SUBJECT: State Route 74
Memorandum of Understanding
BACKGROUND
State Route 74 is a principal, inter -urban arterial which is
planned to carry large volumes of high -speed vehicles making long
range trips. SR 74 is grade separated at Interstate Highways, and
intersects other major highways at grade which is controlled with
traffic signals. This memorandum concerns the segment between
Interstate 15 and the east City limits.(Riverside Street).
DISCUSSION
State Route 74 is a State operated and maintained arterial.
Therefore, the State is concerned that improvements to the highway
support • the planned operational criteria, i.e. high capacity
roadway with high speed trips. At the same time, certain features
must be built into the roadway to make it safe. Future development
adjacent to the roadway must be controlled to eliminate cross moves
and turning maneuvers.,
The City of Lake Elsinore controls land uses and land development
adjacent to SR.74. We have the power to condition development to
dedicate needed right -of -way and to establish local street systems
to provide alternate access.
Since Caltrans controls the roadway features and the City controls
land development,. it is in both agencies' interests to develop
guidelines for future improvements. The guidelines are set forth
in the attached Memorandum of Understanding (MOU) between the City
of Lake Elsinore and California Department of Transportation.
The guidelines have been reviewed and amended by both jurisdictions
and the final set is fairly restrictive. They allow full access
only at half -mile points which are to be signalized. Between those.
points, left -turn access will be restricted and only right turns in
and out of adjacent properties will be approved. Alternate local
roads must be provided for access to half -mile arterials. In
addition, the City is agreeing to reserve the right =of -way for the
134 foot roadway section, and for roadway re- alignment.
The MOU is a mutual policy statement. It is not binding in any
way. However, in approximately one year Caltrans expects to
present a Cooperative- Agreement for approval. The cooperative
agreement will spell out each jurisdiction's responsibilities.
RECOMMENDATION•
Approve the attached Memorandum of Understanding and request the
Mayor to affix his signature.

THE CITY OF LAKE ELSINORE
This Memorandum of Understanding (MOU) is between the State of
California's Department of Transportation (hereinafter, Caltrans)
and the City of Lake Elsinore (hereinafter, the City). This
Memorandum of Understanding constitutes solely a guide to the
respective obligations, intentions and policies of the City and
Caltrans to use in approving new development along State
Route 74 in the City of Lake Elsinore (East of Interstate 15).
This MOU addresses the Concept Facility as proposed by the City,
however, the Ultimate Facility, is of utmost importance to
Caltrans. This MOU is not designed to authorize funding for the
project effort, nor is it a legally binding contract. It is the
intent of this MOU to establish a mutual policy leading to a
Cooperative Agreement between Caltrans and the City within
approximately twelve (12) months after the execution of this MOU.
The basic understanding is as follows:

ultimate rear access points to local streets.

negotiations with the City. These will include from;
Ramsgate Drive to E1 Toro Road and E1 Toro Road to
Riverside Street.
7. Intersection and Limited Access Design will be
developed in accordance with policies, procedures,
practices and standards normally followed by Caltrans
and the City. Variations from these standards will be
subject to negotiations between Caltrans and the City
and other funding agencies.
8. All full access openings will be signalized and
interconnected with conduit and hard wire, type 170
controllers with QuicNet software.
9. Maintenance, intersection signalization and design
specifications will be in accordance with policies,
procedures, practices and standards of the various
departments within Caltrans and the City.
10. This MOU supersedes all previous agreements entered
into by Caltrans and the City for the development of
Route 74, East of Interstate 15 (I -15).
