PLANNING COMMISSION MEETING

CALL TO ORDER:
Chairman O'Neal called the Regular Planning Commission Meeting to order at 6:05 PM.
PLEDGE OF ALLEGIANCE:
Commissioner Mendoza led the Pledge of Allegiance.

Also present were: Director of Community Development Preisendanz, Planning
Manager Weiner, Deputy City Attorney Santana, Public Works Director Seumalo,
Associate Planner Carlson, Associate Planner Resendiz, Planning Technician Miller,
Senior Planner Harris, and Office Specialist Baron.
PUBLIC COMMENTS (Non-Agenda Items)
Hector Zubieta, resident of Lake Elsinore thanked staff and the Commission for their
assistance and requested support from the Commission on the septic and infrastructure
issues throughout the City.
Dayle Dottie spoke of her concerns with her submittal of her submitted design review
and the time that has accrued with the process.
CONSENT CALENDAR
Chairman O'Neal requested to pull Item Nos. 1 through 5 from the Consent Calendar.
(1) Minor Design Review of a single family residence located at 16930 Pierrott
RECOMMENDATION: Approval

Chairman O'Neal asked the applicant Hector Zubieta if he has read and agreed to the
Conditions of Approval. Mr. Zubieta agreed to the Conditions as presented.
Associate Planner Carlson stated that Condition Number 47 needs to be modified to
strike the words and sewer and add Condition Number 47b to state the following: prior
to the issuance of a building permit the applicant shall submit a copy of the applicable
form from Riverside County Environment Health authorizing the installation of private
sewerage disposal system. Mr. Zubieta agreed to the added condition.
It was moved by Commissioner Zanelli and seconded by Commissioner Mendoza to
adopt Planning Commissioner Resolution No. 2007-091, approving Minor Design
Review of a single family residence located at 16930 Pierrott Avenue to include the
modifications to the Conditions of Approval; the motion passed unanimously.
(2) Minor Design Review of a single-family residence located at 30168 Mountain
View Street (APN: 375-283-041).
RECOMMENDATION: Approval
Dave Madden, applicant agreed to the Conditions of Approval.
Associate Planner Carlson stated that Condition Number 48 needed amending to strike
the words and sewer and add Condition Number prior to the issuance of a building
permit the applicant shall submit a copy of the applicable form from Riverside County
Environment Health authorizing the installation of private sewerage disposal system.
Mr. Madden agreed to the added Condition.
It was moved by Commissioner Gonzales and seconded by Commissioner Mendoza to
adopt Planning Commission Resolution No. 2007-092 approving Minor Design Review
of a single family residence located at Minor Design Review of a single-family residence
located at 30168 Mountain View Street to include the modifications to the Conditions of
Approval; the motion passed unanimously.
(3) Minor Design Review of a single family residence located at 408 North Lewis
RECOMMENDATION: Approval
Community Development Direct Preisendanz noted that Condition No. 70 has been
modified to include the drainage fee in the amount of $548.24.
Chairman O'Neal noted that the applicant was not in attendance of the meeting.

Commissioner Zanelli stated that he was not happy to learn that the project commenced
before coming to the Planning Commission for approval. He stated that it appears that
grading has begun and the pad for the foundation has been prepared. Planning
Manager Weiner indicated that no grading permits have been issued for the site. He
stated that the Building and Safety Department has since been to the site and have
ceased construction of the project.
It was moved by Commissioner Flores and seconded by Commissioner Mendoza to
continue project Minor Design Review of a single family residence located at 408 North
Lewis Street off calendar; the motion passed unanimously.
(4) Minor Design Review of a single family residence located at 17067 Gunnerson
Street (APN's: 378-171-001 & 002 and 378-171-015 & 016).
RECOMMENDATION: Approval
Community Development Direct Preisendanz indicated a modification to Condition
Number 49.
Planning Manager Weiner provided an overview of the project to the Commission with
the noted that Condition Number 49 would be changed to Condition No. 49a and
modified to strike the sentence as follows: applicable water agency stating that yvate~
and sewer. He stated that Condition Number 49b would be inserted as follows: prior to
the issuance of a building permit the applicant shall submit a copy of the applicable form
from Riverside County Environment Health authorizing the installation of private
sewerage disposal system.
RECOMMENDATION: Approval
Vince Gibbons, applicant for the project agreed to the Conditions of Approval
Rosendo Envagas spoke in favor of the project.
Gerardo Campa spoke in opposition of the project.
Commissioner Flores spoke of the design of the project and asked the applicant on his
plans for the area near the front of the driveway. Mr. Gibbons stated that the area
would be grading and landscaped. Commissioner Flores asked if curbs, gutters and
sidewalks would be required. Planning Manager Weiner stated that the applicant is
required to pay an in-lieu fee which is stated in Conditions No. 56 and 57.
Commissioner Gonzales asked about the driveway. Mr. Gibbons stated that the
driveway meets the requirements for the maximum flow. He stated that the position of
home is placed in order to take advantage of the view.

It was moved by Commissioner Flores and seconded by Commissioner Mendoza to
adopt Planning Commission Resolution No. 2007-093 approving Minor Design Review
of a single family residence located at 17067 Gunnerson Street; the motion passed by
unanimously.
(5) Minor Design Review of a Single-Family Residence located at 16813 Bell Avenue
(APN: 378-261-051).
Chairman O'Neal and Vice Chairman Gonzales recused themselves from the dais.
Community Development Director Preisendanz provided an overview of the project. He
indicated that Condition No. 49 needed to be modified to become 49a and Condition
Number 49b would be inserted as follows: prior to the issuance of a building permit the
applicant shall submit a copy of the applicable form from Riverside County Environment
Health authorizing the installation of private sewerage disposal system.
Commissioner Zanelli asked the applicant if he agreed to the Conditions of Approval.
Kevin Bowen, applicant stated that he agrees to the Conditions with the exception of
Condition Number 9.
Deputy City Attorney Santana stated that Affordable Housing Condition of Approval is a
condition that the City Council implemented in 2005 to satisfy the California
Redevelopment Law.
Ms. Dawn Bowen, applicant introduced herself to the Commission. She stated that they
have been working on this project since November 2006 and did not know of this
requirement and expressed her disappointment to the Commission that she was not
made aware of this law until recently.
Planning Manager Weiner stated that the applicant submitted their application for
development in January 2006. He stated that staff reviewed the project with the
applicant and made every attempt to inform them of everything. Director of Community
Development Preisendanz stated that the City has a fee schedule to follow, however
this fee is fairly new. He stated that the City Council adopted this fee, and can not
waive it.
Commissioner Zanelli asked if they would need to conduct a sewer percolation. Ms.
Bowen indicated that the percolation has been completed and have had the
Environment Health Department inspect the area.
Commissioner Zanelli requested public comments.
Michael O'Neal, resident spoke in opposition of the project and suggested to the
Commission to either continue or deny the project.

Commission Zanelli requested Commissioner comments.
Commissioner Flores asked if the driveway could be changed from asphalt to concrete.
Community Development Director Preisendanz stated that the applicant requested
asphalt which is allowed.
Commissioner Flores noted that he had trouble reading the engineers stamp on the
plans and stated that his expiration date appears to have expired. Ms. Bowen indicated
that the engineer did renew his license and has a copy of the renewal.
Commissioner Zanelli inquired the length of the driveway approach. Planning Manager
Weiner stated that the approach would be twelve feet which is the minimum amount
required.
Commissioner Zanelli asked about the fencing. Director Preisendanz stated that the
City requires a block wall along the street; however he stated that this is a local street
and therefore the code allows a wooden fence. Ms. Bowen indicated that they were
looking into having vinyl fencing because of the longevity. Community Development
Director Preisendanz stated that it would be important to have consistency on the
property.
Commissioner Zanelli suggested continuing the item until June 5m in order to allow the
applicant and staff to work on the issues.
It was moved by Commissioner Zanelli and seconded by Commission Mendoza to
continue Minor Design Review of a Single-Family Residence located at 16813 Bell
Avenue to the June 5, 2007 Regular Planning Commission meeting; the motion passed
with a 3 to 2 vote with Vice-Chairman Gonzales and Chairman O'Neal absent.
Chairman O'Neal and Vice-Chairman Gonzales returned to the dais at 7:11 p.m.
PUBLIC HEARING ITEMS
(6) Conditional Use Permit No. 2007-03. Commercial Desian Review No. 2007-
01 "Wachovia Bank Building".
RECOMMENDATION: Approval
Chairman O'Neal opened the Public Hearing at 7:10 p.m.
Community Development Director Preisendanz introduced staff that would be reviewing
the project with the Commission. Senior Planner Harris provided an overview of the
project to the Commission.

Glen Daigle thanked staff for their hard work and agreed with the Conditions of
Approval.
Public Works Director Seumalo indicated that staff had realized an error in Condition
No. 70, whereas it outlines the fair share of the permanent median on Collier Avenue.
Mr. Daigle agreed to the Condition.
Chairman O'Neal closed the Public Hearing at 7:17 p.m.
Commissioner Mendoza questioned the security lighting. Mr. Daigle indicated that the
only security lighting would be installed on the 30 foot poles in the Target Center.
Chairman O'Neal indicated asked the applicant if they had considering having a
monument sign at the intersection of Collier and Center. Mr. Daigle indicated that they
have submitted a proposed design to staff for consideration.
It was moved by Commissioner Gonzales and seconded by Commissioner Zanelli to
adopt Planning Commission Resolution No. 2007-094 of the City of Lake Elsinore,
California, recommending that the City Council adopt finding of consistency with the
Multiple Species Habitat Conservation Plan of the Wachovia Bank Building; the motion
passed unanimously.
It was moved by Commissioner Zanelli and seconded by Commissioner Mendoza to
adopt Planning Commission Resolution No. 2007-095 of the City of Lake Elsinore,
California approving Conditional Use Permit No. 2007-003; the motion passed
unanimously.
It was moved by Commissioner Zanelli and seconded by Commissioner Flores to adopt
Planning Commission Resolution No. 2007-096 of the City of Lake Elsinore, California
approving Commercial Design Review No. 2770-01 Wachovia Bank Building; the
motion passed unanimously.
(7) Commercial Design Review No. 2006-05 for a maintenance and golf cart
storage facility.
RECOMMENDATION: Approval
Chairman O'Neal opened the Public Hearing at 7:25 p.m.
Community Development Director Preisendanz introduced Planning Consultant Miller
who would be providing an overview of the project to the Commission.

Michael Fuller, representing John Laing Homes stated that he agrees with the
Conditions of Approval.
Vice Chairman Gonzales addressed his concerns with the fuel tanks. Mr. Fuller stated
that the fuel tanks are above ground and noted that should flooding occur the modular
building and fuel tanks could be removed.
Commissioner Flores asked if the reclamation water be used to wash the golf carts. Mr.
Fuller indicated that the reclamation water would only be used to water the golf course
and not the vehicles.
It was moved by Commissioner Mendoza and seconded by Vice Chairman Gonzales
to adopt Planning Commission Resolution No. 2007-097 of the City of Lake Elsinore,
California recommending to the City Council adoption of findings that the project is
consistent with the Multiple Species Habitat Conservation Plan; the motion passed
unanimously.
It was moved by Commissioner Mendoza and seconded by Commissioner Flores to
adopt Planning Commission Resolution No. 2007-098 of the City of Lake Elsinore,
California recommending to the City Council of the City of Lake Elsinore the approval of
Commercial Design Review 2006-05; the motion passed unanimously.
BUSINESS ITEMS
(8) General Plan Conformity Determination for Proposed Capital Improvement
Program for Fiscal Years 2007-2008 through 2011-2012.
RECOMMENDATION: Approval
Community Development Director Preisendanz introduced the project to the
Commission.
Public Works Director Seumalo provided an overview of the project to the Commission.
Commissioner Zanelli indicated that he did not have time to review the entire plan over
the weekend; however, asked about the proposed bike lane project. Director Seumalo
noted that this project is currently unfunded and are not in the current project list for
construction.
It was moved by Commissioner Mendoza and seconded by Commissioner Flores to
adopt Planning Commission Resolution No. 2007-099, a resolution of the Planning
Commission of the City of Lake Elsinore, California for the finding of conformity of the
Capital Improvement Program of the General Plan; the motion passed unanimously.

(9) General Plan Circulation Element Conformity of the Summary Street Vacation for
the right-of-way known as "Green Street".
RECOMMENDATION: Approval
Director Seumalo provided an overview of the project to the Planning Commission.
Vice Chairman Gonzales asked if the property would be going back to the owner.
Director Seumalo stated that vacation streets depend on how the streets were
dedicated, and if was in fee title, then staff is obligated to recommend that the property
is sold back to the entity.

here on forward, only action minutes are taken from approved Resolutions stored in the
archives.
Planning Commission approved Resolution No. 2007-100, recommending that the City
Council of the City of Lake Elsinore adopt findings that the vacation of Green Street
conforms to the City Circulation Element and is exempt from the California
Environmental Quality Act (CEQA); the motion passed unanimously.

for the right-of-way known as "Crane Street".
RECOMMENDATION: Approval
Planning Commission approved Resolution No. 2007-100, recommending that the City
Council of the City of Lake Elsinore adopt findings that the vacation of Crane Street
conforms to the City Circulation Element and is exempt from the California
Environmental Quality Act (CEQA); the motion passed unanimously.
