SUBJECT: ACCEPTANCE OF DRAINAGE EASEMENT DEED FOR PORTION OF
APN 379 - 180 -004 (WESSELINK PROPERTY)
BACKGROUND
Community Facilities District 88 -3 encompasses several public
facility projects including the Line "C" and "C -1" Storm Drain.
Construction of the downstream storm drain facilities at the
terminus of Joy Street requires the acquisition of a portion of
property owned by the Wesserlinks.
The Line "C" and "C -1" Storm Drain improvements were completed in
July, 1992. The work on the subject property was done under a
Right -of -Entry Permit because the City does not own the property.
The Right -of -Entry shall terminate upon the recordation of an
easement to the City of Lake Elsinore.
DISCUSSION
John P..Neet, MAI, Consulting Real Estate Appraiser, was retained
by the City to estimate the "Fair Market Value" of the proposed
easement acquisition. The fair market value based upon the
independent appraisal dated May 13, 1991 is $45,500.00.
MacFarlane and Associates has been negotiating with the owners of
the property on behalf of the City. On May 1, 1992, the owners
(Richard H. Wesselink, Sr.; Richard H. Wesselink, Jr.; and Mary E.
Wesselink) accepted the City's offer of $45,500.00 for the easement
acquisition. All costs are included in the easement purchase price
of $45,500 and the escrow costs of $775.00.
FISCAL IMPACT
Sufficient funds exist in the CFD .88 -3 Phase 2 Improvements
contingency fund to acquire this drainage easement and pay escrow
fees in the amount of $46,275.00.
RECOMMENDATION
1. Authorize the payment of $45,500 for the acquisition of the
drainage easement over a portion.of APN 379 -180 -004, and
$775.00 for escrow fees.
2. Request the Mayor to execute the escrow instructions and
accept the Drainage Easement Deed on behalf of the City.
