Nmo I i U01 I M4 On Februar 28, 2012, the Cit Council considered the subject appeal of a nuisance abatement action on the 7,411 s foot structure located at 522 North Rile Street. At the time, the Cit Council a not to act on the appeal and continued the matter to allow the propert owner an opportunit to provide the necessar information to determine if the structure could be saved and reconstructed to meet Buildin Code re In addition, Ron Hewison from HOPE (Helpin Our People in Elsinore) stated that he was interested in the propert and would like the abatement action deferred to a future date to g ive him enou time to investi the buildin and see if he could obtain the necessar funds from the Count to purchase the propert Subse the Cit Council voted 5-0 to continue the item to the Ma 22, 2012 Cit Council meetin Discussio Over the past couple of months, staff has met with the owners representative, Dou Shackelton {Shackelton Consultin to discuss the propert and determine the necessar materials needed to be submitted b the owner to show how the buildin would be retrofitted to meet Buildin and Fire Code re The owner intends on continuin the retail clothin desi repair and sales business in approximatel 788 s feet of the buildin and usin the remainin s foota (approximatel AGENDA ITEM NO. 4 Pa 1 Structure Abatement Appeal North Rile Street Ma 22, 2012 Pa 2 6,623) for personal stora The buildin has a land use desi • of Nei Commercial ( NC) and zonin district of Tourist Commercial (TC) which allows reta a uses. Manufacturin is not proposed b the propert owner and is not permitted in th TC zone I On Ma 15, 2012, Mr. Shackelton submitted a Code Compliance Plan to the Cit outlinin the proposed retrofit process (see Attachment "A"). At that time, Mr. Shackelton also submitted construction drawin and paid the necessar plan check fees to the Buildin Division. The information provided in the Code Compliance Plan details: • Action dates; • Submitted plans and t of occupanc • Construction schedule; and • Estimated construction costs. The estimated completion date for construction is April 15, 2013, and the total cost for the retrofit improvements is approximatel $209,000. Staff has reviewed the Code Compliance Plan and is in a with the process, timeline and estimated construction costs. Durin this period, staff has also had several conversations with Mr Hewison re HOPE's interest in the Rile Street propert Hr. Hewison informed staff that since the last Cit Council meetin he has worked dili with the Count Board of Supervisors to determine if the propert would be an appropriate site for HOPE in the future. In his letter dated Ma 11, 2012, Mr. Hewison indicates that CDBG fundin from the Count has been approved for a different location, which would result in HOPE not pursuin that Rile Street buildin However, Mr. Hewison stated that there ma be a possibilit that HOPE would still be interested in the propert in the future if ne fail for the other location (see Attachment "B"). This written report and the plans identified herein and submitted to the Cit Dept. of Buildin and Safet as of Ma 15, 2012 constitute the "plan" re b the Cit Council. The effect of the Cit Council's motion on Februar 28, 2012, was to suspend the Structural Abatement Action or case on this propert pendin a response to the Council's re in this motion. 2. ACTIONS TO DATE Since Februar 28, 2012, the owner, Mrs Re has accomplished the followin A. Demolished the carports and stora buildin at the rear as re b the Cit B. Rile Street The project team of Architects, the General Contractor and Shackelton Consultin collaborated on preparin the followin Estimate Construction Costs for the project. These are rou estimates based on the experience of the project team and not on precise take offs from the plans. This is the case because the plans were not finished until that date of this report Ma 15, 2012. Nevertheless we believe that the estimated costs represent a reasonable close ma of what the actual final cost of the project will be. The total estimated project cost of $202,285 is $27.29 per s foot of buildin area. The team believes this cost is achievable because while there is major structural work, there is ver little interior finish or tenant improvement work, no heatin or air conditionin and no paintin to be done. The report details the efforts and work done to date, the work necessar to compl with codes as re b the Cit a realistic schedule to do the work, and a reasonable expectation of the cost to complete the work. The owner and the project team are prepared to work with Cit staff to implement all details of the plan and have alread started b submission of plans for plan check. Therefore the owner respectfull re that the Cit Council take the followin actions: 1. Accept this report for the record and determine that it is substantial compliance with the Council's Februar 28, 2012, motion on this matter. 2. In m E. Mail dated 22 March (cop attached) I outlined the action we had taken re the future facilit for HOPE. All references to Flint Street should, of course, have said Rile Street! The principal point to arise was that the Board of Supervisors favored a lar facilit that would enable HOPE to expand services into job search, trainin and resource activities, as well as the possibilit of additional Count services bein at the same lar location. The fundin for the la facilit remains an issue but at their Ma 8 2012 meetin the Supervisors approved the overall Count wide CDBG fundin for 2012-2013. Included in the action items the approved $220,000 for the lar facilit This is not sufficient fundin to purchase the facilit but ma be enou to open ne which are now underwa This would result in HOPE not pursuin the Rile Street buildin However, as the fundin is lower than that needed to g uarantee closin on the lar facilit there is still a possibilit that, if negotiations fail, then the allocated CDBG fundin could be made available for the Rile Street buildin Not as decisive as I would like but an honest assessment.
