The proposed Tree Improvements included the removal of 34 liabilit trees, removal of 93 stumps and g rid prunin of 414 trees at a cost of $30,858.60. Staff re the remainin allocated funds be utilized to transplant Canar Island Palms, located throu the Cit that are at risk of bein topped and killed b utilit companies in order to prevent a fire hazard from the palm fronds bein in close proximit to electrical power lines. The preservation of "at risk" Canar Islands Palms is an important Cit value as expressed in LEMC Chapter 5.116 SIGNIFICANT PALM TREES ( See Attachment Discussion Southern California Edison and Cit Staff have identified 27 Canar Islands Palms that are "at risk" and should be relocated as soon as possible. Per the attached mappin most of these trees are located alon Gunnerson Street. Cit Staff proposes to transplant eleven ( 11 ) trees to the La La Resort & Boat Launch and sixteen (16) trees to the Collier Avenue median in front of the Lake Elsinore Outlet Center. Definitions. Permit re Permit application. Permit procedures — Conditions. Permit issuance or denial. Exemptions. Appeal. Licenses — Permits — Securit 5.116.010 Purpose. The purpose of this chapter is to provide a mechanism to re the removal, destruction and relocation of si palms within the Cit limits. In adoptin this chapter, the Cit primar concern is that removal, destruction and relocation of si palms is likel to have an adverse affect upon the surroundin environment. Past removal and destruction of si palms within Cit limits has not onl interfered with the natural scenic beaut of the Cit but also g reatl y diminishes the ecolo and historic value of these livin monuments, while also postin a risk to public safet throu the use of heav machiner and unnoticed earth-movin activit The Cit Council finds and determines that the public health, safet and welfare will be promoted b the preservation of si palms for the followin 1�4 � A. Si palms are an important source of food for lar native and nonnative bird species; B. Si palms provide nestin areas and/or nestin materials for birds which, in turn, consume si amounts of insect pests; C. Si palms are effective in aestheticall enhancin the communit D. In several locations, man of the Cit oldest si palms constitute si livin reminders of the Cit rich historical herita E. Si palms collect dust and solids from the air which are washed to the g round b rainfall; and Pa 3 F. The a of si palms enable them to better survive extremes of weather and periods of drou than most plants of a similar size. For the fore reasons and in accordance with the mandate of the State set forth in Section 65560 of the Government Code re open space plannin the Cit in order to preserve and protect the best interest of its citizens, does enact this chapter. [Ord. 1044 § 1, 1999. Code 1987 § 5.78.010 5.116.020 Definitions. The followin words shall have the meanin ascribed to them, unless otherwise noted: "Drip line" means a line which ma be drawn on the g round around a si palm directl under the outermost frond tips and which identifies that location where rainwater tends to drip from the si palm. "Remove" and "removal" mean an direct or indirect action that substantiall impairs the health and/or aesthetic q ualities of a si palm, includin (without limitation) the ph removal of a si palm, or causin the death of a si palm as a result of dama the trunk, toppin the crown, or poisonin "Si palm(s) it means the species of the famil Palmaceae set forth hereinbelow which, unless specificall provided otherwise, exceed five feet in hei measured from the g round at the base of the trunk to the base of the crown: 1. Phoenix canariensis (Canar Island Date Palm); 2. Washin filifara (California Fan Palm); 3. Reserved; 4. Trach (Windmill Palm 5. Chamaerops (Mediterranean Fan Palm 6. Phoenix reclinata (Sene Date Palm); 7. Butia capitata ( Pindo Palm); 8. Phoenix roebelenii (P Palm [Ord. 1160 § 11 2•• 5; Ord. 1044 § 1, 1999. Code 1987 § 5.78-020]. Pa 4 5.116.030 Permit re No si palm g rowin g within the Cit limits ma be removed or relocated unless and until a permit has first been obtained from the office of the Director o Communit Services. [Ord. 1044 § 11 1999. Code 1987 § 5.78.030 1 5.116.040 Permit application. An application for permit re b this chapter to remove or relocate an si palm within the Cit shall be filed with the Director of Communit Services, to with an application fee. The application fee shall cover the costs of processin and administerin the application and shall be established b resolution of the Cit Council. The application shall be submitted with a report which shall include: A. The acknowled written permission from the record land owner notarized and on such forms as prescribed b the Cit and verified b the Director of Communit Services; I C. The location of all si palms and each si palm proposed to be removed or relocated on a plan or map surve with a certified en report identif ( 1 ) the propert b street address and assessor's parcel number, (2) the centerline of the street, (3) the monuments establishin the propert line, and (4) the distance between each si palm and the propert line; D. The identification of each si palm b species and approximate hei and spread; E. Photo of the si palm to be removed or relocated; F. The proposed manner of removal, the proposed e to be utilized for removal and the planned truck/e route; G. The species, number, and size of an proposed replacement palm trees shall be desi H. The health of an si palm declared diseased or d shall be verified b a written report of a certified arborist; and si palm is proposed to be relocated to another location on the same propert or within the Cit then the relocation site shall be identified and site preparation and relocation methods described. [Ord. 1044 § 1, 1999. Code 1•87 § 5.78.040 Pa 5 5.116.050 Permit procedures — Conditions. A. The Director • Communit Services shall approve, conditionall approve ol- den the application to remove or relocate an si palm. The Director o Communit Services shall re for an permitted activit that applicant: I 2. Appropriate protection of all under utilities prior to an activit 3. Backfill and compact all holes to g rade level in accordance with Cit standards and remove all cut fronds; 4. Arran proper traffic control measures and approvals for operation in Cit streets or ri 5. Make the issued Cit permit available for review on site durin activit operations; 6. Post a si as prescribed b the Cit on each si palm to be removed or relocated not less than seven da prior to such removal/relocation; 7. That removed si palms are relocated within the Cit and/or are replaced with tree(s) of like species and q uantit y and of commensurate aesthetic value as determined b the Director of Communit Services. B. The Director of Communit Services ma impose conditions deemed necessar to preserve and protect the health of si palms relocated to another site on the same propert or within the Cit b re the applicant to provide documentation demonstratin 1. That the environmental conditions of the new location are favorable to the survival of the si palm and there is a reasonable probabilit that the si palm will survive its relocation; 2. That such relocation is accomplished b q ualified personnel under the supervision of the Director of Communit Services, or his/her desi and C. Further, the Director of Communit Services ma impose measures to preserve and protect the health of new palm trees planted to replace those removed or relocated. Such measures ma include but not be limited to: 1. Erection of temporar or permanent protective devices around the new palm tree(s) so that no substantial impairment or removal of the structure or feeder roots occurs; and 2. That no fill material be placed within three feet from the outer trunk circumference of an new palm tree(s) or within the drip line of an palm tree in excess of 18 inches in depth. [Ord. 1044 § 1, 1999. Code 1987 § 5.78.050]. As The followin criteria shall be considered where applicable in evaluatin applications for issuance of permits re • this chapter: i A. Necessit to remove the si palm because its continued existence at such location prevents the reasonable development of the sub propert B. The si palm shows a substantial decline from a condition of normal health and vi and restoration is not advisable, throu appropriate and economicall reasonable preservation procedures and practices; C. Due to an existin and irreversible adverse condition of the si palm, the si palm is in dan of fallin D. The presence of the si palm interferes with, or is dama to, the site line of the motorin public, utilit services and roadwa walkwa foundations, draina or other existin structures, within or without the subject propert and the onl reasonable alternative is the relocation and/or replacement of the si palm; E. The topo of the land and the effect of the si palm removal on erosion, soil retention, and the diversion or increased flow of surface waters; F. The number and/or location of si palms existin on the propert and the effect of si palm removal upon aesthetic and propert values and enjo of the g eneral public; and G. Good forestr practices, i.e., the number of health si palms that a g iven parcel of land will support. [Ord. 1044 § 1, 1999. Code 1987 § 5.78.0601 5.116.070 Exemptions. A permit is not re to remove or relocate a si palm under the followin circumstances: B. Si palms dama b thunderstorms, windstorms, floods, earth fires or other natural disasters and determined to be dan b a peace officer, fireman, or Code Enforcement Officer in their official capacit Pa 7 C. When removal is determined necessar b Fire Department personnel activel en in fi g htin g a fire; and D. Si palms planted, g rown and/or held for sale as part of a license0i nurser business. An applicant a b an decision made b the Director of Communit Services on an application filed pursuant to the provisions of this chapter ma appeal such decision to the Cit Mana Such appeal must be submitted to the Office of the Cit Mana in writin within 10 da of the decision ("notice of appeal"). The notice of appeal shall state briefl the g rounds of the appeal and be si b the applicant. Within 10 da after the hearin the Cit Mana shall g ive written notice of the decision to the appellant. The decision of the Cit Mana shall be final. [Ord. 1044 § 1, 1999. Code 1987 § 5.78.080 5.116.090 Licenses — Permits — Securit All contractors, or an removin or relocatin a si palm, shall have a valid business license from the Cit and a valid California landscape contractor's license, and shall obtain all applicable permits from the Cit and/or public entit exercisin jurisdiction over the activit and/or the propert includin (without limitation an oversized load permit or encroachment permit. In addition, the Director of Communit Services ma re that insurance and/or ade securit be provided as deemed necessar and appropriate for the protection of the public. [Ord. 1044 § 1, 1999.
