The Tentative Tract Map proposes to subdivide a portion of the 100 year old Pacific Clay mine consisting of 1,371.1 acres into 10 parcels for conveyance and financing purposes only. No development is proposed on the site at this time. PROJECT LOCATION The 1371.1 acre site which forms the basis for the subject Tentative Tract Map is located in the northern part of the City of Lake Elsinore, west of the 1-15 freeway where Temescal Road intersects with Lake Street, and which is described in the attached Tentative Tract Map (the "Project Site"). The Project Site is composed of a series of vacant active mining areas and rolling to steep hills that contain significant deposits of clay shale, sand, and aggregates. The Project Site is accessible from both Temescal Road and Lake Street. PC August 21, 2012 Item No. 2 Page 1 of 8 TTM No. 35000 August 21, 2012 Page 2 of 3 ENVIRONMENTAL SETTING The project site is bound by undeveloped/vacant land to the north and single family homes to the northwest (Horsethief Canyon Specific Plan) and southeast (Alberhill Ranch). Lake Street borders the eastern perimeter of the Project Site. EXISTING LAND ZONING- GENERAL PLAN USE Project Vacant M-3 Mining Mixed Land Use Site North Vacant/rural Riverside County Mountainous and Open Single-Family Space (Riverside County Residential General Plan South Alberhill Ranch Specific Plan Specific Plan East Vacant/Brighton Specific Plan Specific Plan Alberhill Ranch Specific Plan West Vacant Riverside County Rural Residential Mountneous and Rural Residential Rural Residential ANALYSIS The applicant is proposing to subdivide the site into 10 large parcels for conveyance and financing purposes only. The intent of the subdivision is to allow the property owner to transfer property from the Pac Clay mining operation to the development branch of Castle & Cooke once mining is complete for future development. The proposed parcels will range in size from approximately 26 acres to 413 acres. Staff has reviewed and analyzed Tentative Tract Map No. 35000 pursuant to the appropriate Planning and Zoning Laws, and Chapter 16 (Subdivisions) of the Lake Elsinore Municipal Code ("LEMC"), and found that the Map is consistent with all laws and City procedures. In addition, the Pproject has been adequately conditioned by all applicable departments and agencies and, therefore, will not result in any significant environmental impacts. The proposed project, togetherwith the conditions applicable thereto, will not be detrimental to the public health, safety, or welfare or materially injurious to properties or improvements in the vicinity. PC August 21, 2012 Item No. 2 Page 2 of 8 TTM No. 35000 August 21, 2012 Page 3 of 3 ENVIRONMENTAL DETERMINATION Tentative Tract Map No. 35000 is exempt from the California Environmental Quality Act (Cal. Publ. Res. Code §§21000 et seq.:"CEQA") and the State CEQA Guidelines (14. Cal. Code Regs §§15000 et seq.), specifically pursuant to Section 15061(b)(3) (Review for Exemption) in that it can be seen with a certainty that there is no possibility that approval of Tentative Track Map No. 35000 for conveyance and financing purposes only will have a significant effect on the environment. RECOMMENDATION Staff recommends that the Planning Commission take the following actions: Adopt Resolution No. 2012- , recommending to the City Council of the City of Lake Elsinore approval of Tentative Tract Map No. 35000, based on the attached findings, exhibits and conditions of approval. Tentative Tract Map 35000 PC August 21, 2012 Item No. 2 Page 3 of 8 RESOLUTION NO. 2012- RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE, CALIFORNIA, RECOMMENDING TO THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE APPROVAL OF TENTATIVE TRACT MAP NO. 35000 GENERALLY LOCATED ON THE WEST SIDE OF LAKE STREET AT TEMESCAL ROAD WHEREAS, an application has been filed with the City of Lake Elsinore by Castle & Cooke Alberhill Ranch, LLC for the subdivision of 10 parcels or lots of land, all having legal access consisting of 1371.1 acres (`the Project") for conveyance financing purposes only. The Project is generally located on the west side of Lake Street at Temescal Road, further identified as Assessor Parcel Numbers (APNs: 391-800-011, 391-230-009, 391-240-001,389-020-063,390-130-031,390-160-012, 390-190-019, 391- 200-012, 391-230-005, 390-170-001, 390-160-001, 390-160-002, 390-190-011, 391- 230-002, 391-200-007, 391-230-003, 391-200-004, 391-230-004, 390-130-020, 390- 130-006,391-170-005,391-170-007,391-200-010,391-200-003,390-230-010), and, WHEREAS, the Planning Commission of the City of Lake Elsinore has been delegated with the responsibility of making recommendations to the City Council for Tentative Tract Maps; and, WHEREAS, on August 21, 2012 at a duly noticed public hearing, the Planning Commission considered evidence presented by the Community Development Department and other interested parties with respect to this item. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. Prior to making a recommendation to the City Council, the Planning Commission has reviewed and analyzed Tentative Tract Map No. 35000 pursuant to the appropriate Planning and Zoning Laws, and Chapter 16 (Subdivisions) of the Lake Elsinore Municipal Code ("LEMC"). SECTION 2. The Planning Commission hereby finds and determines that Tentative Tract Map No. 35000 is exempt from the California Environmental Quality Act (Public Resources Code 21000 et seq.: "CEQA") and the Guidelines for Implementation of CEQA (14 California Code of Regulations 15000 et seq.: "CEQA Guidelines") pursuant to Section 15061(b)(3) (Review for Exemption). Specifically, the Planning Commission finds it can be seen with a certainty that there is no possibility that approval of Tentative Track Map No. 35000 for conveyance and financing purposes only will have a significant effect on the environment. SECTION 3. That in accordance with State Planning and Zoning Law and the Lake Elsinore Municipal Code, the Planning Commission makes the following findings for approval of Tentative Tract Map No. 35000: PC August 21, 2012 Item No. 2 Page 4 of 8 PLANNING COMMISSION RESOLUTION NO. 2012-_ PAGE 2 OF 4 1. The proposed subdivision, together with the provisions for its design and improvement, is consistent with the General Plan. The proposed subdivision is compatible with the objectives, policies, general land uses and programs specified in the General Plan (Government Code Section 66473.5). The General Plan designates the site for a mixed land use. Consistent with that designation, the Tract Map can accommodate future mixed land uses. The Tract Map is consistent with the designated land use, development and design standards, and all other appropriate requirements contained in the General Plan„ and Subdivision Map Act. 2. The effects this project is likely to have upon the housing needs of the region, the public service requirements of its residents and the available fiscal and environmental resources have been considered and balanced. The Tract Map is consistent with the land use plan, development and design standards and programs, and all other appropriate requirements contained in the General Plan. Tentative Tract Map No. 35000 is consistent with the future mixed land use specific plan designation and applicable development and design standards. 3. Subject to the attached conditions of approval, the proposed project is not anticipated to result in any significant environmental impact. The project has been adequately conditioned by all applicable departments and agencies and will not therefore result in any significant environmental impacts because it is not for development purposes but only for parcel conveyances for financing purposes. The proposed use, together with the conditions applicable thereto, will not be detrimental to the public health, safety, or welfare or materially injurious to properties or improvements in the vicinity. SECTION 4. Based upon the evidence presented, the above findings, and the attached conditions of approval, the Planning Commission hereby recommends that the City Council approve Tentative Tract Map No. 35000. SECTION 5. This Resolution shall take effect from and after the date of its passage and adoption. Tentative Tract Map No. 35000 will expire two (2) years from date of approval unless within that period of time an appropriate instrument has been filed and recorded with the County Recorder, or an extension of time is granted by the City of Lake Elsinore City Council in accordance with the Subdivision Map Act and the LEMC. 2. The applicant shall defend (with counsel acceptable to the City), indemnify, and hold harmless the City, its Officials, Officers, Employees, and Agents from any claim, action, or proceeding against the City, its Officials, Officers, Employees or Agents to attach, set aside, void, or annul an approval of the City, its advisory agencies, appeal boards, or legislative body concerning Tentative Tract Map No. 35000. 3. The Tentative Tract Map shall comply with the State of California Subdivision Map Act and shall comply with all applicable requirements and standards of the Lake Elsinore Municipal Code (LEMC), Title 16 unless modified by approved Conditions of Approval. ENGINEERING DIVISION 4. Existing right of way dedications (easements) shall be labeled prior to tentative map approval. Confirmation of existing right of way dedications shall be obtained through a title search with a copy provided to the Engineering Division prior to final map approval.
