HomeMy WebLinkAboutItem No. 32CITY OF LAKE ELSINORE REPORT TO CITY COUNCIL TO: HONORABLE MAYOR AND CITY COUNCIL FROM: RON MOLENDYK, CITY MANAGER DATE: OCTOBER 26, 1993 SUBJECT: EXTENSION OF TIME FOR TENTATIVE TRACT MAP NO. 22904, REVISION #6 (CANYON BAY DEVELOPMENT CORP.) BACKGROUND On July 13, 1993, the City Council continued their consideration of a request for a final one year extension on Tentative Tract Map No. 22904. The reason for the continuance was to allow staff additional time to work with the applicant to resolve outstanding financial obligations. This revised map was initially approved by the Lake Elsinore City Council on July 25, 1989. The proposed single - family residential subdivision is located at the end of Scenic Ridge Drive, between the Summerhill tracts and the Tuscany tracts. Staff has had some discussions with the applicant regarding their outstanding financial obligations. In the intervening time the State Assembly and Senate passed in early September of this year and the Governor signed into law on September 13, 1993, Bill Number SB 428 (effective immediately upon the Governor's signature) which automatically gave all outstanding tentative tract and parcel maps in the State of California a two (2) year extension. The State took this action because of the. prevailing adverse economic conditions in the development industry. Tentative Tract Map No. 22904 which was due to expire on October 10, 1993 (July 25, 1993 plus 77 days for previous water moratorium) was outstanding at the time the state bill became effective. This tentative map will now not expire until October 10, 1995 without the City having to take any further action. The applicant has indicated to the City's Administrative Services Director that they will continue to work with the City regarding payment of their outstanding financial obligations. State Bill No. SB 428 effects, every other tentative tract and parcel map within the City that was outstanding as of September 13, 1993. Therefore, there will not necessarily be any need for subdividers to seek extensions from the City on their maps for the next two years. Staff recommends that the City Council acknowledge the State's mandated automatic extension of time for tentative maps which applies to Tentative Tract Map No. 22904 so that closure of the continuance on this item can be reflected in the minutes. No other specific action is required.
