ROLL CALL PRESENT: COUNCILMEMBERS: ALONGI, DOMINGUEZ, WASHBURN; WINKLER ABSENT: COUNCILMEMBERS: CHERVENY Also present were: Executive Director Molendyk, Legal .Counsel Harper, Administrative Services Director Boone, Community Services Manager Sapp,.. Manager -, of Special_ Projects. Watenpaugh, City Treasurer Pape and Clerk of.the_Board Kasad. BUSINESS /DISCUSSION ITEMS 1. Award of Contract - San Jacinto River Channel Construction. Executive Director Molendyk noted, the prior discussions and recommendations at the Board Meeting on June 8, 1993, and noted that the. criteria: for ,bidding appears to need clarification. Legal Counsel Harper advised that regardless of the position ,taken ,by. the Board on this item, there would be some level of exposure to litigation. Sam.Alhadeff, Lorenz, Alhadeff, Cannon & Rose,, representing American Contracting, presented a packet of information dated June 15, 1993, addressed to the Redevelopment Agency Board of Directors. He discussed the impact�pf disqualification of his client's bid. He compared the.bid to that of the next low bidder Hubbs, noting the bidding, with sand bedding versus filter bedding material. He urged that the Board award the .contract to American Contracting. Boardmember Washburn concurred that the criteria needs to be clarified and-suggested rebidding of the project.- Boardmember,Alongi asked the Legal Counsel,if there were any assurances that action would-not incur a lawsuit at a later. date. He expressed concern that the bidding process was appropriate and suggested that it may. have not been bid .properly.. Legal Counsel Harper explained the,logic of the ,,base material and clarified that even if it was right, depending on the results, either Hubbs or American would probably pursue litigation.. He further explained that - the Board has the right to reject all bids and rebid the project. He stressed that it would be best to reject all.bids and rebid.. AOEND.; ITEM NO. I �� PAGE TWO - AGENCY MINUTES - JUNE IS, 1993 Boardmember Alongi. expressed concern with the analysis that portions of the bid were too high, rather than reviewing the bid as a whole. Legal Counsel Harper commented that there were no findings necessary to reject all bids; .and it did not involve a question of whether it was bid correctly or not. He noted that the most significant issue appears to be the "sand" bedding issue. A representative of American Contracting indicated that, it would not be a fair statement to say that no one else bid in the same way he had. Mr. Aldaheff questioned the areas of concern, if use of sand bedding material is responsive to the bid process. He also questioned.the logic for starting over. Public Services Director Tecca indicated that sand bedding was not the issue. He clarified the original bid and the addendum. He. further indicated that some were out of balance by comparison. Mr. Aldaheff questioned the issues of this rejection and issues which had not been previously discussed. He suggested that numerous imbalances could also be found in the other bids submitted. He requested that his client be given the opportunity to perform, since they have all necessary bonds and - insurance in place. Legal Counsel Harper indicated that Hubbs also had everything in line and advised that it would be in the City's. best `interest not to award the contract at this time. He noted for the record that this action had nothing to do with American Contracting or their bidding. Boardmember' Dominguez indicated that he, would accept the recommendation of Legal Counsel. MOVED BY DOMINGUEZ, SECONDED BY WASHBURN AND CARRIED BY UNANIMOUS VOTE'OF THOSE PRESENT TO REJECT ALL BIDS AND GO OUT FOR RE -BID.. 2. Executive Director Molendyk recommended award of this contract. MOVED BY WASHBURN, SECONDED BY DOMINGUEZ AND CARRIED BY UNANIMOUS VOTE OF THOSE PRESENT TO AWARD THE CONTRACT FOR CONSTRUCTION MANAGEMENT OF THE SAN JACINTO RIVER CHANNEL CONSTRUCTION PROJECT TO ROBERT BEIN,,WILLIAM FROST AND ASSOCIATES /NINYO AND MOORE. Executive Director Molendyk recommended that the item pertaining to the outlet channel agreement be added to the Redevelopment Agency agenda for concurrence since the Redevelopment Agency would be paying for the related bridges. MOVED BY WINKLER, SECONDED BY DOMINGUEZ AND CARRIED BY UNANIMOUS VOTE OF THOSE PRESENT TO ADD THE COOPERATIVE AGREEMENT .WITH THE RIVERSIDE COUNTY FLOOD, CONTROL AND WATER CONSERVATION DISTRICT REGARDING THE LAKE ELSINORE OUTLET CHANNEL: . MOVED BY WASHBURN, SECONDED BY DOMINGUEZ AND CARRIED BY UNANIMOUS VOTE OF THOSE PRESENT TO ADJOURN THE REDEVELOPMENT AGENCY MEETING AT 3:24 P.M.
