific Plan Area, which is 3.62 EDUs per acre. Parcels designated as sites for public facilities (elementary schools, neighborhood parks, community parks, parkway parks, open space and major /minor roads) will be exempt from assessment. The engineering costs (ie: design engineering, soil engineering, and construction staking) will be apportioned using the assessment methodology established for the improvements to Railroad Canyon Road as their cost is included in the Benefit Reimbursement Fee. Formation and Financing Costs will be apportioned' using the same basis as the improvements for Railroad Canyon Road. An itemization of costs may be found in Part II, Exhibit 1 of this report. In conclusion, it is my opinion that the assessments for the above - referenced Assessment District have been spread in direct accordance with the benefits that each parcel receives from the works of improvement.
