The applicant, The western Company requests approval of the
following items:
• Annexation 62 an annexation of approximately 1321 acres
to the City of Lake Elsinore;
• General Plan Amendment. 93 -2 which proposes to change
approximately 22 acres currently designated Mountainous
to Very Low Density Residential; and
Zone Change 93 -4 which will pre -zone approximately 199
acres of the annexation area to R -R Rural Residential and
OS Open Space.
The applicant, the City of Lake Elsinore, is proposing approval of
the following items:
Annexation 68 an annexation of approximately 442 acres to
the City of Lake Elsinore;
• General Plan Amendment 93 -3 which proposes to change
approximately 65 acres currently designated Mountainous
to Very Low Density Residential and Low Density
Residential; and
• Zone Change which will pre -zone approximately 212 acres
of the annexation area to R -R Rural Residential and R -A
Residential Agricultural.
At its October 21, 1993 meeting the Planning Commission recommended
to City Council approval of Annexation 62, General Plan Amendment
93 -2, Zone Change 93 -4, Annexation 68, General Plan Amendment 93 -3,
and Zone Change 93 -5 by a 3 -0 vote .(minutes and staff report
attached). Because the Planning Commission felt that all the above
mentioned items were interrelated they voted to hold.a joint Public
Hearing and hear all the items concurrently. As a result all
discussion regarding these items is listed together and as a
consequence one report has been prepared for both sets of items
despite having separate applicants.
DISCUSSION
Several neighboring residents, generally from the Brookstone Ranch,
North Amorose and Woodhaven developments, raised concerns with.
respect to the proposed annexation boundary within'Annexation 62
and the City's proposed Annexation 68. Some of these residents in
this area are opposed to annexation and have a concern that

Annexation 62 (Laguna Heights) by itself will create an island of
unincorporated territory between the City boundaries to the north
and west of Machado Street (the area that include Brookstone Ranch,
North Amorose and Woodhaven). It is their impression that because
this annexation could create an island, the Local Agency Formation
Commission ( LAFCO) will force the area where the island is to be
created (Annexation 68) to annex without the inhabitants of this
area having an opportunity to oppose it and /or vote on it. This is
essentially untrue, because if an annexation is inhabited (which
the area within Annexation 68 is) and the residents of an area to
be annexed are opposed they may register written opposition to
LAFCO. if this opposition totals more than 25% of the registered
voters in the annexation area, the annexation will be returned to
the city for a vote in the form of a protest hearing.
Some residents in the Brookstone Ranch, Woodhaven and North Amorose
areas are also in opposition to being annexed but also feel that
because Annexation 62 is proposed separate from Annexation 68
(where they live) they will be prevented from having an opportunity
to vote on whether Annexation 62 is to be annexed. These
residents feel that because the Laguna Heights annexation and its
associated specific plan may have an impact on their community,
they should be able to vote on whether Annexation 62 is approved
and therefore on whether development as proposed can proceed. As
submitted to LAFCO, these residents would not-be able to vote on
whether Annexation 62 is annexed to the City. LAFCO at its own
hearings could tie Annexations 62 and 68 together, thereby not
allowing one annexation to move ahead without the other, or they
could leave them separate.
In addition, some of the Brookstone, North Amorose and Woodhaven
residents also presented testimony to Planning Commission that they
have a concern that the City of Lake Elsinore will be unable to
adequately provide some of the more important services such as
schools, and police and fire protection to these areas if they are
annexed. Staff reminded these residents that the provision of
these services will be for the most part unchanged or improved upon
annexation. Some of the agencies which provide these services
provide the services independent of. the City's jurisdictional
boundaries. For example, the Lake Elsinore unified'School District
currently provides school facilities and services to that area and
would continue to do so regardless of whether the area is annexed
or not. This is also true of fire services. To a certain extent
as a result of mutual aid agreements, police services would
probably improve due to the City's contracts with the Sheriff's
department.
Another concern expressed by the residents of this area was that if
the area were burning to the extent that assistance from the State
or Federal fire fighting agencies were required, would the City be
responsible for paying for this assistance and if so could the City
financially handle this responsibility. At the time staff was
unable to completely address this issue. As a result the Planning
Commission instructed staff to prepare an answer to this question
for City Council for this meeting. The Riverside County Fire
Department Battalion Chief for this jurisdiction was. consulted and
had the following response: If a fire were to occur in this area
requiring the use of State and Federal agency equipment and
services, standard operating procedure would be to provide these
services due to its proximity to the Cleveland National Forest
without necessarily any cost to the City. However, if it were
definitively determined that the fire emanated from within the
City's limits due to action by the City or its residents the City
could potentially be required to contribute funds to offset the
cost of the use of the State and /or Federal Government's equipment

1. This project is consistent with -the Goals,-Policies and
Objectives of the General Plan.
2. This zone change establishes the necessary pre- zoning for this
site.
3. This request will not result in any significant adverse
impacts on-the environment.
FINDINGS - ANNEXATION NO. 68
1. The proposed annexation area is, entirely within the City's
Sphere of Influence.
2. The proposed annexation area is contiguous to the City of Lake
Elsinore.
3. The project will not result in any significant adverse impacts
on the environment.
FINDINGS - GENERAL PLAN AMENDMENT 93 -3
1. The approval of the requested designations permits development
to the highest and best nature within mitigable means to
insure maintenance of the general public health safety and
welfare.
2. Granting of the requested designations will permit reasonable
development of the property consistent with its constraints
and more compatible with adjacent properties and proposed
development.
3. The proposed General Plan Amendment would establish a land
use density and usage more in character with the subject
property's location, access and constraints. I

and services. City staff has also learned from LAFCO staff that
LAFCO may condition the annexation to require the City to enter
into a separate agreement with the California Division of Forestry.
Environmental Impact Report 92 -1, certified on September -14, 1993
(Resolution 93 -52), addresses all environmental impacts associated
with this project.

Approve General Plan Amendment 93 -2 and adopt Resolution

Approve Zone Change 93 -4 and adopt Ordinance 90 based on the
following Findings;

Appro a General Plan Amendment 93 -3 and adopt Resolution -
93V and

PUBLIC HEARINGS
IT WAS THE CONSENSUS OF THE COMMISSION TO CONSIDER PUBLIC HEARINGS
1 AND 2 CONCURRENTLY, SINCE RELATED.
Associate Planner DeGange presented the following proposals:

A request to approve an annexation of 1,321 acres; General
Plan Amendment modifying an area of 22 acres currently
designated Mountainous to Very Low Density Residential and
Prezoning for a 199 acre portion of the annexation area to R -R
(Rural Residential) and OS (Open Space) . The annexation area
is generally located to the west of Grand Avenue and the
termini of Amorose Street and Toft Drive and to the north of
Amorose and south of Toft.
A request to annex a 442 acre area; General Plan Amendment
amending a 65 acre area currently designated Mountainous to
Very Low Density Residential and Low Density, Residential;
Prezoning of a 212 acre portion of the annexation area to 51
acres of R -R (Rural Residential) and 161 acres of R -A
(Residential Agricultural). The project site is generally
located to the east and west of Grand Avenue between the City
Limits to the north and Plumas Street to the south.
He explained that environmental impacts for both projects have
been addressed by Environmental Impact Report 92 -1 certified
on September 14, 1993.
He further explained that Annexation No. 62 is for Laguna
Heights and Annexation No. 68 encompasses the existing
neighborhoods (i.e. Brookstone Ranch, North Amorose, and
Woodhaven) east of Laguna Heights that otherwise would be left
as a pocket or island of county unincorporated area. The
Local Agency Formation Commission (LAFCO) may require, during
the hearing process for Annexation No. 62, the elimination of

therefore the City has initiated
Vice Chairman Bullard opened the public hearing at 7:15 p.m.,
and asked for any written communication. The Secretary
reported no written communication. He then asked for anyone
wishing to speak in favor.
Dave Gottlieb, representing The Western Company, gave a brief
history on the project and detailed their intent. He then
introduced their annexation consultant Ron Sullivan who will
explain the requirements of LAFCO.
Ron Sullivan, Inland Planning, 28480 Highway 74, Suite A.
Romoland, explained LAFCO requirements and if there is a
potential to create a pocket or island this must be eliminated
or attempts made to eliminate. He further, explained that two
annexations were created, one being Laguna Heights and one
being Brookstone, and each must stand on their own. The
Brookstone Ranch people would be able to decide for themselves
whether they desire to come into the City.
City Planner Leslie stated for clarification Mr. Sullivan
referred to one annexation as the Brookstone Annexation and it
includes more than Brookstone, it also includes North Amorose
and Woodhaven.
Vice Chairman Bullard then asked for anyone else wishing to
speak in favor. Receiving no response, he asked for those
opposed. The following people spoke:
Patricia Lee Nolan, 30620 Plumas, opposed to the annexation
and wants the area to remain county. She stated these should
not be separate annexations so that everyone affected has a
chance to vote and has an equal say in.what happens to their
property.
Lea Routledge, 14505 Amorose Street, opposed to the
annexations, stating her concern is that the City is not
capable of servicing the citizens -- municipal services: fire,
police, and schools.
Vivian Beaumont, 30630 Brookstone Lane, agrees that this
should be just one annexation. Concerned with the prezoning
designation of the mountainous areas.
Ace Vallejos, 15231 Colby Street, why are you trying to deny
us our right for a say in the project? Concerned with the
1993 FBI Crime Report, increase in population and municipal
services.
David Buchanan, 30831 Plumas, the right to vote on what
happens to us up stream is being cut out. This is.a blatant
attempt by the developer to cut us out of our right to vote.
Alan Knight, 30570 Brookstone, concerned with Lots 13 and 14,
for the proposed equestrian center - -this is a sham. Brook-
stone Ranch is a residential community that is protected under
California corporate laws. Annexation 62 and 68 is an
attempt to divide the area.
Lee Bulen, 14949 Toft Drive, opposed to Annexation 62 and 68.
Concerned with the way public notice are written and sent to
citizens - -to the public these notices are very confusing and
uninformative. Would also like to have it entered into the
record that I am opposed to Annexation 68, because I feel it

Wesley Bertz, 14625 Amorose Street, main concern, is crime.. He.
then commented that the developer has not met and bargained
with them in good faith..
Hearing no other requests to speak,. Vice Chairman Bullard
stated that.he would like to, -close the public hearing.

is a transparent - attempt by the City and the developer to
evade the statutorily defined protest process. 'He stated the
communities of Brookstone Ranch, North Amorose, Patrick Court
and Woodhaven are opposed to the Laguna Heights project being
annexed to the City because of the adverse effects it will
have.. We know that the City can not provide the public
services needed for projects already approved.and started let
alone any new ones.- He further stated they feel that if
Laguna Heights is processed; as an, uninhabited annexation
without regard to the community, which will be directly
impacted, it will create ',an island or peninsula of
unincorporated area that LAFCO nor the.area'residents desire.
He further stated that they as.the affected area request that
the City include them within the boundaries of the proposed

Annexation 62, so that they as citizens will have the right to
a voice in their future.
Vice Chairman Bullard asked for anyone else wishing to speak
in opposition or on -the matter..

site.
4. This request will not result in, any significant adverse
impacts on the environment.

A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF LAKE ELSINORE, CALIFORNIA, RECOMMEND-
ING TO THE CITY COUNCIL OF THE CITY OF LAKE
ELSINORE APPROVAL OF GENERAL PLAN AMENDMENT
93 -2 - THE WESTERN COMPANY
WHEREAS, the General Plan must be periodically updated to meet
new conditions and from time to time be revised or amplified to
respond to unforeseen.changes or needs; and
WHEREAS, the Planning Commission of the City of Lake Elsinore
has been delegated the responsibilities of making recommendations
for changes in the General Plan; and
WHEREAS, an application has been -filed with the City of Lake
Elsinore by The Western Corporation to amend the City of Lake
Elsinore General Plan to revise the land uses specified on the
General Plan Land Use Map of the Land Use Element relating to 22
acres currently designated Mountainous to Very Low Density
Residential; and
WHEREAS public notice of said application has been given, and
the Planning Commission has considered evidence presented by the
applicant, Community Development Department and other interested
parties at a public hearing held with respect to this application
on October 21, 1993;
NOW THEREFORE, the Planning Commission of the City of Lake
Elsinore DOES HEREBY RESOLVE as follows:
SECTION 1. The Planning Commission has considered Environ-
mental Impact Report 92 -1, certified on September 14, 1993, to the
proposed General Plan Amendment 93 -2, prior to making a decision to
recommend that the City Council approve the proposed amendment to
the 1990 City of Lake Elsinore General Plan. The Planning
Commission finds and determines that Environmental Impact Report
92 -1 is adequate under California Environmental Quality Act (CEQA)
to analyze the environmental effects of General Plan Amendment 93-
2, and recommends City Council approval, based upon the following
findings and determinations:
SECTION 2. That in accordance with State Planning and Zoning
law and the City of Lake Elsinore the following findings for the
approval of General Plan Amendment 93 -2 have been made as follows:
1. The approval of the requested designations 'permits
development to the highest and best nature within
mitigable means to insure maintenance of the general
health safety and welfare.
2. Granting of the requested designations will permit
reasonable development of the property consistent with
its constraints and more compatible with adjacent
properties and proposed development.
3. The proposed General Plan Amendment would establish a
land use density and usage more in character with the
subject property's location, access and constraints.
4. The proposed change will not result in any significant
- adverse impacts on the environment.

A request to:
• Consider a Resolution for the Commencement of Proceedings
for the intent to annex approximately 442 acres to the
City of Lake Elsinore, Annexation No. 68;
• Approve a General Plan Amendment changing 65 acres
currently designated Mountainous to Very Low Density
Residential and Low Density Residential (GPA 93 -3); and
• Approve a Change of Zone (pre -zone) of a 212 acre portion
of the annexation area to R -R Rural Residential and R -A
Residential Agricultural (ZC 93 -5).
The project consists of a potential annexation of 442 acres of
territory which includes the Brookstone Ranch development, a the
greater Woodhaven development, Withrow Elementary School and eight
parcels along Amorose Street and east of Grand Avenue. The project
also includes an amendment to the General Plan for a 65 acre
portion of the North Amorose area. In addition, the project
includes pre - zoning for a 212 acre portion of the annexation area
including Brookstone Ranch, North Amorose, Withrow School and the
eight parcels along Amorose and Grand.

Commented that this evening's meeting was very interesting and
everyone has learned a lot. He commented on everyone having the
right to do their process by following the rules and regulations,
and believes every individual has the right to express their
opinion and desires. He further commented that he was for
controlled growth, which our City Fathers have seen and planned
for, and hopes the annexations go forward so that we can improve
our city and lifestyle.
Attended the League of California Cities Conference, October 16-
19th, and the classes and seminars were very informative.

SIZE AND LOCATION
The annexation area includes the area which corresponds to that
portion of the Laguna Heights Specific Plan area not within the
City limits, a 39 acre area near the intersection of Toft Drive and
Grand Avenue and a 160 acre parcel under the ownership control of
the U.S. Forest Service for a total of approximately 1321 acres.
The area being considered for amendment to the General Plan
includes two parcels totaling approximately 22 acres located south
of Toft Drive. The area being pre -zoned totals approximately 199
acres and includes the U.S. Forest Service land to be zoned Open
Space and six other parcels along Grand Avenue and south of Toft
Drive to be zoned R -R Rural Residential.

BACxGROUND
At its September 14, 1993 meeting City Council approved the Laguna
Heights Specific Plan which encompasses most of the area proposed
for annexation. On April 23, 1992 the Local Agency Formation
Commission ( LAFCO) approved the deferral of pre - zoning requirements
for a majority of the area currently being proposed for annexation.
This would have allowed concurrent processing of the annexation
with the City and LAFCO. Since the Specific Plan has already been
approved and the annexation has not yet been heard by LAFCO this
step proved to be unnecessary. The approved Laguna Heights
Specific Plan is in effect pre - zoning of the specific plan area.
This specific plan, however, can not be implemented until this area
is annexed to the City. The additional area beyond the specific
plan boundary that the applicant is also requesting to be annexed
does require pre- zoning. 1

The project site, consists of a 1321 acre annexation which is
entirely within the City's Sphere of Influence and is contiguous to
the City limits along the project's northern boundary. The site is
primarily under common ownership with the exception of a 160 acre
portion which is controlled by the U.S. Forest Service. The
project area is generally undeveloped and uninhabited.

The proposed annexation area outside of the specific plan boundary
has three General Plan land use designations including 160 acres of
Open /Recreation (U.S. Forest property) , 17 acres of area designated
within Specific Plan "A" (Laguna Heights Specific Plan) and 22
acres of Mountainous. The applicant proposes to change that
portion of the site currently designated Mountainous to Very Low
Density Residential making the area more consistent with the land
uses within the approved Laguna Heights Specific Plan and to
facilitate pre- zoning.
On April 23, 1992 LAFCO approved the deferral of the requirements
for pre- zoning for the Laguna Heights Specific Plan area. Since
that time the zoning for this portion of the site has been
established with the approval of the Laguna Heights Specific Plan.
A portion of the current annexation area, however, is not part of
the Laguna Heights Specific Plan area and has not necessarily
received approval for the deferral of the requirement for pre -
zoning. Consequently, this portion of the annexation area,
constituting approximately 199 acres, is being pre -zoned R -R Rural
Residential (39 acres) and OS Open Space (160 acres).
ANALYSIS
Annexation 62•
The proposed annexation is an extension of the existing City limits
and is entirely contained within the City's Sphere of Influence.
The annexation of this property by itself, however, creates a
pocket of unincorporated territory between the City boundaries to
the north and to the east at Machado Street. In anticipation of
this being a concern with LAFCO the City has concurrently prepared
a Resolution of Commencement of Proceedings (Annexation 68) with
the intent to annex additional territory if deemed necessary by

LAFCO. This additional territory would include the Brookstone
Ranch development, the Woodhaven development, the North Amorose
area, Withrow School, and eight parcels south of Withrow School.
Annexation 65 (Western Desert) which proposes to annex 120 acres
roughly at the northeast intersection of Grand Avenue and Machado
Street if approved by LAFCO would also serve to reduce the pocket
of unincorporated territory created by this annexation.
Annexation of the Laguna Heights Specific Plan will allow this plan
as adopted by the City to be implemented. In addition to the 160
acre U.S. Forest Service area, the other proposed annexation areas
encompass the area where Laguna Heights Drive South has been
proposed to be located, which will provide the alternative access
to the Laguna Heights project.

The proposed General Plan Amendment will change a 22 acre portion
of the annexation area, which is currently designated Mountainous,
to Very Low Density Residential. This designation is more
consistent with the land uses established within the Laguna Heights
Specific Plan and will better facilitate pre - zoning.
Zone Chanae (Prezone)(ZC1 93 -4:
The Open Space zoning assigned to the Forest Service property is
consistent- with the General Plan. The proposed R -R Rural
Residential zoning for the other 39 acres of the subject property
will be in conformance with the General Plan provided General Plan
Amendment 93 -2 is approved. The R -R zoning basically allows one
single - family residence for every 2 acres, it would also allow
Laguna Heights Drive South and it would also allow an equestrian
Center by Conditional Use Permit which the applicant has indicated
he may propose in the future.
FISCAL IMPACTS
The ability of the City to provide services for the proposed
annexation area has been addressed by a Plan for Municipal Services
and a Fiscal impact Report (FIR) . These documents have determined
that the City will be required to provide the following services:
animal control, community development, parks and recreation, street
and road maintenance, street lighting, and solid waste collection
and disposal. All other services such as fire protection, police
protection, public schools, library service, water and sewer, cable
service, gas and electric, public transit, health and public
assistance, and judiciary and corrections are currently being
provide will continue to be provided by the respective agencies.
The Plan for Services and the FIR also indicate that the City is
capable of assuming the responsibility of providing these services
and the fiscal impact is minimal.
Environmental Impact Report 92 -1, certified on September 14, 1993
(Resolution 93 -52), addresses all environmental impacts associated
with this project.
It is recommended that Planning Commission:

Annexation 68 is being proposed in the event that the Local Agency
Formation Commission (LAFCO) makes a determination that the area
being proposed for annexation within Annexation 62 is insufficient.
This annexation proposes to bring all the territories which would
form unincorporated pocket-areas and /or an island if Annexations 62
and 65 are approved.
The potential annexation area consists:'df a 442 acre annexation
which is entirely within the City's Sphere of Influence and
contiguous to. the City limits along the northern and eastern
project boundary. The site is inhabited, developed with single -
family dwellings and characterized by multiple ownership.
A portion of the potential annexation area has a General Plan land
use designation of Mountainous. A proposed amendment to this
designation is requested because currently there is no
corresponding zoning classification for Mountainous within the
Zoning Ordinance. This proposal would change the 65. acres
currently designated Mountainous to 51 acres of Very Low Density
Residential and 14 acres of Low Density Residential.
Zone Change (Pre- zone) (ZC) 93 -5:
As requirement of the annexation process the project site is to be
pre- zoned. This proposal includes the request for pre- zoning for
a 212 acre portion of the annexation area which includes Brookstone
Ranch, North Amorose, Withrow School and the eight parcels along
Amorose and Grand. The remaining portion of the annexation area
included within this application (the 'Woodhaven area) has been
previously pre -zoned as part of Annexation 65 (Western Desert)
approved on September 21, 1993.

The proposed R -R Rural Residential and R -A Residential Agricultural
zoning classifications to be assigned to this area are consistent
with the 'Very Low and Low Density Residential General Plan
designations. The proposed R -R Rural Residential zoning for the
parcels within North Amorose portion of the annexation area will be
in conformance with the General Plan provided General Plan
Amendment 93 -3 is approved.
The R -R and R -A zoning classifications are not only being proposed
for pre- zoning in this area because they are consistent with the
General Plan, but also because the City is,putting forth an attempt
to preserve zoning of these areas that is nearly consistent with
existing County zoning of these areas. The R -R and R -A districts
require larger densities and permit the keeping of various animals
as an accessory use.
Though the County's R -A and the City's R -A districts are very
similar, distinctions do exist. For example, the County allows the
keeping of animals as an accessory use with a minimum lot size of
20,000 square feet, where as the City requires a minimum lot size
of one half acre (21,780 square feet). The County's zoning
classification is more restrictive, however, with respect to the
keeping of additional animals. For every two (2) additional
animals you are allowed to be keep in the County it is required
that you have an additional acre, whereas in the City you are
allowed to keep two (2) additional animals per one half acre of lot
size.
PROVISION OF SERVICES
The ability of the City to provide services for the proposed

PROJECT CONCERNS
In past public hearings and neighborhood meetings many of the
residents within this annexation area have expressed opposition to
annexation. The following is list of some of these residents'
concerns: 1) additional assessments will be assessed to their
property upon annexation; 2) residents presently utilizing septic
systems within this area will be required to hook up to sewer; 3)
there will be a loss of their equestrian rights; 4) and that as
residents of the City they will be required to pay for street
maintenance, street sweeping, special projects being constructed in
the City, and a higher rate for trash service.
The following responses can be made with respect to these concerns:
1) As residents of the City an assessment for the City's Lighting
Landscaping and Maintenance District will be applied, however,

2) The County Health Department and Elsinore valley Municipal
Water District (EVMWD), independent of whether or not a

3) As was previously discussed, the proposed zoning
classifications which these properties are to be pre -zoned
with, are similar to what is currently in place in the County.
The R -A and R -R districts permit the keeping of animals
(including horses) as an accessory use.
4) City services such as street maintenance and street sweeping
are paid by funding within the City's General Fund. No
individual property owner or group of property owners are
required to pay for these services. Projects ongoing within
the city such the Eastlake project, the Lake Management
Project, the Baseball Stadium and wal -mart are being funded by
either redevelopment funds, grants from federal, state and
local agencies and /or private funding supplied by the
developer. Residents within the City are not responsible for
funding these projects. Due to the fact that the City
recently implemented a waste reduction management program the
cost for trash service has been increased.

gECOMHENDATION
It is recommended that Planning Commission:
Recommend to City Council commencement of proceedings to annex
to the City of Lake Elsinore Annexation No. 68;
Recommend to the City Council approval of General Plan
Amendment 93 -3 and adopt Resolution No. 93 -11 and Zone Change
93 -5 based on the following Findings.
1. The proposed annexation area is entirely within the City's
Sphere of Influence.
2. The proposed annexation area is contiguous to the City of Lake
Elsinore.
3. The project will not result in any significant adverse impacts
on the environment.
1. The approval of the requested designations permits development
to the highest and best nature within mitigable means to
insure maintenance of the general public health safety and
welfare.

2. Granting of the requested designations will permit reasonable
development of the property consistent with its constraints
and more compatible with adjacent properties and proposed
development.
3. The proposed General Plan Amendment would establish a land
use density and usage more in character with the subject
property's location, access and constraints.
4. The proposed change will not result in any significant adverse
impacts on the environment.
FINDINGS - ZONE CHANGE 93 -5
1. This project is consistent with the Goals, Policies and
Objectives of the General Plan as amended.
2. This request will bring the zoning for the project area into
conformance with the General Plan and the proposed General
Plan Amendment.
3. This zone change establishes the necessary pre- zoning for this
site.
4. This request will not result in any significant adverse
impacts on the environment.

DETACHMENT FROM THE ORTEGA TRAILS RECREATION
AND PARR DISTRICT CERTAIN UNINHABITED
TERRITORY DESCRIBED HEREIN AND DESIGNATED
"ANNEXATION NO. 62 - THE WESTERN COMPANY
WHEREAS, the proponent of the Annexation, known as
"Annexation No. 62 - The Western Company," has requested that the
City Council consent to the commencement of proceedings to annex
said area, which is contiguous to the City of Lake Elsinore; and
WHEREAS, the said annexation area is entirely within the
City Sphere of Influence; and
WHEREAS, the City Planning Commission, at a special
meeting held on October 21, 1993, made its report upon the
desirability and made its recommendations in favor of said
annexation; and
WHEREAS, the City Council has considered evidence
presented by the Community Development Department, the applicant,
and other interested parties at a public hearing held on November
9, 1993; and
. WHEREAS, it is the desire of the City Council to give its
consent to the commencement of annexation proceedings and
concurrent detachment from the Ortega Trails Recreation and Park
District.
WHEREAS, the City has detached all areas within the City
and request Annexation No. 62 to the City be detached from the
Ortega Trails Recreation and Park District. The City assumes the
service responsibility for Parks and Recreation within the City
boundaries and for Annexation No. 62 and; therefore, requests the
tax revenues currently collected by the Ortega Trails Recreation
and Park District within the proposed annexation be transferred to
the City.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
LAKE ELSINORE, CALIFORNIA:
1. That consent be and hereby is granted for the
commencement of annexation proceedings in accord
with California Government Code Section 56000 et
seq. for the uninhabited territory designated
hereby as "Annexation No. 62 - The Western
Company," which consists of 1,321 acres of land,
whose boundaries are set forth in Exhibit "A"
attached hereto and by this reference incorporated
herein; and
2. The City Clerk shall certify to the adoption of
this resolution.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF LAKE ELSINORE, CALIFORNIA, MAKING
AMENDMENT TO THE LAKE ELSINORE GENERAL PLAN
FOR THE THIRD CYCLE OF THE CALENDAR YEAR OF
1993
THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE,
CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS:
WHEREAS, Section 65361(a) of the Government Code provides
that no mandatory element of a General Plan shall be amended more
frequently than four times during any calendar year;
WHEREAS, the Planning Commission held a public hearing on
this General Plan Amendment on October 21, 1993, and that this
public hearing was advertised as required by law. The Planning
Commission made recommendations to the City Council concerning this
General Plan Amendment and has filed with the City Council copies
of maps and reports; and
WHEREAS, notice was duly given of the public hearing on
the Amendment, which public hearing was held before the City
Council on the 9th day of November, 1993 at the hour of 7:00 p.m.,
with testimony received being made a part of the public record; and
WHEREAS, all requirements of the California Environmental
Quality Act have been met for the consideration of whether the
project will have a significant effect on the environment.
NOW THEREFORE, in consideration of the evidence received
at the hearing, and for the reasons discussed by the Council
members at said hearing, the City Council now finds that the Lake
Elsinore General Plan be amended as follows:
GENERAL PLAN AMENDMENT 93 -2
APPLICANT /PROPERTY OWNER: The Western Corporation
LOCATION: THE PROJECT SITE IS LOCATED TO THE WEST OF
GRAND AVENUE AND THE TERMINI OF AMOROSE STREET
AND TOFT DRIVE AND TO THE NORTH OF AMOROSE AND
SOUTH OF TOFT.
Approval is based on the following:
1. The approval of the requested designations permits
development to the highest and best nature within
mitigable means to insure maintenance of the general
health safety and welfare.
2. Granting of the requested designations will permit
reasonable development of the property consistent with
its constraints and more compatible with adjacent
properties and proposed development.
3. The proposed General Plan Amendment would establish a
land use density and usage more in character with the
subject property's location, access and constraints.
4. The proposed change will not result in any significant
adverse impacts on the environment.
