Maximizing Productivity- Minimizing Waste Creating Competitive Advantage 4/30/2009 TO: Honorable Mayor and Members Of The City Council FROM: John Treese, Resident Serenity Neighborhood DATE: April 27, 2009 SUBJECT: Industrial Design Review No. 2007 -04 54 neighbors of the Serenity neighborhood have signed a petition that opposes the storage facility on the corner of Palomar and Corydon, agenda item 12, April 28, 2009 (CUP No. 2007 -22, IDR No. 2007 -04, Variance No. 2007 -06). The petition was presented to the planning board at one of the public hearings before them on this issue. Only 1 family in the Serenity neighborhood was in favor of the project. After reviewing the 86 page agenda document detailing the project I have the following comments and concerns: 1) Page 2 of 86 (page 2 of Report to City Council, Subject: IDR No. 2007 -04) Fiscal Impact. The city contends that the proposed entitlement will have a positive impact to the community. My research has shown that the storage fees do not require the payment of sales tax. Without a sales tax assessment the financial impact to the city will be quite minimal. 2) Page 31 of 86 (page 3 of Report to City Planning Board, Subject: Conditional Use Permit No. 2007 -22, Industrial Design Review No. 2007.04 And Variance No. 2007 -06) Conditional Use Permit requires 4 findings prior to approval as stated on the referenced page. Two of the four findings are not met. They are: a. The proposed use is in accordance with the objectives of the Specific Plan and the Planning Area in which the site is located. i. The proposed use requirement is not met since the property in question is zoned residential. I can't see how an industrial operation meets the objective of the planning area when the planning area is R1. R1 permits residential, park and open space, and recreational type land use. This industrial operation will be sided by a residential tract, a mobile home park and a neighborhood park, again, I don't see how this meets the objectives of the planning area. 9.2.2 specifically states that they "The Conditional Use Permit process is intended to provide for the discretionary review by the Planning Commission of certain types of development projects, which because of their unusual characteristics, require special consideration to ensure the use is appropriate and properly located ". The plans for the storage facility have no unusual characteristics. The unusual characteristics are putting an industrial operation on a residentially zoned property and the property itself. Industrial uses are not listed as conditionally permitted uses of R1 as part of ELSP. b. The site is adequate in size and shape to accommodate the proposed use, and for all the yards, setbacks, walls or fences landscaping, buffers and other regulations required by this Specific Plan. i. The design required a variation for setbacks, page 33 of 86. A variation for setback obviously means the site is not adequate in size or shape therefore failing to meet this requirement. The setback requirement is 40', in some areas the setback will be only 15'. 9.2.2 is quite clear that all setbacks must be met, not after variances are granted. 3) Page 7 of 86 (Resolution 2009 -, Section 2, Item 6) "The proposed project is consistent with the Urban /Wildlands Interface Guidelines. The Property is surrounded by existing urbanized areas and is not located adjacent to any conserved or open space areas ". This is a misstatement. On page 30 of 86, Setting, the property Northwest to the site is listed as Open Space - Public park. The findings in the resolution are therefore not accurate. Besides the technical arguments the residence of Serenity have voiced several safety concerns that were not adequately addressed by the planning department or board. These concerns are: 1) Traffic safety, currently Palomar has a serious problem with speeding and related issues such as passing on double yellow. The issue of getting trucks with trailers, RV's and rental trucks in and out of the facility was never adequately addresses. The facility is a gated facility that drivers will have to use an access code to get in. People pulling trailers will have to swing into oncoming traffic to make a right into the facility and if their truck and trailer is long could potentially leave the rear end hanging out in the street causing traffic to cross double yellow to get around. Vehicles making a left into the facility will be blocking traffic if they have to wait due to vehicles entering or exiting the facility. Again causing serious traffic issues. The driveway of the storage facility is 40' from curb to gate. 2) The corner of Corydon and Palomar does not have sufficient turning room for vehicle to make a right off of Corydon onto Palomar. Vehicles regularly have to swing into the left hand turn lane on Palomar to make their right hand turn. The city has proposed to widen the North bound lane on Palomar 18 inches. Again, this does not adequately address the issue. 3) The corner already has limited visibility due to the hill on Corydon. Adding a tall structure that extends to the corner will make this issue even worse. Parents spoke out about kids crossing the corner to go to school and posed very serious safety concerns. I and 54 residents of the Serenity neighborhood request and urge you to vote against the storage facility on the corner of Corydon and Palomar Road.
