Approve and adopt Resolution No. 2012 -041 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA ESTABLISHING A HISTORIC PRESERVATION AD HOC COMMITTEE. 2. Appoint the five (5) persons who shall serve as members of the Historic Preservation Ad Hoc Committee, with each City Council member appointing one (1) person to the Ad Hoc Committee. 3. Appointment of the Chair of the Ad Hoc Committee by Mayor Tisdale. 4. Require that Staff shall provide only a de minimis level of support for the Historic Preservation Ad Hoc Committee and that a committee - appointed secretary shall be responsible for the keeping the records of Committee meetings including, but not limited to, distribution of agendas and keeping minutes of Committee meetings. Background On June 12, 2012, the City Council considered the establishment of an Ad Hoc Committee that would evaluate and make recommendations regarding historic preservation within the City of Lake Elsinore. The City Council directed Staff to return with a resolution formally creating a five (5) member Historic Preservation Ad Hoc Committee pursuant to City Council Policy No. 200 -5B. Additionally, the City Council determined that the Ad Hoc Committee would have no designated staff support. AGENDA ITEM NO. 10 Page 1 of 6 Historic Preservation within Lake Elsinore June 12, 2012 Page 2 of 2 The attached resolution will establish the Historic Preservation Ad Hoc Committee that will serve until July 31, 2013 subject to any extensions of time approved by the City Council and identifies the duties and responsibilities of the Ad Hoc Committee. Although each City Council member is entitled to appoint one person to the Ad Hoc Committee, pursuant to the provisions of Paragraph IV.D of City Council Policy No. 200- 5B, the Chair of an Ad Hoc Committee "shall be appointed by the Mayor." City Council Policy No. 200 -5B also provides that if the City Council has not assigned support staff to assist the Committee in its duties, the Committee shall appoint a Secretary to keep records of Committee meetings. As directed by the City Council, City staff shall provide only a de minimis level of support services which shall be generally limited to the following: a. The proper noticing and posting of all regular, special, cancelled and adjourned Committee meetings. (Required by Paragraph IV.F.1.ii of Policy No. 200 -5B). b. Transmittal by the City Manager of all referrals and requests from the City Council for advice and recommendations. (Required by Paragraph IV.I of Policy No. 200 -5B). c. Assistance in scheduling Historic Preservation Ad Hoc Committee consultation with the Planning Commission and reports to the City Council. Fiscal Impact City Council Policy No. 200 -5B states that Ad Hoc Committee members serve on a voluntary basis without compensation. The potential fiscal impact resulting from the establishment of an Ad Hoc Committee will be the cost of de minimis staff support to the Committee. It is estimated that this cost would be in the range of $2,500 to $5,000 over the one -year life of the Ad Hoc Committee. Prepared by: Richard J. Resolution No. 2012- 041 Page 2 of 6 RESOLUTION NO. 2012 -041 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA ESTABLISHING A HISTORIC PRESERVATION AD HOC COMMITTEE WHEREAS, City Council Policy No. 200 -5B defines policies and procedures for the appointment by the City Council of members of Ad Hoc Committees; and WHEREAS, after due consideration, the City Council has decided to appoint a Historic Preservation Ad Hoc Committee for the purpose of studying and making recommendations regarding historic preservation within the City of Lake Elsinore; and WHEREAS, the City Council determined that the Historic Preservation Ad Hoc Committee shall consist of five (5) members. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. The City Council hereby establishes a Historic Preservation Ad Hoc Committee for the purpose of studying and making recommendations regarding historic preservation. SECTION 2. The Historic Preservation Ad Hoc Committee shall consist of five (5) members who shall be at least 18 years of age. Each City Councilmember shall appoint one person to the Ad Hoc Committee. The list of persons appointed to the Ad Hoc Committee is attached hereto as Exhibit A. SECTION 3. The Historic Preservation Ad Hoc Committee has a special limited purpose to make recommendations regarding historic preservation within the City of Lake Elsinore and its duties and responsibilities are attached hereto as Exhibit B. SECTION 4. The Historic Preservation Ad Hoc Committee shall comply with the policies and procedures set forth in City Council Policy No. 200 -5B. The Historic Preservation Ad Hoc Committee shall complete its mission no later than July 10, 2013; subject to any extensions of time approved by the City Council. SECTION 6. This Resolution shall take effect from and after the date of its passage and adoption. PASSED, APPROVED AND ADOPTED this 10th day of July 2012. The Historic Preservation Ad Hoc Committee shall evaluate and to make recommendations regarding historic preservation within the City of Lake Elsinore including, but not limited to, the following: a. The appropriateness of establishing a City Historic Preservation Commission and if so, whether the City's Planning Commission should be designated to serve as the City's Historic Preservation Commission, or whether there should be a separate Historic Preservation Commission. b. Whether there should be a voluntary advisory council to make recommendations to the Planning Commission regarding the placement of historic structures and sites on a City of Lake Elsinore list of historical resources. c. The preparation of a current inventory of structures and sites within the City of Lake Elsinore and its sphere of influence that warrant consideration for designation as historical resources. d. The identification and prioritization of structures and sites that are endangered due to the lack of structural integrity or due to development activity. e. The creation of a City of Lake Elsinore register /list of designated historical structures or sites. f. The establishment of criteria for identifying which structures should be placed on the City's list of historical resources. g. The establishment of an application process, such as a Certificate of Appropriateness, that will allow the Planning Commission to determine and whether modifications to or the demolition of designated historical structures, and to approve or deny such applications. h. The establishment of penalties for the unpermitted demolition of designated historic structures. i. The implementation of the Mills Act within the City of Lake Elsinore. j. Identification of an estimated budget for implementation of the Ad Hoc Committee's recommendations, and research and report on the availability of grants and other funding sources available to the City to finance a historic preservation program. 2. The Historic Preservation Ad Hoc Committee shall consult with the Planning Commission prior to finalizing and reporting its recommendations to the City Council, and shall include the Planning Commission's comments in its report.
