Ma Tisdale read the Proclamation declarin Ma as Mental Health Month and presented a Proclamation to Care Poindexter declarin Ma as Asthma Awareness Month. Donna Franson advised the public of the Candidate Forum scheduled for the Tuscan Hills Recreation Center on Ma 24th at 7:00 p.m. Tim Flemin expressed his concerns with the issues of movin Date Palms from Lakeshore Drive due to overhead wire interference. Cit Clerk Bloom announced an email received from Pamela Hall of Voices for Pets advisin the Council and the communit of a person bein released from jail followin a conviction relatin to animal cruelt Cit Clerk Bloom read a letter into the record from Supervisor Bob Buster to Ma Tisdale providin $50,000 for Lake Patrol services to the Cit CONSENT CALENDAR (2) Approval of Minutes Recommendation: It is recommended the Cit Council approve the Minutes of: a) Joint Stud Session Meetin of April 10, 2012 b) Re Cit Council and Successor A Meetin of April 24, 2012 (3) Warrant List dated April 26, 2012 Recommendation: Receive and File Warrant List dated April 26, 2012. (4) Plannin Division Professional Service Contracts for 2012-2013 Fiscal Year Recommendation: It is recommended that the Cit Council authorize the Interim Cit Mana to prepare and enter into contract with Carole Donahoe, Kirt Cour and Richard MacHott to provide specialized plannin services to the Cit of Lake Elsinore on an annual basis, subject to an minor modifications as approved b the Cit Attorne (5) Landscape Plan Check and Inspection Services; S election of Consultant for Fiscal Year 2012-2013 Recommendation: It is recommended that the Cit Council authorize the Interim Cit Mana to prepare and enter into a contract with SCES to provide landscape plan check and inspection services to the Cit of Lake Elsinore on an annual basis, subject to an minor modifications as approved b the Cit Attorne Pa 5 Re Cit Council Minutes Meetin of Ma 8, 2012 Pa 4 of 10 (6) Lake Elsinore Municipal Code Waivers for National Jet Boat Association Special Event Recommendation: It is recommended that the Cit Council waive the Lake Elsinore Municipal Code sections 9.96.120 Boat Speed Limits, 9.96.200 Motorboat Noise, 8.40.040A Alcohol is prohibited in Cit parks, 9.28.030 Furnishin alcoholic bevera in public, and 8.40.060E Lake Use Pass for the proposed National Jet Boat Association Special Event, subject to compliance with all other conditions for the event as approved b the Interim Cit Mana Council Member Melendez re Item No. 3 pulled from the Consent Calendar. Council Member Melendez q uestioned various items on the warrant list and staff provided responses thereto. Director Morelion advised that the consultant's fees are paid from the cost recover account funds collected from development applications and their hours var however all work at Cit Hall. ( 8 ) Consideration of Revisions to Lake Elsinore Municipal Code Re Unde of Overhead Utilities Recommendation: It is recommended that the Cit Council: a) Direct Staff to modif Chapter 16.64 to include chan resultin from the Cit Council's review of the enclosed draft ordinance; or b Alternativel if the Cit Council is satisfied with the draft ordinance as presented, waive further readin and introduce b title onl Ordinance No. 2012-1304 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, AMENDING AND RESTATING CHAPTER 16.64 TO THE LAKE ELSINORE MUNICIPAL CODE CONCERNING UTILITIES Director Seumalo provided an overview of the pro to Council. Pa 7 Re Cit Council Minutes Meetin of Ma 8, 2012 Pa 6 of 10 Tim Flemin resident spoke of his concerns with under utilities and the complications that the Cit would be up a Ma Pro Tern Hickman explained that utilit towers are projected to be placed alon the 1-15 Freewa and was concerned with the aesthetics. He added he is concerned with Potter Street and the recent dama to the utilit poles. Interim Cit Mana Evans su a meetin with Southern California Edison. He stated with respect to the Under Distribution S it is the Cit plan to identif several streets and present ideas to Council durin the Capital Improvement Pro ( CIP ) Bud review process. Council Member Weber addressed the potential cost involved and the uncertaint of the overall plan. Viet Tran of Southern California Edison stated that Edison is g overned b the Offices of the California Public Utilities Commission ( CPUC ) and if the Commission deems the re of the utilities to be placed under then Edison would proceed. Council Member Weber re strikin the lan under section 16.64.010 General re and 16.64.035 exclusions, section B, relatin to volta Director Seumalo advised Council Member Weber that CPUC sets the limits of the re volts, which is consistent with the volta of the surroundin cities. Council Member Melendez asked if staff has heard from Buildin Industr Association ( BIA ) and if homeowners would be re to have the utilities placed under when improvin their undeveloped parcels. Director Seumalo stated that the homeowner's would need to be consistent with the surroundin area and that staff has not heard from BIA. Dou Pinnow addressed Council Member Weber's concerns of the volta and stated that Cit Council could re the utilities to be placed under but the cost is approximatel four times more than the amount above g round. He stated the item was added to provide Council with a g raph of the sales tax revenue and show areas that the Cit could tar businesses which would provide more sales tax revenue.
