BACKGROUND At the City Council Meeting of December 8, >1992, the City Council approved the application submitted by The Great Main Street Antique Emporium (Rick Zwiefel) to -hold> six..Antique and Collectible Street Faires beginning Saturday,..January 23, 1993. A condition of that approval was that each event would be on a trial basis with an evaluation upon completion of each event. Modifications would be made on an event -by -event basis to continue with the requested dates, provided the promoter met with all modified conditions. At the March 9, 1993 City. Council, Meetin%, the, City Council approved staff's recommendation of approval with exception of condition 42 which allows the applicant to utilize volunteers identified with bright, orange reflective vests and hand held radios for open communications and control to man barricades. Two additional private security guards were approved as well. At the April 13, 1993 City Council meeting, under "public comments" non - agendized items, Mr. Zwiefel stated that due to an incident at the second fair (held March 27th) with an altercation which made it difficult for him to ensure the safety of participants, there would be no more street faires. On Thursday, May 13, 1993, Mr.. Zwiefel submitted a letter tQ.the .Community Services Department requesting to resume his event beginning with the July 24th event, and all remaining dates as previously approved by.City Council. DISCUSSION The event held on Saturday, March 27, 1993 operated between the hours of 8:00 a.m. and 3:00 P.M. was held without incident or problems as witnessed by staff. The event attendance was good and all conditions were met by the applicant as required. . Based on the statements of the applicant at the April 13th City Council Meeting relating to his possible inability to ensure the safety of the participants, staff has added Condition #12 to address the applicant's comments.. The following listing of conditions will need to be.met by the applicant by Friday, July 16th, in order to assure another event: 1. Provide the City of Lake Elsinore with a Certificate of Insurance listing the City as additionally insured for the amount of one million dollars. 2. Rent all needed and mandated barricades and signs based upon the "Traffic Control Plan" developed by the City's Engineering Department. 3. Provide for street sweeping /cleaning immediately following the event at the promoter's expense. 4. Pay all staff associated costs related to the event (which may include an extra duty Deputy if Council so desires at $35.61 per hour). �,�J� AGENDA ITEM N�7._ �0 PAGE_.J___O I � 5. Port -A- Potties to be provided for public use with location of units approved jointly between staff and applicant. 6. Identified volunteers equipped with a communication device linked to the promoter to be placed at the corner of Main and Sulphur, Main and Heald, and Graham and. Spring to secure traffic barricades, and also at the alleyway on east Graham Avenue. Two private security guards be hired to rove the event for security purposes for the duration of the day to include set -up and clean -up. 7. A three (3) yard dumpster be provided with its location jointly agreed upon by staff and the applicant. 8. A City staff person be provided at the promoter's expense to monitor the event for compliance on behalf of the City. 9. A "Notification Roster" be implemented to verify that all downtown affected businesses have been contacted. , 10. City to be'provided copies of publicity being utilized such as press releases, flyers, mailers, etc. 11. Promoter's staff shall be aware of the location of public phones and port -a- potties within the event area so as to direct the public-to those locations. 12. To ensure participants' safety, one extra duty Sheriff Deputy be hired at $35.61 for the hours of operation (8:00 a.m. - 3:00 p.m.) at a cost of $249.27 FISCAL IMPACT None. All fees to be paid by the promoter. RECOMMENDATION Staff's recommends that the Mayor and City Council approve the applicant's request for a Street Faire, on Saturday, July 24th, providing that the applicant meets all conditions as specified in this report and related correspondence by Tuesday, July 16, 1993. Staff also suggests that Council evaluate condition number 12 as it relates to the security of the event at the expense of the promoter. Street Faire - March 27. 1993. (F:151.1) City Manager Molendyk highlighted the prior approval of this.event which occurred for the first time on January 23rd with positive feedback. He noted that.staff met with the organizer to address areas of concern and the modifications were included in the staff report. Rick Zwievel, 101 S. Main Street, commented that the Street Faire is a self sufficient event, with no requests for co- sponsorship. He advised that he_ was *in,agreement with'the conditions requested-by the Community. Services Department except Condition #2 regarding security; he expressed concern that the five officer requirement was not discussed. He also expressed concern with Condition 14 requiring a City staff person. He stressed that he did everything required last time and the event was a success: Community Development Director Sapp explained that the Sheriff's Department had indicated it would be more comfortable with deputies or private security for this type of event. Councilman Alongi inquired what problems there had been _ with the first event.,. Mr. Sapp indicated that he, was not aware of any. .,Councilman Alongi stressed that this event is an effort to draw.people.to the community.: He indicated -that if there had been problems last time he would have no problem with the security requirement. He stressed the need to reduce the costs for the applicant., Mayor Washburn questioned the cost of security. Mr. Sapp advised that it would be approximately $10 per hour /per officer. He also noted that the increased recommendation for the number of officers was based on the level of participation anticipated for the event-. Councilman Alongi commented that there has not been security at the ,barricades barricades for the Parades, and questioned whether it would be more advantageous to have a Sheriff circulate and private people on the barricades. Mr. Sapp clarified that.,the_ applicant could have three private security for the price of one deputy. Councilman Winkler questioned the security used at the AGENDA {TES" NO. PAGE 3.OF­L�— last event. Mr. Sapp clarified that private people with orange vests and walkie- talkies were utilized. Mr. Zwievel indicated that the individuals were friend of his who were currently unemployed. He noted that there were also 2 officers from Price Security. He stressed that he had purchased the orange vests and walkie- talkies and if the new proposal for security is used that money is wasted. He also stressed the success of the last event and its boost for the business on Main Street in general. Councilwoman Cherveny commented on the requirements of the first event, noting that there were no problems and it was a good event. She further commented that the volunteers were clearly identifiable. She concurred with the need for porta potties, but expressed concern with the expense of the security suggested. She also commented that she was sure the Sheriff's Department would advise the City of problems if they occur. She advised that she would support the two Price Security officers supplemented by volunteers and the deletion of Condition 14 requiring a City staff member. City Manager Molendyk clarified that the conditions had been suggested based upon review with the Sheriff's Department, and if lesser requirements are set the promotor would need to assume the liability. He noted that if there are problems they can be addressed after the event. Mayor Washburn commented that he would see the City staff person to oversee and prevent liability problems and some of the follow -up items which were not done last time, such as removal of barricades. MOVED BY WINKLER, SECONDED BY CHERVENY TO APPROVE STAFF RECOMMENDATIONS WITH THE EXCEPTION OF CONDITION 02; WHICH WOULD BE CHANGED TO ALLOW FOR USE OF VOLUNTEERS. Councilman Winkler commented that the City staff person would be helpful in preventing liability. Mr. Zwievel accepted the change in the security arrangement as fair and advised that he will still have two Price Security people. Councilman Alongi questioned the security contemplated. Councilman Winkler indicated it was basically the same as last time. Councilwoman Cherveny noted that she had pursued this item further and thanked CR & R for their agreement to provide the dumpster and the street sweeping for this event at no cost. Mayor Washburn stressed the need for the volunteers to be identifiable for contact. THE FOREGOING MOTION CARRIED BY UNANIMOUS VOTE. A condition of that approval was that each event would be on a trial basis with an evaluation' upon - completion of each event..: Modifications would be made on an event -by -event basis to continue with the 'requested dates, provided the promotor met with all. modified conditions. The initial event held on Saturday, January 23, 1993 went well. It was very well attended with no major incidents to report. The promotor tried to meet all requirements placed upon him, but minor modifications will need to be made to the event if It is to continue. Concerns from the January 23rd event are listed below with required modifications for the March 27th event: 1) Port -A- Potties be provided for - public use and not merchants' businesses. 2) Licensed, uniformed private security guards must be hired to secure the main traffic concern areas at the corners of Main and Sulphur, Main and Heald and Graham at Spring. 'An identified volunteer, equipped with a communication device linked to the promotor will be placed at the alleyway on east Graham Avenue. Two (2) additional guards are to rove the event for security purposes for the duration of the day. 3 ) A three ( 3 ) yard dumpster be provided to avoid trash and debris from being knocked over and blown throughout the downtown area. 4) A City staff be provided at the promotor's expense to monitor the event for compliance on behalf of the promotor as well as assist in securing the event with crowd control. 5) A "Notification Roster" be implemented to verify that all downtown affected businesses have been contacted and are aware of the event. 6) City be provided copies of publicity being utilized. 7) Promotor's staff be aware of the location of public phones within the event area to direct the public to said locations. Included as part of these conditions are those that were placed upon the promotor initially: 1) Provide the City of Lake Elsinore with a Certificate of Insurance listing the City as additionally insured for one million dollars. Port -a- potties shall be provided for the public's use. A total of four will be required. 2. A "Business Notification Roster" will be required showing that you have notified all businesses of the upcoming event. A copy of this will need to be submitted to the Community Services Department by Friday, March 19th. 3. Barricades shall be manned by a private, licensed security company with a current business license to operate within the City of Lake Elsinore. A total of five individuals. will be required. The City's existing ordinance was prepared several years ago and is rather prohibitive and difficult to enforce. Discussion Following a meeting in the City Manager's Office the consensus that the existing City process for dealing with, street faires /sponsors and vendors is cumbersome and prohibitive. Staff was.asked.to research how other cities handle street faires and see if a revised process can be developed. In following through with the request, it has become very apparent that each city seems to handle street faires differently. In addition, it depends upon which department you contact as to the response you receive. _ Staff contacted eight cities and asked if a business license was required for the promoter and each vendor. In addition, staff asked what the fee was and if sales tax was collected (chart attached with the results). As you can see from the chart, each area handles street faires a little differently. Thus, it is staff's suggestions that the City implement a street faire policy that would stimulate activity within the City and assist established businesses with the spin -off revenues that would be derived from the promotion and attendance of a regularly held street faire. It would appear that the city could charge the promoter of a street faire a flat fee of $too plus $50 in lieu of charging each vendor for a business license. In addition, the promoter would pay staff time to post "no parking" and for City police or private security to patrol the event and supply the City with a $1' million insurance policy.
