REPORT TO PLANNING COMMISSION TO: FROM: DATE: HONORABLE CHAIRPERSON AND MEMBERS OF THE PLANNING COMMISSION WARREN MORELION, AICP ACTING COMMUNITY DEVELOPMENT DIRECTOR JUNE 5, 2012 SUBJECT: ZONE CODE AMENDMENT NO. 2012-01 - A REQUEST TO AMEND PORTIONS OF CHAPTERS 17.08, 17.20, 17.104 AND 17.128 OF THE LAKE ELSINORE MUNICIPAL CODE TO IMPLEMENT RESIDENTIAL BOAT DOCK STANDARDS. APPLICANT: CITY OF LAKE ELSINORE, 130 SOUTH MAIN STREET, LAKE ELSINORE, CA 92530 Backaround On May 1, 2012, the Planning Commission considered the subject Zone Code Amendment to amend Title 17 (Chapters 17.20, 17.104 and 17.128) of the Lake Elsinore Municipal Code (LEMC) to allow residential boat docks as a "permitted use" in the Lakeshore Overlay District (L), Recreational District (R), and Commercial Park District (C-P) if the docks comply with the provisions outlined in the proposed Safety and Construction Standards for Residential Docks ("Dock Standards"). Any residential boat dock not complying with the Standards may still be allowed within all of the above-referenced zones subject to review and approval of a Minor Design Review (MDR). An amendment was also proposed to the Definitions chapter (Chapter 17.08) to provide key definitions that apply to the development, design, and construction of residential boat docks. At the May Planning Commission hearing, a number of lakeshore residents spoke in opposition of the Dock Standards. The majority of the residents that attended the meeting were from the County side of the Lake and believed only the County had authority to regulate their docks. The residents also believed the Dock Standards needed to be modified to address their concerns. After a significant amount of dialog between the Planning Commission and residents, the Planning Commission chose not to act on the PC June 5, 2012 Item No. 6 Page 1 of 50 Zone Code Amendment 2012-01 June 5, 2012 Page 2 of 4 project until the Dock Standards Subcommittee had a chance to review the additional public comments received. Subsequently, the Planning Commission voted 5-0 to continue the project to the June 5, 2012 Planning Commission meeting. The lakeshore property owners identified the following concerns, which are further discussed below: • Docks placed by County residents should be permitted by the County; • No Docks should be allowed on vacant land; • Standard anchoring system for floating docks is unsafe; • Maximum length of docks should be increased; • Maximum width of docks should be increased; • Permanent piling and stiff-armed anchored docks should be permitted; • Mobile pipe anchoring system should be permitted; • Revise definition for Roll-in Type docks; • The elevation for required removal of docks should be increased; • Remove listing City as "additionally" insured from insurance requirement; and • Fees not clear. Discussion Over the last few weeks, the Dock Standards Subcommittee met twice to discuss the public comments that were brought up by the lakeshore residents at the Planning Commission meeting. The Subcommittee also reviewed two emails that were received from property owners outlining their concerns relating to the current Dock Standards. The outcome of the Subcommittee meetings and subsequent revisions to the Boat Dock Standards are further discussed below. County Permitting of Docks: County Staff from the Transportation & Land Management Agency recently stated that the County does not permit docks below an elevation of 1,265' above Mean Sea Level on shoreline property abutting Lake Elsinore. Furthermore, the County's standard practice is to defer to the U.S. Army Corps of Engineers to permit docks on the Colorado River, even though they are located in the County of Riverside. Docks on Vacant Land: The Subcommittee decided that vacant property owners should be permitted to place a dock on or over the surface waters of Lake Elsinore based on the following factors. a. Docks are a fundamentally different type of structure. b. A dock is not a permanent structure. c. Docks are primarily placed on or over the surface waters of the Lake and not permanently affixed to the land. d. History of existing shoreline property owners enjoying this use. Docks are a common and expected feature along lakes, with minimal visual impacts from conforming docks. • Standard Anchoring for Floating Docks (#40 (b) The Subcommittee provides an approved alternative anchoring system for floating docks based upon the design by a Marine Engineer for the docks at the City's Seaport Boat Launch. • Maximum Length of Docks (#21): The Subcommittee decided the maximum length for a "standard" dock should be sixty (60') feet. This should suffice the vast majority of shoreline property owners. Applicants proposing non-standard docks must seek an exemption through the Minor Design Review process. • Maximum Width of Docks (#21): The Subcommittee decided the maximum width for a "standard" dock should be eight (8) feet. This should suffice the vast majority of shoreline property owners. Applicants proposing non-standard docks must seek an exemption through the Minor Design Review process. • Fixed Piling Anchored Docks (#13 & #14): The Subcommittee decided that permanently fixed piling or stiff-armed anchored docks should be prohibited from the "standard", due to aesthetics and extreme hydrology of Lake Elsinore. Such pilings would need to be excessively tall and spatially distant to cope with the widely fluctuating elevations of Lake Elsinore. • Portable Piling Anchored Docks (#14): Portable piling or stiff-armed anchored docks are permitted under the standards. • Definition for Roll-in Type Docks: The Subcommittee amended the definition to allow greater flexibility in the design by deleting "upright poles" and inserting "elements" in the definition. • Removal of Docks for Flood Event (#20): The Subcommittee amended the requirement for removal of all docks during the 100-Year Flood Event. • Insurance for Docks (#50): The Subcommittee amended the insurance requirement by deleting the "listing of the City as additional insured" and restated an indemnity clause. • Application & Annual Fees (Page 11): The "Dock Application Fees" has already been established under the Building & Safety Permit Fee Schedule and is consistent with fees for other structures. The Annual Permit Fee needs to be adopted by resolution by the City Council. Fees are not typically made part of an ordinance. Staff believes the fees are clear as stated on Page-11 of the standards. Pub. Res. Code 21000 et seq.: "CEQA") and the CEQA Guidelines (14 C.C.R. 15000 et seq.), pursuant to Section 15060.b.3 (Review for Exemption)-The activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. Draft Safety and Construction Standards for Residential Docks PC June 5, 2012 Item No. 6 Page 4 of 50 RESOLUTION NO. 2012- RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE, CALIFORNIA, RECOMMENDING APPROVAL OF THE AMENDMENT TO THE CITY OF LAKE ELSINORE MUNICIPAL CODE, TITLE 17 - ZONING, CHAPTER 17.08 - DEFINITIONS, CHAPTER 17.20 - (L) LAKESHORE OVERLAY DISTRICT, CHAPTER 17.104 - (R) RECREATIONAL DISTRICT AND CHAPTER 17.128 - C-P COMMERCIAL PARK DISTRICT (ZONE CODE AMENDMENT NO. 2012-01) WHEREAS, there are no existing regulations establishing standards for private residential boat docks in the Lake Elsinore Municipal Code (LEMC); and WHEREAS, certain use designations involving boat docks, boat landings, boat ramps and piers need to be updated for purposes of providing consistency within the city's zoning ordinance; and WHEREAS, Government Code Section 65860 requires that a city's zoning ordinance be consistent with its general plan; and WHEREAS, the Planning Commission of the City of Lake Elsinore continued item from the May 1, 2012 Planning Commission hearing; and WHEREAS, public notice of the Amendment has been given and the Planning Commission of the City of Lake Elsinore has considered the evidence presented by the Community Development Department and other interested parties at a public hearing held on June 5, 2012 with respect to this item. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE, CALIFORNIA, DOES HEREBY RECOMMEND AS FOLLOWS: SECTION 1. Prior to making a recommendation to the City Council, the Planning Commission has reviewed and analyzed the proposed Amendment pursuant to the California Planning and Zoning Laws (Cal. Gov. Code 65000 et seq.), the Lake Elsinore General Plan and the Lake Elsinore Municipal Code (LEMC) and finds and determines that the proposed Amendment is consistent with the requirements of California Planning and Zoning Law and with the goals and policies of the Lake Elsinore General Plan and the LEMC. SECTION 2. That in accordance with the California Planning and Zoning Law and the LEMC, the Planning Commission hereby makes the following findings for the Amendment to the LEMC: 1. The proposed amendment and additions will not be a) detrimental to the health, safety, comfort or general welfare of the persons residing or working within the neighborhood of the proposed amendment or within the City, or b) injurious to the property or improvements in the neighborhood or within the City. The proposed amendments will be beneficial to the public health, safety, comfort and welfare and will improve public safety on the Lake. 2. The proposed amendment will permit reasonable development of the area consistent with its constraints and will make the area more compatible with adjacent properties. a. The proposed amendment provides for continued use of dock, ramps and piers that are permitted uses and conditional uses, thereby enabling a property owner to determine the highest and best use of his or her land. b. The proposed amendment will provide standards for private residential boat docks to ensure that such docks are constructed in a consistent manner. 3. The proposed amendments are categorically exempt. a. The amendments will not affect a physical change to the environment. Boat docks and similar structures are currently allowed in the three affected zones and will continue to be allowed. The amendments merely delineates between docks that are a permitted use and dock that are a conditional use. SECTION 3. Based upon the evidence presented, both written and testimonial, and the above findings, the Planning Commission hereby recommends approval of the Amendment to the City of Lake Elsinore Municipal Code, Title 17 - Zoning, amending Chapter 17.08 - Definitions, Chapter 17.20 - (L) Lakeshore Overlay District, Chapter 17.104 - (R) Recreational District and Chapter 17.128 - C-P Commercial Park District.
