SUBJECT: ADOPTION OF RESOLUTION CONFIRMING VOLUME DISCOUNT TO
ANNUAL COMMERCIAL LAKE USE PASS FEES FOR RESIDENT
BUSINESSES
Recommendation
That the City Council adopt the attached Resolution confirming the City Council's May 22,
2012 approval of a volume discount to annual commercial Lake Use Pass fees for resident
businesses.
Discussion
At the May 22, 2012 meeting, the City Council approved a volume discount for annual
commercial lake use passes offered to resident businesses. The City Attorney's office has
prepared the attached resolution confirming the May 22, 2012 action.
The resolution provides that the annual Lake Use Pass fee issued to a resident business
shall be based on the following sliding scale which provides for a volume discount for
purchasing more than 5 passes:
If purchasing 5 or fewer passes, $350 per pass for all passes;
If purchasing between 6 and 10 passes, $300 per pass for all passes;
If purchasing between 11 and 15 passes, $250 per pass for all passes;
If purchasing between 16 and 20 passes, $200 per pass for all passes;
If purchasing 21 or more passes, $150 per pass for all passes.

The accumulated number of passes purchased over the course of a calendar year will be
applied to the fee charged at the time of purchase of any new passes. However, no
retroactive discount will apply to previously purchased passes and no refunds will made for
previously purchased passes made at a higher fee.
Fiscal Impact
The fiscal impact was discussed at the May 22nd meeting. Adoption of the attached
resolution will not change the fiscal impact already approved but merely documents by
Resolution the City Council's prior action.

A RESOLUTION OF THE CITY OF LAKE ELSINORE AMENDING
RESOLUTION NO. 2010 -039 APPROVING VOLUME DISCOUNT
TO ANNUAL COMMERCIAL LAKE USE PASS FEES FOR
RESIDENT BUSINESSES
WHEREAS, the City Council has previously adopted Resolution No. 2010 -039
establishing Lake Use Fees; and
WHEREAS, the City Council has determined to provide for a volume discount for
resident businesses purchasing annual commercial lake use passes.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE
DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. That portion of Section 2 of Resolution No. 2010 -039 regarding
"Commercial Pass" is hereby amended and restated as follows:
Commercial Pass
Non - resident Business: $500.00 per year
Resident Business:
If purchasing 5 or fewer passes, $350 per pass for all passes;
If purchasing between 6 and 10 passes, $300 per pass for all passes;
If purchasing between 11 and 15 passes, $250 per pass for all passes;
If purchasing between 16 and 20 passes, $200 per pass for all passes;
If purchasing 21 or more passes, $150 per pass for all passes.
The accumulated number of passes purchased over the course of a calendar

No retroactive discount will apply to previously purchased passes. No refunds

The passes are not transferable to other business entities or individuals.
SECTION 2. This Resolution shall take effect from and after the date of its
passage and adoption.
