HomeMy WebLinkAboutItem No.32CITY OF LAKE ELSINORE REPORT TO CITY COUNCIL TO: HONORABLE MAYOR AND CITY COUNCIL FROM: RON MOLENDYK, CITY MANAGER DATE: APRIL 27, 1993 SUBJECT: WEED ABATEMENT PROGRAM nISCUSSION For the past six (6) years the Weed Abatement Program has been done on a contractual basis with a contractor. The last agreement was for three (3) years, and this year's proposed agreement will be for a three year period. Seven (7) contractors expressed an interest in this year's program, however, only three (3) submitted bids. Smith Tractor Services of Wildomar was the low bidder (see attached), and has also been the City's contractor in the past. FISCAL IMPACT None. All costs are recovered by placing the assessment on the tax bill. RECOMMENDATION It is recommended that the City Council approve the contract and authorize the Administrative Services Director to execute the contract with Smith Tractor Services. MISC CHAINSAWS AND WEEDEATERS FAGE. ^A 1 L., . k;i - OF CONTRACTOR'S SERVICES AGREEMENT The CITY OF LAKE ELSINORE, hereinafter referred to as CITY, and S.S.# hereinafter referred to as CONTRACTOR, hereby agree as follows: 1. PROJECT: The CONTRACTOR shall perform services in the nature of discing lots or mowing or removing rubbish, refuse and dirt within the City of Lake Elsinore. 2. SCOPE OF SERVICES: The CONTRACTOR shall furnish a tractor suitable to complete the job of abatement of the property. The CONTRACTOR shall provide transportation to and from job sites, for his equipment at his expense. 3. TIME FOR PERFORMANCE: The CONTRACTOR shall commence performance of service forthwith upon the execution of this agreement and and upon written direction to commence from from the City. 4. TERM OF AGREEMENT: This agreement shall be for a term of three years commencing from the date of execution. 5. LICENSES: The CONTRACTOR, its employees, agents contractors, and subcontractors shall maintain professional licenses required by the laws of the State of California at all times while performing services under the agreement. 6. PERMITS AND RIGHTS OF ENTRY: The CITY will provide any and all necessary permit and rights of entry as required to perform the proposed services. The CONTRACTOR will prosecute the work in a manner to minimize inconvenience and any possible hazard to the CITY. 7. WORKERS COMPENSATION INSURANCE: The CONTRACTOR certifies that he is aware of the laws of the State of California requiring employers to be insured against liability for Workers Compensation and shall comply with such laws during the term of this Agreement. 8. CONTRACTOR'S LIABILITY: The CONTRACTOR shall indemnify and hold the CITY, its officers, employees, and agents free and harmless from any liability whatsoever, including wrongful death, based or asserted upon act or omission of the CONTRACTOR, its employees, subcontractors, and agents relating to or in anyway connected with the accomplishment of the work or performance of service under this agreement. As part of the foregoing indemnity, the CONTRACTOR agrees to protect and defend at his own expense, including attorney fees, the CITY, it officers, agents, and employees in any legal action based upon any such alleged acts or omission. A Certificate of Insurance is required with limits of one million CSL, naming City additionally insured. 9. WORK PRODUCT: Work shall be considered complete upon inspection and approval of the Building Department. 10. TERMINATION: This agreement may be terminated by either the CONTRACTOR or the CITY upon thirty day written notice to other party in the event of substantial failure of performance by the other party, or in the event the CITY shall elect to abandon or indefinitely postpones the project and gives notice of termination. INDEPENDENT CONTRACTOR: CONTRACTOR and his agents, servants, and employees shall act at all times in an independent capacity during the term of this Agreement and in the performance of the services to be rendered hereunder, and shall not act as, and shall not be, and shall not in any manner be considered to be agents, officers, or employees of the CITY. 12. ASSIGNMENT: Neither this agreement nor any part thereof shall be assigned by the CONTRACTOR without the prior written consent of the CITY. 13. NON - DISCRIMINATION: CONTRACTOR shall not discriminate at its recruiting, hiring, promotion, demotion, or termination practices on the basis of race, religious creed, color, national origin, ancestry, physical handicap, medical condition, marital status or sex in the performance of this contract, and, to the extent they shall be found to be applicable hereto, shall comply with the provisions of the California Fair Employment Practices Act (commencing with Section 1410 of the Labor Code), and the Federal civil Rights Act of 1964 (P.L. 88- 352) Purchasing Agent Contractor Date Date AGENDA ITEN, U. 3 PAGE-27— Of — L,
