SUBJECT: Temporary Runway /Skylark Airport
BACKGROUND
In February 1993, Mr. Brogden, Airport Manager, submitted a letter to
the City of Lake Elsinore requesting support for a temporary runway to
allow Skydive California to continue operations at the airport.
DISCUSSION
On February 24, 1993, Mayor Washburn, following the direction of the
City Council, submitted the requested letter of support to Skydive
California, who in turn submitted the letter to the Department of
Transportation, Division of Aeronautics.
Mr. Riesen, Chief of the Office of Airports, responded to Mr. Brogden's
request for a temporary runway March 5, 1993, with a letter
conditionally approving the temporary runway.
On or before the temporary approval was obtained, it was realized that
the neighborhood had not been notified of the request for the temporary
runway and the neighborhood had a number of issues and concerns that had
not been addressed.
At the March 23, 1993, City Council meeting, a number of residents
expressed concern for the lack of communication and information being
provided to their neighborhood (Serenity Development) requested the City
Council reconsider their action.
Based on the residents concerns, the City Council set a study session
for April 1, 1993, at 3:00 p.m. to discuss the residents concerns
(information packet attached).
A second meeting was scheduled at the request of the residents to be
held at the airport. This meeting was set for Tuesday April 6, 1993, at
6:00 p.m. The purpose of the meeting was to address safety and airport
responsibility issues, as well as the possibility of allowing Mr.
Perkins to secure permission to use the temporary runway which would
allow him to continue his airplane maintenance business.
At the Tuesday April 6, 1993, meeting, eight residents attended and
addressed the following issues and concerns:
1. Potential of lengthening the runway?
2. Why the school could oppose and the residents can't?
3. Safety, monitoring and responsibility?
4. Will soaring also use the runway?
5. Night flights
The responses to the issues and concerns were as follows:
1. There is the potential to lengthen the runway by approximately
100 to 145 feet if CalTrans will approve.
2. Residents can oppose - CalTrans approved this temporary runway
because it was the same one used during the 1980 floods and
CalTrans has stipulated it is safe based on compliance with
their listed conditions.
3. Mr. Brogden has followed through with his conditions and
presented residents with a direct telephone number to his
voice mail. Mr. Perkins, if his request is approved, will be

on the airport 8 -10 hours per day, and will be the
one to monitor the airport. The final responsibility
stands with the airport manager.
4. The issue of soaring has not been discussed or addressed with
the temporary runway - it is assumed by staff that only the
issue of Mr. Perkins, business is the issue before the City
Council.
5. Night flight will not be allowed until approved lighting is
installed.
Based on the input received and the discussion with Mr. Brogden, Airport
Manager, Mr. Perkins, Skylark Aviation and the residents present, it is
staff feeling that the issues have been resolved to a level of agreement
that Mr. Perkins, maintenance business could continue to operate.
The fiscal impact to the City is nominal, business license revenues
only.
RECOMMENDATIONS
Based on the information collected and presented in this report, it is
recommended that the Mayor and City Council consider approving Mr.
Perkins request to use the temporary runway for his aviation maintenance
business with the following conditions:
1. Mr. Perkins pilot or copilot each airplane into the airport on
the approved flight path.
2. only one (1) airplane may be brought in, by air, per week (one
landing and one take -off).
3. Mr. Perkins accept the responsibility to monitor the airport
for non - authorized landing or take -offs.
4. Skydive California not use the runway for any take -offs or
landings for the next four to six months.
5. Skydive California notify the Serenity Development prior to
resuming skydiving at the Skylark Airport; and
6. Mr. Brogden, Airport Manager, provides a contact telephone
number to residents of the Serenity development should they
have any questions.

SUBJECT: AIRPORT INFORMATION
As a follow up to the City Council meeting of March 23, 1993, the
following information has been prepared so that you may review
before the meeting of April 1, 1993, at 3:00 p.m., at City Hall.
General Comments and Response to Council Questions:
> There have been two airplane mishaps (crashes) in the last
three and a half (3 1/2) years that Mr. Brogdon is aware of
at Skylark Airport.
> The Airport is on a normal flyway so their is considerable
air traffic over the area.
> The Airport must comply with all Federal and Caltrans
Aviation Regulations and Requirements
> City of Lake Elsinore Police Officers and Code Enforcement
Officers can cite any unauthorized planes for taking off or
landing (City Ordinance No. 626)
> Mr. Brogdon is the Airport Manager (letter attached) and
has the authority to modify or change runways with proper
permit approvals (CUP) and inspection ( Caltrans).
Based on Caltrans approval (letter attached) the item
should come before the Planning Commission and City
Council for an amendment to CUP 86 -1 Revised Skylark
Airport.
> The City Attorney feels the City can control the airport
runway modifications through the CUP process (changes would
need an amendment)
> Mr. Brogdon, the Airport Manager, would prefer the City not
close the Airport for the next 4 -6 months, but rather allow
him to submit a letter stating he will not be flying any
planes out of the Airport for Sky Diving for the next 4 -6
months

> Mr. Brogdon, Airport Manager would also like to get
approval for Mr. Perkins to fly in and out, one plane per
week to continue his business operation of servicing
planes.
• Runway 5/23 was closed down in 1987 (north /south runway)
> Currently there is an aviation easement over the Serenity
Tract that provides for aircraft to fly over the property
• Mr. Brogdon has physically closed the runway (placed a
road grader in the way).
• Mr. Brogdon met with Dr. Long, Superintendent of
L.E.U.S.D., and discussed the temporary runway. Dr. Long
stated that if the planes were not flying over the school
grounds, no action would be necessary by the School
District.
> Department of Transportation, Division of Aeronautics
Chief, Mr. Riesen, stated he would not be able to have
anyone present at the April 1st, 1993, meeting. The cost
is prohibitive and the local agency (city) has land use
control.

purchase, the property had been established as an airport
for an unknown length c:f time.
1955:
By 1955, soaring /gliderplane and parachute operations had
been established.
1956:
Cal Trans Aviation Dept. certified runway 11/29. This run -
way points directly toward the lake.
1969:
Airport property was annexed into the City of Lake Elsinore.
1974:
Cal Trans certified a parallel. runway to the existing runway
11/29, also the diagonal runway 5/23 was certified.
1975 -1979:
During these years,aircraft operations peaked at approximately
25,000 annually. One take -ofi or one landing constitutes
one operation. Airport activity during this period of time
consisted of soaring /glidertow, parachute center and general
aviation activity. In 1976, Cy Perkins sold the airport and
the parachute center business to Arora Leasing Company.
1980:
Flood waters inundate the airport. area. Cal Trans temporarily
cancels operating authority.
1981:
In September, Cal Trans certiFi,es a ter,px�rary r.nway near and
parallel to Corydon Street. The paraclute center re- opens.

runs on a diagonal to the lake.
Today:
This runway
Runway 5/23, is used as the primary runway until floodwater
recedes sufficiently to re -open the ariginal main runway 11/29
Evaporation projections indicate lak-:2 water should recede in
10 to 12 months sufficiently to allow re- certification of the
main runway. Currently there are 9 general aviation aircraft
based on the field. Jump center and soaring operations have
not been re- activated to date.
F IND INGS :
THE BUCHANAN PROJECT:
The committee has determined that the existing runway 5/23 or
the proposed runway (see recommendations), would not adversely
impact this project with reguard to air or ground safety.
The possibility of noise pollution from aircraft- operations
does exist, particularly to those homes proposed nearest to
the extended centerline of runerav 5/23. This problem can be--
minimized by altering the ground track of transiting aircraft
near the project.
THE JEAN HAYMEN SCHOOL:
The committee has determined that runway 5/23, as positioned
on Cal Trans maps, would create the possibility of an over-
flight of the school. Cal Trans Aviation Dept. has indicated
to this committee a willingness to co- operate and expedite
a runway re- aligivnent that would correct this problem.

To eliminate the impact from runway 5/23 on ,lean Haymen School,
the committee recommends the re- alignment of runway 5/23 to
a new heading of approximately 4/72•
The southwest runway end would be moved west - northwest approx-
imately 116 feet from the original centerline.
The northwest runway end would be moved .:pprox-mately 466 feet
northwest from the original. centerline.
This will move the extended centerline of the ne'i✓ runway to
a point approximately 1/4 mile northwest of the 7rhool. site
and eliminate the possibility of over - flights.
2.
To expedite runway re- alignment, the committee, recommends
the City waive the E.I.R. requirement.
3.
When floodw -caters recede suff9.ciently, runway 11/29, which
runs directly toward the lake, Should Le re- activated and
used as the primary runway. Runway 4/27_ would tnen be
designated as an alternate runway to be used onl./ when
weather conditions dictate.

On- street parking or storage of boats, motorhomes, trailers and
trucks over one -tor. capacity on the streets is prohibited and
may also be enforced by City Code Enforcement Officers.

antennas will not be permitted and any other location must be
out of the line of sight from the street or from neighbors or
be properly screened so as not to be readily visible. Location
is subject to approval by the Architectural Committee.
Each owner shall grant.and convey unto the Skylark Airport, it,s
successors, assigns, lessees, sublesees, licensees and
invitees, an avigation easement for 'the free and unobstructed
overhead passage of all aircraft which are authorize v
use the airport. -

FOR INFORMATION AS TO YOUR OBLIGATIONS AND RIGHTS, YOU
SHOULD READ THE RESTRICTIONS ATTACKED HERETO.
USES AND ZONING: A commercial shopping center site is proposed
to the southeast portion of this project on Corydon Street. A
multi - purpose sports field is to be built adjacent to the
northwesterly portion of this project. This field will be
nightlighted and some owners may be affected by the lighting.
Lake Elsinore is located approximately 3/4 mile westerly of the
project site.
HAZARDS: There is an earthquake fault zone lying within the
park area located northerly of the residential building sites.
Residential `__ildings are not permitted in the fault zone. -
There will be a large covered storm drain channel flowing from
east to west through the center of Serenity. No houses will be
built on the storm drain channel or right of way which is
planned to be owned and maintained by the Riverside County
Flood Control and Conservation District.

reason of any operational incidental effects thereof including
such as may occur in and from take -off, landing and approach
patterns into and from the Dominant Tenement.

To have and to hold said easement and right -of -way and
all rights appertaining thereto unto Grantee, its successors,
assigns, lessees, sublessees, licensees and invitees, until the
Dominant Tenement shall be abandoned and shall cease to be used
for public airport purposes, it being understood and agreed that
these covenants and agreements shall run with the land.
Grantor, for itself, its -heirs, administrators,
executors, successors and assigns, does hereby waive, remise and
release any right or cause of action which it may now have or,
which it may have in the future against Grantee, its successors
and assigns, due to such noise, sound or shock waves, vibrations,
odors, fumes, dust, fuel particles, smoke, light, thermal waves,
air quality changes and other results in said airspace that my be
caused or may have been caused by the operation of aircraft of
all types now known or hereafter designed and used for navigation
of or flight in the air, by reason of any use ancillary or
incidental to the operation of the Dominant Tenement . and by
reason of any operational incidental effects thereof including
such as may occur in and from take -off, landing and approach
patters into and from the Dominant Tenement. Said waiver and
release shall include, but shall not be limited to, claims, known
or unknown, for damages for physical or emotional injuries,
discomfort, inconvenience, property damage, death, interference
with use and enjoyment of property, diminution of property
values, nuisance or inverse condemnation or for injunctive or
e \other extraordinary or equitable relief. Grantor, for itself,
its heirs, administrators, executors, succrrscors and assigns,
agrees that Grantee shall have no duty to avoid or mitigate such
damages by, without limitation, setting aside or condemning
buffer lands, rerouting air traffic, erecting sound or, other,
barriers, establishing curfews, noise or other regulations.

executors, successors and assigns, agrees not to construct or
permit the construction or growth of any structure, tree or Other
object that obstructs or interferes with the use of the rights
herein granted or that creates electrical interference with radio

aircraft, or, to cause difficulty for pilots to distinguish
between airport lights and other lights, or it impair visibility
in the vicinity of said airport, or to otherwise endanger the

Skydive California, Inc., current managing operator of Skylark
Airport is requesting a Conditional Use Permit to establish a
commercial parachute school, skydiving center, and to allow the
placement of temporary coach trailers within the floodplain area.

SIZE AND LOCATION DESCRIPTION
The subject site is approximately 178.6 acres located approximately
450 feet northwest of the intersection of Corydon Street and Cereal
Street (APN 370 - 080 -010). The proposed office trailers and
requested operations will be conducted on the southeast portion of
the site totaling 18.76 acres. (Exhibit A).
ENVIRONMENTAL SETTING
Prior to introducing this application, the applicant submitted a
preliminary application for review, (P# 90 -19) on December 28,
1990. Staff reviewed the application and concluded that a

Conditional Use Permit would be required. Since then, the
applicant has decided to move forward with the original request and
is now applying for a Conditional Use permit to allow the placement
of the trailers in the floodplain, the establishment of a
commercial parachute school and a skydiving center on a temporary
basis.
PROJECT DESCRIPTION
The applicant proposes to establish a commercial parachute school
and skydiving center on 18.76 acres located at Skylark Airport. The
applicant will utilize four (4) temporary coach trailers to house
the office, video review, lounge, and equipment sales and
maintenance. The temporary trailer facilities will be located
above the 1265' a.s.l. elevation which represents the boundary of
the 100 -Year Flood Zone and will be setback 10' from the southeast
property line adjacent to the mini- storage. (Exhibit A)
The four trailers are to be single story, 12 feet by 60 feet (12'
X 601) structures made of prefabricated wood and galvanized
construction. Exterior materials are T -1 -11 wood siding and
galvanized roofing. Roof mounted air conditioning units are
proposed. All trailers are. manufactured in compliance with the
State of California, Department of Housing, Title 25 Standards and
Code. (Exhibits B,C,D) Two portable restroom facilities that
feature self flushing urinals, china bowl toilets, and stainless
steel sinks will be used. (Exhibit E)
The facilities will be open five (5) days a week, (Wednesday
through Sunday), from 8:00 am until sunset, twelve (12) months a
year. There will be fifteen (15) part -time and full -time
employees. This includes Operation Managers, Jumpmasters,
Instructors, and Ground Support Personnel. It is anticipated on an
average that 50 to 75 club members and students will use the
facilities per day on weekends with a much fewer number on
Wednesday through Friday. The site can accommodate 157 parking
stalls. This number exceeds the anticipated number of users.

The applicant will also utilize four (4) passenger airplanes that
are currently operating under the airport management to perform the
skydives.
The applicant anticipates that during peak times of operation,
perhaps 15 to 25 takeoffs and landings associated with the airport
operations will be expected utilizing standard flight procedures.
The operations intends to use the existing runway at Skylark
Airport. By published Club rules, jumping over inhabited or
occupied areas is prohibited. All activities will occur over
vacant lake bottom and airport site.
ANALYSIS
In light of the fact that the requested use is typical and
appurtenant to the operations of the airport, that it is incidental
and temporary in nature, and that it is situated within the
floodplain, staff feels that the use would be appropriate until
the East Lake Specific Plan is adopted.
With these facts in mind, a Conditional Use Permit is requested by
staff to permit the use and enable the Lake Elsinore Planning
Commission to place Conditions upon that use.

SPECIAL PROJECT
Staff concerns relate to the potential on -site flooding situation.
The location of the airport within the floodplain makes new
construction of permanent facilities problematic. Ordinance No.
906 "Flood Damage Prevention", restricts and prohibits any
development or man -made changes in the floodplain including the
construction of buildings. This proposal does not require Building
Permits and is temporary in nature. The use of temporary coach
trailers is appropriate within the floodplain because in the event
of flooding, the units can be relocated to higher grounds.
Generally, the use of temporary coach trailers would not be
recommended except as a construction office. In this case, it is
a logical alternative as a temporary structure for an intermediate
use within the floodplain. The trailers will be required to
remain on their axles and an emergency plan will be required in the
event of flooding conditions.
The area around the trailers will be required to be properly
landscaped using six (6) 15 gallon Rhuslancia trees, eight (8) 24"
boxed Eucalyptus Sideroxylon trees, 12" -18" Mondo grass, and
Fresque grass. (Exhibit F)
ENVIRONMENTAL
The project as proposed is Categorically Exempt from the
requirements of the California Environmental Quality Act based on
Section 15311 Class 11. This Section establishes that the
placement of minor structures appurtenant to existing commercial
facilities are exempt from the CEQA process.
RECOMMENDATION
Staff recommends that the Lake Elsinore Planning Commission approve
a request to allow Skydive California, Inc, to place temporary
coach trailers in the floodplain, and operate a commercial
parachute school and skydiving center at Skylark Airport, based on
the Findings, Conditions, and Exhibits A,B,C,D,E,F,G herein
contained.
FINDINGS
1. That this proposed use, on its own merits and within the
context of its setting, is in accordance with the Goals,
Objectives, and Policies of the Lake Elsinore General Plan.
2. That the requested use, as proposed will not be detrimental to
the general health, safety, morals, and welfare of the persons
residing in the neighboring area or the City.
3. That the site is adequate in size and shape to accommodate the
use, and for all the yards, setbacks, walls or fences,
landscaping, buffers and other features required by the Zoning
Ordinance.
4. That in approving this use as requested, there will not be an
adverse effect on abutting property because the site is
already an airport.

Planning Department
1. This Conditional Use Permit will expire in five (5) years
after the Lake Elsinore Planning Commission approval date.
Upon expiration, it may be extended subject to the Community
Development Manager approval on a yearly basis for no more
than three (3) years thereafter. In the event that the East
Lake Specific Plan is adopted during the term of this approval
and land use changes are required on the site by the Specific
Plan, this Conditional Use Permit shall be null and void.
2. The applicant shall secure all proper permits from the
Department of Building and Safety. If permits are not
obtained and requested Use has not commenced within one (1)
year of the date of this approval, then the approvals as
indicated by this Use Permit shall be expired and require
resubmittal.
3. An emergency evacuation plan shall be prepared and filed with
the Community Development Manager to provide for evacuation
and protection of the facilities and prevention of hazards in
the event of potential flooding. This evacuation plan shall
be implemented upon notice by the City.
4. The proposed office trailers shall substantially conform to
the illustration provided (Exhibit B,C,D,E). Proper skirting
around the trailers in the form landscaping or plywood will be
required.
5. All office trailers, parking areas, and landscaping shall be
in conformance with Exhibits A, F, and G.
6. No habitation of any premises shall be permitted at the
airport, this includes no camping or overnight parking of
recreational vehicles.
7. Signage shall conform to the provisions of Title 17, Chapter
94.
S. Meet the requirements of County Flood Control District.
9. Provide documentation to the City that the Operator has met
all Federal Aviation Administration and Caltrans Department of
Aeronautics permitting requirements.
10. The applicant shall place a $1,000.00 cash bond for each
trailers to assure the proper removal upon expiration.
11. Prior to the issuance of Final Certificate of Occupancy, the
applicant shall submit all Binders of Liability Insurance
naming the City of Lake Elsinore Additionally insured. This
document shall be subject to the approval of the Risk
Management Director.
12. All Conditions of Approval shall be met to the satisfaction of
the Community Development Manager before Final Certificate of
Occupancy is granted.

SUBJECT: Conditional Use Permit 86 -1 REVISED Skylark Airport
Pursuant to the Airport Committee Meeting this morning and
subsequent discussion with the City. Attorney, it is suggested that
CUP 86 -1 Revised be placed on the City Council Agenda for July 14
for an extension of time with modifications to Conditions 1 and 20
as indicated below.
Modified Conditions:
1. Immediately upon approval of the extension of CUP 86 -1
Revised, and in any case within 24 hours, the letter
attached as Exhibit "A" shall be signed by the
operators of the airport and submitted to the City for
transmittal to Division of Aeronautics. If building
permits are not obtained within sixty days and
construction completed within ninety days of the date
of this approval, this Use Permit shall expire and the
structure shall be condemned by the City and
demolished, unless an extension is granted by City
Council prior to the expiration date. Prior to
approval of another Use Permit for offices or any
other structures or improvements, a Master Plan for
the Airport shall be submitted addressing a schedule
of improvements and proposed uses with a plan of the
areas that would be devoted to various uses.
20. During construction phase, portable restroom
facilities may be used. When construction is
completed, permanent restroom facilities shall be
installed within a period not to exceed three years
from the completion of rehabilitation of the hanger
unless extended by the City Council. Plans for the
restroom facilities shall be subject to approval of
the Director of Community Development and shall
include screening of these facilities.
Condition 1, as modified, would provide compliance with Condition 26
(copy of complete conditions attached).
In this morning's meeting concern was also expressed by the Haskells
regarding building plans. Although these plans have been submitted
for building plan check, I had the Chief Building Official perform a
courtesy plan check which resulted in the attached Correction List
which generally addresses the need to comply with floodproofing
requirements.

1. If permits are not obtained and construction commenced within
three (3) months from the date of this approval, this Use
Permit shall expire and the structure shall be condemned by
the City and demolished, unless an extension is granted by
City Council prior to the expiration date. Prior to approval
of another Use Permit for offices or any other structures or
improvements, a Master Plan for the Airport shall be submitted
addressing a schedule of improvements and proposed uses with a
plan of the areas that would be devoted to various uses.
2. No habitation of any premises shall be permitted at the Air-
port, this includes no camping or overnight parking of
recreational vehicles for sleeping.
3. Dust control measures shall be incorporated into management
practices. This shall include provision of dust control
measures for aircraft and vehicles. Excessive off -site dust
impacts shall be deemed sufficient cause for revocation of
this Permit. To this end, decomposed granite, gravel, asphalt
or other surfacing may be used, subject to the approval of a
grading plan.
4. A grading and drainage plan shall be submitted to the Division
of Building and Safety for review and approval and that any
fill or other imported material below the 1270' elevation
above sea level shall be balanced by the export of an equal
amount of material. This grading plan shall require the
approval of the City Engineer who shall submit the plan to the
Federal Emergency Management Agency (F.E.M.A.) for comment,
prior to approval. Final disposition of all exported materials
shall be indicated on this grading plan.
5. An emergency evacuation plan shall be prepared and filed with
the Community Development Director prior to Certificate of
Occupancy or release of utilities. It shall provide for eva-
cuation and protection of the facilities and prevention of
hazards in the event of potential flooding. This evacuation
plan shall be implemented upon notice by the City.
6. A complete set of plans for rehabilitation of the hanger, along
with certification by a licensed engineer attesting to the
structural stability and integrity of the existing walls, foun-
dations, and roof systems shall be submitted for review and ..
approval of the Building and Safety Division. These plans shall
meet FEMA requirements and shall be certified by a licensed
engineer. The exterior of the hangers shall be refinished with
= stucco or other material approved by the Community Development
Director.
7. All Conditions of Approval shall be net to the satisfaction of
the Community Development Director before final Certificate of
Occupancy is granted or utilities released.
S. Signage shall conform to the provisions of Title 17, Chapter 94.
9. Meet all requirements of Ordinance No. 636 (Chapter 15.72 of
the Municipal Code) regarding grading.
10. Meet the requirements of County Flood Control District.
11. Provide a notarized affidavit from the property owner which
shall be recorded and which acknowledges the flood hazard
associated with this site.

b. Affirm that all future owners or assignees shall
be notified and responsible for this arrangement.
12. Record a "Notice of 100 -Year Flood Hazard; Waiver of Liability
Claims; and Agreement to Notify Future Purchasers of £ncum-
brancers," in a format which meets the approval of the Director
of Community Development.
13. Meet the requirements of the County Fire Department as listed
below or modified in writing by the Fire Marshall:
a. The Fire Department is required to set a minimum fire
flow for the remodel or construction of all commercial
buildings using the procedure established in Ordinance
546.
b. Provide or show there exists a water system capable of
delivering 500 GPM fire flow for a 2 -hour duration at 20
PSI residual operating pressure.
c. The required fire flow shall be available from a 701 -F2
hydrant, located not less than 25 feet or more than 165
feet from any portion of the building as measured alonc
anproved vehicular travelways.
14. Use of domestic water service (for other than fire protection,
irrigation, dust control and similar uses) shall be prohibited
until such time as sewer service is provided for wastewater
disposal.
15. Prior to Final Certificate of Occupancy and release of utili-
ties for the rehabilitated hanger, and prior to issuance of
any grading permits, all junk, salvage, or similar materials
and any aircraft or vehicles inoperable for more than thirty
(30) days shall be stored inside a building or removed from
the property, except for two (2) planes presently on -site which
have some local historical significance, providing these planes
are restored to an operating appearance.
16. All business operations at the airport, except those businesses
with an existing valid City business license for operations at
the airport, shall require approval of a Conditional Use Permit
and other requisite.City approvals.
17. No other structures of either temporary or permanent status
shall be permitted on Airport property without prior City
approvals.
18. The hanger can be used for storage purposes prior to its com-
plete reconstruction and final issuance of a Certificate of
Occupancy and release of utilities, if certified to be safe
by a licensed engineer, per approval of the Community Devel-
opment Director.
19. Office uses of this hanger are specifically not permitted by
this Use Permit.
20. During construction phase, portable restroom facilities may
be used. When construction is completed, permanent restroom
facilities shall be connected to the sewer. If construction
is not completed, all portable restroom facilities will be
removed within ninety (go) days after issuance of permits,
pursuant to Condition Number One (1). Plans for restroom
facilities shall be subject to approval of the Director of
Community Development.

21. The applicant shall contact Elsinore Valley Municipal Water
District concerning the feasibility of installation of a back
flow valve in the water line to protect the system against
flood water infiltration. If feasible and recommended by
Elsinore Valley Municipal water District, this valve shall be
installed. Evidence of compliance with this condition shall
be provided to the Director of Community Development prior to
Certificate of Occupancy or release of utilities.
22. The Applicant shall submit a plan of operations which will
indicate aircraft "runup" and taxi areas showing their rela-
tionship to adjacent existing residences, and proposed auto-
mobile and aircraft parking areas. Such plans shall be sub-
ject to the approval of the Director of Community Development
and violation of said plan shall be grounds for revocation of
this Conditional Use Permit.
23. All owners of the properties on which Skylark Airport is loca-
ted shall execute a notarized Release, Hold Harmless, and
Indemnity Agareement as approved by the City Attorney and the
Risk Manager.
24. Use of the hanger shall be limited to storage of aircraft and
related vehicles and no maintenance activities involving engine
work shall be permitted in the hanger. Signs shall be-posted
and maintained regarding this and all users of the hanger shall
be notified by the operators of the airport of these restric-
tions. It shall be the airport operator's responsibility to
enforce these restrictions.
25. The applicant shall obtain from the FAA and Cal Trans Division
of Aeronautics written verification that the hanger location
and design complies with all rules and guidelines for airport
operations and shall submit this and all other appropriate
documentation to the City, including a drawing drawn to scale
and completely dimensioned showing the location, width and
length of all runways and taxiways and the location of the
hanger with respect to these.
26. Safety concerns must be mitigated and approvals for such must
be obtained from Cal Trans, Division of Aeronautics, and the
Lake Elsinore School District for Runways 5/23. Approvals
must be. in writing.

AS FOLLOWS:

SECTION ONE.
There is hereby added to the Lake Elsinore Municipal Code
Section 9.48.010 which is to read as follows:
"It is unlawful for any person to operate an aircraft, including,
but not limited to, an ultralight vehicle, an ultralight aircraft, or a
motorized hang glider, in violation of Federal Aviation Regulations, Part
91 (General Operating and Flight Rules) as amended, and as hereafter amended,
or Part 101 (Moored Balloons, Kites, Ultralight Vehicles, Unmanned Rockets,
and Unmanned Free Balloons) as amended, and as hereafter amended, within or

above the city limits of the City of Lake Elsinore."
SECTION TWO.
This ordinance shall take effect as provided by law.

SECTION SIX:
The City's Law Enforcement Agency and Code Enforcement Officers are
appointed inspectors to assure compliance with all provisions herein and shall
investigate and determine compliance and /or to enforce and perform all the regula-
tory provisions of this ordinance.
SECTION SEVEN:
In the event that any provision of this ordinance is determined to be
invalid by a court of competent jurisdiction, the remaining sections shall remain
in full force and effect.
SECTION EIGHT:
This ordinance is determined to be an urgency measure for the preserva-
tion of the public health, safety and welfare of the City of Lake Elsinore, and
will become effective immediately upon its adoption to reduce the possibility of
injury or damage to persons or property due to unsafe operation of the Skylark
Airport.
SECTION NINE:
This ordinance shall become effective upon adoption.

AN URGENCY ORDINANCE OF THE CITY OF
LAKE ELSINORE, CALIFORNIA, AMENDING
PORTIONS OF ORDINANCES 349, 455, AND
480 AND REPEALING CHAPTER 17.36 OF
THE LAKE ELSINORE MUNICIPAL CODE, AND
ADDING NEW CHAPTER 17.36 TO SAID CODE
ENTITLED "R," RECREATIONAL DISTRICT.
(AMENDMENT 86 -1)
The City Council of the City of Lake Elsinore hereby
finds that:
1. The Recreational District is coincident with the
area of special flood hazard around Lake Elsinore,
as identified by the Federal Emergency Management
Agency and that this area is subject to periodic
flooding and other hazards.
2. New uses, including an airport and recreational
vehicle parks proposed for properties within the
Recreational District, and these uses have the
potential to adversely impact the public peace,
health, and safety.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE
ELSINORE, CALIFORNIA, DOES ORDAIN AS'
"FOLLOWS:
Section 1. Uraerncv. This urgency ordinance is deemed
necessary to protect the public peace, health, safety
and welfare of the residents and property owners within :
the City of Lake Elsinore.
Section 2. Chapter 36 of Title 17 of the Lake Elsinore
Municipal Code is hereby repealed in its entirety and a
new Chapter 36 of Title 17 of the Lake Elsinore Municipal
Code is hereby enacted to read as follows:
CHAPTER 17.36
RECREATIONAL DISTRICT
Section 17.36.010 Putpose. There are some areas of the
City, which, under present conditions, are not suited for
permanent occupancy or residence by persons or property -:-
for the reason that they are subject to periodical flood-
ing and other hazards. These lands pertain to property

below one thousand two hundred sixty -five feet (12651
above mean sea level, which may be subject to flood
waters. Therefore, for the public safety and.interest,
health, comfort, convenience, preservation of the public
Peace, order and the public welfare, the City Council
has created a zone classification within which it is
unlawful to erect or maintain places for human occu-
pancy or for other uses not specifically granted herein.
Section 1,7.36.020 Permitted Uses. All uses, or expan-
sion of any existing uses, within this district shall
be subject to approval of a conditional use permit.
Section 17.36.030 Uses Subject to a Conditional Use Permit.
The following uses may be permitted subject to approval
of a conditional use permit, provided that all structures
associated with such uses shall be temporary or removable,
or of a permanent type which shall not be subject to
damage from flooding and shall not constitute a hazard in
the event of a flood:
1. Agriculture or horticulture
2. Airports or heliports
3. Athletic fields
4. Boat docks, marinas, and boat launching facilities
S. Campgrounds
6. Equestrian-facilities, including trails, riding
stables, riding academies, showgrounds and compe-
tition facilities

Fishing piers and facilities
Golf courses and driving ranges
Parks, picnic grounds, and playgrounds

be in accord with the purposes of this chapter and
having characteristics similar to those uses listed

Section 17.36.040 Desicn Review. All structures, parking
facilities, or storage lots and grading operations within
this district shall be subject to Design Review Board
approval, and shall comply with all provisions of Chapter
15.64, Flood Hazard Areas, and Chapter 15.68, Floodplain
Management.
Before any building permit shall be issued or any condi-
tional use permit, or variance, or conditional exception
shall be approved, the City Engineer shall first approve
any and all permits or uses.
Section 3. Effective Date. This ordinance shall become
effective upon its adoption.

Dear Sirs:
Subject to approval by Cal Trans, the Lake Elsinore Unified
School District, and other regulating agencies, the City of
Lake Elsinore has no objection to Skydive California and the
California Department of Aeronautics determining an
appropriate, temporary runway at Skylark Field. This will be
used during the period of flooding which prevents the use of
the existing runways.
The proposed operations for the runway would be for skydiving
only, subject to School District concurrence. To forestall
any problems with the school east of the field, you -must
condition the use to allow use of the westerly runway for
takeoffs and the easterly runway for landings. These will not
be open for -use by the public. You must assure that your
aircraft, as much as possible, make turnouts to avoid
overflying the housing southwest of the field. In the event
that the conditions call for a departure to the East, all
aircraft must be able to turn prior to reaching Mission Trail
and departing over the lake bed. Although we do not
anticipate any additional liability, the City would also
require that you execute a hold harmless agreement with the
City.
You may not use the DC -3 aircraft on this runway. The two
Twin Otters and one Cessna may be used. All considerations
for reduced noise levels must be taken as long as no reduction
in safety is caused.

This letter is your authorization from the California Department of Transportation,
Division of Aeronautics, to operate temporary Runway 3/21 at Skylark Airport. The
following conditions must be met or this authorization is cancelled immediately.
• Operation of this temporary runway cannot be in violation of any FAA Federal Air
Regulation or local rules and regulations.
• Approval to establish and operate a temporary runway must be obtained from the
City of Lake Elsinore, the Riverside Sheriffs Department and the land owner.
• Runway use restricted to day VFR only.
• Runway use limited to Cessna -182 and Twin Otter aircraft operated by Skydive
California. No other aircraft authorized to use the runway.
o Runway centerline to be no closer than 125 feet from southerly property line
o Southwest end of runway to be no closer than 200 feet from property line
• Northeast end of runway to be no closer than 100 feet from fence line on southwest
side of parking lot.
• The drainage ditch must be covered at least 60 feet from runway centerline.
• Runway usage limited to takeoffs only on Runway 21 and landings only on Runway 3.
No overflights of Jean Hayman School east of the airport. Runway 3 will be marked
with an "R" and Runway 21 with an "X ".

The Work Session was called to order by Mayor Washburn at 3:05 p.m.

The Pledge of Allegiance was led by Director of Special Projects
Watenpaugh.
DISCUSSION ITEM
1. use of Runways - Skylark Airport.
.eex of Special Projects Watenpaugh commented on the
history of the airport and detailed recent discussions
concerning the temporary use of the alternate runway. He
further commented that upon investigation, he had found
indications of only two crashes in the last 3 to 3 -1/2 years.
He noted a substantial amount of "transient" air traffic in
this airport. He also noted that the runway was presently
blocked to prevent landings. He addressed questions of
safety, advising that the airport is required to follow
Federal and Caltrans safety requirements; responsible
authority for citations being City Police Officers or Code
Enforcement; responsibility for suggesting changes, which lies
with Tony Brogdon, Airport Manager; and existing Conditional
Use Permits, which are held by the airport and Skydive
California. He explained that the runway being considered for
temporary use was closed in 1987 when Jean Hayman School was
constructed. He further explained that an avigation easement
exists over the Serenity Homes tract. He advised that what is
presently being requested is the ability for one plane per
week to take -off and land in connection with the airplane
repair business of Mr. Perkins. He stressed that the School
District has no problems with this request and does not even
feel Board considerati necessary. He also noted
discussions with Mr. and Mr. Ferguson of the
Department of Transportation, in which they indicated their
concern is insuring that safety requirements are met for the
runway.
Mayor Washburn requested clarification of the runways and
their direction. Mr. Brogdon detailed showed the runway

configuration, noting that the normal operation runway is
toward the Lake.
Mayor Washburn requested clarification of the letter
previously authorized by the City Council. Mr. Brogdon
clarified that it allowed for use of one Cessna and one Otter,
With DC -31s excluded.
Director of Special Projects Watenpaugh noted that there are
currently no approvals for night take -offs or landings,
because there is no lighting in place.
Mayor Washburn commented on the original approval of the
Serenity Homes tract. He questioned the details of the CUP,
believing that it regulated only buildings and lighting. He
also questioned the ability of the City to regulate the
operations.
City Manager Molendyk indicated that staff has now been told
by Mr. Reasons that it is the City's responsibility to close
a runway. He noted that there is some uncertainty as to what
the current problem is. He questioned whether thib is an
ongoing problem which might be related to the airport
management or whether it is only a problem due to the recent
flooding and temporary runway. He noted that clarification
has been provided that Mr. Brogdon is the Airport Manager. He
explained the ability of local law enforcement to obtain
numbers from the planes and cite the planes when on the ground
at the airport.
Mayor Washburn questioned the enforcement issues. Mr. Brogdon
detailed an example which occurred on March 23rd, in which a
ggntleman was told he could not fly out of the airport and
would be required to remove the wings and transport via land.
The man disregarded this information and took -off from Skylark
and landed at Chino Airport. He has since been arrested and
is in jail in connection with this incidence.
Councilman Winkler inquired when the water truck was placed to
block the runway. Mr. Brogdon indicated it was placed on
March 24th.
Mayor Washburn inquired whether there was a runway not
controlled by Mr. Brogdon. Mr. Brogdon indicated that there
was one on Mr. Pribble's property, however is not an approved
runway.
Mayor Washburn questioned the number of aircraft at this
airport and the logging system used. Mr. Brogdon indicated
that they have a list of the planes tied down at Skylark, and
the Cessna is the only plan currently authorized to take -off
and land.
Pamela Rieder, resident of Racquet Club Way, alerted Council
to the danger of this runway being pointed toward the Serenity
Homes tract. She noted that she has spoken with Mr. Brogdon
previously. She suggested that is someone was at the airport
to log the flights it would assist in controlling the
aircraft. She addressed the take -off on March 23rd indicating
that it took -off directly over the Serenity Tract at a low
altitude. She stressed that the residents are not against the
airport, but are concerned with the flights since the flooding

occurred. She further stressed the risks noting crashes in t
Cerritos and Perris. She expressed concern with the
enforcement issues, noting response time by the Sheriff's
Department.
City Attorney Harper requested clarification that the CC & R's
included a statement relating to the avigation easement. Mrs.
Rieder confirmed that it was included, but noted the
requirement that it be used as "authorized by law ", stressing
that the law is not being followed.
Councilman Winkler inquired whether there have been problems
in the last 8 days since the water truck was placed to block
the runway. A resident indicated that one flight had occurred
this date, suggesting that it was very near the Serenity
Tract.
Mayor Washburn commented that the flooding problem occurred
quickly and efforts have been made to solve the problems
without safety concerns. He further commented that the
skydiving has already ceased and Mr. Perkins is attempting to
continue business.
Ed Mobley, resident of Somerset Drive, addressed insurance and
financial liability for the City. He particularly noted the
transient air traffic and suggested that the City had a
responsibility to prevent it.
Mayor Washburn clarified the confusion that previously existed
as to who could control the facility.
City Attorney Harper clarified that while F.A.A. has indicated
that the City can control the land use, the responsibility
shifts to F.A.A., once the planes leave the ground.
Mr. Mobley further commented on unauthorized uses and
liability on the part of the City, particularly with "deep
pocket" legislation. City Attorney Harper indicated that he
would disagree with Mr. Mobley on the level of liability, in
that any lawsuit would include the airport as a defendant and
liability on the part of the City would be very unlikely.
City Manager Molendyk indicated that he heard the neighborhood
saying there was no problem under normal conditions, and since
this is part of the emergency actions he questioned the time
frame for this temporary runway and whether other runways
could be used. He noted that it would be necessary to assure
proper management in any case and questioned the meaning of
"temporary" in this case, and when "normal" operations would
resume.
Mr. Brogdon indicated that it could take two years for
sufficient evaporation to occur. He addressed Mrs. Rieder on
the unauthorized flight and noted that the last plane at the
airport had left this date and would not return. He clarified
that the current request would be to allow for one plane per
week for Mr. Perkins repair operation. He noted that Mr.
Perkins ability to continue business would ensure that someone
would be present 10 hours per day to monitor any unauthorized
flights. He stressed the blockage of the runway and the
departure of the last plane.

Mrs. Rieder indicated that they are unsure that this will be
all. She expressed concern with a flight of the DC -3 and
suggested that there is a credibility problem. She indicated
that she could see no assurances that planes would not take-
off and land. She requested clarification of the current
request.
Larry Perkins, 32019 Corydon, adjacent to the airport,
detailed his background with the airport and aircraft
maintenance. He explained that he has made a request to
Caltrans to be able to bring aircraft in for maintenance. He
read his letter of request for use of the temporary runway,
indicating he would bring one aircraft per week in to the
airport. He detailed the types of aircraft which could be
anticipated.
Mrs. Rieder questioned the flight pattern proposed to the
Transportation Department. Mr. Perkins indicated that he had
requested it as proposed in the diagram presented. He
stressed that the flights would go no closer to the Serenity
tract than Mr. Pribble's hangar. He demonstrated the take -off
of the flight this date on the map. He explained that the two
runways currently underwater would use a pattern almost
directly over the Serenity tract at approximately 800 feed: He
stressed the efforts of the pilots to be good neighbors to
nearby homeowners. He commented on "outlaw" flights and
explained that the potential for them always exists,
particularly if the airport is completely closed and no one is
present.
Councilman Winkler questioned Mr. Perkins request to the
Department of Transportation, and whether it would require
that he pilot the planes. Mr. Perkins advised that this would
primarily be the case, but in some instances he might be the
co -pilot instead.
Councilman Winkler questioned whether the departure was the
most crucial concern. Mr. Perkins indicated that departure
and landing were nearly equal.
Mayor Washburn commented that skydiving has been suspended for
4 to 6 months.
City Manager Molendyk inquired based on the six month
suspension of skydiving, what assurances the residents would
want. He inquired whether there would be some benefit to
pumping the water from the runways. Mr. Perkins indicated
that more is involved than the runways.
Ann Jonsson, resident of Rolling HIlls Estates, detailed her
experience as a pilot and her participation in the formation
and operation of the Lake Elsinore Soaring Club. She detailed
accident statistics obtained from the National Transportation
Safety Board. She indicated that pilots will make every
effort to avoid housing areas and land in a field, on a road
or other open space. She suggested that the airport
representatives meet with the homeowners to address concerns,
noting that this has not occurred to date. She commended the
operators of Skylark for their concern and professionalism.
Councilman Winkler question the current status of Mr. Perkins

request. Mr. Brogdon indicated that three letters are
necessary, one from the Sheriff's Department, one from the
City and one from the airport owner.
City Attorney Harper clarified the ability to modify the
existing Conditional Use Permit through the public hearing
process.
Councilman Winkler stressed that no action could be taken at
this meeting. He commented that if a danger exists the City
should respond. He further commented that he had gone to the
site and reviewed the situation and gone on a flight. He
concurred that the turn was completed before the hangar
building owned by Mr. Pribble. He further concurred that
concerns do exist for transient air traffic. He stressed the
actions taken by the airport to prevent air traffic. He noted
that he would personally trust Mr. Perkins based on his
acquaintance with him and his reputation. He assumed
responsibility for not notifying the residents prior to the
consideration of the letter of support. He expressed
satisfaction that the concerns are being addressed. He
commented that based on his experience he does not feel the
homes are at risk, particularly in comparison to the incident
in Perris, which occurred just off the runway.
Ms. Jonsson stressed the statistics for planes which are-out
of control and that only 11 deaths have occurred in 10 years,
all of which related to the Cerritos Incident.
Councilman Winkler requested that Mr. Brogdon take down the
names of the residents present at this meeting and get
together and meet with them.
Mrs. Rieder reiterated that there have been no problems until
this runway began to be used. She expressed concern for the
credibility of the airport operators. She further expressed
concern with a lack of certainty that an accident will not
occur. She questioned who could ensure that the laws are not
broken.
Councilman Dominguez commented on his experience with the
runways and the Serenity Tract, noting he was involved when
this tract was originally considered. He noted that the
concern at that time was for the Jean Hayman School. He
further noted that the developer was required to advise
potential residents of the airport and the avigation easement.
He stressed the fact that flights have occurred over Serenity
all along. He commented that the biggest concern appear to be
control and communication.
Mayor Washburn commented that every time there are emergencies
in the Community, situations are created that are not perfect.
He stressed the efforts to respond to the situation under a
sense of urgency. He further stressed that this at times
requires decisions to be made on the spot. He also stressed
that Council is looking for a short term solution to the
problem and assurances that it will not become a long term
situation.
City Attorney Harper questioned the potential of adjusting the
runway angle slightly to alleviate concerns. Mr. Brogdon

indicated that he did suggest that to Caltrans, but adrainage
ditch prohibits such a change. Mr. Harper suggested a very
slight variation.
Curly Annis, Operations Director at the Airport, explained
that another problem with angling the runway is the ground, as
this location is the only section that remains adequately
solid with the water that is encroaching on the airport. He
stressed that much of the ground is too soft. City Attorney
Harper inquired what would happen if the end of the runway was
shifted a few feet. Mr. Perkins indicated that is required to
be at least 125 feet from the property line. Mr. Annis
explained the limitations of the property such as power
facilities and poles. Discussion ensued as to possible
alternative configurations.
Councilman Winkler questioned how much space could be gained
by taking the runway back to Cereal Street. Mr. Perkins
indicated that they could gain approximately 280 feet. Mr.
Brogdon indicated the mobiles are in the process of being
moved and he would agree to this change.
City Manager Molendyk inquired of Mrs. Rieder if this plan was
acceptable. Mrs. Rieder expressed continued concern with the
credibility issue. She indicated that the best situation
would be guarantee that the airport was not in use, however if
it is feasible to shifted the runway back it would make sense
to her. She questioned the level of risk, if the schools
mandate that flights not occur over them. City Attorney
Harper clarified that the reason for the change was because
the funding for the school would have been pulled.
Mayor Washburn stressed the need to find a level of tolerance
and understanding between the two sides of this issue. He
indicated he was looking for cooperation to make the situation
acceptable to both sides. He stressed the need for reasonable
discussions to occur.
City Manager Molendyk requested clarification that the
direction to staff is to have the operator look at moving the
runway back 280 feet and assist in coordinating a meeting
between the airport operator and the residents.
Councilman Winkler indicated he felt that 270 feet should
provide an better cushion and ease some of the concerns.
A gentleman in the audience commented on restrictions placed
on runways on military bases and in other communities. He
indicated that he is aware of the existing easement and noted
that he is now aware of the temporary closure and that the
operator is responsible for the airport and its safety
requirements.
Mr. Brogdon indicated that when he heard there were concerns
he called every person he heard had concerns and stressed that
this does concern him as well. He stressed the difficulty of
discussion at the previous Council meeting, due to the
unruliness of the crowd. He detailed his background in
planning skydiving events worldwide and noted his primary
concern with addressing what could go wrong. He indicated
that he does his best to control the situation, and will

pursue steps to address the gentleman who took -off illegally.
He expressed a desire to meet with the residents to address
their concerns.
Mayor Washburn indicated that Mr. Watenpaugh is the lead staff
representative on this matter and any further concerns or
discussions can go to him. He hoped that Mr. Perkins and Mr.
Brogdon would work to resolve the situation. He stressed the
temporary nature of this runway usage.
City Manager Molendyk commented that it is a advantage to the
City to know with certainty that Tony Brogdon is the
authorized Manager of the Airport.
Mayor Washburn suggested discussion of date and time before
the residents leave this meeting. Mr. Watenpaugh questioned
the

Councilman Winkler indicated that this could be on the next
agenda, and suggested that the meeting be held as soon as
possible. He stressed that the first concern is safety and
peace of mind for the residents.
